Abstract

This study examines the role of consumer dispute resolution institutions in Indonesia and Thailand, with particular attention to the non-litigation mechanisms available to protect consumers amid the expansion of the digital and cross-border economy. Using a normative juridical method with statutory and comparative approaches, the research analyses primary legal materials, principally Indonesia’s Law Number 8 of 1999 on Consumer Protection and Thailand’s Consumer Protection Act B.E. 2522 (1979), together with secondary legal literature obtained through library research. The results show that Indonesia resolves consumer disputes mainly through the Consumer Dispute Settlement Body (BPSK), a semi-judicial institution operating under the Ministry of Trade that issues binding decisions through mediation, conciliation, and arbitration, generally within twenty-one to sixty days. Thailand, by contrast, relies on the Office of the Consumer Protection Board (OCPB) together with the Thailand Consumers Council (TCC) and the Thailand Arbitration Center (THAC), which emphasise community-based mediation and have progressively incorporated online dispute resolution. Both systems share the same normative objective of providing consumers with accessible, efficient, and non-litigious remedies, yet they differ markedly in institutional structure, the binding character of settlements, and the extent of digital-technology adoption. This study recommends strengthening the institutional capacity and digital infrastructure of BPSK, drawing on Thailand’s more independent and technologically integrated model, to enhance access to justice for Indonesian consumers, and calls for closer ASEAN-level harmonisation of consumer dispute resolution standards.

Abstract

This study aims to examine the legal protection of parties in ship charter agreements (charter party) under Indonesian positive law, with a case study of Time Charter Agreement Number /MSW-BHI/TC/X/2024 between PT Mitha Samudera Wijaya as ship owner and PT Bestie Hoper Indonesia as charterer for vessel SPOB Julvinda. This research employs a normative juridical method with statutory and conceptual approaches. The results show that the legal regulation of ship charter agreements in Indonesia is scattered across the Civil Code, Commercial Code, and Law Number 17 of 2008 on Shipping. Legal protection for parties is realized through balanced contractual clauses covering rights and obligations, deposit mechanisms, off-hire provisions, and dispute resolution through the Medan District Court. Default in ship charter agreements can be resolved through litigation or non-litigation (mediation and arbitration). This study recommends the need for a single maritime law codification in Indonesia to ensure legal certainty and balanced protection for all parties.

Abstract

Indonesia is known for its rich cultural heritage, one of which is Javanese culture that encompasses a variety of traditions, including wedding ceremonies. One significant element in traditional Javanese weddings is Kembar Mayang, a decorative arrangement made from young coconut leaves (janur kuning) that carries deep symbolic and philosophical meanings. This tradition serves not only as an ornament but also as a medium for instilling ethical values, spirituality, and social harmony. However, amid the currents of modernization and rising religious consciousness, the practice of Kembar Mayang has sparked differing views, particularly among the Muslim community in Sako Dua Village, Kerinci. While some consider it a cultural heritage worth preserving, others see it as conflicting with the tenets of Islamic monotheism (tawhid), deeming it to contain elements of shirk (polytheism). This study employs the Islamic legal sociology approach to analyze how the Kembar Mayang tradition is understood and practiced within its social and religious contexts. The research aims to offer a balanced understanding between cultural preservation and adherence to Islamic principles, and to promote an educational approach that ensures the tradition remains relevant without causing value-based conflicts in society.

Abstract

Community advocacy against child marriage does more than communicate risk or link residents to services. It also makes social positions recognisable and distributes preventive work. This secondary qualitative analysis examines nine adult interview documents associated with Women’s Crisis Center Palembang in South Sumatra, Indonesia. Because the analysis was restricted to the approved adult corpus, girlhood is examined through adult- and programme-mediated representations. A critical interpretivist single-case design combined framework analysis with scholarship on subject formation, recognition, responsibilisation, gendered community labour, and participation. The records depict recurring dialogue, accompaniment, women’s cadres, material activities, referral, and institutional relationships. They offer three interconnected subject positions: the future-oriented girl, the preventive female caregiver, and the relational woman intermediary. These positions articulate education, employment, preparation, and delayed marriage as legitimate futures, while making women’s local knowledge and community proximity organisationally useful. Yet the records document preventive labour and recognition much more clearly than resource control, agenda-setting, household decision authority, or enforceable institutional obligations. The article proposes responsibility-authority asymmetry as a diagnostic concept for this uneven evidentiary visibility. It does not establish that authority was absent or unchanged in practice. The corpus supports reported changes in understanding, caregiving orientation, and future planning, but not behavioural change, reduced child-marriage incidence, programme effectiveness, or causal impact. The contribution is to connect social-identity formation with the allocation of preventive labour while specifying the evidentiary limits of claims about power.

