Strategi Memperkuat Integritas Lembaga Peradilan Indonesia
ISSN: 3025-7182 Penerbit: Ikatan Hakim Indonesia (IKAHI) 0009-0000-1749-8018 : ORCID Fokus dan Ruang Lingkup Judex Laguens bertujuan untuk menyediakan wadah bagi akademisi, peneliti, dan praktisi untuk mempublikasikan artikel penelitian asli atau artikel review. Ruang lingkup artikel yang dimuat dalam jurnal ini membahas berbagai topik di bidang hukum dan peradilan. Frekuensi: 3 terbitan per tahun (April, Agustus, dan Desember) Judex Laguens merupakan jurnal akses terbuka dan peer-review yang bertujuan untuk menyebarkan hasil penelitian atau pemikiran asli yang fokus pada isu-isu di bidang hukum dan peradilan. Penulis diundang untuk mengirimkan naskah yang termasuk dalam lingkup Judex Set Lex Laguens. Artikel-artikel yang diterbitkan di Judex Set Lex Laguens melalui proses peer-review double-blind. Oleh karena itu, diterima atau tidaknya karya ilmiah tersebut merupakan hak Dewan Redaksi berdasarkan rekomendasi peer reviewer. Silakan baca informasi tentang proses peer-review. Mohon membaca dan memahami pedoman penulis dalam penyusunan naskah. Penulis yang menyerahkan naskah ke editor harus mematuhi pedoman dan template penulis. Jika naskah yang dikirimkan tidak sesuai dengan pedoman atau menggunakan format yang berbeda, maka naskah tersebut akan ditolak oleh tim editorial sebelum ditinjau. One of the big challenges from the past until now for judicial independence in Indonesia, namely the large number of interventions that come from various parties, both internal and external. This phenomenon illustrates that the current judicial situation is unhealthy, because institutions that should stand by maintaining their independence, are actually weakening due to influences and conflicts that attack the integrity of the judicial institution. This situation certainly raises questions from the public about the demise of Indonesia's judicial independence, which ultimately makes the public lose confidence in the judiciary as a place to seek justice. The judge in this case as a functional body of the implementation of the judiciary, which basically the judicial power is formed and compiled on the basis of legislation. As a law enforcer, the integrity of judges can be seen through their decisions, therefore judges must have freedom and moral values as their authority to decide cases, because the independence of judges is a representation of the state of law. Although various policy measures have been pursued in order to reform the judiciary, without independence or independence in the judicial power body, it will certainly be easier to provide access to opportunities that can affect and adversely affect including paving the way for the emergence of abuse of power or deviation of power and also the neglect of human rights by state rulers.

The dynamics of community development have resulted in an increase in legal conflicts arising as factual expressions between legal subjects, as well as influencing an increase in cases in court. Meanwhile, the General Court does not classify the Panel of Judges based on areas of expertise, between criminal and civil cases, which has the potential to disrupt the integrity of the judiciary. This phenomenon boils down to two issues, namely the urgency of classifying the fields of expertise of judges in the General Courts in terms of the public character of criminal cases and the private character of civil cases, as well as the workload of judges and the design of the chamber system within the General Courts. This study concludes that the absence of a judge's expertise in the General Courts greatly affects the integrity of the judiciary. This happened due to the mixing of judges with a variety of cases of a different nature, between public and private. This phenomenon necessitates the application of a chamber system in the General Courts through the Criminal Chamber and the Civil Chamber in the District Court and High Court. This design which focuses on the judges' areas of expertise is in line with the model for filling the positions of Candidates for Supreme Court Justices which go directly to the Chamber System through areas of expertise. In the era of the fourth industrial revolution, human roles have started to be replaced by artificial intelligence (AI) technology. Artificial intelligence is a computational program created to simulate human thinking and decision-making abilities. In the field of justice, several countries have applied AI technology to determine judges handling cases, create transcripts of court proceedings, and even provide legal considerations and sentencing recommendations. Despite having various benefits, the use of AI in the judicial system is not without risks such as security and privacy concerns. Additionally, there are also issues related to the principle of fair trial proceedings. Therefore, there are several conditions that the Supreme Court needs to consider when implementing AI in the Indonesian judicial system. Firstly, the use of AI must be adjusted to the national legal context in Law No. 19 of 2016 concerning Amendments to Law No. 11 of 2008 concerning Electronic Information and Transactions. Secondly, the Supreme Court needs to pay attention to the five principles outlined in the European Ethical Charter on the Use of Artificial Intelligence in Judicial Systems and their environment. Thirdly, decision-making by AI still requires human intervention (hybrid decision-making) to mitigate errors in the system. It is hoped that the integration of AI into the Indonesian judicial system will be able to realize the vision of "Realizing an Honorable Indonesian Judiciary."

