Abstract

This study aims to find interactions between the press and law enforcement, as well as the information function needs of the press for law enforcement. This type of research used in this research is descriptive research. Analysis of the data used is qualitative. The results showed that the press had a large role in law enforcement and the development of Indonesian national law. Interaction between the functions of the press and the principles of law enforcement stated above can be mutually supportive, but also can inhibit each other. According to Bagir Manan, there are at least three aspects of press relations with law enforcement. First; the press as an object of law enforcement or affected by law enforcement. Second; the press as a facilitator of law enforcement.Third; the press as a barrier to law enforcement.

Abstract

Notaris merupakan profesi  yang sangat disegani dalam aktifitas hukum dan perdagangan karena terkait perjanjian dan pengurusan akta jual beli. Notaris berupaya untuk memberikan edukasi, pendekatan, hingga konsultasi bagi klien yang awam terhadap kegiatan perjanjian, kontrak, hingga jual beli yang mengakibatkan terjadinya perpindahan asset atau hak yang dimiliki. Notaris yang selalu menjadi langganan klien dan akrab dalam memberikan sumbangsih pemikiran dalam kegiatan bisnis klien telah membangun komunikasi interpersonal secara baik dan mudah dalam memberikan solusi serta jalan keluar.Penelitian ini bersifat deskriptif kualitatif. Penelitian kualitatif melalui pengumpulan data berupa observasi, wawancara, dan dokumentasi. Hasil penelitian ini mengungkapkan bahwa Komunikasi interpersonal yang dilakukan oleh Notaris dan klien memiliki sisi dinamis dan terus berubah seiring berjalannya waktu karena pola hubungan yang interaktif, dibangun oleh susasana akrab, dan bersifat timbal balik. Profesi notaris yang memegang teguh sumpah jabatan profesi perlu berpikir untuk konsisten setiap ungkapan dan standar moral dan etika profesi. Di sisi lain untuk menjaga hubungan dan kelancaran komunikasi  yang baik maka diperlukan  kegiatan tatap muka secara fisik dan sosial.

Abstract

Undang-Undang Nomor 22 tahun 2001 tentang Minyak dan Gas Bumi mengaturmengenai kegiatan usaha hulu dan kegiatan usaha hilir. Kegiatan usaha hilir dibidang niaga dapat dilaksanakan setelah mendapatkan izin usaha dari Pemerintah. Penelitian ini mengangkat permasalahan tentang penjualan BBM yang dilakukan oleh Pertamini yang tidak mempunyai izin dari pemerintah namun tidak dilakukan proses penegakan hukum. Penelitian ini bertujuan untuk mengetahui penegakan hukum undang-undang nomor 22 tahun 2001 tentang minyak dan gas bumi terhadap penjualan bahan bakar minyak oleh pertamini di kota Samarinda dan mencari solusi pemecahan masalah terhadap penjualan bahan bakar minyak yang lebih mahal oleh pertamini. Jenis Penelitian yang dipakai dalam penulisan hukum ini adalah penelitian yuridis empiris yang intinya mengkaji ketentuan hukum yang berlaku serta apa yang terjadi dalam kenyataan masyarakat. Pendekatan penelitian yang digunakan adalah deskriptif yang bertujuan untuk memberikan memberikan gambaran atau penjelasan secara spesifik tentang keadaan objek atau masalah yang diteliti. Hasil penelitian menyimpulkan bahwa penegakan hukum undang-undang nomor 22 tahun 2001 tentang minyak dan gas bumi terhadap penjualan bahan bakar minyak oleh pertamini di kota samarinda belum bisa dilakukan sebab masih belum adanya aturan daerah mengenai pertamini di kota Samarinda, sehingga belum dilakukan penegakan hukum terhadap keberadaan Pertamini.

Abstract

The aim of this research is to know the corruption as an extraordinary crime .The method is based on library through magazine and regulation No 31 the year 1999 , has been revised by the regulation No. 20 in the year 2001 on the combat of corruption and at  once  the  Book  of  Regulation  Crime  Act  (  KUHP)  namely  join  to  do  the corruption.The results of the research are (1).Corruption is difficult to find out it is , therefore , taking a long time to detect,(2).The proof tools have to be strong by calling the seewaitness,(3).The Regulation of the Corruption act is complete ,(4).The activity which needs budget has to be factually done, (5).Corruption must have to enrichen himself or herself and others,(6).The KPK staffs are very patient and inteligent.The suggestins are(1).KPK staffs have to be patient ,countable and calm ,(2).The proof tools have to be valid ,(3).Every officer has to study the regulation completely and seriously the regulation,(4).No fictive ativity ,(5).Every officer has to avoid to enrichen himself and others,(6).The KPK fficers continue to improve their performance.

