Abstract

This study examines the implementation of care governance in environmental public administration by highlighting the role of non-human actors. Based on Actor–Network Theory (ANT), exploratory qualitative research was conducted in the densely populated area of Tanjungpinang (April–June 2025). In environmental management, success is determined not only by technical skills, but also by the capacity of citizens to manage digital documents, spatial data, and technological infrastructure. Through interviews, observations, and document analysis. This approach was chosen because it allows for in-depth exploration of complex, contextual, and previously unstudied social phenomena, especially in the context of care governance to involve the relationship between humans and non-human objects in the local government ecosystem. Findings show that flood sensors, digital SOPs, inter-agency WhatsApp groups, and monitoring dashboards function as actors that trigger, direct, and accelerate coordination and decision-making. The integration of sensors and dashboards automates early warnings and the distribution of instructions, enabling rapid response. Implications: digital systems need to be designed as administrative actors with ethics, accountability, and capacity building. This study concludes that the implementation of care governance in environmental public administration at the local level cannot be separated from the active role of non-human actors such as flood sensors, digital documents, and online communication systems. Findings show that entities Findings show that these entities function not only as technical tools, but also as an integral part of a decision-making network capable of directing, accelerating, and streamlining administrative responses to environmental situations.

Abstract

This research aims to analyze the conflict of authority between the Constitutional Court (Mahkamah Konstitusi) and the Supreme Court (Mahkamah Agung) within Indonesia’s constitutional system, focusing on institutional disputes that have emerged following the amendment of the 1945 Constitution. The main objective is to examine the legal foundations, juridical implications, and mechanisms for resolving jurisdictional conflicts between the two courts through a normative juridical approach and case-based analysis. The findings indicate that authority conflicts between the Constitutional Court and the Supreme Court often arise from overlapping legal norms and ambiguities in the delineation of constitutional functions established by the 1945 Constitution and its implementing laws. In several cases, such as disputes over the judicial review of regulations below the level of statutes, divergent interpretations have occurred regarding the scope of constitutional versus administrative jurisdiction. This study reveals that legal harmonization through regulatory reform and inter-institutional coordination is essential to prevent future jurisdictional overlaps. The conclusion emphasizes the need to strengthen the principles of checks and balances and clarify the hierarchy of norms to ensure stability in Indonesia’s constitutional framework. The research recommends the establishment of a cross-institutional constitutional forum as a mediation mechanism among state institutions to uphold constitutional supremacy and legal certainty in Indonesia.

Abstract

This study examines the practice of project-based procedural text learning in seventh grade at SMP Negeri 4 Cilacap in the context of the implementation of the Independent Curriculum. The approach used was qualitative with a case study method through participatory observation, in-depth interviews, and documentation. The results showed that teachers implemented contextual and project-based learning strategies by utilizing digital media and integrating the values of the Pancasila Student Profile. Students demonstrated active involvement in learning activities, especially in the creation of video tutorials and procedural posters. However, there were still obstacles in the form of teachers' limited understanding of the application of learning differentiation and formative assessment, as well as a lack of adequate digital infrastructure support. This study provides a theoretical contribution to the development of a more contextual and transformative Indonesian language learning model. Practically, these findings can serve as a reference for teachers and policymakers in designing learning strategies relevant to student needs and encouraging the use of innovative media to increase student participation and understanding, particularly in coastal areas.

Abstract

The advancement of digital technology has created new opportunities for cybercrime, including revenge porn the non-consensual distribution of intimate content motivated by revenge. In Indonesia, such cases have surged significantly, predominantly affecting women of productive age, with multidimensional consequences including psychological trauma, social stigmatization, and job loss. This study analyzes the element 'without right' (tanpa hak) in Article 27 paragraph (1) of the Electronic Information and Transactions Law (UU ITE), which is both the core and the main source of legal uncertainty in prosecuting revenge porn cases. Through normative legal research using statute and case approaches, analyzing the Banten High Court Decision No. 96/Pid.Sus/2023/PT BTN, this research finds that the element 'without right' must be interpreted holistically by making a clear distinction between consent to create and consent to distribute. The appellate court decision demonstrates a progressive human rights-based approach, integrating the principle of reasonable expectation of privacy and victimological impacts. However, normative ambiguity continues to create disparities in rulings and disproportionate evidentiary burdens on victims. The research recommends legislative reform through amendment of the UU ITE or enactment of specific legislation on image-based sexual abuse to provide stronger legal certainty and substantive victim protection.

