Abstract

Islamic family law is a part of the Sharia that regulates the relationship between men and women within the institution of marriage. However, patriarchal bias remains embedded in its construction, particularly in provisions related to marriage guardianship (wali), divorce (ṭalāq), and polygamy, which may limit women's rights. This issue arises from interpretations of religious texts that are shaped by classical socio-cultural contexts rather than the core values of Islam. This article aims to address two main questions: to what extent has patriarchal dominance influenced the formulation of Islamic family law, and what gender-equitable interpretive alternatives can be proposed? This study employs a qualitative approach using literature review methods, focusing on primary sources from classical fiqh and feminist interpretations of Islamic texts. The analysis is carried out through the lenses of gender studies, hermeneutics, and maqāṣid al-sharī‘ah. The findings highlight the urgency of reinterpreting Islamic family law texts to ensure contextual relevance and inclusivity of women's lived experiences. Such reinterpretation is essential for achieving substantive justice and maintaining the relevance of Islamic values in the face of dynamic social change.

Abstract

Marriage registration is one of the family law reformation carried out by muslim countries in the world. The aim is to achieve legal certainly, rule of law, and legal protections of a marriage. Hence, various contries in the Islamic world made the registration of marriage as on oligation which regalized in any regulatory. However, in itsimplementation, there is a difference perspective requirements and not related to the validity of the marriage because in this case validity of the marriage remained propped against the provisions of islmic law. Marriage registration is one of the national legal principles under Law Number 1 of 1974 on marriage. In Indonesia marriage legislation, the existence of marriage registration related to and devined validity of marriage besides following provision of their religions and beliefs. Otherwise registration and making marriage acte is an obligation in marriage legislation in Indonesia. But in the practice, registration and making marriage acte is ambiguity, because that obligation only administratively, not influence to marriage validity. Even the marriage done based on their religion provision, but if not registrate, the marriage does not have legal position. This unregistrative marriage cause husband, wife and ther children do not have legal protection. Relation with that, its need legal reform related to marriage regislation with constectual approach for giving legal certainly and protection for husband, wife and their children.

Abstract

Marriage is a contract that legitimizes the relationship between a man and a woman with the purpose of building a family that is sakinah (tranquil), mawaddah (loving), and rahmah (merciful). In its implementation, there are specific pillars and conditions that must be fulfilled, including the use of specific utterances in the ijab (offer) and qabul (acceptance). While the majority of Islamic jurists stipulate the use of the terms zawaj (marriage) and nikah (matrimony), some Hanafi scholars permit the use of the term hibah (gift). This article examines the arguments employed by Hanafi scholars, as well as the counter-arguments from the majority of jurists who assert that the permissibility of using the term hibah was a specific privilege granted exclusively to Prophet Muhammad (SAW). This study aims to clarify the legal status of using the hibah utterance in the marriage contract based on the interpretation of legal verses (tafsir ayat al-ahkam) and the opinions of Islamic jurists.

Abstract

This study aims to examine the role of habitual dhuha prayer and musafahah (handshaking) in shaping students’ moral character (akhlakul karimah) at MI An-Nidhom Kebunrejo Genteng. The research focuses on integrating spiritual and social dimensions in developing students’ religious character. Using a descriptive qualitative approach, data were collected through observation, interviews, and documentation involving the principal, Islamic education teachers, and fourth to sixth-grade students. The findings reveal that dhuha prayer fosters students’ discipline, sincerity, and spiritual responsibility, while musafahah cultivates respect, empathy, and affection within the school community. The synergy of both activities creates a balance between hablun minallah (relationship with God) and hablun minannas (relationship with others), resulting in a harmonious and civilized religious character. This study reinforces the view that character formation in Islamic education is most effective through consistent religious practices and moral habituation rather than mere theoretical instruction.

Abstract

Students come to class with diverse backgrounds, readiness levels, interests, and learning styles. This diversity has the potential to foster creativity if managed properly. Unfortunately, learning in schools still tends to be uniform, so the unique potential of students is often overlooked. The Merdeka Curriculum introduces differentiated instruction that adapts content, process, and product to student characteristics based on diagnostic assessments. This study aims to describe the implementation of differentiated learning in the subject of Islamic Religious Education and Character Education within the Merdeka Curriculum to foster student creativity. The research design uses a qualitative approach with a case study at SMPN 1 Cluring. Data were collected through interviews, observations, and documentation, then analyzed using Miles and Huberman’s interactive model. Data validity was maintained through source and method triangulation. The results show that the implementation of the Merdeka Curriculum at SMP Negeri 1 Cluring is carried out through three main stages: planning, implementation, and evaluation. Overall, the application of differentiated learning has been proven to enhance student creativity, as evidenced by increased willingness to ask questions, active participation in discussions, the ability to produce creative works, and improved collaboration.