Most research has focused on how Indonesian courts apply international law. In fact, Indonesian courts can also help shape international law through the International Court of Justice (ICJ) as a source of law used by the ICJ. This article addresses two main questions about whether or not ICJ could use Indonesian court decisions as a source of international law. The first issue is that the ICJ participated in making international law. The ICJ's decision may come from the domestic court decision. Second, Indonesian court decisions could be used by ICJ as a source of law when making international law. The way to do this is through informal channels, such as legitimacy, which is gained when other countries recognize the decisions of Indonesian courts. Legitimacy can be achieved by improving the system and structure of judicial institutions, creating references to Indonesian court decisions in international languages, assuring judges know both customary law and international law, and encouraging Indonesian judges to become judges in ICJ.

Hakim sebagai unsur utama dalam pengadilan yang menempatkan profesinya tersebut sebagai wakil tuhan, sebab tugas hakim adalah untuk menentukan hukum dan keadilan dalam masyarakat, sehingga tanggung jawab yang diembannya sangatlah berat namun mulia. Oleh karena itu kekuasaan yang begitu besar dimiliki oleh profesi hakim, maka hakim dituntut dengan keseimbangan sikap yang penuh rasa tanggungjawab pada hati nurani serta nilai-nilai etik terhadap profesinya. Namun jika melihat kenyataan saat ini, terjadi penurunan kualitas hakim tidak hanya dalam putusanya namun juga menyangkut penurunan aspek moral. Penguatan etika dalam profesi hakim menjadi keharusan dan kewajiban bagi penyelenggara negara sebab etika menjadi koridor utama bagi hakim dalam mengemban tugasnya agar tetap menjalankan profesinya secara profesional tanpa mengesampingkan nilai-nilai kejujuran serta moralitas. Hal tersebut sebagai upaya dalam mewujudkan penegakan hukum yang berkeadilan. Metode penelitian yang digunakan dalam penelitian ini adalah metode normatif dengan pendekatan konseptual dan pendekatan peraturan perundang-undangan. Hasil penelitian ini adalah hakim harus mampu mengejawantahkan nilai-nilai etika dan moral sebagaimana yang telah dirumuskan dalam kode etik profesi hakim, yakni dengan menyelami rasa keadilan yang dianut masyarakat. Dengan landasan etika dan moral melalui kode etik profesi hakim, maka hakim akan mewujudkan penegakan hukum yang berkeadilan.

In this paper, the author discusses the urgency of implementing a digital forensic readiness framework used by the Supreme Court of Indonesia and stakeholders to identify, collect, and maintain digital evidence and respond faster during the post-incident phase than usual by initiating forensics investigations. Digital photography, as soon as possible, upon incident detection, gets digital evidence first. The proposed Guideline has been created by considering the principles of digital forensic readiness requirements based on ISO/IEC 27043.

