Abstract

The rapid advancement of information technology has significantly transformed global civilization, including the financial sector through the emergence of Financial Technology (fintech). One of the most widely used forms of fintech in Indonesia is Peer-to-Peer (P2P) Lending, which offers easy access to financing without collateral through digital platforms. However, this rapid growth has also raised new challenges, particularly regarding consumer protection. This study employs a normative juridical approach with descriptive-analytical specifications to examine the legal framework for consumer protection in P2P Lending services. The findings reveal that although the Electronic Information and Transactions Law (ITE Law) does not explicitly regulate fintech lending, various regulations such as OJK Regulation No. 77/2016, No. 13/2018, and No. 06/2022 provide legal protection through both preventive and repressive measures. Furthermore, the enforcement of administrative and criminal sanctions against illegal fintech operators is essential, along with the reinforcement of the principle of good faith in debt collection practices. Thus, a more comprehensive and stringent regulatory framework is needed to ensure legal protection, personal data security, and consumer confidence in P2P Lending services.

Abstract

The development of digital technology has transformed the consumption patterns of modern society by introducing an internet-based trade system known as e-commerce. This transaction model provides ease and speed in the buying and selling process, but it also harbors various risks for consumers. Consumers are often harmed by the actions of irresponsible business actors, such as the delivery of goods that do not match, delays, and even fraud. This study aims to analyze the legal protection of consumers in e-commerce transactions based on the applicable laws and regulations in Indonesia. This research uses a normative jridical method, with an approach to legislation, legal literature, and case studies. The results show that although consumer protection has been explicitly regulated in various regulations such as Law No. 8 of 1999 concerning Consumer Protection, the ITE Law, and Government Regulation No. 80 of 2019 concerning. Electronic Trading Systems, however, its implementation still faces significant challenges both from technical, legal, and public awareness perspectives. This analysis provides an in-depth overview of legal protection efforts as well as recommendations that can be implemented to enhance the effectiveness of consumer protection in the future.

Abstract

Sungai Nanam Village has faced serious challenges in managing waste piled up on the roadside since 2021 due to the lack of a final disposal site that pollutes the environment with rotting waste, causing air pollution and damaging the beauty and aesthetics of the environment. Although the community has made efforts to reduce waste disposal into the river through community service and collaboration with the Environmental Agency, the waste problem remains a significant issue despite the existence of Solok Regency Regulation Number 7 of 2018 concerning Waste Management, thus raising the following questions: 1) How is the implementation of Solok Regency Regulation Number 7 of 2018 concerning Waste Management in Sungai Nanam Village? 2) What obstacles does Sungai Nanam Village face in waste management? 3) What is the urgency of creating a Village Regulation related to waste management? To answer these questions, an empirical juridical research method was used through interviews. The research approach used a statute approach and a case approach, resulting in the following conclusions: 1) The implementation of Solok Regency Regulation No. 7 of 2018 in Sungai Nanam Village has not been implemented properly because the Village Regulation is still in the process of being drafted and has not been ratified; 2) Obstacles faced in waste management are the lack of facilities (Final Disposal Sites and Dump Trucks), low public awareness, inconsistent enforcement of sanctions and limited Human Resources and budgets also weaken the sustainable waste management system; 3) The preparation of Village Regulations is very urgent to be carried out to support the implementation of Regional Regulations at the local level as well as a technical legal basis that is in accordance with village conditions, strengthens guidance, supervision, and sanctions, and encourages community participation in waste management effectively and sustainably.

Abstract

One of the areas in Pesisir Selatan Regency, namely Barung-Barung Balantai Selatan, is prone to ecological disasters, especially landslides and floods due to deforestation and development without good spatial planning. Currently, this area is facing water infiltration problems that interfere with community activities, even though so far there has been Regional Regulation Number 1 of 2020 concerning Water Infiltration Areas as an effort to preserve the environment and optimize the function of water infiltration areas in the region, but in reality this problem still occurs. The limitations of the problems studied in this regard include: 1) the implementation of the Regional Regulation of South Pesisir Regency Number 1 of 2020; 2) obstacles or obstacles faced by the Wali Nagari in overcoming regional regulations related to Water Infiltration Areas in Kenagarian Barung-Barung Balantai Selatan Koto XI Tarusan. To unravel this problem, a type of empirical juridical research is used with a case approach (case aproach) and a statutory approach (statute aproach) so that conclusions are obtained: 1) The implementation of Regional Regulation Number 1 of 2020 in South Barung-Barung Balantai Kenagarian has not been effective because there is no Nagari Regulation on water catchment areas. After the flood on March 7, 2024, the Nagari collected residents' complaints and planned a discussion about the local regulation.They will draft Nagari Regulations with sanctions for violators. Some measures, such as building culverts and providing assistance to flood victims, have been taken. Nagari is trying to solve the problem of water catchment areas by involving residents.; 2) Inadequate development of Irrigation Areas can disrupt water catchment areas. Wali Nagari needs to protect the area.

