Abstract

Inheritance law is the rules that regulate a person's assets after the owner dies. In general, inheritance or distribution of inheritance can be carried out using three models, namely using patrilineal, matrilineal and bilateral or parental systems. This research aims to determine the distribution of inheritance in Puhkerep village, Rejoso subdistrict and the reasons behind it, as well as the views of Article 852 of the Civil Code on the distribution of inheritance in Puhkerep village, Rejoso subdistrict. This research is field research where the author went directly to observe, interview and research the inheritance distribution system in Puhkerep village, Rejoso subdistrict and the data was compared with KUHPer article 852 in order to find authentication between KUHPer article 852 and the findings in Puhkerep village, Rejoso subdistrict. From the results of the researchers' findings, many people in Tinampuh village, Rejoso subdistrict, share inheritance between men and women equally (1:1) because the culture in Tinampuh village, Rejoso subdistrict, on average, both men and women work equally for meet daily needs, and for heirs who inherit their parents, one share is added. According to the Civil Code article 852, the division of inheritance in Tinampuh village, Rejoso district, has a point of similarity, namely that men and women are equalized in the distribution of inheritance, however there is a slight difference, namely the addition of one share for heirs who share their parents.

Abstract

"Mahar" is something that must be present in a marriage. It is a gift given by a husband to his wife. According to Wahbah al-Zuḥaily, mahar is "property that becomes the right of a wife due to the occurrence of a contract or actual intercourse." In addition to mahar, there are also "srah-srahan" or gifts brought by the groom's family to the bride's family. The form of srah-srahan varies according to the traditions of each region, ranging from food, clothing, to even household items. This article will answer how the tradition of presenting household items in the wedding ceremony in Bagor Wetan Sukomoro Nganjuk Village is practiced and how the "urf" views the tradition of presenting household items in Bagor Wetan Sukomoro Nganjuk Village. This type of research is field research using a qualitative approach. The conclusion of this research is that the tradition of presenting household items in Bagor Wetan Village is a tradition that has existed since ancient times. This tradition is carried out by the groom's family and is done after the wedding ceremony along with the "temu manten" ceremony, where all the household items and other srah-srahan items are brought by the groom's entourage. In terms of material, the tradition of presenting household items is included in "urf amali," in terms of its scope of use, the tradition is included in "urf khas," and in terms of its evaluation of good or bad, the tradition is included in "urf Shahih."

Abstract

Artikel ini mengkaji fenomena wanita bekerja dalam memenuhi kebutuhan keluarga di Desa Getas Kecamatan Tanjunganom Kabupaten Nganjuk. Fokus pembahasan mencakup tiga hal, yaitu (1) bagaimana pandangan nafkah bagi istri bekerja di Desa Getas Kecamatan Tanjunganom Kabupaten Nganjuk? (2) apa saja faktor-faktor yang melatarbelakangi istri bekerja di Desa Getas? (3) bagaimana dampak dalam keluarga ketika istri berperan sebagai wanita bekerja di Desa Getas? Metode penelitian yang digunakan, karena deskriptif-kualitatif, adalah wawancara, observasi dan dokumentasi. Artikel ini penelitian lapangan dengan menggunakan teknik analisis data data reduction, data display dan conclusion drawing. Hasil pembahasan menunjukkan bahwa konsep nafkah wanita bekerja di Desa Getas meliputi beberapa hal, seperti pekerjaan istri dalam membantu mencari nafkah merupakan suatu bentuk pengabdian yang dilakukan kepada suami. Selain itu, juga dilakukan dengan sepenuh hati untuk membantu suami dalam mencari nafkah keluarganya, dengan dalih untuk menambah penghasilan sehari-hari dalam keluarga. Pada titik tertentu, bahkan mencari nafkah keluarga bersama merupakan suatu tanggung jawab bersama bagi mayoritas masyarakat Desa Getas. Faktor-faktor yang melatarbelakangi terjadinya nafkah wanita bekerja di Desa Getas, yaitu faktor ekonomi, faktor perasaan seorang istri yang memiliki rasa kasihan terhadap suaminya, telah memiliki usaha atau telah memiliki kontrak kerja meneruskan cita-cita yang telah dirintis seorang istri sejak masih muda dan meneruskan usaha orang tua yang telah ada. Dampak positif meliputi meringankan beban suami, mencotohkan kemandirian kepada anak-anak dan dengan bekerja dapat menghilangkan stres. Sedangkan dampak negatif yang timbul meliputi kurangnya perhatian terhadap anaknya dan bertambahnya biaya untuk keseharian, seperti membeli makanan.

Abstract

The tradition of people passed away marriage is a wedding ceremony performed in front of the deceased body of one of the parents of the bride or groom who has passed away before the wedding. This people passed away marriage occurs when the parents of one of the bride or groom have passed away before the scheduled wedding date or when the couple is already engaged. This study includes empirical research and uses a phenomenological approach. This article examines the tradition of mayit marriage from the perspective of human rights using Hans Kelsen's theory. According to Kelsen, human rights are fundamental rights that must be protected without exception, regardless of cultural or traditional contexts. This study uses qualitative data as its main material, including primary and secondary data. Secondary data was obtained through interviews. The results of this study indicate that the mayit marriage is performed in front of the deceased body of the parent. In the context of human rights, it is important to consider the freedom of consent, emotional well-being, and gender equality in marriage practices. The government and religious authorities need to work together with the community to ensure that cultural traditions are respected, but also ensure that marriage practices do not violate individual basic rights and meet national legal requirements. Article 18B of the 1945 Indonesian Constitution (Article 2) acknowledges customary law and traditional community rights. In Hans Kelsen's human rights theory, which emphasizes positive legal construction.

