Abstract

Seizure of collateral (conservatoir beslag) aims to prevent the transfer of assets during the judicial process. Problems arise when the seized assets are claimed by a third party who is not directly involved in the dispute. This study analyzes the judge's considerations and the legal consequences of the decision of Case No. 28/PDT/2018/PT BGL on the rights of third parties. The Bengkulu High Court overturned the decision of the Bengkulu District Court and confirmed that the seizure of collateral remains valid, causing the third party (Siti Zahara) to lose her rights to the disputed land. The deed of agreement and power of attorney to sell that she owned were not recognized because they were not registered with the BPN. Other legal consequences are that the third party cannot file a re-claim (ne bis in idem), cannot change the name of the certificate, and bears the costs of the case. Legal efforts that can still be taken include a Judicial Review (PK) to the Supreme Court if there is new evidence, a PMH lawsuit, negotiation, or a complaint to the Judicial Commission and Ombudsman. In conclusion, the status of seizure of collateral is stronger than a claim of ownership based on a deed of agreement. Therefore, the third party must ensure the legality of ownership through official registration at the BPN in order to avoid legal problems.

Abstract

Advances in information technology have brought significant changes to efforts to prevent and combat money laundering. One innovation that plays an important role in detecting suspicious transactions is Artificial Intelligence (AI). This study aims to analyse the role of AI in identifying transaction patterns that may constitute money laundering crimes, with a focus on AI's ability to process data quickly and accurately. The method used in this study is a qualitative study with a descriptive-analytical approach. The results of the study indicate that the application of AI in financial systems, particularly through machine learning and data mining techniques, can significantly improve the effectiveness of early detection of suspicious transactions. However, challenges such as algorithmic bias, limitations of historical data, and regulatory aspects pose obstacles that need to be addressed. This study suggests collaboration between financial authorities, technology institutions, and regulators to optimise the use of AI within a suitable legal framework.

Abstract

This article examines the regulatory challenges in addressing unfair business practices in Indonesia. The research aims to identify legal gaps, analyze their impact on market fairness, and propose policy alternatives. A qualitative descriptive method was used with literature and case study approaches. The findings indicate that while regulatory frameworks exist, enforcement mechanisms remain weak, leading to widespread violations. Recommendations include strengthening institutional capacity and revising outdated regulations.

Abstract

The study examines the implications of monopolies and market competition within the context of Indonesian railways PT. Kereta Api Indonesia (KAI). The analysis highlights the challenges posed by monopolistic practices in PT. KAI, including their impact on consumer welfare, market dynamics, and economy equity. The researcg objectives include analyzing the legal framework governing monopolies, assessing market competition dynamics, and evaluating the regulatory challenges in promoting for competition. The study employs a combination of legal-normative and empirical approaches, including case studies to explore these issues. The findings reveal that while state-owned enterprises (BUMN) are granted exemptions under Law No. 5 of 1999 to engage in monopolistic practices for national interests, such practices can still lead to market inefficiencies and hinder competition. The study also identifies the need for enchanced regulatory mechanisms to ensure fire market conditions and protect consumer rights. Additionally, the research underscores the importance of balancing states interest with competitive market dynamics to achieve sustainable economic growth.

Abstract

Employment law is the branch of law that deals with rules governing both individual and collective employment relationships. Also referred to as labor law. Employees that have a subordinate relationship with their employers are always the subject of this rule. This area of law deals with employment laws or agreements, the reciprocal rights and obligations between employers and employees, salary determination, job security, and workplace health and safety. In Indonesia, the employment phenomena happens frequently. Numerous events can occasionally result from this phenomena. Conflict and solutions are brought about by the occurrences that take place. But at the moment, there are more disputes than answers. Therefore, further regulations are required to reduce the likelihood of these events. Indonesia has taken this seriously by enacting Law No. 13 of 2003.

