Abstract

Criminal law is a set of regulations aimed at preventing criminal acts by deterring individuals from committing offenses. In the field of comparative criminal law, the study of its object focuses on analyzing criminal law disciplines to gain a deeper understanding of investigative methods and legal procedures. One example of comparative criminal law can be seen in the study of premeditated murder offenses in Indonesia and Singapore, which share similarities and differences in their legal systems. This discussion focuses on two main aspects: the application of sanctions for premeditated murder based on Indonesian criminal law (Article 340 of the Criminal Code) and Singaporean criminal law (Penal Code Act 224), as well as an analysis of the similarities and differences in the systematic approach of both regulations. This research employs a normative juridical approach with a descriptive-analytical nature, relying on primary, secondary, and tertiary legal sources. In Singapore, premeditated murder is regulated under Section 300 of the Penal Code Act 224, which imposes the death penalty. Meanwhile, in Indonesia, premeditated murder is stipulated in Article 340 of the Criminal Code, which provides sanctions in the form of the death penalty, life imprisonment, or imprisonment for a maximum term of 20 years. In general, Indonesia and Singapore have distinct legal systems. However, regarding the regulation of premeditated murder, both countries share similarities in legal provisions, while differences exist in terms of legal subjects and the application of sanctions.

Abstract

This study examines the effectiveness of the International Criminal Court (ICC) in addressing terrorism and its implications for international law enforcement. Based on the 1998 Rome Statute, the ICC has limited jurisdiction as terrorism is not explicitly categorized as an international crime. A normative legal research method with legislative and conceptual approaches was employed to analyze international legal instruments and the ICC’s role. Findings reveal that the ICC can indirectly address terrorism through crimes against humanity, but its effectiveness is hindered by the absence of a universal definition of terrorism, jurisdictional limitations, and insufficient ratification of the Rome Statute. The implications highlight the ICC’s contribution to strengthening international legal norms and fostering global cooperation, though amendments to the Rome Statute are needed to explicitly recognize terrorism as a core crime. The conclusion underscores the necessity of harmonizing terrorism definitions and legal reforms to enhance the ICC’s role in enforcing international law.

Abstract

This study examines how legal dualism and the lack of ratification of international instruments hinder the enforcement of cross-border human trafficking laws in Indonesia. Using a normative juridical method, the research analyzes national regulations and international instruments such as the Palermo Protocol and ACTIP. The findings reveal that legal dualism creates misalignment between domestic and international laws, obstructing cross-border cooperation, extradition, mutual legal assistance, and victim protection. The limited ratification of international instruments weakens Indonesia’s position in transnational collaboration. The study recommends harmonizing domestic laws, accelerating ratification, and strengthening law enforcement institutions to enhance the effectiveness of combating human trafficking.

Abstract

Genocide is a serious crime against human rights and is recognized as a norm of jus cogens in international law, binding all states without exception. The 1948 Genocide Convention obligates participating states to prevent and punish perpetrators of genocide, regardless of the location of the act or the nationality of the perpetrator. However, the implementation of this obligation is often hindered in international legal practice, particularly when citizens of a state commit genocide beyond its territorial jurisdiction. Issues of jurisdiction, sovereignty, and political complexities frequently pose challenges in enforcing justice and accountability for genocide perpetrators. This paper explores the responsibility of states regarding their citizens who commit genocide abroad, analyzing relevant international laws and principles.

Abstract

This study examines the legal aspects of mystery box sales transactions in e-commerce, which raise legal challenges, particularly regarding the validity of contract objects and consumer protection. The object of mystery boxes is often unknown to consumers, potentially leading to breach of contract. Under civil law, this may violate Articles 1320 and 1238 of the Civil Code. According to Law No. 8 of 1999 on Consumer Protection, the lack of clarity in mystery box contents may violate the consumer's right to accurate information and cause harm. This study emphasizes the importance of regulation and consumer education to ensure fair and lawful transactions.

Abstract

This study examines the interplay between the principle of state sovereignty and the jurisdiction of the International Criminal Court (ICC) in enforcing law against international crimes. Using a normative-qualitative method and literature review approach, the research finds that state sovereignty is no longer absolute due to the evolution of international law, particularly in human rights protection. The ICC serves as a complementary mechanism (complementarity) when national judicial systems are unwilling or unable to prosecute international crimes. However, the ICC's effectiveness remains constrained by political factors and resistance from non-party states to the Rome Statute.

Abstract

State sovereignty over airspace according to international law is complete and comprehensive. However, in practice, the use of unmanned aircraft (drones) has not been specifically regulated through international regulations or conventions. The slow development of drone regulations is due to the absence of laws and standards from the International Civil Aviation Organization (ICAO). This study aims to examine the legality of drones crossing state borders and Yemen's responsibility for the actions of the Houthi rebels. This study uses a normative legal method with a descriptive approach, using secondary data analyzed qualitatively, and drawing conclusions deductively. The results of the study show that although drones are equated with aircraft in their regulations, the term drone has not been explicitly regulated in national or international air law.

Abstract

Background: Bankruptcy represents a strategic legal institution for resolving complex debt and credit problems in Indonesia. Law No. 37 of 2004 concerning Bankruptcy and Suspension of Debt Payment Obligations has been implemented for almost two decades, yet continues to face various challenges in practice. Objective: This research aims to analyze the effectiveness of bankruptcy law implementation in Indonesia, identify problematic issues in its application, and formulate recommendations for improving the national bankruptcy legal system. Method: This research employs normative juridical methods with descriptive analytical approaches. Primary data were obtained through interviews with legal practitioners, curators, and commercial court judges. Secondary data were collected from literature studies, court decision analysis, and comparative legal studies with other countries. Results: The implementation of Law No. 37/2004 still faces significant obstacles, including: (1) unclear minimum requirements for bankruptcy filing causing inconsistent court decisions; (2) insufficient PKPU timeframe that proves ineffective for restructuring; (3) diverse curator competencies affecting the quality of bankrupt estate management; (4) weak commercial court supervision over curator performance; and (5) minimal socialization of bankruptcy law to the public. Conclusion: Bankruptcy law reform is necessary through regulatory improvements, human resource capacity enhancement, and strengthening of supervisory systems to create an effective and equitable bankruptcy system.

Abstract

Money laundering is a serious problem that threatens economic stability and social order. This paper discusses money laundering in Indonesia from the perspective of positive law and Islam. Money laundering involves efforts to disguise the origin of illegal funds to make them appear legal. Based on positive law, money laundering is categorized as a criminal act regulated in Law No. 8 of 2010. From an Islamic perspective, money laundering is considered haram because it violates the principles of halal and transparency of transactions. Cases in Indonesia show the development of increasingly complex modus operandi with the use of technology. Therefore, a comprehensive legal approach and the application of Islamic values are needed to prevent money laundering practices.
