Abstract

Southwest Aceh is one of the districts that has customary land, the result of community consultations regarding the management of customary land, the community is able to manage with a maximum land limit of 1 hectare per person on condition that it cannot be traded. This study aims to determine and explain the management of village customary land according to customary law and the existence of village customary land ownership rights according to customary law in Manggeng District, Southwest Aceh Regency. The method in this research is juridical empirical. The results showed that the Management of Gampong Customary Land According to Customary Law in Manggeng District, Aceh Barat Daya Regency was carried out in a structured and open manner where customary ownership rights were joint property rights based on village law and authority where the land was managed by the village government. Deliberations on customary law in the gampong can be carried out with several provisions including: 1) The community manages the customary land of the gampong in turns. 2) Each community can manage for 1 year or 2 harvests. 30 The results of the management are divided into 2 (two) where 50% is for the manager and 50% for the village treasury. 3) If the provisions are violated, then the sanctions will not be justified again. The existence of Hak Milik on Customary Land according to customary law has existed, grown and developed along with the development of the area itself. Customary property rights are applied from generation to generation in the life of legal alliances that are spread throughout the territory in Indonesia. Customary property rights have received constitutional recognition along with the recognition of customary law and indigenous peoples.

Abstract

As technology advances, criminal acts in gambling cases have developed, previously it was done in secret but now it can be done openly anywhere, the Higgs Domino online game has emerged and is categorized as a type of gambling act in recent years. in West Aceh Regency and law enforcement officers have arrested some of the perpetrators, but in reality there are still many members of society who carry out this gambling. This study aims to find out how law enforcement is and also the constraints that influence law enforcement carried out by law enforcement officials in West Aceh District against higgs domino online gambling actors based on Qanun Jinayat. This research is an empirical legal research that uses qualitative methods, data obtained through interviews and field observations.The research results show that law enforcement is carried out by the Police by means of appeals, collaboration with shop owners, patrols, joint raids and arrests. The Prosecutor's Office uses legal counseling and a program for prosecutors entering schools, while the Syar'iyah Court uses examination and adjudication, while the Satpol PP and WH use the WH Friday Khatib program, patrols and joint raids. Factors that hinder law enforcement are the large legal area, the site is still easily accessible, the public's lack of legal awareness, the public's unwillingness to cooperate, and several obstacles faced by police investigators. Suggestions in this study, the police need to work together with the ministry of communication and information technology to create a sophisticated tool that can detect, track and also remove sites that contain gambling, including the higgs domino online game. To the West Aceh District Government to create a special task force and provide infrastructure, special training for the task force in mastering technology in order to deal with gambling that arises with various variations.

Abstract

Tugas dan fungsi seorang Syahbandar diatur secara khusus dalam Undang-Undang Nomor 17 Tahun 2008 Pasal 207 ayat 1 tentang Pelayaran. Meskipun sudah ada peraturan yang mengatur peran Syahbandar dalam pengawasan, namun masih terdapat kejadian dimana peran Syahbandar belum terlaksana secara efektif. Tidak jarang dijumpai beberapa kecelakaan laut yang disebabkan oleh kelalaian Syahbandar dalam menjalankan tugasnya. Masih banyak terjadi kecelakaan laut akibat tabrakan kapal pada malam hari antara kapal dengan kapal laut atau perahu nelayan dengan tongkang pelampung lidah. Tujuan dari penulisan skripsi ini adalah untuk mengetahui sejauh mana tanggung jawab Syahbandar dalam melakukan sosialisasi mengenai rute pelayaran dan standar berlabuh tongkang kepada masyarakat. Penelitian ini menggunakan metode yuridis empiris, dengan pendekatan studi lapangan dan pendekatan kepustakaan. Teknik pengumpulan data yang digunakan dalam penelitian ini adalah pengumpulan data lapangan dan data kepustakaan, setelah itu data yang diperoleh disajikan secara deskriptif. Hasil penelitian menunjukkan bahwa dalam menjalankan tanggung jawabnya, Syahbandar bertugas menyampaikan informasi mengenai jalur pelayaran dan standar berlabuh tongkang kepada masyarakat.

