Abstract

As the world's largest archipelagic nation, Indonesia possesses vast and strategic maritime territory, both economically and geopolitically, and for national defense. However, Indonesia currently lacks a maritime court specifically addressing maritime disputes and violations. Maritime case management remains scattered across various judicial bodies, leading to fragmented authority and weak maritime law enforcement. This study aims to legally analyze the urgency of establishing a maritime court in Indonesia as a defense management instrument to safeguard the maritime sovereignty of the Unitary State of the Republic of Indonesia (NKRI). The research method used is normative juridical, with legislative, conceptual, and comparative approaches. The results indicate that the establishment of a maritime court is a strategic national necessity to strengthen maritime law enforcement, increase legal certainty, and support a national defense system based on maritime sovereignty

Abstract

This study aims to analyze the evidence for the mens rea element of evil in corruption stemming from public policymaking, focusing on the alleged sugar import corruption case involving Tom Lembong. The primary issue in this case is the blurred line between policy discretion and corruption. Using normative juridical research methods and a case study approach, this study examines whether violations of administrative procedures automatically represent criminal mens rea (evil intent). The results show that in policy-based corruption, mens rea cannot be simply equated with administrative errors. Evidence of fraudulent intent, as defined by Article 2 of Law Number 31 of 1999 in conjunction with Law Number 20 of 2001, is required, with the intention to enrich oneself, others, or corporations for illegitimate economic gain or to the detriment of the state. Law enforcement that relies solely on state losses without proving personal motives or kickbacks risks the criminalization of policies, which could stifle bureaucratic innovation in Indonesia.

Abstract

This study examines the reconstruction of the recognition of living law in society (living law) in the National Criminal Code (KUHP) and its implications for the principle of criminal legal certainty in Indonesia. The recognition of living law through Article 2 of Law Number 1 of 2023 marks a paradigm shift from absolute legal positivism to inclusive legal pluralism. However, the integration of unwritten law into the codified criminal system poses serious challenges to the principle of formal legality (nullum crimen sine lege scripta). The research method used is normative juridical with a conceptual approach and the legislation of the new Criminal Code. The results of the study indicate that the recognition of living law requires juridical reconstruction in the form of codification of customary norms into Regional Regulations (Perda) as a requirement to fulfill the aspect of legal certainty. Without clear parameters regarding the types of sanctions and the territorial boundaries of its application, this recognition has the potential to trigger legal discrimination and uncertainty for legal subjects. This study concludes that synchronizing local justice values with national human rights standards is key to the successful implementation of living law in a modern legal system.

Abstract

This research aims to comprehensively examine the alignment between Muhammadiyah's Manhaj Tarjih logic and mathematical thinking, alongside its implications for education, humanization, and enlightenment dawah. Employing a qualitative approach through library research, data were gathered from primary sources, including official organizational documents, educational philosophy literature, and relevant national and international scientific journals. The analysis was conducted using inductive and reflective content and thematic analysis to achieve a holistic understanding. The findings reveal a robust epistemological alignment between Manhaj Tarjih logic and mathematical reasoning, particularly regarding rationality, systematic structure, and consistency. Furthermore, mathematics education serves a strategic role in integrating Muhammadiyah’s scientific mission, fostering humanistic awareness, and internalizing Islamic values into pedagogical practices. This study concludes that mathematics is an essential medium for developing progressive Islamic education that is critical, rational, and welfare-oriented. Ultimately, this synergy strengthens the enlightenment dawah movement, ensuring it remains adaptive to modern scientific dynamics while staying firmly rooted in humanistic principles and religious values.

Abstract

Youth development is a strategic aspect of enhancing human resource quality and regional competitiveness, which in Indonesia is measured through the Youth Development Index (YDI) covering five domains: education, health and well-being, employment opportunities, participation and leadership, and gender and discrimination. East Java Province has a large youth population and a YDI score comparable to the national average; however, several indicators remain stagnant or vulnerable, particularly in the domains of health and well-being and employment. This condition raises questions about the extent to which youth policies and programs implemented by the East Java Provincial Youth and Sports Office (Dispora Jatim) contribute to improving the YDI. This study aims to analyze the role of Dispora Jatim’s policies and programs in enhancing the YDI and to identify gaps between program design and YDI indicators. Using a descriptive-analytical approach, this research applies public policy analysis and secondary data analysis based on the 2023 YDI report, the 2025–2026 Strategic Plan of Dispora Jatim, and supporting statistical data. The findings indicate that while Dispora Jatim’s programs are normatively aligned with YDI dimensions, their impact on several indicators remains limited due to a stronger emphasis on program outputs rather than sustainable social outcomes, highlighting the need for YDI-based policy evaluation and stronger cross-sectoral integration in youth development.

Abstract

This study analyzes the patterns of husband-wife relationships based on the mubadalah perspective, which emphasizes reciprocity, fairness, and cooperation in the household. The study was conducted in Sidomulyo Timur Village, Marpoyan Damai District, Pekanbaru City, using a qualitative approach and in-depth interviews with married couples as the main informants. The results of the study identified four developing relationship patterns: (1) Owner–Property, (2) Head–Complement, (3) Senior–Junior, and (4) Equal Partner. Among these four patterns, only the Equal Partner pattern fully reflects the values of mubadalah, while the other patterns show variations in the level of equality and involvement of the couple. This study concludes that an ideal husband-wife relationship should be built on the principles of mubadalah and taradhin (mutual consent) in order to achieve a harmonious, fair, and equal household.

Abstract

In educational practice, students are often treated as a homogeneous group within a heterogeneous environment. The "one-size-fits-all" approach has proven ineffective as it overlooks the segmented needs of diverse individuals. This study aims to perform student profiling through cluster analysis to identify groups requiring specialized support or enrichment. The methodology compares two clustering algorithms: K-Means (partition-based) and DBSCAN (density-based). Prior to modeling, optimal parameters were determined using the Elbow method for K-Means and the K-distance graph for DBSCAN. Model evaluation was based on the number of resulting clusters and the Silhouette Score. The results indicate that DBSCAN outperformed K-Means with a Silhouette Score of 0.4 compared to 0.3. Furthermore, DBSCAN produced a more optimal and cohesive structure with 5 clusters, making it more interpretable for student profiling than the 8-cluster solution from K-Means. The analysis successfully identified five student profiles: High Achievers, Above Average, Moderate, Below Average, and At-Risk/Underprivileged. This study concludes that multivariate cluster analysis is an effective instrument for targeted educational intervention, particularly in prioritizing economic aid and academic mentoring for vulnerable groups without relying on demographic identity as a determinant of individual ability.

Abstract

This study aims to examine educational marketing in school management through the perspective of the philosophy of science, encompassing the dimensions of ontology, epistemology, and axiology. The study employed a qualitative approach with a library research design combined with philosophical-conceptual analysis. The research data were sourced from primary and secondary literature in the form of classic and recent books, articles from accredited and internationally reputable national journals, and policy documents relevant to educational marketing and school management. Data analysis was conducted through the stages of concept reduction, thematic categorization, philosophical interpretation, and argumentative synthesis. The results of the study indicate that ontologically, educational marketing is an integral part of the nature of school management as a public service institution oriented towards social and humanitarian missions. Epistemologically, educational marketing is built on the integration of theory, empirical data, and practical experience in school management, explained scientifically and reflectively. Meanwhile, axiologically, educational marketing demands the application of ethical values, honesty, social responsibility, and an orientation towards mutual education. The integration of these three dimensions emphasizes the importance of developing meaningful, ethical, and sustainable educational marketing.
