Abstract

This study aims to seeThe Influence of Organizational Culture and Job Satisfaction on Employee Performance with Job Stress as a Mediating Variable at BPJS Ketenagakerjaan Branch Offices throughout Medan Raya. This type of research uses a quantitative method, this research was conducted at BPJS Ketenagakerjaan Branch Offices throughout Medan Raya, the population used was 80 employees consisting of Medan City as many as 20 personnel, Medan Utara as many as 20 personnel, Tanjung Morawa as many as 20 personnel and Binjai as many as 20 personnel. The sample used was all populations of 80 employees with saturated samples as the sampling technique. The data sources used were primary data sources and data collection by distributing questionnaires. This research model uses phat analysis and the measuring instrument is the smart PLS application version 3.3.3. The results of this study are as follows: Organizational culture has a positive and significant effect on employee performance with an original sample value of 0.285 and p values 0.045. Organizational Culture has a positive and significant effect on Job Stress with an original sample value of 0.628 and P values 0.000. Job satisfaction has a positive and significant effect on employee performance with an original sample value of 0.492 and p values of 0.000. Job satisfaction has a positive and significant effect on Job Stress with an original sample value of 0.281 and p values of 0.007. Job Stress has a positive and insignificant effect on employee performance with an original sample value of 0.191 and p values of 0.149. Organizational Culture has a positive and insignificant effect on employee performance through work stress indirectly with an original sample result of 0.120 and p values of 0.165. Job satisfaction has a positive and insignificant effect on employee performance through work stress with an original sample value of 0.054 and p values of 0.234.

Abstract

This study aims to see the influence of work motivation and leadership style on employee performance through job satisfaction as a mediating variable at the BPJS Ketenagakerjaan, Sumbagut Regional Office. This type of research uses a qualitative method, this research was conducted at BPJS Ketenagakerjaan, Sumbagut Regional Office, the population used was 60 employees. The sample used was all populations of 60 employees with saturated samples as the sampling technique. The data sources used are primary data sources and data collection by distributing questionnaires. This research model uses phat analysis and the measuring instrument is the smart PLS application version 3.3.3. The results of this study are as follows: Leadership style has a positive and significant effect on job satisfaction with the original sample value of 0.276 and P values 0.000. Leadership style has a positive and insignificant effect on employee performance with the original sample value of 0.102 and p values 0.615. Job satisfaction has a positive and significant effect on employee performance with the original sample value of 0.737 and p values 0.000. Work motivation has a positive and significant effect on job satisfaction with the original sample value of 0.859 and p values 0.000. Work motivation has a positive and insignificant effect on employee performance with the original sample value of 0.001 and p values 0.999. Leadership style has a negative and insignificant effect on employee performance through job satisfaction indirectly with the original sample result of -0.199 and p values 0.095. Work motivation has a positive and significant effect on employee performance through job satisfaction with the original sample value of 0.630 and p values 0.000.

Abstract

This article analyzes the criminal liability of traffic accidents caused by Over Dimension Overload (ODOL) in goods transport vehicles. ODOL practices lead to increased road damage, traffic congestion, and higher accident rates, posing significant safety risks to both vehicles and public infrastructure. The research focuses on case number 49/Pid.Sus/2022/Pn-Idi, in which a logistics company was convicted for modifying a truck and violating load capacity regulations. The study explores the legal framework regulating vehicle dimensions and load limits in Indonesia, and examines the enforcement of these laws, particularly the challenges in controlling ODOL practices despite existing regulations. The results highlight the need for stricter enforcement and clearer legal standards to ensure road safety and reduce infrastructure damage.

Abstract

The criminal offense of sexual harassment against children is a serious crime regulated under Law No. 35 of 2014 concerning Child Protection and Aceh Qanun No. 6 of 2014 concerning Jinayat Law. This study aims to analyze the comparison of legal regulations regarding child sexual harassment between the two laws, particularly in terms of definition, criminal sanctions, and protection of children as victims. The Child Protection Law at the national level emphasizes imprisonment and fines, while the Aceh Qanun introduces additional punishments such as whipping and using gold as the basis for fines. This study highlights significant differences between the two regulations, especially in the application of physical punishment and restitution for victims. The research concludes that the application of Sharia law in Aceh provides a distinct approach to protecting children from sexual harassment but does not fundamentally contradict national law.

Abstract

This study examines the crime of adultery committed by individuals who are already married based on the provisions of Qanun Aceh No. 6 of 2014 concerning Jinayat Law. Qanun Jinayat, which enforces Islamic criminal law in Aceh, applies to all residents, both Muslims and non-Muslims, within the province. The primary objective of this qanun is to regulate society's behavior within the framework of Islamic law and to deter violations of Islamic principles through punitive measures, including fines, imprisonment, and flogging. The crime of adultery in Islam is classified into two categories: muhsan (those who have had legitimate sexual relations in marriage) and ghairu muhsan (those who have not). The punishment for muhsan includes stoning, while ghairu muhsan is punished by 100 lashes and exile. In contrast, under Qanun No. 6 of 2014, the punishment for adultery, regardless of the marital status of the offender, is 100 lashes without the distinction between muhsan and ghairu muhsan. Furthermore, the Qanun differs from Indonesia's national law (KUHP Article 284), which requires a formal complaint from the injured spouse for prosecution. In contrast, under Qanun Jinayat, no complaint is required for adultery cases to be prosecuted, and the penalties for those who facilitate or promote adultery are also included. The research also delves into a case study, Case No. 4/JN/2021/MS.Idi, where the perpetrator was sentenced to 100 lashes under Qanun Jinayat for committing adultery. The study compares the treatment of adultery under national law and Qanun Aceh and concludes that the Qanun provides harsher penalties to ensure deterrence and uphold Islamic values in Aceh.