Abstract

Sektor pertanian dan peternakan memegang peranan penting dalam kehidupan sosial, ekonomi dan perdagangan. Namun, berbagai masalah muncul ketika hewan ternak tidak dipelihara dengan baik dan menimbulkan kerugian bagi orang lain. Penelitian ini memfokuskan permalasahan terhadap pertanggungjawaban perdata pemilik hewan ternak atas kerugian yang dialami oleh pengguna jalan. Penelitian ini bertujuan untu mengkaji den menjelaskan pelaksanaan pertanggungjawaban perdata pemilik hewan ternak terhadap kerugian terhadap orang lain yang ditimbulkan oleh hewan ternaknya. Metode penelitian yang digunakan ialah yuridis empiris. Dengan mengumpulkan data primer dan data sekunder melalui obsevasi dan wawancara serta studi kepustakaan. Data yang diproleh kemudian dianalisis secara preskriptif dengan pendekatan kualitatif. Hasil penelitian menunjukkan bahwa pertanggungjawaban perdata pemilik hewan ternak atas kerugian yang dialami pengguna jalan di Desa Ujong Tanoh Darat Kecamatan Meureubo Kabupaten Aceh Barat ditetapkan dan dilakukan secara musyawarah dan mufakat. Pemilik hewan ternak menanggung atas kerugian yang dialami pengguna jalan di  Desa Ujong Tanoh Darat. Mekanisme pelaksanaannya diawali dengan pertemuan kedua belah pihak yang difasilitasi perangkat gampong untuk bermusyawarah dalam penentuan ganti rugi.

Abstract

The legal basis for business licensing in the agricultural sector is based on PP Number 24 of 2018 concerning electronically integrated business licensing services. As for getting this business license, business actors can register it through OSS (online single submission) where business actors are assisted by office employees where they take care of the licensing process. The purpose of the study was to find out the mechanism for granting business permits in the agricultural sector and to find out the obstacles faced by entrepreneurs in administering business permits for the Agricultural Sector at the Office of the Investment and One Stop Service, Manpower and Transmigration Office, Southwest Aceh Regency. The method used in this study is empirical law that uses descriptive research methods, in which this study describes the application of business licensing in the agricultural sector based on a review of state administrative law at the Office of Investment and One Stop Integrated Services, Manpower and Transmigration, Aceh Barat Daya Regency. The results of the study indicate that the mechanism for granting agricultural business permits at the Office of Investment and One-Stop Integrated Services, Manpower and Transmigration in Southwest Aceh Regency, namely: The applicant comes to the Office to collect the application form, The service counter officer checks the application file and administrative requirements for licensing and it is stated that the file is complete and correct, a receipt for the application file is made to the applicant, The service officer records the applicant's data and attaches a control form to the application file. Obstacles in obtaining business permits for the agricultural sector in Aceh Barat Daya Regency are: There are still limited human resources and there are still many people who still do not understand how to register online. There is still a lack of facilities and infrastructure. There are not enough human resources within the scope of the Southwest Aceh one-stop service office.

Abstract

The existence of fines as one of the main types of punishment contained in Indonesian criminal law, has been a form of punishment applied since the time of the Dutch Criminal Code until now it has been adopted by Indonesia as its colonial country. The enactment of Law Number 1 of 1946 concerning Criminal Law Regulations which is a transplant of the Dutch Criminal Code into national criminal law, until the birth of a new Criminal Code based on Law Number 1 of 2023 concerning the Criminal Code, the existence of fines as a form of principal crime, is maintained so that the scope of the new criminal fines regulation. The new Criminal Code continues to categorize fines as one of the main types of criminal penalties, both in the new Criminal Code and the Old Criminal Code, such as, classification of criminal fines into eight categories, time period and method of payment of criminal fines, provisions regarding confiscating and auctioning off the property/belongings of convicts who do not pay fines, substitute penalties for fines which were previously in the form of imprisonment into prison sentences, supervision penalties and social work penalties which are the regulations governing the new Criminal Code

Abstract

Undang-undang nomor 32 tahun 2009 tentang perlindungan dan pengelolaan lingkungan hidup terdapat asas pertanggung jawaban mutlak ( strict liability ), yakni segal yang suatu yang dituntut karena pencemaran lingkungan korporasi dapat dimintai pertanggung jawaban secara perdata atau ganti rugi. namun masih banyak perusahaan korporasi melakukan pembakaran lahan secara ilegal untuk tujuan perluasan lahan Skripsi ini bertujuan untuk menganalisis kasus perbuatan melawan hukum yang terjadi pada pembukaan lahan dengan cara membakar yang dilakukan oleh Pt kallista Alam,jenis penelitian yang digunakan ialah penelitian normative dengan pendekatan konsep,dan pendekatan perundang undangan. Hasil penelitian ini menunjukkan bahwa dalam pertimbangan hakim pada putusan nomor 12/pdt.g/2012/pn.mbo yaitu telah memenuhi unsur keadilan,dalam kepastian hukum di Indonesia aturan-aturan yuridis yang dapat menjamin adanya kepastian bahwa hukum berfungsi sebagai suatu peraturan yang harus di taati,namun pelaksaan pada putusan nomor 12/pdt.g/2012/pn.mbo belum berjalan dengan semestinya.

