Abstract

Penelitian ini bertujuan untuk mengetahui konsep pengembangan promosi wisata Kuta Mandalika melalui digital tourism dengan model pantehelix. Metode penelitian menggunakan pendekatan kualitatif, penelitian kualitatif merupakan payungnya berbagai metode penelitian naturalitik dalam kehidupan sosial. Dalam penelitian ini yang akan menjadi data primer adalah pemerintah (DISPAR), komunitas swasta (PT. ITDC), pelaku usaha (UMKM), media, dan akademisi. Teknik pengumpulan yang digunakan peneliti yaitu observasi, wawancara (Interview), dan dokumentasi, Dari hasil penelitian yang dilakukan oleh peneliti diketahui bahwa pengembangan promosi wisata melalui digital tourism di wisata kuta Mandalika telah dilakukan melalui berbagai pengembangan aplikasi berbasis website dan melalui berbagai platform media sosial untuk mendukung promosi wisata kuta mandalika, selain hal itu secara bersama-sama kolaborasi melalui model pentahelix kerja sama antara pemerintah, akademisi, komunitas, pebisnis dan media telah memberikan dampak positif bagi perkembangan wisata kuta Mandalika. Penerapan digital tourism ini berfungsi sebagai media komunikasi, informasi, promosi serta pelayanan kepada masyarakat dalam pengembangan wisata kuta mandalika.

Abstract

Arbitration proceedings are conducted in private and confidential, a principle that is universally accepted in arbitration practice around the world. The private nature of arbitration proceedings ensures the confidentiality of the parties' disputes, given that arbitration is a forum for resolving business disputes where the evidentiary process often requires parties to present evidence in the form of business contracts containing company secrets. There are a number of countries that regulate the conduct of arbitration proceedings in an absolute closed manner, such as Indonesia. However, some countries, such as Singapore, regulate the conduct of arbitration proceedings in a non-absolute closed manner. Singapore's regulations allow for arbitration proceedings to be open in certain circumstances. Arbitration proceedings may be open if the parties to the dispute agree to open them. The arbitral tribunal may order arbitration proceedings to be open in disputes involving the public interest. Conducting arbitration proceedings in the open can provide legal protection for the public and fulfill the right to social control over an arbitration dispute involving the public interest. The concept of regulating open arbitration proceedings can be applied in Indonesia to disputes involving the public interest, such as arbitration disputes involving the government, local governments, state-owned company, and regional-owned company (known as BUMN and BUMD).

Abstract

Law Number 16 of 2017 on Community Organizations was enacted as the government’s response to organizations deemed contrary to Pancasila and the 1945 Constitution. The most significant change introduced by this law is the elimination of judicial mechanisms in the dissolution of organizations, which had previously been required under Law Number 17 of 2013. This study applies Mahfud MD’s theory of political configuration of law to analyze the political dynamics behind the regulation. The findings show that removing the due process of law strengthens the dominance of the executive branch and undermines both the rule of law and the constitutional right to freedom of association. Therefore, Law Number 16 of 2017 reflects a conservative legal product shaped by an authoritarian political configuration.

Abstract

This study aims to see whether an electronic contract can be said to be valid, especially in Indonesia. Electronic contracts are contracts that arise due to technological and information developments, where buying and selling transactions begin to be carried out through electronic or online media. Since its creation is not like conventional agreements, it is necessary to have clear arrangements regarding the legal terms and legal force of electronic contracts. The research method used is a normative research method and the data in this study was obtained from literature research. Based on the results of the research conducted, it can be concluded that the validity of electronic contracts in e-commerce transactions  in Indonesia still faces various challenges of uncertainty regarding the validity and strength of contracts carried out electronically as evidence even though Indonesia already has a clear legal basis, but the ITE Law still holds the problem that from the perspective of the Civil Code and UNCITRAL, the ITE Law does not guarantee legal certainty and firmness regarding the validity of electronic contracts.

Abstract

This research provides an analysis of how the closure of the Piyungan landfill in the Special Region of Yogyakarta on March 5, 2024 marks a crisis in waste management due to the capacity that has exceeded its limits since 2012. Waste management policies that are still oriented towards an end-of-pipe approach have proven unsustainable and require transformation based on the political principles of environmental law. Regulations such as Law No. 18 of 2008 concerning Waste Management and Regional Regulation No. 3 of 2013 have provided a legal basis, but implementation still faces various challenges, including inter-regional coordination, lack of processing infrastructure, and community resistance to the construction of new landfills. This research uses a descriptive qualitative method with a political law approach to analyze the effectiveness of environmental policies in waste management in Yogyakarta. The results show that existing policies have not been able to overcome structural problems in waste management, especially related to the weak synergy between local governments, communities, and the private sector. This study recommends a paradigm shift from a conventional disposal system to a circular approach based on reduce, reuse, recycle (3R) supported by stricter regulations, strengthening economic incentives, and increasing public legal awareness of ecological responsibility

Abstract

Fisheries subsidies are a central issue in the context of international trade regulated by the WTO Agreement. For Indonesia, a country with a significant fisheries sector, these subsidies have a significant impact on the lives and livelihoods of fishermen. Although the WTO regulates various aspects of fisheries subsidies, their implementation and impact on Indonesian fishermen remain a major concern. This study explores the concrete impacts of fisheries subsidies within the framework of the WTO Agreement on the socio-economic conditions of fishermen in Indonesia. This analysis covers the implications of WTO policies on the welfare of fishermen, the protection of fishery resources, and the impact on trade and national food security. Considering this context, this study is not only relevant for understanding the dynamics of economic globalization in the fisheries sector, but also provides insights into policy strategies that can improve the welfare of Indonesian fishermen in the future.

Abstract

This study focuses on answering two questions, namely: first, how restitution is provided to victims of human trafficking; and second, what are the advantages and disadvantages of Law No. 21 of 2007 on the Eradication of Human Trafficking in providing justice for victims. The research method used in this study is normative legal research, which focuses on the study of applicable positive legal norms. In this context, it refers to Law No. 21 of 2007 on the eradication of human trafficking. The results of this study are as follows: First, legal protection for victims of human trafficking is still inadequate and has not been implemented optimally. Although Law No. 21 of 2007 regulates the rights of victims, including the right to restitution, its implementation has not been effective. Many law enforcement officials do not understand the mechanism for providing restitution, while victims are often unaware of their rights. Therefore, it is necessary to establish specific regulations regarding restitution for victims of human trafficking, accompanied by an increased role for relevant institutions such as the Social Services Agency in assisting and rehabilitating victims. Second, weaknesses in the application of this law indicate the need for criminal law reform so that law enforcement can be more rigorous and fair. This reform is important to strengthen the protection of victims and ensure that their rights are fulfilled. Without reform, the objectives of the law to achieve justice, certainty, and benefit will not be realized, especially in ensuring justice for victims of human trafficking crimes.
