Abstract

Bonds are debt certificates issued by an agency or company that make the party issuing the bond indebted to the buyer and owner of the bond. One of the bond cases handled by the West Sumatra High Prosecutor's Office is case Nomor 158/PDT.G/2021/PN.PDG. This case began when the Plaintiff, who was the heir of one of the owners of the State Bond, sued the government with an expired state bond case. Then the judge decided to grant the Plaintiff's claim. The decision contradicts KMK Nomor 466a/KMK.011/1978 which states that the language of the bond claim is Nomor longer valid after 5 years have passed, while the lawsuit was filed 72 years ago. The judge's decision also contradicts the Prosecutor's Exception. The formulation of the problem in writing includes: 1) What is the basis for the Prosecutor's considerations in defending the state in the expired bond case Nomor 158/PDT.G/PN.PDG; 2) What are the obstacles faced by the Prosecutor as a State Attorney in handling the expired bond case case Nomor 158/PDT.G/PN.PDG. To answer this question, an Empirical Juridical research type was used with an interview technique using a semi-structured interview model. The type of approach used in the study was a case study and the following conclusions were drawn: 1) In this case, the Prosecutor stated that there was an error in the authority to try, the plaintiff's legal standing was unclear, the claim had expired based on KMK 466a/1978, the explanation of the legal basis and procedures for issuing bonds was incomplete and there was Nomor adequate explanation of the alleged unlawful act.; 2) The main obstacle faced by the Prosecutor in handling this bond case was the limited evidence. Suggestions for the obstacles faced by the Prosecutor include the need to create an integrated digital archiving system to store important state documents. Create a special database for state bond documentation. Preserve and digitize ancient documents to prevent further damage and improve the Prosecutor's competence in handling bond cases.

Abstract

The misuse of narcotics continues to rise, as reported by the National Narcotics Agency (BNN) of Indonesia. Narcotics cases from 2020 to 2022 increased from 833 to 879 cases. According to the latest data from BNN in 2023, the province of West Sumatra recorded 65 thousand of its residents involved in narcotics cases. This number places West Sumatra sixth in the highest narcotics cases in Indonesia. Therefore, serious efforts from various parties are required to address this issue. One such case handled by the High Prosecutor's Office of West Sumatra is Case No. 582/Pid.Sus/2023/Pn.Pdg. Based on the results of the discussion, the research questions in this study include: 1) What was the basis for not prosecuting the defendant as a narcotics abuser? 2) What preventive measures can the High Prosecutor's Office of West Sumatra take to reduce the circulation of narcotics? To answer these questions, the study uses an Empirical Legal research method with semi-structured interviews. The approach used is a case study, and it can be concluded that: 1) The prosecutor’s consideration in case No. 582/Pid.Sus/2023/Pn.Pdg was based on Article 114 paragraph (1) of the Narcotics Law and Supreme Court Circular Letter (SEMA) No. 4 of 2010 regarding the placement of narcotics abusers, victims, and addicts into rehabilitation institutions; 2) Preventive measures that the High Prosecutor’s Office of West Sumatra can take to reduce narcotics circulation include conducting socialization to the public and schools, implementing rehabilitation for narcotics abusers, and providing training so that narcotics abuse victims can acquire skills to meet their life needs.

Abstract

LGBT is an immoral phenomenon that threatens the security of society. This study aims to obtain information on the criminalization of LGBT behavior and the imposition of rehabilitation measures for such criminal acts. This study uses normative juridical research method with data obtained through literature study. The primary and secondary data collected are analyzed in a culaitative manner. The result of this research informs that LGBT behavior can be criminalized. Furthermore, rehabilitation measures are an effective form of punishment for LGBT criminal offenses.

Abstract

Humanitarian crimes against Uyghur Muslims in Xinjiang China have drawn increasing attention from around the world. This study aims to examine the regulation of individual criminal responsibility according to the 1998 Rome Statute and the possibility of Xi Jinping being punished for the persecution of Uighur Muslims. This study is a normative law study with a literature study to collect data. The data obtained is processed with a descriptive qualitative analysis method. The results of the study show that individual criminal responsibility for acts of persecution can be taken by the ICC if it fulfills the jurisdiction and flow stipulated in the Rome Statute in line with that Xi Jinping has the possibility of being punished for acts of persecution against Uighur Muslims based on complementarity jurisdiction.

