Abstract

Hukum adat merupakan nilai-nilai (kebenaran dan keadilan) yang hidup di Tengah tengah masyarakat. Bahwa dalam kaitan dengan pembangunan substansi hukum, UUD 1945 secara tegas mengakui dan memberikan tempat dan dasar bagi keberlakuan norma hukum dan pranata hukum yang berasal dari hukum yang hidup dan berlaku dalam Masyarakat yaitu hukum adat dijadikan sebagai bagian dari hukum nasional. Pasal 28 1 Ayat (3) yang menyatakan identitas budaya dan hak masyarakat tradisional dihormati selaras dengan perkembangan zaman dan peradaban. Eksistensi hukum adat sebagai salah satu bentuk hukum yang diakui keberadaannya dalam kehidupan dan budaya hukum masyarakat Indonesia tercantum pada Undang-Undang Dasar Republik Indonesia Tahun 1945 atau untuk singkatnya UUD 1945 yaitu pada pasal 18B ayat (2). Serta penjelasan mengenai pengakuan hukum adat oleh Negara juga terdapat pada pasal 27 ayat (1) UUD 1945.

Abstract

Penelitian ini mengkaji hubungan antara integritas pemilu, polarisasi politik, dan keamanan demokrasi dalam konteks dinamika politik lokal di Indonesia yang masih diwarnai oleh praktik politik dinasti dan loyalitas personal. Integritas pemilu menjadi faktor krusial dalam menjaga stabilitas demokrasi, terutama ketika polarisasi sosial-politik semakin menguat dan memengaruhi rasionalitas pemilih. Dalam situasi tersebut, pemilu tidak lagi dipahami sekadar sebagai mekanisme memilih pemimpin, melainkan sebagai instrumen legitimasi yang menentukan kepercayaan publik terhadap sistem politik. Penelitian ini menggunakan metode kualitatif deskriptif-analitis melalui wawancara, studi literatur, dan analisis dokumen untuk menelaah bagaimana integritas penyelenggara pemilu berperan meredam potensi konflik, mengurangi penyebaran disinformasi, serta memperkuat kohesi sosial. Hasil penelitian menunjukkan bahwa integritas penyelenggara pemilu memiliki dampak langsung terhadap persepsi publik, legitimasi pemerintahan, serta ketahanan demokrasi. Penyelenggara yang profesional, transparan, dan bebas intervensi mampu membatasi dampak negatif polarisasi, mencegah konflik horizontal, dan mengurangi ruang bagi praktik manipulatif seperti politik uang dan mobilisasi birokrasi. Sebaliknya, ketika integritas ini melemah, demokrasi menjadi rentan terhadap delegitimasi, ketidakstabilan politik, dan meningkatnya ketegangan sosial. Temuan penelitian ini menegaskan bahwa penerapan prinsip pemilu jujur dan adil merupakan prasyarat utama bagi demokrasi yang sehat, sekaligus mekanisme korektif terhadap distorsi politik yang ditimbulkan oleh polarisasi dan politik dinasti. Penelitian ini diharapkan menjadi referensi bagi pembuat kebijakan dan masyarakat sipil dalam merancang strategi penguatan demokrasi yang lebih substantif dan berkelanjutan.

