Abstract

The problem of this research is how the implementation of the management control system in TOSERBA MMTC and what strategies are carried out to improve competitiveness in TOSERBA MMTC. The purpose of this study is to determine how the implementation of the management control system in TOSERBA MMTC and to determine what strategies are carried out to improve competitiveness in TOSERBA MMTC. This research method uses a qualitative approach. The data analysis techniques used are data reduction, data presentation and drawing conclusions. The results of the study TOSERBA MMTC has implemented a structured management control system at three levels: strategic, operational, and financial. Strategic involves quarterly planning based on historical data; operational combines computerized information systems and a collaborative work culture; while finance applies tiered authorization and bottom-up budgeting, which has successfully reduced budget deviations by 22%. To improve competitiveness, MMTC carries a hyperlocal strategy by selling 45% local products, digital transformation such as WhatsApp Business and dynamic discount systems, and marketing through local social media and digital loyalty programs, which have proven effective in increasing sales and customer retention.

Abstract

The democratic journey of the Indonesian nation has always experienced quite brilliant ups and downs and is not in accordance with the norms of good civility. By disobeying various things that always prioritize various principles of democracy and social life for society. The Constitutional Court (MK) as an institution that safeguards the constitution and protects the supremacy of law in Indonesia plays an important role in ensuring the sustainability of democratic principles and the protection of human rights. However, in recent years, the dignity of the Constitutional Court has often been questioned due to various controversies surrounding the integrity, independence and legitimacy of this institution. This article aims to analyze the causes and impacts of the collapse of the MK's dignity on legal governance and democratic stability in Indonesia. Using a normative-empirical approach, this article discusses the challenges faced by the Constitutional Court, including political interference, external pressure, and internal problems related to the code of ethics and professionalism of judges. This study found that the legitimacy crisis experienced by the Constitutional Court not only damaged the credibility of the institution but also threatened the stability of the law and constitutional order in Indonesia.

Abstract

Domestic Violence (DV) is a serious human rights violation, particularly affecting women as a vulnerable group. Gorontalo City has seen a significant rise in DV cases, reflecting weak prevention efforts and law enforcement. Although Law No. 23/2004 regulates the elimination of DV, its local implementation faces structural, cultural, and resource-related challenges. This study analyzes the effectiveness of DV law enforcement in Gorontalo and identifies key obstacles. Using an empirical juridical method with a qualitative approach, data were collected through field research, interviews with law enforcers, and document analysis. The findings reveal that despite procedural efforts, barriers such as low public legal awareness, partiality among officials, limited victim protection facilities, and patriarchal norms hinder effective enforcement. Law enforcement remains ineffective due to weak institutional synergy and victims’ reluctance to seek justice. The study recommends specialized training for law enforcers, strengthening integrated victim services, and intensive legal outreach to build a more responsive environment to DV issues.

Abstract

The Era of the 4.0 Industrial Revolution has transformed various aspects of life, particularly with the advent of Artificial Intelligence (AI), which brings innovation and efficiency to sectors such as healthcare, education, and governance. However, the rapid development of AI also presents challenges related to law and ethics that must be addressed, such as legal responsibility for damages caused, secure management of personal data, and ethical boundaries regarding technological intervention. This article aims to discuss the legal and ethical issues surrounding the use of AI in Indonesia, focusing on the importance of developing an adaptive legal framework and the application of appropriate ethical principles. This research uses a normative research method with a regulatory approach and a conceptual approach. The discussion covers the definition of AI, legal and ethical challenges in its use, and recommendations for responsible technology implementation. The findings suggest that to ensure fair and sustainable use of AI, Indonesia needs to strengthen existing regulations, raise ethical awareness in society, and establish a dedicated regulatory body for AI technology.

Abstract

Human Rights (HAM) are a universal concept that guarantees the freedom and dignity of every individual. From a Western perspective, human rights emerged from a long historical experience marked by oppression, absolutism, and the struggle for individual freedom, thereby emphasizing secular, rational, and individualistic aspects. Meanwhile, in the Islamic perspective, human rights are not only rational and social in nature but also theological, as they originate from divine revelation and are part of human nature (fitrah). Islam views human rights as fundamental rights granted by Allah SWT to all of humanity, which must be respected and protected, with an emphasis on the balance between rights and obligations, as well as between individual freedom and the interests of society. One of the fundamental differences between the two is that human rights in Islam are theocentric, based on the revealed teachings of the Qur'an and Hadith. In contrast, Western-secular human rights are anthropocentric, founded upon philosophical thought as their main foundation.

