Abstract

The transition from analog to digital broadcasting in Indonesia has increased the public’s need for Set Top Boxes (STBs). However, this process has also raised legal concerns due to the widespread circulation of illegal STBs that fail to meet technical standards and certification requirements. This study analyzes the criminal elements involved in the distribution of illegal STBs and examines the criminal liability of business actors engaged in their production, distribution, or sale. The research employs a normative legal method using statutory and conceptual approaches. Findings indicate that the circulation of illegal STBs fulfills both actus reus and mens rea under the Telecommunications Law, Consumer Protection Law, and the Electronic Information and Transactions Law. Business actors knowingly trade uncertified devices and disseminate misleading information through digital platforms, posing safety risks, harming the electronics industry, and obstructing the digital broadcasting migration program. The study concludes that addressing illegal STB distribution requires stronger law enforcement, enhanced regulatory oversight, updated digital trade regulations, and improved consumer literacy to ensure a safe and equitable digital broadcasting ecosystem..

Abstract

This study examines the concepts of ‘Amm and Khâsh in uṣūl al-fiqh, which play a significant role in understanding the Qur’an and Hadith. The purpose of this research is to explain the meaning, types, and legal implications of general and specific expressions in Islamic legal interpretation. The method applied is library research by reviewing classical and contemporary scholarly works that discuss ‘Amm and Khâsh. The findings show that ‘Amm refers to expressions that apply to all individuals within a category without exception, while Khâsh points to a singular expression with a definite and limited meaning. This study also highlights three main forms of ‘Amm: ‘Amm yurâdu bihi ‘Amm, ‘Amm yurâdu bihi Khusûs, and ‘Amm makhsûs, whose interpretation depends heavily on context and qarīnah. In conclusion, a deeper understanding of ‘Amm and Khâsh is essential for ensuring accuracy in deriving Islamic laws and for affirming both the universal and specific nature of the Sharī‘ah in various situations

Abstract

Law Number 8 of 1999 on Consumer Protection constitutes an important legal foundation for safeguarding consumer rights in Indonesia. However, in practice, the implementation of consumer protection still faces various challenges, particularly related to institutional weaknesses in handling consumer dispute resolution. This study aims to identify the weaknesses of consumer protection institutions, namely the National Consumer Protection Agency (BPKN), the Consumer Dispute Resolution Body (BPSK), and Non-Governmental Consumer Protection Organizations (LPKSM), in effectively exercising their functions and authorities. Several issues identified include limited resources, weak institutional authority, low public awareness of consumer rights, and insufficient coordination among relevant institutions. Furthermore, this research proposes strategies for strengthening consumer protection institutions in the future through structural reform, enhancement of human resource capacity, and optimization of digital-based dispute resolution systems that are faster, more affordable, and fair. Such strengthening not only improves the effectiveness of dispute resolution but also represents a tangible form of state defense in the context of protecting citizens’ rights as consumers in achieving the Sustainable Development Goals (SDGs). Thus, the state actively plays a role in ensuring justice and legal certainty in national economic activities.

Abstract

Kekerasan seksual menjadi isu hukum yang krusial untuk ditelaah karena dampaknya terhadap hak asasi manusia para korban, yang menimbulkan gangguan baik secara mental maupun fisik. Indonesia dengan tingkat kasus kekerasan seksual yang dapat dikatakan tinggi terutama melibatkan korbannya yaitu perempuan maupun anak -anak dibawah umut harus segera untuk diatasi dan diberikan perlindungan kepada mereka. Penelitian ini bertujuan untuk mengkaji UU TPKS dari segi perlindungan dan perspektif aktivis hukum. Metode penelitian dengan menerapkan penelitian normatif, sedangkan hasil penelitian menunjukan bahwa Undang-Undang nomor 12 tahun 2022 tentang Tindak Pidana Kekerasan Seksual berusaha memberikan perlindungan dalam berbagai bentuk perlindungan pemerintah banyak memberikan bentuk perlindungan yang diusahakan dalam peraturan perundang undangan Tindak Pidana Kekerasan Seksual. Perlindungan trersebut berupak hak yang diberikan kepada korban seperti hak Penanganan, Hak Perlindungan dan hak pemulihan.Selain perlindungan terdapat pasal 4 ayat 2 yang sering menjadi kritikan dikarenakan kurangnya pemberian definisi mengenai bentuk -bentuk kekerasan seksual.

Abstract

International law is a complex and dynamic normative framework that regulates relations among states, international organizations, and other legal subjects at the global level, emphasizing fundamental principles such as state sovereignty, non-intervention, the prohibition of the use of force, and human rights. This article provides an in-depth analysis of the definition, scope, history, sources, key principles, and the role of international organizations in the context of contemporary challenges, including climate change, cybersecurity, terrorism, migration, and geopolitical conflicts. Using historical, analytical, and case-study approaches, including the 2022 Russian invasion of Ukraine, the author explores the evolution of international law from the 17th century to the current digital era. The main findings indicate that although international law promotes global stability and cooperation, its effectiveness is often undermined by unequal enforcement, the realpolitik of powerful states, and gaps in emerging norms for new issues. This article contributes to the international law literature by advocating structural reforms, such as strengthening enforcement mechanisms and integrating technology, to address 21st-century challenges.