Abstract

Narcotics abuse is a serious issue in Indonesia that continues to escalate, causing significant harm to society. Narcotics, which are intended for medical and research purposes, are often misused, leading to profound social, physical, and mental impacts. This study examines the criminal acts of narcotics abuse under Law Number 35 of 2009 and the Indonesian Criminal Code (KUHP) as regulated in Law Number 1 of 2023. Law Number 35 of 2009 introduces strict criminal sanctions as well as rehabilitation for narcotics addicts. Meanwhile, the Criminal Code addresses the classification of criminal acts and the penalties imposed, including life imprisonment and the death penalty for severe offenses. The study aims to explore the legal provisions governing narcotics abuse and identify the differences in legal enforcement between the two regulations. The findings highlight that, despite stringent regulations, the rate of narcotics abuse remains high, indicating a need for a more integrated approach between law enforcement and rehabilitation efforts.

Abstract

Aceh is a provincial area which is a special legal community unit and is given special authority to regulate and manage its own government affairs and the interests of the local community. Minor crimes that can be resolved by customary institutions as mandated by Article 13 of Aceh Qanun Number 9 of 2008 concerning the Development of Customary Life and Customs that can be resolved in a customary manner through customary institutions. Meurah Mulia District, North Aceh Regency also practices the settlement of minor crimes based on Qanun Number 9 of 2008. The problem to be studied in this study is the Implementation, Settlement of Minor Criminal Acts of Theft of Livestock. The approaches used in this thesis are the Historical approach, the Sociological approach, and the Normative approach. The types of research are field research and library research. The data analysis model uses an interactive model, namely data reduction, data reduction presentation and conclusions. The minor crime of livestock theft that occurred in Meurah Mulia District, North Aceh Regency has been implemented properly according to the regulations in Qanun Number 9 of 2008 with different verdicts. The settlement of the minor crime of livestock theft is carried out using peaceful settlement and compensation. The minor crime of livestock theft that occurred in Meurah Mulia District, North Aceh Regency has ended effectively. The effectiveness indicator is assessed from the completion of the entire series of settlements of the minor crime of livestock theft in accordance with Article 16 of Aceh Qanun Number 9 of 2008.

Abstract

The Professional and Security Division (Propam) plays a crucial role in enforcing the law against police officers who commit criminal offenses in the Aceh Regional Police (Polda Aceh). This study examines the responsibilities of Propam in maintaining discipline and upholding the code of ethics among police officers. Propam's function is to ensure accountability and professionalism within the Indonesian National Police by handling internal violations and conducting disciplinary hearings. In addition to criminal proceedings, police officers are subject to internal disciplinary measures, which may result in double punishment for violations, including criminal sentences and disciplinary actions. This study also addresses the challenges faced by Propam, such as obtaining witness testimonies and interpreting internal regulations. Through its oversight, Propam contributes significantly to improving the professionalism of the police force, which is essential for maintaining public trust and security. The findings indicate that despite the strict enforcement of laws and ethics, additional efforts are needed to strengthen internal discipline and community involvement in monitoring police conduct.

Abstract

The criminal acts of assault and ganging up have become prevalent in many communities, including Aceh Tamiang, where such acts often result in serious injury or even death. This research analyzes case number 216/Pid.B/2021/PN KSP, in which the defendant, Riski Efendi, along with other perpetrators, committed violent assault. The defendant was sentenced to 1 year and 6 months in prison under Article 170 of the Indonesian Criminal Code for collective violence. The legal analysis highlights the regulations surrounding such offenses, including Articles 170 and 358 of the Criminal Code, which regulate collective violence and the role of joint action in violent crimes. The decision of the court was based on legal evidence that clearly supported the guilt of the defendant, considering the physical injuries inflicted on the victim. This study also reflects on the limitations of current legal enforcement, suggesting that restorative justice approaches might have been more appropriate in resolving the dispute. The research underscores the importance of adequate law enforcement to deter mob violence and ensure justice.

Abstract

This study aims to analyze the impact of compensation on work motivation and work quality at BPJS Ketenagakerjaan Regional Office of North Sumatra. Compensation is considered a critical factor influencing employee work motivation, which in turn affects work quality. This quantitative research involves a saturated sample of 80 permanent employees. Data were collected using questionnaires, and the analysis was conducted using Structural Equation Modeling (SEM) based on Partial Least Square (PLS). The results indicate that compensation has a positive and significant effect on work quality but does not significantly affect work motivation. Moreover, work motivation positively and significantly impacts work quality. Compensation also indirectly influences work motivation through work quality. These findings provide important implications for company management in efforts to improve work quality through appropriate compensation policies and maintaining employee motivation.