Abstract

In 1935 ships-Ordinance has been determined on the requirements of thefeasibility of doing the cruise ship and the requirements in the form oflicenses issued by the Indonesian Bureau of Classification issued by thegovernment or cq Harbormaster and the Head Office of the Department ofTransportation. To and survived the voyage, the ship inland waters mustbe equipped with ship letters which is a guarantee for the feasibility of theship to sail in accordance with the requirements specified in theOrdinance of 1935 ships and inland vessels Ordinance 1927 and itsimplementation rules. A ship is said to worth screens for transportingpassengers and / or goods if it has a certificate of excellence. It ismentioned in Article 6 paragraph ( 1 ) and ( 3 ) ships Ordinance 1935. Inthe operation of inland water transport in particular freight , carriers andshippers generally have never made a carriage agreement in writing butmade verbally, and thus the rights and obligations of the parties is notreflected clearly impractica. In the event of an adverse event party shippermoney due to damage, reduced or loss of an item because of an error oromission of the carrier, the carrier usually fixed indemnify though not asbig as the real loss suffered. In terms of passenger transport (people), thecarrier is always considered to be responsible for the losses suffered bythe passenger if he were injured or died, without any obligation for thepassengers or their heirs to prove their right to compensation, just whenhe argues that he suffered injuries caused by transporting it. The newpresumption disappears if the carrier can prove that the loss occurredthrough no fault on his part or can not be avoided ( overmacht ) orbecause of his own fault passengers.

Abstract

In general, adoption according to law is the transfer of a child to adoptive parents from the biological parents in its entirety and is carried out according to legal local customs. So, the biological parents have let go of the child, and the responsibility shifts to the parents who adopted him. Although the Qur'an does not give adopted children the right to inherit from their adoptive parents, this is regulated in the Compilation of Islamic Law which is a human product from various schools of thought and made as a source of law in our country by providing provisions. that adopted children are entitled to receive a share of the inheritance.The legal position of the adopted child will result in that in general the child will have an inheritance relationship with the adoptive parents and inherit from the original parent will be removed based on Article 209 Paragraph 2 Compilation of Islamic Law (KHI), adopted children who do not receive a will will be given mandatory will. The position of adopted children according to Islamic inheritance law is not getting their inheritance rights from their adoptive parents, but still as legitimate children based on a court decision by not deciding the lineage / blood with their biological parents, because the principle of adoption according to the Islamic Law Compilation is a manifestation of faith that carrying a humanitarian mission that is manifested in the form of maintenance in its growth and development by fulfilling all its needs.Regarding the distribution of inheritance in the Compilation of Islamic Law Article 209 paragraph (2) for adopted children who do not receive a will but are given what is called a will, obligatory maximum of 1/3 (one third) of the inheritance of their adoptive parents, as stated in Article 195 paragraph (2) will allow a maximum will of only 1/3 of the inheritance unless all the heirs agree.