Abstract

Marital rape is the act of someone forcing their partner to have sexual relations by force/without consent. This type of research is doctrinal law which examines the concept of rape in marriage. Researchers use a conceptual approach that focuses on norms, theoretical principles of marriage law, statutory regulations and provisions of Islamic law. This research shows that marital rape can be viewed from a paradigm, legal and psychological perspective. Even though marital rape is regulated in UUPKDRT and Criminal Code Law no. 1 of 2023, but it is still difficult to stop because it is only a criminal act in a complaint offense. Islamic marriage law views rape in marriage as based on two basic principles of good relations between husband and wife, mutual consent and deliberation and supporting evidence for its hujjah in the form of hadith. A married couple's sexual relationship can turn into marital rape if there is coercion involved.

Abstract

The importance of a child's legitimate lineage status impacts the rights they receive, such as the right to maintenance, inheritance, custody, and identity recognition. Additionally, it affects the child's psychological development because children born out of wedlock or labeled as illegitimate are likely to be bullied and ostracized by their peers, which can hinder their psychological growth and lead to deterioration. This study aims to examine the provisions in the Compilation of Islamic Law (KHI) regarding the status of legitimate children, explore the legal foundations used, and analyze the practical implications of these provisions. The research employs a literature study method by collecting information from sources such as journals, books, documents, and manuscripts relevant to the research topic through the maqasid shariah theoretical approach. The findings indicate that KHI prioritizes the welfare of preserving lineage (hifdzu al-nashab) over the preservation of religion (hifdzu ad-din) to ensure children receive their rights, including maintenance, inheritance, custody, and identity recognition. However, there is a negative aspect, as this could lead to an increase in extramarital relationships since zina (fornication) is considered haram, and the existence of such laws might cause society to trivialize zina, leading to a rise in issues related to fornication.

Abstract

In Indonesia, there is currently no universal law of inheritance that applies to all citizens. This is because the inheritance system in Indonesia is divided into three, namely Islamic inheritance law, inheritance law based on the Book of Civil Law, and inheritance law based on local customs. In the context of Islamic inheritance law, the Religious Court plays a central role as a separate institution with full authority in resolving inheritance disputes for Muslim communities. This aligns with the teachings of the Prophet, emphasizing the importance of applying Islamic inheritance law to prevent disputes over inheritance. This study aims to analyze Islamic inheritance law from its concepts, legal sources, principles, order of heirs, obstacles in inheritance, and procedures for dividing inheritance according to Islamic law. The research method used is a library method involving relevant books and journals. The research results show that Islamic inheritance law covers who is entitled to inheritance, the size and reduction of inheritance portions, and the implementation of inheritance distribution. This is based on legal norms sourced from the Quran, Hadith, Ijma, and Ijtihad of Ulama, which must be followed by all society.

Abstract

The study of Islamic inheritance systems is a serious topic of inquiry among Islamic thinkers because it includes Allah's ordinances. Various interpretations of inheritance verses have developed and given rise to diverse methods of Islamic inheritance distribution. For example, the Sunni inheritance system is a common model among methods of inheritance distribution, characterized by a patrilineal pattern. Hazairin interprets inheritance verses through a contextual approach to the society in Indonesia, resulting in a parental or bilateral inheritance system. Unlike Syahrur, he believes that there are maximum and minimum limits in the concept of Islamic law set by Allah, making Islamic law both certain and flexible for interpretation within those limits. Syahrur approaches the interpretation of inheritance verses using a mathematical approach, resulting in the theory of limits (hudud). This article will examine the historical evolution of Islamic inheritance systems, focusing on the thematic phases of Pre-Islam and the Medinan period, starting with inheritance verses in the Quran, the Arab Tribal and Medinah phases, definitions of inheritance, the historical evolution of Islamic inheritance systems in the Pre-Islam and Medinah phases, which include three inheritance systems in the Pre-Islam phase through lineage and kinship, adoption (tabanni), and covenantal bonds, and the Islamic inheritance system in the Medinah phase.

Abstract

The practice of polygamy has existed since before Islam came, and a husband could even marry up to a dozen women. This fact proves that the practice of polygamy continues to be maintained today with various justifications, social, economic and religious. In fact, polygamy has become part of a man’s lifestyle, which is why this practice has become entrenched in certain environments. If you look at polygamy in the Qur’an, there are three things that can be drawn, namely, giving men the opportunity to practice polygamy. Second, a warning to the husband to be able to act fairly. Third, there is the inability of men to behave fairly towards their wives even though they try hard. From these three points it can be concluded that one verse allows polygamy, while the other two verses seem to deny the realization of fair conditions.

Abstract

The engagement process is carried out with various different processions in each region, depending on the customs of the region. Nowadays, the factor of modernization has brought foreign culture into a trend and lifestyle that is followed by the wider community. The proposal which is also commonly called engagement in today's era is carried out with a ring exchange procession which is originally not part of Islamic law. The ring exchange tradition is the procession of attaching rings to the bride and groom during the proposal procession witnessed by each family as a symbol of interest or commitment to move towards something more serious. This ring exchange procession is also considered a complement to the engagement event that is carried out. The ring exchange is generally carried out with each party who is engaged putting the ring on their partner's finger in turn. In this procession, it is not uncommon for men and women to touch each other directly to put on the ring. As for the ring used in the exchange, it is a ring made of gold, while the use of gold rings for men is forbidden or prohibited by Islamic law.