Abstract

Constitutionalism plays a fundamental role in limiting state power and ensuring that government authority operates within ethical, legal, and democratic boundaries. Indonesia and Thailand offer two contrasting examples of constitutional development in Southeast Asia. Following the 1998 Reform era, Indonesia successfully strengthened mechanisms of checks and balances through the establishment of the Constitutional Court, decentralization reforms, and the empowerment of independent oversight bodies. In contrast, Thailand has experienced repeated cycles of military intervention, where post-coup constitutions have served not as tools to restrict state power, but rather as instruments legitimizing centralized authority and military dominance. This article synthesizes existing scholarly literature and identifies critical research gaps related to constitutionalism studies in both countries. First, there remains a scarcity of long-term empirical and quantitative studies assessing the effectiveness of constitutional limitations on executive, legislative, and judicial power. Second, current research has insufficiently examined informal political practices, including patronage networks, oligarchic influence, and military entrenchment within state institutions. Third, comparative constitutional studies covering the 2014–2025 period remain limited, particularly in assessing post-authoritarian and post-coup constitutional dynamics. The findings of this review highlight the need for deeper interdisciplinary research, integrating political science, legal studies, and institutional analysis to better understand the evolving nature of constitutionalism in Southeast Asia.

Abstract

This study examines the application of the Piercing the Corporate Veil doctrine in cases of fiduciary duty violations by the President Director of PT Bakara Bumi Energi, based on the Jakarta Central District Court Decision No. 451/Pdt.P/2019/PN.JKT.Pst. Using a normative juridical approach, the research analyzes primary and secondary legal sources, including Law No. 40 of 2007 on Limited Liability Companies and relevant court rulings. The findings reveal that the President Director's failure to provide transparent financial reports and operational information constitutes a breach of fiduciary duty, encompassing duties of loyalty and care, leading to financial losses such as tax arrears and reputational damage. Furthermore, this breach justifies the application of the Piercing the Corporate Veil doctrine to hold the director personally liable, as supported by similar judicial precedents. The study concludes that enforcing this doctrine enhances corporate governance and accountability, recommending clearer regulatory frameworks for broader application to directors and other corporate organs.

Abstract

Cigarette excise crimes are a form of economic crime that significantly impact state revenues, national economic stability, and the market balance of the tobacco industry. This phenomenon not only causes material losses to the state but also has implications for social justice and the economic order of society. This study aims to analyze in depth the characteristics, causes, and implications of cigarette excise crimes from the perspective of economic criminal law and criminology. The research method used is a juridical-normative approach combined with criminological analysis to identify the relationship between social, economic, and legal factors in cigarette excise violations. The results indicate that these crimes are driven by economic motives, regulatory imbalances, weak law enforcement, and low public awareness of excise obligations. Through this analysis, the study emphasizes the need for synergy between criminal law policy, economic oversight, and a criminological approach to create an effective and equitable excise control system in Indonesia.

Abstract

The position of judges in the process of proving civil cases occupies a fundamental role in upholding justice and legal certainty within the Indonesian judicial system. This study aims to examine the judge’s position, duties, and authority in the evidentiary process of civil cases through a literature review focusing on doctrines and jurisprudence. Using a normative juridical method with a library research approach, this paper analyzes legal theories, statutory provisions, and judicial precedents that regulate evidentiary procedures in civil law. The findings show that a judge is not merely a passive law enforcer but an active truth-seeker who must interpret and assess evidence based on principles of fairness, propriety, and moral values. The judge’s discretion in evaluating evidence reflects the responsibility to harmonize formal legal norms with the pursuit of substantive justice. Jurisprudence demonstrates that judges play an essential role in shaping evidentiary standards and ensuring that court decisions reflect the ideals of justice and legal certainty. The study concludes that the authority and independence of judges are crucial in realizing a fair trial, as they ensure that decisions are based on verified facts, logical reasoning, and moral responsibility. Strengthening the professionalism and integrity of judges is necessary to guarantee that the evidentiary process in civil proceedings fulfills the principles of equality before the law and promotes justice in society.

Abstract

This study analyzes the practice of staple food price manipulation at Cik Puan Market in Pekanbaru, which is alleged to be carried out by a group of traders through stockpiling, supply coordination, and price regulation that could potentially cause market distortions. This phenomenon has led to unreasonable price increases in strategic commodities such as chili, onions, rice, cooking oil, and chicken, thereby negatively affecting consumers and regional economic stability. This research uses a normative juridical approach with descriptive qualitative analysis methods, supported by empirical data from local government reports, official news, and findings from trade department supervision. The results of the study indicate that these price manipulation practices are in violation of Articles 5, 11, and 19 of Law No. 5 of 1999 about Consumer Protection. This study emphasizes that the weak supervision of the supply chain in traditional markets, as well as the minimal coordination between agencies, causes price manipulation practices to continue repeatedly. It is necessary to strengthen law enforcement, ensure transparency in the distribution of basic necessities, and enhance the role of local governments and the KPPU in order to create stable, competitive, and fair prices for the public.