Abstract

Warga Negara Indonesia yang akan melangsungkan perkawinan harus memahami betul aturan hukum perkawinan. Pasal 2 Ayat (2) Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan mengatur bahwa tiap-tiap perkawinan harus dicatat menurut Peraturan Perundang-undangan. Namun, di Desa Lasikin, Kecamatan Teupah Tengah, masih terdapat perkawinan yang tidak dicatatkan atau nikah siri. Tujuan dari penelitian ini adalah untuk mengetahui Implementasi Pasal 2 Ayat (2) Undang-Undang Nomor 1 Tahun 1974 Terhadap Perkawinan Siri di Desa Lasikin Kecamatan Teupah Tengah Kabupaten Simeulue dan untuk mengetahui hambatan-hambatan dalam Implementasi Pasal 2 Ayat (2) Undang-Undang Nomor 1 Tahun 1974 Terhadap Perkawinan Siri di Desa Lasikin Kecamatan Teupah Tengah Kabupaten Simeulue. Metode penelitian yang digunakan dalam penelitian ini adalah metode yuridis empiris dengan sifat deskriptif dan sumber informasi yang diperoleh melalui wawancara. Hasil penelitian menunjukkan bahwa di Desa Lasikin dari tahun 2020-2023 masih ada masyarakat yang melakukan perkawinan siri, hal ini menunjukkan bahwa masyarakat belum melaksanakan Pasal 2 Ayat 2 Undang-Undang Nomor 1 Tahun 1974 terhadap Perkawinan Siri. Hambatan dalam implementasi Pasal 2 Ayat 2 Undang-Undang Nomor 1 Tahun 1974 Terhadap Perkawinan Siri di Desa Lasikin adalah hambatan dari segi prosedur administrasi, kurangnya penyuluhan/sosialisasi hukum, kurangnya kesadaran hukum masyarakat, faktor ekonomi dan kurangnya pendidikan masyarakat serta sulitnya mengurus perceraian. Dengan demikian, saran kepada masyarakat agar dapat melaksanakan Pasal 2 Ayat 2 Undang-Undang Nomor 1 Tahun 1974 terhadap Nikah Siri agar perkawinan mereka memiliki kepastian hukum dan perlindungan hukum. Kepada Kepala Kantor Urusan Agama (KUA) agar lebih teliti dalam melakukan penyuluhan/sosialisasi hukum di setiap desa dan melakukan pengawasan dan evaluasi secara berkala terhadap pencatatan perkawinan agar upaya yang dilakukan dapat berjalan dengan efektif dan diharapkan kedepannya dapat meminimalisir praktek perkawinan siri.

Abstract

 Myanmar is a country in Southeast Asia whose government is currently being overthrown and controlled by the military. The military junta carried out attacks against civilians, such as massacres against demonstrators and several riots that resulted in the destruction of several state assets and casualties. Myanmar's internal conflicts can be classified as low-intensity conflicts because they are carried out openly and have caused a crisis of legal legitimacy in the region. The purpose of this research id to find out the protection of civil society applied in the armed conflict in Myanmar in International Law and to find out the consewuences of the failure to protect civil society in the armed conflict in Myanmar based on International Law. This research was conducted using a normative research method or library research as a primary material and a study of legal materials in the field as a secondary material for supporting data to be analyzed and explained accurately to the problems studied. The theory used in this study is the theory of state responsibility, the theory of emergencies and the theory of law enforcement. This study found that there were serious violations against civil society in Myanmar and besides that there were several provisions regarding the protection of civilians in a state of conflict, there were preventive rules regarding the possibility of civilian casualties. It is recommended that the state of Myanmar carry out a consensus settlement of the coup in Myanmar by appointing a neutral country that has the power to intervene in the current territory of Myanmar to oversee the transition of power or at least issue a resolution to summon the Myanmar military junta to comply with the applicable conventions so that crimes against humanity do not occur for as long as possible. emergency period in Myanmar.

Abstract

The Aceh People's Representative Council in carrying out its controlling function supervises the Acting Governor's policies related to the Reforcusing funds in the 2020 APBA which range from Rp.1.7 trillion to Rp.2.3 trillion, the funds were diverted for the response to the COVID-19 pandemic, but no description of the activities and the amount of the budget was submitted to the DPRA, the next reason is about the installation of consumption stickers for the use of Premium and Subsidized Solar for Subsidized Cars and several other reasons, so that based on a number of these reasons the DPRA members consider that the Acting Governor of Aceh has violated the law and oath of office and plans to use his right to impeach the Acting Governor. The writing of this journal aims to find out whether the DPRA has the authority to impeach the Acting Governor and the extent of the authority possessed by the DPRA. This research uses normative / library juridical methods with a Legislation approach and a historical approach, data collection techniques in this study by examining primary legal materials, secondary legal materials, and tertiary legal materials, then the data that has been obtained is presented descriptively. The results of this study indicate that the DPRA does not have the authority to impeach the Acting Governor's position because the position is not a definitive position and the DPRA only has the authority to supervise not to the impeachment process. It is recommended that the DPRA continue to oversee the course of government run by the Acting Governor so that the course of government remains in accordance with the corridor, but do not impeach the Acting Governor, because the DPRA does not have this authority