Abstract

The issue of mining waste from PT Freeport Indonesia has become a complex and controversial environmental problem, particularly regarding the disposal of tailings through the Aghawagon and Ajkwa Rivers and their placement in the Modified Ajkwa Deposition Area (ModADA), covering 230 km² in Papua. This study aims to analyze the environmental impacts, relevant regulations, and the implementation of waste management by PT Freeport Indonesia. The research employs a normative juridical analysis with an environmental regulation approach, as well as an empirical review of the social and ecological impacts of tailings disposal. The findings indicate that although PT Freeport operates under a Contract of Work and holds waste management permits, its tailings disposal practices have resulted in ecosystem changes in the rivers, sedimentation, and disruptions to indigenous communities in affected areas. Existing regulations, such as Law No. 32 of 2009 on Environmental Protection and Management and Government Regulation No. 101 of 2014 on Hazardous and Toxic Waste Management, have not been fully adhered to in tailings management implementation. This study recommends strengthening government oversight, increasing corporate responsibility in environmental restoration, and adopting a more sustainable approach to tailings management. Additionally, an evaluation of the Contract of Work and stricter environmental regulations should be enforced to ensure that mining industry practices are not only economically beneficial but also environmentally sustainable and socially responsible.

Abstract

Penulisan ini mengkaji tanggung jawab hukum korporasi pertambangan terhadap kerusakan lingkungan dalam UU/Perpu Cipta Kerja, melalui studi kasus banjir bandang yang mengakibatkan kerugian atas areal persawahan seluas 43 hektar di Desa Bongkaras, Kabupaten Dairi yang diakibatkan oleh kelalaian PT Dairi Prima Mineral dalam menutup lubang bor selama masa eksplorasi. Para penggugat dalam perkara ini merupakan “Masyarakat yang Terkena Dampak Langsung” sebagaimana diatur dalam Pasal 22 UU Nomor 11 Tahun 2020 tentang Cipta Kerja jo. PERPU No. 2 Tahun 2022, yang mensyaratkan bahwa dokumen Analisis Mengenai Dampak Lingkungan (AMDAL) harus disusun oleh pemrakarsa dengan melibatkan masyarakat. Penelitian ini menggunakan pendekatan kualitatif melalui analisis literatur, perundang-undangan, dan putusan pengadilan guna mengetahui apa tanggung jawab hukum korporasi pertambangan terhadap lingkungan yang diatur dalam Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja jo. PERPU No. 2 Tahun 2022 tentang Cipta Kerja terkait kelalaian operasional pertambangan.

Abstract

Hutan memegang peranan yang sangat krusial dalam proses pembangunan nasional. Berdasarkan Undang-Undang Nomor 18 Tahun 2013 tentang Pencegahan dan Pemberantasan Perusakan Hutan, hutan didefinisikan sebagai satu kesatuan ekosistem yang mengandung sumber daya alam dan didominasi oleh pepohonan dalam lingkungan alaminya yang tidak dapat dipisahkan satu sama lain. Hal ini menegaskan bahwa hutan memiliki potensi besar untuk memberikan manfaat maksimal demi kesejahteraan rakyat.

Abstract

This paper explores the trade dispute between Indonesia and the European Union at the WTO, triggered by Indonesia’s decision to ban raw nickel ore exports. The policy forms part of a broader national downstreaming strategy aimed at strengthening domestic industrialization and supporting the global shift towards green energy. However, the European Union considers the measure a trade barrier that breaches liberalization principles under GATT 1994. Using a normative legal approach, this study examines relevant international trade and environmental laws, as well as Indonesia’s domestic regulations. The analysis reveals a persistent tension between developing countries’ sovereign rights to manage their natural resources and the global pressure to comply with free trade norms. The dispute highlights the need for international trade law to evolve and better accommodate the sustainable development priorities of developing economies.

Abstract

Global warming has become a significant issue faced by all countries worldwide. One of the main causes of global warming is the excessive emission of carbon resulting from human activities. Governments play a crucial role in limiting carbon footprints, as reducing carbon emissions can significantly impact national economic activities. Indonesia has demonstrated its commitment to mitigating global warming by ratifying the Paris Agreement. The country has also implemented a Carbon Economic Value (CEV) policy. This policy aims to reduce carbon emissions and encourage green investment. This study aims to examine government policies in reducing carbon footprints in Indonesia.

Abstract

The sea fence phenomenon at Pantai Indah Kapuk 2 (PIK 2) raises legal issues related to reducing community access and adverse impacts on the environment. This research aims to conduct a further study of legal violations arising from the sea fence incident. This research was conducted by analyzing and systematizing the data and information obtained qualitatively. Data on legal violations due to the sea fence phenomenon were collected using the literature study method. The data collected was analyzed using normative legal methods with a statutory and conceptual approach. The results of this study inform that the phenomenon of sea fencing violates various provisions of Indonesian laws and regulations. Furthermore, the sea fencing phenomenon is also identified as contradicting the principles of sustainable marine resource management and potentially violating the state’s obligation to protect and preserve the environment as per Article 192 of UNCLOS 1982.