Abstract

PKWT (Fixed Term Employment Agreement) workers are non-permanent employees who are employed with an employment agreement that has a certain duration or period. PKWT is often used for temporary or project-based work. PKWT employees are entitled to compensation money as a replacement for rights after the employment agreement is completed. Protectionifor PKWT workers has not been specifically regulated, although there are general provisions in the Manpower Law regardingitermination of employment, problems often arise such as lower salaries and cases of termination of employment (PHK) before the contract ends, compensation money not given by employers which is detrimental to workers. The government provides legal protection to workers both preventively and repressively, through the formation of laws and regulations and the implementation of systematic supervision. The focus of this study is to analyze the form of legal protection for workers with the status of a Fixed Term Employment Agreement (PKWT), especially regarding the right to compensation after the employment contract ends. The Job Creation Law and its implementing regulations are a form of protection for workers' fundamental rights that are adjusted to the dynamics of employment developments. This study uses a normative legal research method, by analyzing primary and secondary legal materials through a statutory, conceptual, and case study approach. The results of the study show that if the employment relationship ends before the PKWT period is over, the employer is still obliged to pay compensation to the worker,iwith the amount calculated based on the period of work that has been undertaken. Fulfillment of basic workers' rights is the responsibility of the employer and requires active government involvement, both in the form of regulation and supervision. The conclusion of this study confirms that legal protection for PKWT workers in terms of providing compensation after the contract ends has been regulated and guaranteed by the government, referring to the provisions of Article 61A of the Job Creation Law and Articles 15, 16, and 17 of Government RegulationiNumber 35 of 2021 concerning the provision of compensation for PKWT workers.

Abstract

Sebagai negara serumpun, Indonesia dan Malaysia memiliki beberapa persamaan dalam hukum adat, terutama karena sejarah dan pengaruh budaya yang serupa di masa lalu. Kedua negara mengakui dan menerapkan hukum adat dalam berbagai aspek kehidupan, meskipun dengan variasi dan penyesuaian lokal.Hukum adat di Indonesia dan Malaysia memiliki sejarah dan perkembangan yang berbeda. Perbedaan sistem hukum ini berbeda atas faktor sejarah yaitu penguasaan atau penjajahan dari 2 buah kuasa besar barat. Malaysia dijajah oleh British dan Indonesia dijajah oleh Belanda. Kedua-dua buah negara ini mempunyai sistem hukum yang tersendiri Dalam masa pemerintahan nasional dewasa ini eksistensi dan kedudukan hukum adat justru menjadi persoalan Tulisan ini membahas bagaimana posisi hukum adat Indonesia dan Malaysia, apakah masih sama berlakunya ketika zaman penjajahan, di Indonesia Hukum Adat Sebagai The Living Law, Mazhab sejarah memandang bahwa hukum yang baik itu adalah hukum yang berasal dari jiwa bangsa/semangat rakyat (volkgeist). Hukum yang mengikuti volkgeist di dalam masyarakat Indonesia dikenal dengan istilah hukum adat. Namun, ajaran filsafat hukum dan positivism hukum barat terutama ajaran dari civil law (eropa continental) dan common law (anglo saxon) untuk dijadikan sarana adan alat pembangunan hukum Indonesia. Semestinya sistem kodifikasi tidak berarti memarginalkan atau mematikan atau tidak memberikan ruang lagi bagi hukum adat. Malaysia merupakan Negara bekas jajahan Inggris, Sebagai bekas jajahan Inggris, Malaysia tetap mempertahankan tradisi hukum kebiasaan Inggris ( Common Law Sistem ) Malaysia merupakan salah satu dari sekian banyak dari anggota negara-negara persemakmuran Inggris. Malaysia tidak menghilangkan Hukum Asli sudah ada jauh sebelum Hukum Inggris masuk ke dalam tatanan hukum negara Malaysia.