Abstract

This research aims to describe the implementation of the Lampung Begawi Program as a strategy for promoting local culture while simultaneously empowering MSMEs (Micro, Small, and Medium Enterprises) in Lampung Province, and to formulate strategic recommendations for its sustainable development. Lampung Begawi is an annual program that integrates cultural festivals, MSME product exhibitions, training workshops, and multi-stakeholder collaboration in one platform. This study adopts a mixed-methods approach by combining qualitative and quantitative data through document analysis, in-depth interviews, and surveys targeting participants and MSME actors. The findings indicate that the program has successfully increased cultural exposure and generated tangible economic benefits for MSMEs, including revenue growth, digital market access, and expanded business networks. However, several challenges remain, such as limited funding, insufficient professional digital branding, and low participation from rural-based MSMEs. The study recommends strategies such as branding enhancement, establishment of an endowment fund, digital partnership with online marketplaces, and strengthening local government’s role in mentoring and capacity building. Conceptually, this research contributes to the development of an integrated evaluation model that links cultural preservation with community-based creative economy. With a collaborative approach, Lampung Begawi holds potential as a national model for synergy between cultural revitalization and local economic empowerment.

Abstract

Labor regulation in Indonesia plays a crucial role in creating a harmonious industrial relationship between workers and employers. This article aims to examine the fundamental aspects of labor law, including the rights and obligations of both parties, types of employment agreements, as well as the challenges and recent developments in labor regulation. Using a descriptive-qualitative approach and literature review, the article concludes that despite several legal reforms—such as the implementation of the Job Creation Law—significant challenges remain, particularly concerning the protection of informal sector workers, outsourcing practices, and the dynamics of the digital labor market. An adaptive and participatory legal approach is needed to ensure a balance between labor market flexibility and the protection of workers' rights.

Abstract

Legal protection for consumers in e‑commerce transactions is crucial to maintaining trust in the digital economy. This study analyzes the legal frameworks governing online consumer protection in Indonesia, focusing on Law No. 8/1999 and PP No. 80/2019. Using a normative‑juridical method, it examines legal provisions and their implementation gaps. The findings show regulatory existence but highlight enforcement weaknesses, limited consumer awareness, and challenges in cross‑border protections. Recommendations include strengthening enforcement, improving digital literacy, and establishing robust dispute resolution mechanisms.

Abstract

Monopoly and business competition constitute two pivotal phenomena in the contemporary business landscape that exert substantial influence on market participants and consumers alike. Indonesia's Law No. 5 of 1999 governs the prohibition of monopolistic practices and anti-competitive business conduct. Under Islamic jurisprudence, monopolistic practices (ihtikar) are similarly proscribed as they contravene fundamental principles of justice and adversely affect public welfare. This study seeks to examine the conceptualization of monopoly, the framework of competition law, the underlying principles and objectives of anti-monopoly legislation, and their implementation vis-à-vis Islamic economic precepts. The research methodology adopts a qualitative approach utilizing comprehensive literature review. The findings reveal that positive legal regulations and Islamic economic principles converge in their fundamental objective of establishing an equitable and balanced marketplace.

Abstract

This article analyzes the landscape of Indonesian copyright law amidst technological disruption. The creative economy significantly contributes to Indonesia's GDP, making robust copyright protection essential. However, rapid technological advancements, particularly digitalization and Artificial Intelligence (AI), pose complex challenges to the existing legal framework, primarily Law No. 28 of 2014 concerning Copyright (UUHC) and Law No. 11 of 2008 concerning Information and Electronic Transactions (UU ITE). This research employs a normative juridical approach with qualitative analysis of secondary data to evaluate the effectiveness of current regulations, identify the impacts of disruptive technologies like AI and blockchain, assess law enforcement efforts by the Directorate General of Intellectual Property (DJKI), and formulate recommendations. Key findings indicate that the current legal framework is not fully adequate to address AI-related issues such as authorship and originality, and digital piracy remains rampant despite enforcement efforts. The study concludes that comprehensive legal reforms, institutional strengthening, leveraging technology for protection, and enhancing public awareness are crucial for safeguarding creativity in Indonesia's evolving digital era. Recommendations include revising the UUHC to address AI, enhancing DJKI's capacity, exploring an Internet Court, utilizing blockchain for rights management, and intensifying public education.