Abstract

This study aims to analyze the position of Constitutional Court decisions in shaping the design of electoral democracy in Indonesia following the implementation of the simultaneous election system. Recent constitutional developments have demonstrated the increasing influence of Constitutional Court decisions on the regulation of the electoral system, ranging from candidacy thresholds and electoral mechanisms to the administration of general elections and regional head elections. This phenomenon has generated debates regarding the limits of the Constitutional Court's authority as the guardian of the Constitution and the potential shift of its role from a negative legislator to a positive legislator. This research employs a normative legal research method using statutory, conceptual, and case approaches. The primary legal materials consist of the 1945 Constitution of the Republic of Indonesia, election-related legislation, and Constitutional Court decisions concerning the design of electoral democracy. The analysis is conducted prescriptively to assess the conformity of Constitutional Court decisions with the principles of constitutional democracy and popular sovereignty. The findings reveal that Constitutional Court decisions occupy a strategic position in shaping the direction of Indonesia’s electoral democracy through progressive constitutional interpretation. However, several decisions indicate a tendency toward judicial activism, which has implications for the expansion of the Constitutional Court’s role in the creation of legal norms. Therefore, clear parameters regarding the limits of constitutional judges’ authority are necessary to maintain a balance between constitutional protection, democracy, and the principle of separation of powers within Indonesia’s constitutional system.

Abstract

This study aims to analyze the legal politics of regional head appointment within the perspectives of democracy and regional autonomy in Indonesia. The appointment of regional heads constitutes an essential instrument in local governance, as it directly affects the quality of local democracy and the implementation of regional autonomy principles. In its development, the mechanism for filling regional head positions has not been limited to direct regional elections but has also involved the appointment of acting regional heads under certain circumstances. This policy has generated debates regarding its compatibility with the principles of popular sovereignty and decentralization as guaranteed by the Constitution. This research employs a normative legal research method using statutory, conceptual, and case approaches. The legal materials consist of primary, secondary, and tertiary legal sources, which are analyzed qualitatively. The findings reveal that the legal politics governing the appointment of regional heads are primarily designed to maintain the stability of local government administration and ensure the continuity of public services. However, the dominant authority of the central government in appointing acting regional heads has the potential to reduce public participation and weaken the essence of local democracy. Therefore, a more democratic and accountable regulatory framework is required while maintaining due consideration for the principles of regional autonomy and the need for effective governance. The reconstruction of the legal politics of regional head appointments should be directed toward achieving a balance between national interests, local democracy, and the strengthening of regional autonomy.

Abstract

The development of the sharia economy in Indonesia has grown rapidly, as shown by the increasing number of Islamic banks, Islamic insurance companies, and businesses based on sharia contracts. According to data from Otoritas Jasa Keuangan, public interest in the sharia economic system continues to increase, which also raises the potential for sharia economic disputes. However, the number of sharia economic cases submitted to Pengadilan Agama Padang remains very low. This condition needs further study to identify its causes. This research aims to analyze the factors causing the low number of sharia economic disputes submitted to the Religious Court of Padang. The study uses an empirical juridical method with a descriptive analytical approach. Data were collected through observation and literature study. The research examines legal regulations concerning the authority of Religious Courts in resolving sharia economic disputes and compares them with conditions found in practice. The results show that the low number of cases is influenced by limited public understanding of the Religious Court’s authority, preference for non-litigation dispute resolution, limited sharia-based business practices, and public trust in judicial institutions.

Abstract

Farmer Protection and Empowerment aims to realize the sovereignty and independence of farmers in order to improve the welfare, quality, and better life; protect farmers from crop failure and price risks; provide agricultural infrastructure and facilities needed in developing agricultural businesses; develop agricultural financing institutions that serve the interests of agricultural businesses; increase the ability and capacity of farmers and farmer institutions in running productive, advanced, modern, value-added, competitive, market-share and sustainable farming businesses; and provide legal certainty for the implementation of farming businesses. To be able to escape dependence on imported food and alleviate farmers from poverty, it is time for Indonesia to build food independence and sovereignty, by utilizing the diversity of biological resources, restoring local food diversity, and building agricultural-based industries in rural areas. Building food independence and sovereignty is a strategic instrument in efforts to alleviate farmers from poverty. In the implementation of food security programs, the fulfillment of food needs in several sectors still depends on international trade. Building food independence is the best strategy to get out of the food crisis. As an agricultural country with diverse biological resources (biodiversity), Indonesia has significant potential to produce sufficient food. Furthermore, Indonesia has a variety of local foods to support national food diversification