Abstract

As a wing organization of the National Mandate Party, Barisan Muda Penegak Amanat Nasional (BM PAN) is strategically responsible for fostering youth leadership at the regional level, including in Lampung Province. The purpose of this study is to investigate the role of BM PAN Lampung in shaping the character of youth leadership through various training, advocacy, and cadre programs. The method used is a qualitative approach that uses participatory observation, documentation studies, and in-depth interviews to collect data. The study shows that BM PAN Lampung has the ability to facilitate constructive political participation for youth and become a place to build leadership skills oriented towards national values. This organization has shown that its cadre program has succeeded in increasing political awareness, public communication skills, and managerial skills among its members. In addition, as shown by Santoso (2014) and Mulyadi (2018) about the importance of youth participation in political regeneration, this study found that youth organizations such as BM PAN play an important role in enhancing participatory democracy at the local level.

Abstract

In ever-evolving era of e-commerce, the Cash on Delivery (COD) Check First feature implemented by Shopee provides a practical solution for consumers who want to ensure security while shopping online. This feature allows buyers to inspect the condition of the product directly before deciding to make a payment. With this feature, consumers can verify that the item received matches the description listed on the platform, thus reducing the risk of fraud or product discrepancies. The transaction security offered through this system is one of the key aspects in increasing consumer trust in e-commerce platforms. This research aims to examine how the COD Check First feature provides additional protection for consumers in e-commerce transactions, particularly concerning the potential risks of fraud or product discrepancies that are common in online trade. This feature gives buyers more control to ensure that the received goods meet their expectations and the product description. Therefore, COD Check First not only facilitates the transaction process but also strengthens consumer protection, making it a relevant mechanism to minimize buyer dissatisfaction in e-commerce, especially in Indonesia.

Abstract

The young generation has a strategic role in driving social, political, and economic change in a nation. This study aims to analyze the role of Garda Pemuda NasDem as a forum for empowering the young generation of Indonesia in facing the challenges of the times and becoming agents of transformative change. With a descriptive qualitative approach, data were collected through interviews, observations, and documentation studies. The results of the study indicate that Garda Pemuda NasDem plays an active role in fostering leadership, political education, and social participation of young people through open, inclusive, and tiered cadre programs. This organization also establishes synergy with government regulations such as Permenpora and Permensos and responds to the challenge of the lack of political participation of young people with a collaborative and educational approach. Although there are still challenges to participation and effectiveness, Garda Pemuda NasDem has succeeded in creating a strategic space for the young generation to become agents of change in national development.

Abstract

The rapid digital transformation in Indonesia has intensified the need for robust personal data protection, particularly through the mechanism of the Data Protection Impact Assessment (DPIA) as stipulated in Law Number 27 of 2022 concerning Personal Data Protection (PDP Law). This study employs a normative juridical and qualitative approach to examine the role of DPIA as a key instrument in identifying, evaluating, and mitigating privacy risks in high-risk personal data processing activities. The findings reveal that although DPIA represents a significant normative advancement, its implementation faces major challenges, including the absence of detailed technical regulations, limited institutional capacity, and insufficient data subject involvement. By comparing international best practices, this research highlights the urgent need to strengthen regulatory frameworks, enhance digital and privacy literacy, and develop a collaborative ecosystem to optimize the DPIA function. Normative recommendations are formulated to reinforce DPIA as a risk management tool and a safeguard for privacy rights, aiming to foster a secure and trustworthy digital ecosystem amid ongoing digital transformation.

Abstract

Gender-Based Violence (GBV) is a significant social problem in Indonesia, where women and children are often victims. This study aims to analyze economic factors that increase vulnerability to GBV and evaluate the effectiveness of existing legal protection. The research method used is empirical legal with a qualitative approach, involving interviews, focus group discussions, and documentation studies. The results of the study indicate that poor economic conditions, patriarchal norms, and limited access to education and legal services contribute to high levels of vulnerability. Although there are laws that protect victims, such as Law No. 23 of 2004, its effectiveness is still in doubt due to the lack of socialization and understanding of the law in the community and law enforcement officers. Many victims do not report because of social stigma and lack of information about their rights. The researcher suggests that there are concrete steps in increasing legal socialization, providing integrated services for victims, and policy reform so that legal protection can be more effective and responsive to the needs of GBV victims, as well as to reduce the rate of violence.
