Abstract

Analisis Pasal 48 Konvensi Jenewa 1949 yakni terkait dengan prinsip distingsi yang mengatur tentang pembedaan antara penduduk sipil dan kombatan, pasal ini bertujuan untuk menjamin perlindungan terhadap penduduk sipil pada masa konflik bersenjata, yakni pada konflik antara Israel dan Palestina yang telah memunculkan pelanggaran dan kesengsaraan bagi warga sipil akibat pembatasan kebebasan dan kekerasan terhadap warga sipil. Penelitian ini bertujuan untuk menganalisis pelanggaran terhadap prinsip distingsi yang dilakukan oleh Israel terhadap Palestina, mengkaji penerapan prinsip distingsi berdasarkan Konvensi Jenewa 1949, serta menjelaskan alasan yuridis mengapa Israel belum di hukum meskipun telah dikeluarkan surat perintah penangkapan terhadap pejabat tinggi Israel oleh lembaga peradilan internasional. Penelitian ini menggunakan metode penelitian hukum yuridis-normatif. Hasil dari penelitian ini bahwa perdana Menteri israel Benjamin Netanyahu dan mantan Menteri pertahanan israel Yoav Gallant memikul tanggung jawab pidana atas kejahatan perang berupa kelaparan sebagai metode perang dan kejahatan terhadap kemanusiaan berupa pembunuhan dan tindakan tidak manusiawi terhadap warga palestina termasuk pelanggaran terhadap prinsip distingsi. Meskipun pengadilan pidana internasional (ICC) telah mengeluarkan surat perintah penangkapan terhadap Benjamin Netanyahu dan Yoav Gallant. Namun, dalam proses penegakan hukumnya mengalami hambatan dikarenakan Israel bukanlah negara yurisdiksi ICC, selain itu posisi Israel juga mendapat dukungan dari negara-negara besar. Penelitian ini menyarankan perlunya penguatan mekanisme akuntabilitas, kerja sama negara anggota ICC secara kooperatif agar independensi dari pengadilan pidana internasional (ICC) dapat terlaksana dengan optimal untuk menjamin penegakan prinsip-prinsip dasar hukum humaniter internasional.

Abstract

Rape constitutes one of the most serious forms of sexual violence, as it directly violates human dignity, personal autonomy, and fundamental human rights. In Indonesia, the regulation of rape was historically governed by Article 285 of the Criminal Code inherited from the colonial era, which narrowly defined rape as sexual intercourse committed by a man against a woman outside marriage through violence or threat. This formulation was increasingly considered inadequate to address contemporary social realities, including diverse forms of sexual violence, male victims, and sexual coercion within marital relationships. In response to these shortcomings, Indonesia enacted Law Number 1 of 2023 on the Criminal Code, introducing significant reforms to the regulation of rape.This study aims to analyze whether the reformed regulation of rape under Law Number 1 of 2023 is consistent with the legal needs of Indonesian society. The research employs a normative juridical method, focusing on doctrinal legal analysis through statutory and conceptual approaches. The study examines primary legal materials in the form of legislation, supported by secondary legal materials such as legal doctrines, scholarly books, academic journals, and purposively selected expert opinions from criminal law scholars.The findings reveal that the reformulation of rape, particularly the expansion of the victim’s subject from “a woman” to “any person,” represents a progressive shift toward a victim-oriented and inclusive criminal law policy. This development aligns with the principles of justice, utility, and legal certainty as articulated in Gustav Radbruch’s theory of legal objectives, and reflects a stronger commitment to human rights protection and equality before the law. However, the recognition of rape within marriage, as regulated in Article 473 paragraph (2)(a), remains controversial. Although normatively intended to protect victims, this provision raises significant challenges related to evidentiary standards, legal certainty, and compatibility with prevailing social, cultural, and religious values. Consequently, while the reform generally moves in the right direction, further refinement is required to ensure effective implementation, proportional criminalization, and balanced protection of legal interests within Indonesian society.