Abstract

The development of artificial intelligence (AI) has brought fundamental changes to the entrepreneurial process, particularly in the stage of entrepreneurial opportunity recognition. Although the literature on AI and entrepreneurship continues to grow, an integrated understanding of how AI transforms the opportunity recognition process remains fragmented. Therefore, this study aims to systematically examine the role of AI in transforming entrepreneurial opportunity recognition through a Systematic Literature Review (SLR) approach. This research follows the PRISMA guidelines by analyzing 40 reputable journal articles published between 2015 and 2025 and sourced from the Scopus, Web of Science, and Google Scholar databases. The analysis employs a thematic synthesis approach to identify key patterns, mechanisms, and implications of AI integration in opportunity recognition. The synthesis results reveal four main themes: (1) AI as an enabler in detecting patterns and latent opportunities, (2) the transformation of entrepreneurial cognition toward a human–machine hybrid model, (3) enhanced opportunity validation and reduced uncertainty through predictive analytics, and (4) ethical challenges and risks of algorithmic dependence. This study contributes theoretically by expanding the understanding of opportunity recognition in the context of digital entrepreneurship and practically by providing implications for entrepreneurs and policymakers in managing the strategic and responsible use of AI.

Abstract

The contemporary music industry has transformed into an ecosystem based on concepts, visual identity, and brand image with high economic value. The practice of musician imitation, including the imitation of group concepts, choreography, visual style, and brand identity, is difficult to address under conventional copyright law, which protects only expression and not ideas. The main legal issue is whether the imitation of creative concepts that are not protected by copyright can be categorized as unfair business competition. This study uses a normative legal research method with statutory, conceptual, case, and comparative approaches. The results show that South Korea, through the Unfair Competition Prevention Act (UCPA) and the Monopoly Regulation and Fair Trade Act (MRFTA), has adopted a progressive legal framework that protects “substantial investment and effort” in creating brand identity, as demonstrated in the Seoul Court decision on the ILLIT vs NewJeans dispute in February 2026, which fulfilled three elements of unfair competition: confusion, parasitic copying, and misappropriation of trade secrets. In contrast, Indonesia still relies on a narrow copyright approach under Law No. 28 of 2014, Article 41, and Law No. 5 of 1999 on Business Competition, which has not specifically regulated concept imitation. This study recommends the reformulation of Law No. 5 of 1999, the strengthening of the role of the Business Competition Supervisory Commission (KPPU), and the preparation of plagiarism guidelines as a form of preventive protection for Indonesian musicians.

Abstract

This study is motivated by the strategic role of fashion SMEs as a pillar of the national economy, which is currently facing the challenges of digitalisation, where their success is highly dependent on managerial capacity and technological adaptation, such as social commerce. The primary objective of this study is to analyse the influence of digital leadership and entrepreneurial orientation of owners on the performance of fashion SMEs, with social commerce strategy as the mediating variable. The research method employed is an explanatory quantitative approach using a cross-sectional design, where data was collected from fashion SME owners in Kebumen Regency via a questionnaire and analysed using Structural Equation Modelling (SEM-PLS). The targeted outputs of this study include a final report, research instruments, raw data, and a scientific article ready for publication in a journal or conference proceedings. This research falls within Technology Readiness Level (TRL) 2 to 3, which encompasses the formulation of technological concepts and proof of concept through field data analysis to validate the model of relationships between variables. The research findings indicate that digital leadership and entrepreneurial orientation have a positive and significant influence on social commerce strategies, which in turn are shown to significantly enhance the performance of SMEs. Furthermore, social commerce strategies successfully play a strong mediating role, demonstrating that the digital vision and risk-taking courage of business owners will have a maximum impact on business performance when implemented through appropriate, interactive, and customer-oriented social media strategies.

Abstract

In an era of increasing environmental awareness and consumer scrutiny, sustainable Corporate Social Responsibility (CSR) has become a strategic approach for strengthening brand loyalty. This study aims to examine the effect of sustainable CSR on brand loyalty, with trust and brand identification as mediating variables among AQUA consumers. The research adopts a quantitative approach using an associative method. Data were collected through an online questionnaire distributed to 100 AQUA consumers in Banyumas Regency aged 18–35 years, selected using purposive sampling. The data were analysed using path analysis with SPSS version 27. The results indicate that CSR has a significant positive effect on trust, brand identification, and brand loyalty. Trust is also found to have a significant positive effect on brand loyalty, while brand identification does not significantly influence brand loyalty. Furthermore, the mediation analysis reveals that trust successfully mediates the relationship between CSR and brand loyalty, whereas brand identification does not serve as a mediating variable. These findings suggest that consumer trust plays a more critical role than emotional identification in translating CSR initiatives into loyalty, particularly in low-involvement products such as bottled water. This study contributes to the literature by integrating sustainable CSR with trust and brand identification in the context of environmental controversy. Practically, the findings provide insights for companies to prioritise transparent and credible CSR initiatives in order to strengthen consumer trust and maintain long-term brand loyalty.