The law is formed is to meet human needs. The existence of a judiciary with integrity is actually a bridge in actualizing law according to the needs of society. However, in reality there are still many irregularities in the administration of the justice system in Indonesia. Demonstrates an inconsistency in its integrity. This also cannot be separated from the unclear meaning of integrity from a regulatory perspective. Addressing two main problems. First, what is the nature of integrity in the world of justice as the basis for realizing public civility? Second, what are the efforts to strengthen integrity in order to create public civilization in the era of society 5.0? Clarity on the meaning of integrity is needed, especially from the perspective of legal hermeneutics. Providing an understanding of integrity as a manifestation of God's values, integrity as a public contract, and integrity as a legal consequence. Efforts to strengthen integrity can be done with a legal system approach. First, carry out regulatory arrangements, namely by providing clarity on the formulation at the level of the law regarding integrity. Second, institutional arrangements, which in this case are built on conventional and digital integration patterns. Third, directing to new habits based on a basic understanding of integrity. Aiming at the same perspective on integrity supported by conventional and digital integration.

This field research which takes place in the Central Lombok district with the title Early Marriage, Social Background, Implications, focuses on the social background of the phenomenon of the practice of early marriage as a result of the dominance of the granting of marriage dispensation applications at the Praya Religious Court as one of the large contributors in the Mataram Religious High Court area, in addition to seeing the implications and finding alternative solutions to prevent it. Through a socio-empirical approach, data from observations, (applicants and children of marriage dispensation, leaders and judges as respondents) were using qualitative methods. The results of the analysis show that PA. Praya in the last 3 years granted more than 90% of Marriage Dispensation applications, the aspect of avoiding adultery (90%) is the main reason for submission, personal desire (40%) dominant factor of parents marrying minors and the occurrence of household disharmony (34%) is the dominant impact. The alternative research strategies are Optimising Children's Capacity, Creating a Conducive Environment for Child Marriage Prevention, Accessibility and Strengthening Services, Strengthening Regulations and Institutions Strengthening Stakeholder Coordination. The role and support of families, communities, educational institutions the government through strengthening and ensuring regulations the most appropriate strategy to prevent underage marriage as the best conclusion and suggestion in this study.

Electronic evidence in the judicial legal system in Indonesia is something new so it has become an object of study in exploring its existence and role. The legality of electronic evidence has become a polemic about how the examination of electronic evidence is regulated in statutory regulations, what is the validity of electronic evidence, what is the procedure for authenticating electronic evidence in trial examinations, and what is the practice of examining electronic evidence in trials so that appropriate solutions must be found? to answer the legal phenomenon in question. This research is descriptive-analytic normative research, namely by examining existing regulations. Data collection is carried out by collecting regulations in the ITE Law, KUHAP, Perma, and the like. The results of the research conclude that First, electronic documents have received recognition as valid evidence in civil trials, in accordance with the Company Documents Law and ITE Law Number 11 of 2008, but as part of the procedural law, electronic documents do not yet have regulations on the procedures for submitting them in trial, procedures for showing it to the opposing party. Second, the technical submission and technical aspects of showing electronic documents at trial can be answered through clear regulations or technical instructions for Elitigation in practice at trial, but to provide legal certainty it needs to be regulated in the Civil Procedure Law or compiled in Supreme Court Regulations

To this date, the applicable rules and regulations in Indonesia have not specified the reasons on which a court may declare a lawsuit inadmissible (Niet-Ontvankelijk verklaard). Although there is still a substantial amount of jurisprudence that fills in legal gaps, uniformity has not been attained. This legal void may lead to Niet-Ontvankelijk verklaard contradicting the principle of prompt, simple, low cost, and complete judgment. This study employs legal research with statute approach, conceptual approach, case approach, and comparative approach to examine this issue. This study reaches conclusions: First, the ratio legis of Niet-Ontvankelijk verklaard is intended to permit civil lawsuits that do not meet the legal conditions for a lawsuit to be settled at the outset of the case settlement procedure, without first analyzing the subject matter of the case. Second, it is paramount essential to introduce new provisions in Indonesia's Civil Procedure that regulates: the types and forms of exceptions; rules on the limitation of legal remedies against Niet-Ontvankelijk verklaard; and an active and ex officio affirmation of the judge's authority stating that the lawsuit cannot be accepted, without objection or exception from the defendant, so long as the decision is based on the reasons for the exception.