Abstract

Konflik bersenjata antara Rusia dan Ukraina menimbulkan berbagai pelanggaran terhadap warga sipil, termasuk wartawan yang menjalankan tugas jurnalistik di wilayah konflik. Wartawan memiliki peran penting dalam menyampaikan informasi yang akurat dan faktual kepada publik internasional, namun dalam praktiknya mereka kerap menjadi sasaran kekerasan, penahanan sewenang-wenang, pembatasan akses, serta ancaman keselamatan akibat situasi konflik dan perang informasi. Hukum Humaniter Internasional memberikan dasar perlindungan terhadap wartawan yang tidak terlibat langsung dalam permusuhan dengan menempatkan mereka sebagai warga sipil, sebagaimana diatur dalam Konvensi Jenewa Tahun 1949 dan ditegaskan secara khusus dalam Pasal 79 Protokol Tambahan I Tahun 1977. Penelitian ini bertujuan untuk menganalisis prinsip-prinsip hukum humaniter internasional yang mengatur perlindungan wartawan perang serta mengkaji implementasi dan kendala penerapan perlindungan tersebut dalam konflik bersenjata Rusia–Ukraina. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan konseptual yang dianalisis secara deskriptif-analitis, menggunakan bahan hukum primer, sekunder, dan tersier melalui studi kepustakaan. Hasil penelitian menunjukkan bahwa meskipun Konvensi Jenewa Tahun 1949 belum mengatur secara spesifik perlindungan wartawan perang, rezim hukum humaniter internasional memberikan perlindungan terhadap wartawan sebagai warga sipil. Pasal 79 Protokol Tambahan I Tahun 1977 secara eksplisit menegaskan status wartawan sebagai warga sipil yang berhak memperoleh perlindungan hukum sepanjang tidak turut serta secara langsung dalam permusuhan. Namun, dalam praktik konflik Rusia–Ukraina, penerapan ketentuan tersebut menghadapi berbagai kendala, antara lain lingkungan konflik dengan pelanggaran hukum humaniter internasional yang luas, dinamika perang informasi, keterbatasan mekanisme penegakan hukum internasional, serta kesulitan pembuktian dan dokumentasi di medan tempur. Kondisi ini menunjukkan bahwa perlindungan hukum terhadap wartawan perang belum berjalan secara optimal dan masih menyisakan kesenjangan antara norma hukum dan realitas konflik bersenjata modern.

Abstract

The use of fake diplomas has become a problem that has attracted the attention of the public, where there are 112 civil servants who use fake diplomas in several Simeulue Regency regional government agencies when registering as CPNS or applying for positions. This research aims to look at the effectiveness of implementing administrative actions and disciplinary penalties against civil servants who use fake diplomas, as well as looking at the factors that influence the implementation of disciplinary penalties against civil servants who use fake diplomas in Simeulue Regency. This research uses empirical juridical methods with a statutory regulation approach and a case approach. The results of the research show that in Government Regulation Number 94 of 2021 concerning Civil Servant Discipline, Article 8 paragraph (1) states the levels and types of disciplinary punishment, namely: light, medium and heavy disciplinary punishment. The implementation of administrative actions and disciplinary penalties against civil servants who use fake diplomas in Simeulue Regency has not been effective, because it is influenced by several factors, namely humanitarian considerations and avoiding social impacts. With these considerations, disciplinary punishment is ineffective because it does not have a deterrent effect on the 112 civil servants and does not rule out the possibility of diploma falsification in the future. It is recommended that the Regional Government be morefirm in providing disciplinary punishments to employees who are proven to have used fake diplomas, so that the law can run effectively and be able to prevent acts of diploma forgery.

Abstract

The contents that must be contained in a court decision are regulated in the provisions of Article 50 paragraph (1) of Law Number 48 of 2009 concerning Judicial Power and Article 197 of the Criminal Procedure Code. A decision that does not meet these provisions is an incomplete decision or insufficient consideration (onvoldoende gemotiveerd). Meuredu District Court Decision Number 46/Pid.Sus/2023/PN Mrn is a decision in a narcotics crime case where the Defendant is subject to Article 112 Paragraph (1) of Law Number 35 of 2009 concerning Narcotics, the minimum penalty for which is 4 (four) years in prison. However, the Panel of Judges imposed a prison sentence under the minimum penalty, namely 2 (two) years in prison without stating and explaining the legal basis used as a reference in imposing a sentence under the minimum penalty. This research aims to find out and analyze whether the judge's considerations in Decision Number 46/Pid.Sus/2023/PN Mrn do not contain complete legal considerations and what are the legal consequences of the judge's decision whose considerations are incomplete. This research is a normative legal research using the statutory approach method and case approach. Data sources were obtained from literature review and secondary data, namely primary, secondary, and tertiary legal materials which were analyzed qualitatively. The results showed that the judge's consideration in Decision Number 46/Pid.Sus/2023/PN Mrn, was an insufficient consideration because the judge did not include SEMA Number 3 of 2015 which is a legal basis that legitimizes judges to be able to deviate from the minimum criminal provisions in narcotics crimes. So that this decision does not create legal certainty and legal remedies need to be taken to be able to correct mistakes in the application of law by judges. These legal remedies are ordinary legal remedies or extraordinary legal remedies.