Abstract

Consumer protection is a crucial aspect of the state's responsibility in ensuring justice and safety within economic activities. Consumers often face issues due to defective products, resulting in material and non-material losses. Law Number 8 of 1999 concerning Consumer Protection provides a strong legal foundation for claiming compensation for such losses. This study uses a normative juridical method with a literature-based approach, aiming to examine the legal remedies available to consumers and the role of consumer protection institutions in dispute resolution. The findings show that consumers can pursue compensation through both litigation and non-litigation channels, supported by institutions such as BPKN, LPKSM, and BPSK. These institutions play vital roles in consumer education, advocacy, mediation, and imposing administrative sanctions on business actors who violate regulations. Collaboration between consumers, the government, businesses, and related institutions is essential to building a fair, transparent, and safe market ecosystem for all members of society.

Abstract

In Nagari Tambang, Pesisir Selatan Regency, people often catch fish in the river using dangerous tools such as using laced materials and centrum tools, which can damage the river ecosystem in Nagari Tambang. Many losses are caused by catching fish in this way, it is clear that this way of catching fish does not provide any benefits. On the contrary, it causes environmental damage in the event that so far there has been a regulation that regulates at the Nagari level, namely the Nagari Tambang Regulation of South Pesisir Regency Number 3 of 2023 concerning the prohibition of fishing in rivers using toxic, hazardous materials and power tools. The problem limitations in this writing include the Implementation of the Regulation of Nagari Tambang, South Coastal Regency Number 3 of 2023 and the obstacles or obstacles faced by the Nagari Wali in implementing Nagari Tambang, South Coastal Regency Number 3 of 2023. To answer these problems, a type of normative jurisprudence research is used using a case approach and a statutory approach. So that the conclusions are obtained: 1) Nagari Tambang Regulation number 3 of 2023 prohibits toxic materials and centrum tools for fishing. However, its implementation is hampered by a lack of understanding and supervision; 2) Wali Nagari faces obstacles because many people do not understand the negative impact of using toxic materials to catch fish. The wali nagari has not maximally explained the Nagari Regulation to the entire community, especially in remote areas.

Abstract

Artikel ini membahas terkait yaitu untuk mengetahui dan menganalisis Kontrak kerja dan hukum ketenagakerjaan memainkan peran sentral dalam membentuk hubungan industrial dan perlindungan hak pekerja. Namun, perkembangan hukum ketenagakerjaan dalam beberapa dekade terakhir menunjukkan adanya pergeseran fungsi hukum yang semula melindungi pekerja, kini cenderung lebih menguntungkan pemberi kerja melalui pendekatan formalistik kontrak komersial, sehingga sering mengabaikan realitas kehidupan kerja sehari- hari. Perbedaan antara kontrak kerja dan kontrak hukum perdata semakin kabur, terutama dengan munculnya bentuk kerja fleksibel dan jarak kerja jauh, yang menuntut penyesuaian regulasi agar tetap menjamin perlindungan sosial bagi pekerja. Perspektif hukum kontrak menegaskan pentingnya prinsip-prinsip dasar kontrak, hak dan kewajiban para pihak, serta perlunya pengawasan dan regulasi pembaruan untuk memastikan perlindungan hak-hak pekerja secara adil dan berkelanjutan. Selain itu, kontraktualisasi hubungan kerja dapat memperkuat posisi pemberi kerja dan memperlemah perlindungan pekerja, sehingga diperlukan strategi hukum dan kebijakan inovatif untuk mengembalikan peran protektif hukum ketenagakerjaan dalam hubungan kerja modern

Abstract

Life in the current era of globalization is increasingly developing so that human life is made easier by rapid progress initheicurrent era of globalization, especially in the media, currently non-social media is not just television but there are many media that are increasingly developing day by day, especially in social media. As social media develops, the criminal crimes that occur today also increase, one of which is the crime of online prostitution, where prostitution is usually carried out online, but now prostitution can be carried out online, as is often heard now is that pimps carry out transactions through online media, apart from making it easier for the perpetrators of pimping, the media also makes it easier for the users of pimping services. The media that pimps usually carry out transactions through online media are WhatsApp, Twitter, Facebook, Instagram, Chat, and even via the web, Padang City is one of the cities where pimp prostitution cases have also been discovered through online media. The problem formulation in this research is 1). How is the enforcement of criminal law carried out by the Padang City Resort Police regarding criminal acts of pimping through online media in the jurisdiction of the Padang City ResortiPolice. 2). What are the obstacles experienced by the Padang City Police in carrying out criminal law against pimps via online media in the Padang City Resort Police Area? This research uses empirical juridical research, data is collected from interviews with the Padang City Police, the nature of the research is descriptive, and the data sources from this research are primary, secondary and tertiary legal materials. The results of the research are that the Police explain what punishments are, what forms of financial punishment are obstacles for the Police in enforcing the Criminal Law for perpetrators of the crime of pimping through online media.
