Abstract

The Cross-Border Pass is a travel document that functions similarly to a passport and visa for residents living in the land border areas between Indonesia and Timor-Leste. This study aims to identify and describe the impact of the Cross-Border Pass Card (KPLB) policy in Silawan Village, East Tasifeto Subdistrict, Belu Regency. This research employs a descriptive method with a qualitative approach. Data were collected through in-depth interviews, observation, and documentation. The results of the study, based on William N. Dunn’s policy evaluation theory, indicate that the KPLB policy has a positive impact in facilitating community mobility in a legal, orderly, and secure manner, as well as supporting social and economic activities in border areas. However, in terms of adequacy, the policy has not fully met the needs of the community, as there are still residents who do not possess the card and face limited access to services. In addition, several challenges were identified in the implementation of the policy, including limited socialization, inadequate supporting facilities and infrastructure, and the potential misuse of the card for illegal activities such as smuggling.

Abstract

The phenomenon of incumbent defeat in the 2024 Belu Regency Election, particularly the defeat of Agus Taolin, who previously served as an active regional head, has become an interesting subject of study because incumbents generally have greater opportunities to win political contests due to their experience, political networks, and established popularity. This study aims to analyze the dynamics of incumbent defeat and the factors contributing to shifts in voter support. This research employs a qualitative approach using a descriptive-analytical method. Data were collected through in-depth interviews with community leaders, campaign teams, and voters, supported by observation and documentation. The analysis applies the Retrospective Voting theory to understand how the public evaluates incumbent performance based on their experiences during the administration period. The findings indicate that the incumbent’s defeat was influenced by negative public assessments of economic performance, public services, policies, and development programs, which were perceived as not fully meeting community expectations. Furthermore, limited communication and public involvement contributed to strengthening public dissatisfaction. Voter decisions reflected an evaluation of past performance, resulting in a “political punishment” through their choices at the ballot box.

Abstract

This study aims to analyze the winning strategy of Christian Widodo and Serena Francis (CS'AN Package) in the 2024 Kupang City Regional Head Election (Pilkada), focusing on the utilization of social media influencers as a campaign strategy. The method employed is descriptive qualitative, with data collected through observation of digital activities on Instagram and TikTok, campaign content analysis, and in-depth interviews with the campaign team and involved influencers. Grounded in Hafied Cangara's communication effects theory, the effectiveness of the campaign is analyzed through three integrated dimensions: cognitive (building public knowledge and awareness), affective (shaping attitudes and emotional proximity), and conative (triggering concrete actions into voting support). The study concludes that the shift from traditional billboard-based campaigns to influence-based campaigns on social media was the decisive factor for victory in the digital democracy era. The success of the CS'AN Package proves that the credibility of local influencers, when managed with authentic content, can be effectively converted into real electoral votes from the youth voter segment (Generation Z and Millennials).

Abstract

The rapid development of information technology has increased the collection, storage, and processing of personal data, leading to a higher risk of data breaches and misuse. To ensure the protection of personal data rights, the Indonesian Government enacted Law Number 27 of 2022 on Personal Data Protection. This study aims to analyze the implementation of Law Number 27 of 2022, examine the legal protection of personal data, and assess the roles of the government, electronic system operators, and the public in supporting its implementation. This research employs a normative legal research method using a statutory approach and a conceptual approach. The findings indicate that Law Number 27 of 2022 provides a comprehensive legal framework for personal data protection. However, its implementation is still constrained by the lack of implementing regulations, the absence of an effective supervisory institution, the low level of compliance among electronic system operators, and limited public awareness regarding personal data protection. Therefore, strengthening implementing regulations, enhancing supervisory mechanisms, and improving public education and awareness are essential to achieving effective personal data protection and ensuring legal certainty.

Abstract

Community participation has become an essential element in environmental planning and management, particularly in addressing climate change risks and environmental degradation. Global experiences indicate that meaningful public involvement can strengthen local resilience and support sustainable development by ensuring that environmental policies are effective, equitable, and responsive to community needs. However, the implementation of participatory policies at the regional level still faces various challenges, including limited access to information, insufficient community capacity, inequality in deliberative processes, and local political influences. This study aims to analyze legal instruments and strategic measures adopted by regional governments in encouraging community participation for long-term environmental conservation. This research employs a library research method with a normative juridical approach through theoretical legal analysis of relevant regulations, policies, and academic literature. The findings show that regional policies have an important role in transforming public participation from a procedural requirement into meaningful engagement that influences environmental decision-making. The implementation of Constitutional Court Decision No. 91/PUU-XVIII/2020 concerning the Job Creation Law provides an opportunity to strengthen public oversight of environmental governance and conservation policies. The study concludes that systemic reform in environmental management, including the improvement of Environmental Impact Assessment (AMDAL) mechanisms, requires active collaboration and involvement from all sectors of society to achieve sustainable ecological protection.

Abstract

This study is motivated by the importance of developing tourism villages as an effort to promote local economic growth through stakeholder collaboration. Coal Village in West Manggarai Regency has developed Bukit Porong as a nature- and culture-based tourism destination involving the government, local communities, and private sectors. However, the collaboration process remains suboptimal due to limitations in infrastructure, human resources, and coordination. This study aims to examine the collaborative governance process in the development of Bukit Porong Tourism Village using the collaborative governance model proposed by Ansell and Gash (2007). A qualitative approach with a descriptive method was employed, using interviews, observations, and documentation as data collection techniques. The results show that collaborative governance has been implemented but has not yet reached optimal effectiveness, particularly in institutional arrangements, coordination mechanisms, and community participation. Despite these challenges, collaboration has contributed to increasing tourist visits and supporting local economic activities. The study concludes that collaborative governance is still in a transitional stage and requires strengthening institutional design, leadership capacity, and community involvement to ensure sustainable tourism development.