Abstract

This study analyzes the application of the Scientific Crime Investigation (SCI) method in the investigation of murder cases at the investigation level as per Decision Number 425/Pid.B/2024/PN Mgl. This case faced obstacles due to the lack of witnesses and evidence, making conventional investigations difficult. The research method used a normative juridical approach supported by an empirical approach. Data was obtained through literature studies and interviews with investigators and lecturers, then analyzed qualitatively. The results of the study show that the application of SCI is carried out through three main areas, namely identification, forensic medicine, and forensic laboratories. Forensic medicine through visum et repertum and forensic laboratories through DNA testing have significant revelatory power in connecting the perpetrator with the victim. However, the application of SCI still faces obstacles in the form of limited forensic facilities, a lack of human resources, weak coordination between agencies, and low public awareness in preserving crime scenes.

Abstract

This study examines legal protection for cohabitation in relation to the right to privacy and criminal regulation from a human rights perspective. Cohabitation is understood as a life choice between two adults in the most private sphere and should be protected from state intervention. However, Article 412 of the Criminal Code opens the possibility of the use of criminal law that could potentially violate human dignity through actions such as raids or inspections of domestic spaces. This study uses a normative juridical method by analyzing the 1945 Constitution, the Human Rights Law, the Criminal Code, the ICCPR, the Universal Declaration of Human Rights, and General Comment No. 16 to assess the compatibility of criminal regulations with the principles of privacy, personal autonomy, and limitations on state power. The study results indicate that the criminalization of cohabitation does not meet the parameters of legality, necessity, and proportionality because it is a victimless act that does not cause concrete harm and has the potential to create discrimination against women and vulnerable groups. The complaint mechanism also does not adequately protect the right to privacy because it leaves room for families to determine whether the state can intrude into an individual's private sphere. This study emphasizes the need for an evaluation of Article 412 of the Criminal Code through judicial review to align criminal policy with human rights principles and constitutional guarantees..

Abstract

The development of Islamic law in the modern era requires a methodology of istinbāṭ capable of addressing contemporary issues. However, in practice, confusion still arises in understanding the differences in function between Qawāʿid Uṣūliyyah, Qawāʿid Fiqhiyyah, and Qawāʿid Tasyriʿiyyah. This reality raises a fundamental question regarding the conceptual and applicative positions of these three types of legal maxims in the determination of Islamic law. This study formulates the following research problems: how do the functions and applications of Qawāʿid Uṣūliyyah, Qawāʿid Fiqhiyyah, and Qawāʿid Tasyriʿiyyah differ, and how can their integration strengthen contemporary Islamic legal methodology. This research employs a normative-qualitative method with a descriptive-comparative approach. Data were collected from classical uṣūl al-fiqh literature, fiqh works, and contemporary studies (2018–2025), and were analyzed using content analysis to identify differences, similarities, and patterns of integration among the three types of legal maxims. The findings indicate that Qawāʿid Uṣūliyyah function as the methodological foundation in the process of legal istinbāṭ, Qawāʿid Fiqhiyyah serve as practical guidelines for resolving everyday cases, while Qawāʿid Tasyriʿiyyah function as a normative basis for the formulation of Islamic law oriented toward maqāṣid al-sharīʿah..

Abstract

The expansion of electronic commerce has greatly facilitated access for Indonesian consumers to purchase goods offered by foreign business actors. However, this convenience also contributes to the rising circulation of counterfeit items, particularly in the fashion sector, which can result in both material and non-material losses for consumers. This research examines the legal responsibility of foreign sellers and evaluates the effectiveness of consumer protection mechanisms provided under the Consumer Protection Act, the Electronic Information and Transactions Act, and Government Regulation No. 80 of 2019 on Electronic Commerce. Using a normative juridical approach, the study reveals that although these regulations establish a legal foundation for consumers to claim compensation, their implementation remains constrained by several challenges, including difficulties in pursuing foreign businesses, limited jurisdiction, obstacles in proving counterfeit goods, and inadequate oversight by e-commerce platforms. The findings indicate that preventive and repressive legal protections have not yet operated optimally in cross-border online transactions. Strengthening marketplace supervision, requiring foreign business actors to appoint local representatives, enhancing international cooperation, and improving consumer awareness are essential measures to mitigate losses arising from counterfeit products.

Abstract

Generation Z's knowledge exploration, interpretation of nationality, and existence as citizens are all influenced by social media, which has evolved beyond its original purpose of sharing news. Combining the emotional intensity of broadcasts with the impersonal nature of automated curation may lead to a loss of context and the polarization of public discourse. This study employs a qualitative literature review by examining scholarly sources published between 2015 and 2025. The analysis was carried out using a thematic synthesis approach to identify patterns, findings, and emerging trends related to disinformation, critical digital literacy, and national identity among Generation Z, This article presents a practical solution: bolstering Indonesian identity while simultaneously combating misinformation via the integration of critical digital literacy, algorithmic awareness, and digital nationalism. A review of research conducted between 2024 and 2025 highlights four important aspects: (1) misleading campaign videos with text often surface on social media platforms like Facebook, YouTube, and TikTok. (2) In order to combat this, schools should implement source verification assignments, encourage slow reading, and create data-based counternarratives. (3) To create an effective literacy the environment, teachers and librarians should prioritize frequent small sessions, literacy teams, student representatives, and interactive channels. (4) Gen Z is more likely to find meaningful cultural hashtags, local collections, historical site vlogs, and participatory national narratives. Thus, being tech-savvy is only the tip of the iceberg when it comes to digital literacy; it also serves as a glue for Indonesian identity and a foundation for public reason
