Abstract

Speaking skills (Maharah al-Kalam) are a vital component in foreign language acquisition; however, they are often hindered by psychological factors, particularly Foreign Language Anxiety (FLA). This study aims to investigate the level of Arabic language anxiety among students of Universitas Darussalam Gontor, with a focus on the influence of interlocutor hierarchy: lecturers, seniors, and peers. This research employs a descriptive quantitative design involving 77 students of the Arabic Language Education Program as respondents, using a questionnaire as the research instrument. The findings indicate that students generally experience high levels of anxiety across all interaction contexts, with a clear hierarchical pattern. Interaction with lecturers triggers the highest level of anxiety (Mean: 13.21), influenced by fear of academic evaluation. Interaction with seniors ranks second (Mean: 13.10), psychologically influenced by the internalization of the cultural value of ta’zhim, which refers to deep respect for seniors/teachers and may create pressure to perform perfectly as well as fear of making mistakes. Meanwhile, interaction with peers shows the lowest level of anxiety (Mean: 12.74), although it still falls within the high category due to social pressure and concerns about negative judgment, such as being labeled “showing off” or “acting smart.” This study concludes that Arabic language anxiety in the pesantren context is not only derived from individual factors but is also significantly influenced by social hierarchical structures. Therefore, this research contributes to the development of pedagogical communication in Arabic language learning, particularly in designing adaptive and socially sensitive communication strategies to reduce language anxiety.

Abstract

This article discusses the Design of curriculum development and educational outputs based on the miracles of the Qur’an. In this study, the author uses descriptive-critical research, with greater emphasis on the strength of the analysis of existing sources and data, drawing on existing theories and concepts to interpret the writings that lead to the discussion. Based on the results of the primary source study, it can be concluded that the educational approach that makes the Qur’an and As-Sunnah the primary foundation in the entire learning process includes aspects of faith, worship, morals, and science. The focus is to form a generation of Qur’anic scholars who are intellectually intelligent, have noble characters (morals), and can read, memorize, understand, and practice the contents of the Qur’an in everyday life. The output of the Qur’an-based curriculum generally aims to form Insan Kamil who integrate spiritual, intellectual, and moral aspects. Abstract

The conflict at the Mujahidin mosque arose from two root causes: first, a misunderstanding between Moel and Latif regarding Moel's desire to give tafsir lectures at the Mujahidin mosque. Second, a difference of opinion regarding the position of the saff. Moel and his supporters wanted to change the saff to match the position of the mosque building, while Latif and his supporters wanted to maintain the position of the saff so that it continued to face the right corner of the mosque, as this position was in line with the direction of the qibla. According to Dahrendorf, the conflict that occurred at the Mujahidin mosque was natural because conflict and differences lead to peace and equality. This is evident in what is happening at the Mujahidin mosque today. After a prolonged conflict from 1998 to 2016, with coordination and awareness from each of the conflicting parties, the conflict finally ended and became a beautiful peace.

Abstract

The rapid advancement of Autonomous Artificial Intelligence (AI) has challenged the traditional human-centric framework of Ahliyyah (legal capacity) in Islamic jurisprudence. This study aims to investigate the legal status of AI entities in executing digital contracts and to propose a reconstruction of Ahliyyah that accommodates non-human autonomous agents. Using a qualitative-normative legal research method with a Maqashid al-Shari’ah approach, this study analyzes classical Fiqh texts alongside modern technological realities. The findings reveal that while AI lacks metaphysical consciousness (Ruh), it possesses "Functional Discernment" (Tamyiz al-Waza’ifi) capable of fulfilling the technical requirements of Ijab (offer) and Qabul (acceptance). The research proposes the recognition of "Digital Personality" (Syakhshiyah Raqmiyah) as a new legal category, shifting the locus of legal capacity from biological existence to functional autonomy. This reconstruction ensures that AI-driven transactions remain valid under Sharia while providing a clear framework for Dhaman (liability) and accountability. This study contributes to the development of a "Digital Fiqh" that harmonizes Islamic law with the global digital economy.

Abstract

Underage unregistered marriage, locally known as nikah siri, remains a persistent socio-legal challenge in Indonesia despite the enactment of Law No. 16 of 2019, which raised the minimum marriageable age. This practice often bypasses state administration, creating a legal vacuum that marginalizes women and children. This research aims to analyze the legal status and consequences of such unions through the lens of Usul al-Fiqh, specifically utilizing the doctrine of Sadd al-Dhari’ah (the obstruction of means). Employing a qualitative normative-juridical methodology, this study evaluates primary Islamic legal texts alongside Indonesian marriage regulations and empirical social data. The findings reveal that while these marriages may satisfy the formal pillars of a religious contract, they constitute a "means" (wasilah) that leads to definitive social and legal harm (mafsadah), including the loss of civil identity, reproductive health risks, and economic vulnerability. The study concludes that applying Sadd al-Dhari’ah provides a robust theological justification for prohibiting underage unregistered marriage, as it prioritizes public interest (maslahah al-ammah) and the preservation of lineage (hifdz al-nasl) over the narrow private benefit of moral prevention. This approach offers a framework for Indonesian policymakers and religious authorities to harmonize religious ethics with modern child protection standards.
Reassessing Hifdz Al-Nasl in the Age of Assisted Reproduction: a Maqashid Al-Shari’ah Perspective on Donor Artificial Insemination Nasiri Nasiri

