Abstract

 The rapid development of online gaming platforms such as Roblox has created a new digital environment widely accessed by children as a medium for recreation, social interaction, and creative exploration. However, the intensity of such usage also increases their exposure to various risks, including inappropriate content, online sexual exploitation, cyberbullying, and the leakage of children’s personal data. This study aims to analyze the legal responsibility of Roblox as a Foreign Private Electronic System Operator (PSE) within the Indonesian legal framework, particularly regarding child protection in digital spaces. This research employs a qualitative approach using a normative juridical method, combining the analysis of legal documents, sectoral regulations, government policies, and scholarly literature related to digital platform governance. The data sources include the Electronic Information and Transactions Law (UU ITE), the Child Protection Law, Government Regulation No. 71/2019, Government Regulation No. 17/2025 on Electronic System Governance for Child Protection, and Ministerial Regulation No. 2/2024 on Game Classification. The findings indicate that Roblox bears legal obligations to implement precautionary measures through age verification, content moderation, parental controls, risk detection systems, and the protection of children’s personal data.

Abstract

This study aims to examine the conformity of Law Number 35 of 2014 with the principle of non-discrimination in the practice of handling children who are victims of bullying. This research employs a quantitative method, and the research design is library research. The results of the study in the first discussion indicate that, based on an analysis of Article 76C of Law Number 35 of 2014, several findings were obtained. Article 76C of Law Number 35 of 2014 has normatively provided legal protection for child victims of bullying, as bullying is categorized as a form of violence against children, both physically and psychologically. This regulation has a broad scope of protection because it not only holds perpetrators accountable but also parties who participate in acts of bullying against children. Thus, it can be concluded that Article 76C of Law Number 35 of 2014 emphasizes the prohibition of all forms of violence against children, including bullying, as a manifestation of legal protection for child victims. This regulation provides a legal basis for law enforcement and prevention against perpetrators of bullying and affirms the obligations of the state, society, and parents to guarantee children’s rights to safety and dignified treatment. However, the effectiveness of protection for children still depends on the consistency of law enforcement and fair and non-discriminatory implementation in practice.The results of the second discussion, based on the analysis above, conclude that with regard to the principle of non-discrimination, several provisions in Law Number 35 of 2014, particularly those related to Article 76C and its sanctioning articles, are not yet fully aligned with indicators of non-discrimination. Based on the above discussion, Article 76C of Law Number 35 of 2014 is considered not fully in line with the non-discriminatory principle because the sanctions stipulated in Article 76C have not entirely reflected the indicators of the non-discriminatory principle.

Abstract

Abstract

Islamic law is a set of rules established by Allah SWT to serve as a guide for humans in living their lives. These rules are sourced from the Quran, Hadith, ijma' and qiyas (consensus), which regulate various aspects of human life, both individual and social. As a manifestation of sharia, Islamic law emphasizes not only the formal legal aspect but also the moral and spiritual dimensions that guide the community in achieving prosperity in this world and the hereafter. This article discusses the basic concepts of Islamic law, including its definition, sources, objectives, characteristics, and urgency in contemporary life. By exploring the role of Islamic law in establishing justice, maintaining social order, and addressing the challenges of modernity, this paper demonstrates that Islamic law has universal relevance, not only for Muslims but also in its contribution to humanitarian values globally

Abstract

This study examines the conflict between the state’s right of priority over tax debts and the position of the holder of a security right in the execution of collateral, focusing on a case of tax seizure that obstructed an auction at the State Asset and Auction Service Office in Surabaya. The main issue arises from the overlapping authority between tax officials and the state auction office when collateral already encumbered with a security right is also subjected to seizure due to the debtor’s outstanding tax obligations. The purpose of this study is to explain the legal standing of each party, assess the practical handling of auctions in real cases, identify the implications of this priority conflict for legal certainty for creditors, and formulate recommendations for more harmonious regulatory arrangements. The research method used is a normative legal approach supported by empirical analysis of auction practices, including the review of documents and field observations. The findings indicate that although the holder of a security right has priority in debt repayment, the application of the state’s priority over tax obligations often delays or hinders the execution of collateral, creating legal uncertainty and financial risks for creditors. Furthermore, inconsistencies between tax regulations and security law contribute to procedural confusion in the auction process. This study concludes that regulatory reconstruction is necessary to clearly govern the relationship between the state’s priority rights and security rights to avoid authority conflicts and ensure legal protection and certainty for all parties involved.

Abstract

Unregistered marriage (nikah sirri) is a social phenomenon that frequently occurs in Sungai Raya Kepulauan District, Bengkayang Regency. This practice is considered religiously valid because it fulfills the pillars and requirements of marriage, but is not officially registered at the Office of Religious Affairs (KUA). This research aims to analyze the perspective of Islamic law regarding the registration of unregistered marriages, identify its impact on the rights of women and children, and evaluate the factors influencing the prevalence of this practice. The research employs a qualitative method with a descriptive-analytical approach. Data was collected through in-depth interviews with couples practicing unregistered marriage, religious figures, the head of KUA, and local community members. The research findings indicate that from the perspective of Islamic law, unregistered marriage is considered valid if its pillars and conditions are fulfilled, but marriage registration is very important as a form of maslahah mursalah to protect family rights. The negative impacts include uncertainty regarding the legal status of wives and children, difficulties in obtaining inheritance rights, and minimal legal protection. Factors driving the practice of unregistered marriage include economic aspects, low legal understanding, local cultural influences, and limited access to official registration.