Abstract

This study aims to develop an Integrative Model of Legal Certainty, Management Governance, and Economic Resilience in building sustainable organizations through an interdisciplinary approach that combines legal, management, and economic perspectives. This research employs a qualitative approach using the Systematic Literature Review method, supported by library research and conceptual analysis. The literature review process was conducted systematically based on the Preferred Reporting Items for Systematic Reviews and Meta-Analyses (PRISMA) guidelines by analyzing reputable scientific articles, reference books, and relevant policy documents. The findings indicate that legal certainty serves as an institutional foundation that provides stability, legitimacy, and predictability in organizational operations. Meanwhile, management governance functions as an implementation mechanism that transforms regulations into transparent, accountable, responsible, independent, and equitable organizational practices. The integration of legal certainty and governance strengthens economic resilience by improving organizational capacity in managing risks, responding to strategic environmental changes, and maintaining long-term operational sustainability. This study identifies a research gap in previous studies, which often examine legal, governance, and economic dimensions separately, resulting in limited comprehensive frameworks. The theoretical contribution of this research is the development of an integrative model that combines Legal Certainty Theory, Good Corporate Governance Theory, Institutional Theory, Stakeholder Theory, Economic Resilience Theory, and Sustainable Organization Theory. The proposed model provides a conceptual foundation for academics, policymakers, and organizational leaders in developing governance strategies that enhance economic resilience and support sustainable organizational development amid global challenges.

Abstract

This study aims to analyze the political communication strategies employed by Lis Darmansyah and Raja Ariza in gaining support from first-time voters during the 2024 Tanjungpinang mayoral election. The research employed a qualitative descriptive method, with data collected through interviews, observations, and documentation. The analysis was conducted using the theoretical framework of political communication strategies integrated with persuasive communication and participatory campaign approaches to examine the effectiveness of political messages delivered to first-time voters. The findings reveal that the success of Lis Darmansyah and Raja Ariza was supported by adaptive communication strategies tailored to the characteristics of young voters. These strategies included humanistic interpersonal communication, balanced utilization of digital and conventional media, and the delivery of simple, relevant, and easily understood political messages aligned with the needs and aspirations of first-time voters. Furthermore, community-based approaches, volunteer involvement, and peer communication patterns effectively fostered emotional connections, strengthened public trust, and encouraged greater political participation. The study concludes that political communication strategies characterized by openness, innovation, consistency, and public participation play a significant role in increasing political support among first-time voters and contributed substantially to the electoral success of Lis Darmansyah and Raja Ariza in the 2024 Tanjungpinang mayoral election.

Abstract

This study analyzes the criminal liability of perpetrators of sexual violence who abuse their position of authority, resulting in the victim's suicide, based on Law Number 12 of 2022 concerning the Crime of Sexual Violence. The research employs a normative legal method using statutory, conceptual, and case approaches. Primary legal materials consist of legislation and court decisions, while secondary legal materials are derived from books, scholarly journals, and relevant research. The findings indicate that criminal liability must be established through proof of the elements of sexual violence, abuse of position or power relations, the perpetrator's culpability, and the causal relationship between the perpetrator's conduct, the victim's psychological trauma, and the resulting death. Article 6(c) of the Law on the Crime of Sexual Violence serves as the primary legal basis for criminal prosecution, while Article 15 may be applied as an aggravating circumstance when the perpetrator is a superior, employer, public official, or organizational administrator whose actions result in severe psychological harm or death. The victim's suicide does not automatically establish or negate the causal relationship. Such causation must be supported by expert testimony, medical records, electronic evidence, psychological autopsy findings, family testimony, and a chronology of the victim's psychological deterioration. Therefore, criminal judgments should be based on the convergence of lawful, relevant, authentic, and corroborative evidence to ensure victim protection, legal certainty, the presumption of innocence, and substantive justice. Law enforcement should also guarantee restitution for the victim's family and promote institutional reforms to prevent similar offenses from recurring.

Abstract

The corruption case concerning official travel expenditures of the Bitung City Regional House of Representatives raises a fundamental question regarding the boundary between justifiable differentiation in criminal responsibility and law-enforcement disparity that violates equality before the law. In District Court of Manado Decision Number 48/Pid.Sus-TPK/2025/PN Mnd, six persons were prosecuted, while the audit referred to in the proceedings associated the irregularities with a broader group of official travelers. This study examines the disparity through the principles of equality before the law and criminal participation. It employs normative legal research using statutory, case, and conceptual approaches. Legal materials are analyzed prescriptively by identifying legally relevant facts, mapping individual roles, testing comparability, and evaluating the justification for differential prosecutorial treatment. The study finds that the numerical gap between persons mentioned in an audit and defendants brought to trial constitutes only a prima facie indication of disparity; it does not automatically establish discrimination. A violation of equality arises only when materially comparable persons considering conduct, culpability, benefit, authority, causal contribution, and evidentiary strength receive different treatment without an objective and lawful justification. Participation doctrine requires individualized attribution and rejects collective punishment based solely on administrative proximity. Because judges are confined by the indictment, the main point of scrutiny lies in investigation and prosecution. The article proposes a three-stage framework comprising a comparability test, a justification test, and an accountability-and-follow-up test for assessing disparities in collective corruption cases.