Abstract

The rapid advancement of Assisted Reproductive Technology (ART), specifically donor artificial insemination, has challenged the traditional boundaries of Islamic family law and bioethics. This research explores the relevance and repositioning of the concept of Hifdz al-Nasl (preservation of lineage) within the framework of Maqashid al-Shari’ah (the higher objectives of Islamic law). Using a qualitative normative-philosophical approach, this study evaluates classical jurisprudence prohibiting third-party genetic intervention against the modern context of genetic certainty and DNA technology. The findings indicate that the traditional "harm" (mafsadah) of lineage confusion, which serves as the primary basis for prohibition, is becoming increasingly mitigable through forensic registries and transparent bio-data systems. The study concludes that Hifdz al-Nasl should evolve from a strictly prohibitive tool into a protective mechanism for the child's identity and legal rights. By adopting a "Systemic Maqashid" approach, the research suggests that a highly regulated, non-anonymous donor system can satisfy the divine intent of protecting the family unit while fulfilling the human need for progeny. This study provides a theological-philosophical framework for harmonizing Islamic legal values with contemporary medical ethics.

Abstract

The digitalization of religious rituals has reached a critical juncture with the emergence of online unregistered marriage services (nikah siri online) in Indonesia. This phenomenon challenges the classical Shafi’i doctrine of Ittihad al-Majlis (unity of the session), which traditionally requires physical co-presence. This research aims to analyze the legal validity and teleological implications of virtual marriage contracts within the framework of Usul al-Fiqh and Maqashid al-Shari’ah. Employing a qualitative normative-juridical methodology, the study evaluates classical jurisprudence alongside Indonesian marriage laws and digital ethnography of online service providers. The findings reveal that while modern telecommunications can satisfy the ‘illah (legal cause) of Ittihad al-Majlis through real-time audio-visual synchronization, the practice of virtual marriage in Indonesia remains fundamentally flawed due to its unregistered status. From a Maqashidi perspective, these unions create a systemic mafsadah (harm), including the loss of civil rights for women and children, which outweighs the perceived benefit of avoiding moral transgression. The study concludes that for a virtual "session" to be legally and theologically valid, it must be integrated into a formal-digital state registry. This research provides a framework for reinterpreting "presence" in Islamic law while maintaining the protective essence of the marital covenant.

Abstract

This study employed a qualitative descriptive design to analyze the implementation of the Deep Approach to Learning in Islamic Education at State Senior High School 1 Palangka Raya under the Merdeka Curriculum. Data were collected through classroom observations, in-depth interviews, and document analysis involving Islamic Education teachers, the principal, the Vice Principal of Academic Affairs, and Grade 10 students. The findings reveal that the Deep Approach to Learning was implemented through three stages: planning, instructional implementation, and evaluation, which emphasize meaningful, mindful, and joyful learning principles. This study contributes novel insights by demonstrating that the Deep Approach to Learning not only enhances students’ conceptual understanding but also strengthens the internalization of religious values through reflective activities, socially contextualized projects, and spiritual integration in classroom practices. Furthermore, the study identifies institutional support and teacher readiness as critical success factors, while uneven student participation and limited conceptual understanding among teachers remain key challenges. These findings extend existing literature by highlighting the pedagogical, spiritual, and character dimensions of the Deep Approach to Learning in Islamic Education.

Abstract

This study examines the legal protection of teaching staff in light of the maqasid al-Shari’ah (objectives of Islamic law) as outlined in Law Number 14 of 2005 concerning Teachers and Lecturers. This research approach implements a qualitative approach with a normative juridical design. Data were obtained through primary sources, including laws on education and books on maqasid al-Shari’ah. The data collection technique of a literature study is a systematic process of gathering information from written sources. The results show that Law Number 14 of 2005, Articles 39 and 41, emphasize the obligation of the government, regional governments, communities, professional organizations, and educational institutions to protect teachers from violence, intimidation, threats, or unfair treatment. The purpose of Sharia lies in the principle of Hifz al-Nafs, which includes guaranteeing physical and psychological safety from acts of violence, abuse, or criminalization while carrying out teaching duties. This aligns with the human rights principles recognized in Islam to honor teachers. Keywords: legal protection, educators, maqasid al-Shari’ah, law