Abstract

The rapid development of the digital economy has introduced financial innovations that enhance efficiency while simultaneously challenging the implementation of Sharia principles. Practices of riba, gharar, and maysir no longer appear in explicit traditional forms but are embedded in modern instruments such as interest-based online lending, conventional insurance, binary options, and speculative cryptocurrency trading. This study examines the continued relevance of these prohibitions in contemporary finance and analyzes the transformation of risks within modern contractual arrangements. Using a qualitative descriptive-analytical approach, the research draws upon classical fiqh literature and contemporary scholarly works. The findings reveal that although transaction mechanisms have evolved through digitalization, the substantive objectives of Sharia prohibitions remain consistent: preventing injustice, excessive speculation, and economic exploitation. Modern financial practices involving interest, high uncertainty, and speculative elements essentially replicate classical prohibitions in new forms. Therefore, strengthening Sharia-compliant financial innovation, adaptive regulation, and public financial literacy is essential to uphold justice, transparency, and risk-sharing in the digital financial system.

Abstract

Religious diversity presents opportunities and challenges for social harmony, especially in multireligious rural communities. Existing studies tend to examine normative frameworks, state policies, and institutional approaches, leaving little attention to the practice of religious moderation at the grassroots level. This study fills this gap by analyzing village heads and Sapta Darma leaders who apply deliberative leadership and public governance mechanisms to religious issues. Using a qualitative case study approach, data were collected through in-depth interviews with village heads and religious leaders and supported by documentation from the village. The findings show that religious moderation in Sukoreno is achieved through deliberative leadership, as demonstrated by inclusive deliberation, continuous dialogue, and collaborative decision-making involving leaders from various communities. Deliberative leadership is further strengthened and made more effective through local practices such as njagong (informal communal interaction) and andhap asor (humility and respect). Village leadership also demonstrates inclusiveness by recognizing indigenous belief communities, including Sapto Darmo, as part of local religiosity. Differences in religious practices and celebrations are deliberated and mutually respected.

Abstract

The development of the Islamic economy in Indonesia has not been fully followed by optimal interest in saving in Islamic savings products, particularly due to limited financial literacy and the effectiveness of marketing strategies. This study aims to analyze the implementation of the marketing strategy of BMT UGT Kalibaru Branch and the social, cultural, and economic factors that influence members' interest in saving. The study used a descriptive qualitative approach to gain an in-depth understanding of marketing practices and members' perceptions of Islamic savings. The results show that members' interest in saving is positively influenced by trust in Islamic principles, a personalized marketing approach, and Islamic financial education, but is not optimal due to limited literacy, marketing resources, and limited use of digital marketing. Optimizing marketing strategies and strengthening Islamic financial education that is adaptive to the community's socio-religious characteristics has been proven to increase members' trust, loyalty, and interest in saving, despite still facing challenges such as limited resources and competition with other financial institutions.

Abstract

The development of the Islamic financial sector in Indonesia has shown significant growth, in line with increasing public awareness of the importance of a sharia-based economic system. One of the microfinance institutions that plays a role in supporting this system is Baitul Maal wat Tamwil (BMT). This study aims to analyze the implementation of the mudharabah contract in the TABAH (Mudharabah Savings) product at the KSPPS BMT NU Genteng Branch. This research method uses a descriptive qualitative approach with data collection techniques through literature studies. The results show that the TABAH product at the KSPPS BMT NU Genteng Branch uses a mudharabah mutlaqah contract, where the customer acts as the shahibul maal and the BMT as the mudharib. The profit sharing ratio applied is 40% for the customer, with a calculation mechanism based on the average daily balance. The application of the mudharabah contract in this product has fulfilled the pillars and principles of sharia by reflecting aspects of transparency, fairness, and accountability in fund management. This study provides academic contributions to the development of Islamic financial theory as well as practical benefits for optimizing fund management in Islamic microfinance institutions.

Abstract

The globalization of education presents both challenges and opportunities for Islamic schools in Indonesia. One response is the integration of the globally oriented Cambridge Curriculum with the nationally designed Merdeka Curriculum. This study explores such integration at SDI Islamic International School PSM Grogol Kediri, showing how local wisdom can meet global standards to promote moderate and tolerant Islamic education. Using a qualitative case study, data were collected through interviews, classroom observations, and analysis of curriculum documents and lesson plans. Findings indicate that integration is carried out through mapping the core content of Cambridge and Merdeka, collaborative lesson planning, and competency-based assessments that combine cognitive, affective, and character aspects. This practice improves learning quality, fosters critical thinking, and cultivates tolerance among students. The study confirms that merging local and global curricula can provide a model of Islamic education that nurtures love, inclusiveness, and social harmony.