Abstract

Drug abuse is a complex problem that has wide-ranging impacts on individuals, society, and the state. Within the Indonesian legal system, drug abusers are not always regarded solely as perpetrators of criminal acts, but also as victims who require medical and social treatment. Based on Law Number 35 of 2009 on Narcotics, particularly Article 54, narcotics addicts and victims of drug abuse are required to undergo medical rehabilitation and social rehabilitation. However, the implementation of this provision in judicial practice often gives rise to problems due to differing legal interpretations regarding the status of drug abusers as suspects or defendants. This study aims to analyze legal discovery (rechtvinding) in the process of granting rehabilitation to drug abusers, as well as to identify the role of law enforcement officials—particularly investigators, public prosecutors, and judges—in determining appropriate forms of treatment. The research method employed is normative juridical, using statutory, conceptual, and case approaches. Data were obtained from library research, statutory regulations, court decisions, and literature related to narcotics law enforcement. The results of the study indicate that legal discovery in the granting of rehabilitation is necessary to bridge normative gaps and address inaccuracies in the application of law in drug abuse cases. Legal discovery by judges and law enforcement officials is essential to ensure that the objectives of law—justice, utility, and legal certainty—are achieved in a balanced manner. Rehabilitation is not merely a form of leniency, but a manifestation of human rights protection for drug abusers to obtain treatment and recovery.

Abstract

The Regional Representative Council (DPD) was established through an amendment to the 1945 Constitution as a form of regional representation in the Indonesian constitutional system. However, the legislative authority granted to the DPD is very limited and therefore not commensurate with the electoral legitimacy it obtains through direct elections by the people in each province. This gap between legitimacy and authority creates a representation problem, especially because all laws inherently impact the regions, thus affecting the DPD's role only on regional issues, which are no longer constitutionally or practically relevant. Constitutional Court Decisions No. 92/PUU-X/2012 and 79/PUU-XII/2014 have affirmed the DPD's equal standing with the President and the House of Representatives in the submission and deliberation stages of certain bills. However, its implementation has been hampered by political resistance and regulations, particularly through the MD3 Law which reduces the DPD's constitutional authority. This study uses a normative juridical method with a regulatory, conceptualization, and case approach to assess the urgency of strengthening the DPD's authority as part of the checks and balances mechanism in the legislative system. The research findings indicate that strengthening the authority of the Regional Representative Council (DPD) through granting veto power for regional-related bills and mandatory involvement in all bill deliberations, even without the right to vote, is a constitutional and political necessity to ensure effective regional representation, strengthen national integration, and balance the House of Representatives' dominance in lawmaking.

Abstract

This study analyzes the jurisdiction of the International Criminal Court (ICC) in handling cases of serious human rights violations against the Rohingya ethnic group in Myanmar. Using a normative approach and literature review, the research highlights principles of international humanitarian law and international criminal law, including the 1998 Rome Statute as the basis of ICC jurisdiction. The Rohingya case is categorized as a non-international armed conflict involving alleged serious human rights violations, including genocide, crimes against humanity, and war crimes. The study reveals that although the ICC’s complementarity principle allows the international court to act when national judicial systems are unable or unwilling to enforce the law, the exercise of ICC jurisdiction faces various obstacles, such as Myanmar’s lack of cooperation, Myanmar’s non-party status to the Rome Statute, and regional political constraints related to the ASEAN non-intervention principle. The findings indicate that despite significant challenges, the ICC still plays a strategic role in upholding international justice for the Rohingya community through the recognition of jurisdiction over violations occurring in the territory of Rome Statute states or through referrals by the United Nations Security Council.

Abstract

The humanitarian crisis affecting the Rohingya ethnic group in Myanmar represents one of the gravest forms of serious human rights violations that demands profound global attention. The manifestation of systematic actions—including mass killings, forced deportations, sexual violence, and policies of citizenship deprivation—strongly indicates the existence of genocidal practices as standardized under the Convention on the Prevention and Punishment of the Crime of Genocide of 1948. This study analytically examines the conformity of the actions undertaken by Myanmar’s authorities with the constitutive elements of genocide within the framework of international law, while also assessing the scheme of state responsibility for such crimes. Employing a normative legal research method with statutory and conceptual approaches, this study concludes that the series of discriminatory policies and widespread violence fulfill the criteria of both actus reus and mens rea of genocide. As a legal consequence, Myanmar bears full responsibility under international law, thereby necessitating the active involvement of the international community in the enforcement of justice and in preventive efforts to avoid the recurrence of similar crimes.
