Abstract

The construction of a glass elevator facility in the Kelingking Beach tourist area located in Nusa Penida has sparked various debates, particularly regarding the possible impact on the stability of the cliffs around the area and the sustainability of ecotourism, which has been the main attraction of the area. This study was conducted with the aim of conducting an in-depth analysis of the environmental impacts caused by the construction process. The analysis covers changes in the geomorphological structure of the area, the potential for increased landslides due to physical intervention, and how all these changes could affect the continuity of nature-based tourism, which has supported the local economy and ecosystem. In its implementation, this study uses a qualitative-descriptive approach that relies on the processing and analysis of secondary data, including reports from the mass media, official government documents, and academic studies focusing on karst cliffs and the development of tourism infrastructure in natural areas. Based on the analysis results, it was found that the construction of the glass elevator has the potential to increase the risk of cliff instability, mainly due to foundation excavation activities and pressure changes that affect the limestone structure that makes up the cliff. Furthermore, the elevator procurement project was deemed not fully aligned with the principles of sustainable ecotourism, due to the lack of involvement of the local community in the planning and implementation process, as well as the potential for environmental degradation that could have a negative impact in the long term. Therefore, this study emphasizes the importance of conducting a thorough and comprehensive evaluation of geological safety aspects, environmental conservation efforts, and effective tourism management so that Kelingking Beach can continue to be maintained as a tourist destination that is not only attractive and popular, but also safe and sustainable for future generations.

Abstract

This study aims to analyze the fairness of the application of legal sanctions to traffic violators through the Electronic Traffic Law Enforcement (ETLE) system using an empirical juridical approach supported by a normative juridical approach. The empirical juridical approach is used to examine the implementation of ETLE in social reality through field observations and interviews with the public, police officers, and road users who have received electronic tickets. Meanwhile, the normative juridical approach is used to examine the legal provisions governing ETLE, such as Law No. 22 of 2009 and police regulations regarding electronic evidence and enforcement procedures. The results of the study indicate that normatively the ETLE system has fulfilled the principles of legal certainty, objectivity, and legality in traffic law enforcement. However, empirically, several obstacles were still found, including a lack of socialization, limited public understanding of the objection mechanism, inconsistencies in vehicle ownership administrative data, and technical constraints on the equipment. Nevertheless, ETLE is considered fairer because it reduces direct interaction between officers and violators and minimizes the potential for irregularities. This study concludes that the conformity between legal norms and field practices still needs to be strengthened so that substantive justice in the ETLE system can be optimally realized.

Abstract

This study aims to analyze the role of law in maintaining social justice in Indonesia through community training and empowerment as an effort to strengthen legal literacy and access to justice. Using qualitative methods with a descriptive-analytical approach, this study explores the experiences, perceptions, and practices of communities involved in legal training programs organized by local governments, non-governmental organizations, and local communities. Data were collected through in-depth interviews, observation, and documentation, then analyzed using data reduction, data presentation, and conclusion drawing techniques. The results show that legal training contributes significantly to increasing understanding of basic rights, increasing community courage in accessing legal services, and establishing community paralegals capable of assisting citizens in resolving simple legal issues. Multi-stakeholder collaboration and the use of technology have also expanded the reach of legal education to communities in various regions. However, structural barriers such as complex bureaucracy and limited facilities remain challenges in achieving equitable social justice. Overall, this study confirms that community training and empowerment are effective strategies for strengthening the function of law as a guardian of inclusive and sustainable social justice.

Abstract

Environmental law enforcement under Law Number 32 of 2009 is both preventative and repressive. Preventive efforts to control environmental impacts must be implemented by maximizing the use of monitoring and licensing instruments, which can be implemented by the central government, regional governments, and the community. Repressive efforts are carried out when environmental pollution and destruction have already occurred, either through administrative, civil, or criminal legal instruments. Implementation of sustainable development and the controlled use of natural resources is the goal of environmental management . Environmental management issues can be considered as one of the main causes of environmental damage . The goal of all environmental problems are done without regard to the development of the environmental factors, which in turn will cause environmental damage and pollution. Given the legal action against the perpetrators of pollution and environmental destruction is composed of administrative aspects, aspects of civil, criminal aspects. In the law enforcement itself should be supported pleh several factors, namely the means of law, law enforcement personnel, facilities and infrastructure, licensing, EIA system, public awareness of the environment.

Abstract

This study aims to evaluate the influence of service quality and consumer commitment on fishermen's satisfaction with trust as a mediating variable at Samudra Kendari Port. Using a quantitative approach with a survey method, data were obtained from 90 fishermen selected based on the number of research indicators and analyzed with Structural Equation Modeling–Partial Least Square (SEM-PLS). The results of the study show that service quality and consumer commitment have a significant effect on satisfaction, as well as contributing to forming trust as the main mediator. The findings also revealed that the dimensions of reliability, assurance, and empathy are the strongest supports in building trust, while affective and normative commitments also strengthen the psychological relationship between fishermen and ports. Trust has been proven to mediate the influence of service quality and commitment on satisfaction, thereby increasing the effectiveness of long-term relationships between fishermen and port managers. Overall, this study confirms that consistent, professional, and user-oriented services are crucial factors in creating satisfaction and loyalty in the port services sector.