Abstract

Penetapan politik hukum keimigrasian yang selektif membuat intitusi ImigrasiIndonesia memiliki landasan operasional dalam menolak atau mengizinkan orang asing, baik dari segi masuknya, maupun kegiatannya di Indonesia. Berdasarkan politik hukumkeimigrasian yang bersifat selektif, ditetapkan bahwa hanya orang asing yang : (a).Memberikan manfaat bagi kesejahteraan rakyat, bangsa, dan negara RepublikIndonesia. (b).Tidak membahayakan keamanan dan ketertiban umum, serta. (c). Tidakbermusuhan dengan rakyat, bangsa dan negara Republik Indonesia diizinkan masuk dandiperbolehkan berada di wilayah Indonesia, serta diberikan Izin tinggal sesuai denganmaksud dan tujuan kedatangannya di Indonesia. Dengan demikian peran penting aspekkeimigrasian dalam tatanan kehidupan kenegaraan akan dapat terlihat dalam pengaturanmasuk atau keluar orang dari dan ke dalam wilayah Indonesia, pemberian Tanda Masukorang asing pada tempat pemeriksaan Imigrasi, dan pemberian izin tinggalKeimigrasian serta pengawasan terhadap orang asing selama berada di wilayahIndonesia dalam hal keberadaan dan kegiatan yang dilakukan orang asing sesuai denganVisa atau Izin Tinggal Keimigrasian yang mereka gunakan di Indonesia khususnya diKota Samarinda.Tujuan penelitian ini adalah 1) Untuk mengetahui pelaksanaan Undang-UndangRepublik Indonesia No.6 Tahun 2011 tentang Keimigrasian bagi warga negara asingyang tidak memiliki dokumen resmi/legal di Kota Samarinda. 2) Untuk mengetahuiupaya pencegahan tindak pidana penyalah gunaan dokumen keimigrasian di KotaSamarinda.Hasil penelitian sebagai berikut : 1) Penegakan hukum Keimigrasian diatur secarategas mengenai pelanggaran yang dikenai Tindakan Administratif Keimigrasian atauTindak Pidana Keimigrasian (projustitia) sehingga faktor yang mempengaruhidiambilnya Tindakan Administratif Keimigrasian sesuai dengan Pasal 75 ayat (1)Undang-Undang Nomor 6 Tahun 2011 tentang Keimigrasian. Pengawasan tersebutmeliputi pengawasan administratif dan pengawasan lapangan. Pengawasan tersebutmeliputi pengawasan administratif dan pengawasan lapangan. 2) Mengantisipasi adanyapenyalahgunaan Izin Tinggal Keimigrasian maka diperlukan pengawasan tenaga kerjaasing pemegang Izin Tinggal Terbatas. Pengawasan Keimigrasian terhadap orang asingsesuai Undang-undang Nomor 6 Tahun 2011 tentang Keimgrasian pasal 66 ayat (2)huruf b.

Abstract

One of the national problem in our education nowdays is the low quality of it. It is, therefore, there are many efforts by the goverment to improit by to improve the tools, instrument’s, human resources curriculum, budget and other else. In this research is willing to know about the improvement of the quality of the student’s activity the location in manado in 2016. The methods is qualitative one. The results of the research is that by the gift of the portain for the student’s they will be given the opportunity to strengthen the cognitive, effective and psicomotoric domain. In cognitive domain they will enlarge the knowledge, creativity, inovation and change the social action to sinergic effect, and the psicomotoric they are able to practice the knowladge into action. The suggestions are (1) the student’s have to be en courage to enrich the science and to be intellectual person (2) the student’s have to suport to be good attitude (3) the student’s have to motivate to practice in the field.

Abstract

The Main Role Of The Proofment In The Process Of ExaminationIn The Crime Count. The legal material of proofment is at the tool ofproofment which content of value and being considered by the corectjudge in the frame of charming the conviction to the only aim to makepunishment (vonis) of criminal core. In the judge court concerned is anaction to state of the event through the facts of the material provementsuggested. The facts found concerned are arranged to be a criminalmaterial which happed really (materiele waarheid) are will be dependedon the accuracy of the facts got and the material proofment.The writing of the law science in order to know the role of theproofment and the consideration of the judge in … decide the sentence thecorrect of crime. The kind of the method is the juridicial normative and thefollowing is the analysis in the descriptive kualitatif. The results orconviction has the important role in finishing the condernation which is tobe proved of material manly the real right based on the crime actionhappened. The judge may not make decision criminal sentence to someonebut if in the minimum to legal proofment tools. The gets the conviction thatthe criminal action has really been happened and the defendant is wrongto do based in the article 183 of the criminal book of crime.

Abstract

The development of the economy today is growing rapidly, which has animpact on the lives of people who need fuel oil (BBM) for daily needs fortheir survival. Economic development in general and in the field ofindustry and national trade in particular has produced a variety of goodsand / or services that can be consumed.The emergence of mini pom phenomena is not a few issues that havearisen among the people. The tools that are in mini poms that are sold ingeneral do not deny causing a particular concern. Jakarta Ministry ofTrade recognizes the existence of mini poms violating the rules. But apartfrom legal issues, they urge the public not to buy retail gasoline at themini pump, if it is not forced to due to inaccurate dosing can harmconsumers.the problems in this study are: (1) What is the Legal Position of the sale ofmini pom fuel according to the applicable laws and regulations ?; (2)How is Pertamina Oil Sales Supervision Related to Consumer Protection?The conclusions of this study are: (1) The sale of Pom Mini Fuel is not inaccordance with the Law, because it is not in accordance with thestandards listed in Law Number 2 of 1981 concerning Legal Metrologyand PerBPH Oil and Gas Number 6 years 2015; and (2) As is known,Pom Mini retail oil seller is an illegal and unlawful business activity thatmay be subject to criminal sanctions.
