Res Publica: Jurnal Hukum Kebijakan Publik is a peer-reviewed journal published by Constitutional Law Department, Faculty of Law, Universitas Sebelas Maret three times a year in April, August, and December. This Journal aims primarily to facilitate scholarly and professional discussions over current developments on legal issues in Indonesia as well as to publish innovative legal researches concerning constitutional law and democracy. It provides immediate open access to its content on the principle that making research freely available to public support a greater global exchange of knowledge. Published exclusively in English and / or Bahasa Indonesia (will be considered), the Review seeks to expand the boundaries of Indonesian legal discourses to access English-speaking contributors and readers all over the world. Novelty and recency of issues, however, is a priority in publishing. The scope of the articles published in this journal deal with a broad range of topics in the fields of constitutional law and democracy. Abstract

This study examines the implementation of Law Number 7 of 2017 concerning General Elections related to the role of the General Elections Commission (KPU) to increase public participation in legislative elections. The purpose of this study was to find out how the implementation of Law Number 7 of 2017 concerning Elections related to the role of the General Election Commission for its efforts to increase public participation in the Legislative General Election in Surakarta City in order to achieve the set targets. This type of research is empirical research and the data used are primary data and secondary data. The research location was carried out at the KPU of  Surakarta City. The efforts made by the KPU of Surakarta to increase public participation are by using the Voter Socialization and Education method which is considered to attract the attention of the community and is done by adjusting based on the needs of each segmentation of society.

Abstract

This study aims to analyze the strengthening of the KPK as a law enforcement agency with independent principles through self-regulatory body. This research is a normative legal research using secondary data in the form of primary and secondary legal materials. The data collection technique was carried out by literature study using model of the statute approach, conceptual approach, and historical approach. The results show that at least there are efforts to weaken the KPK, including legitimacy that degrades the independence of the KPK through the enactment of Law Number 19 of 2019 concerning the Corruption Eradication Commission. It is known that there was a technical action that should have been regulated in the implementing regulations, but it has been sufficiently touched on by the legislation of the Corruption Eradication Commission (KPK).

Abstract

This paper aimed  to know the change of the construction of investigation permission of  parliament (DPR) members to become need the  approval of the President as well as its relevance to the legal principles of the rule of law. This research is the normative legal research which areprescriptive. The permission construction changes as a consequence upon issuance the Constitutional Court decision number 76/PUU-XII/2014. The results showed that the change in investigation permission construction of Parliament (DPR) membersby law enforcement be require approval by the President because Mahkamah Kehormatan Dewan (MKD) is the institution of ethics that have no direct relationship with the criminal justice system. In addition, the DPR as State officials must be balanced with adequate judicial protection and proportionate, as well as an effort to uphold the mechanism of checks and balances between the holder of legislative powers and the holder of the executive power. Then investigation permission of members of Parliament are not relevant when it is  associated with both the principle of rule of law, namely the equality before the law principle and independent and impartial judiciary principle.

Abstract

ABSTRACTThis thesis  examines and describes effect of The Constitutional Court Decision Verdict No. 33/PUU-XIII/2015 concerning the restiction of political dynasty on regional chief election and whether the verdict has been appreciate with Constitution of Indonesia, UUD NRI 1945.This research is normative legal research which is descriptive. The result of this research shows that 1) the effect after constitonal court verdict No. 33/PUU-XIII/2015 resulted in article 7 letter r of Law Number 8 of 2015 having no binding legal force and having an impact of implementing regulating under it, as well as creating a conflict of interest. The implemention of regional chief election if there is a conflict of interest resulting in unequal competition, affect the accountability of local elections, political dynasty, and political corruption.However, if there are no conflict of interest, the implementation of local election run smoothly with a strict supervison of all instrumen. 2) the constitutional court verdict No. 33/PUU-XIII/2015  is not according with mandate of Constitution of Indonesia, UUD NRI 1945 Article 28J paragraph (2) and Article 18 paragraph (4)are related to improving the quality of democracy in regional elections.Keywords : constitional court verdict No. 33/PUU-XIII/2015; political dynasty; local election; local election.

Abstract

This study analyzes and examines the prohibition of members of the Regional Representative Council (DPD) concurrently administrators of political parties and formulates ideal arrangements for the requirements of DPD member candidates regarding the political system of democracy. This research is a legal research that is of a nature perspective, with a legal approach and a conceptual approach. The type of data collected consists of primary legal material and secondary legal material. The data collection technique used is library research. The technical analysis used is a syllogism method that uses a deductive mindset. The results of the study indicate that the prohibition of DPD members and administrators of political parties is right based on (1) a historical analysis of the formation of the DPD; (2) differences in the nature of representatives; and (3) potential conflicts of interest that may arise. The ideal arrangement for the requirements of DPD member candidates is (a) not a political party administrator at least 5 years before nomination (b) domicile requirements for a certain period of time; and (c) organizational / community regional leadership requirements.

Abstract

Penelitian ini bertujuan untuk mengetahui bagaimana kewenangan Kepala Desa Celep dalam pengelolaan dana desa di Desa Celep, serta mengetahui apa saja hambatan yang dialami Kepala Desa Celep ketika menjalankan kewenangannya dalam pengelolaan dana desa di Desa Celep. Penelitian ini merupakan penelitian hukum empiris yang bersifat deskriptif dengan pendekatan kualitatif. Jenis dan sumber data penelitian yang digunakan dalam penelitian ini adalah data primer dan data sekunder dengan mengumpulkan data melalui wawancara dan pengambilan informasi studi tekstual untuk mengkaji data sekunder. Kemudian dianalisis menggunakan teknik analisa data dengan model analisis kualitatif dengan tiga komponen utama yaitu reduksi data, sajian data, dan penarikan kesimpulan. Penelitian ini dilakukan di Desa Celep, Kecamatan Nguter, Kabupaten Sukoharjo dikarenakan pesatnya perkembangan desa baik dari segi pembangunan maupun kependudukan. Hasil penelitian menunjukkan bahwa kewenangan Kepala Desa Celep dalam pengelolaan dana desa di Desa Celep sudah cukup baik dan dalam kategori sesuai dengan Undang-Undang Nomor 6 Tahun 2014 tentang Desa. Hal tersebut dikarenakan dana desa di Desa Celep sudah dikelola dan dimanfaatkan sebagaimana mestinya, mulai dari tahap perencanaan, pelaksanaan, penatausahaan, pelaporan, hingga pertanggungjawaban. Meskipun pada praktiknya tetap terdapat beberapa hambatan, namun kegiatan pelaporan dan pertanggungjawaban dapat terlaksana tepat waktu. Beberapa hambatan tersebut antara lain, kurangnya sosialisasi dan pendampingan mengenai pengelolaan dana desa, sumber daya manusia yang belum sesuai kriteria, dan kurangnya partisipasi dari masyarakat

Abstract

ABSTRAKTujuan   penelitian  ini  adalah   untuk  mengetahui   kebijakan   yang dibentuk   oleh Pemerintah   Kabupaten Wonogiri dalam   rangka melaksanakan sistem zonasi yang ditujukan untuk membentuk sekolah yang tanpa diskriminasi dan berkeadilan. Hasil penelitian menunjukkan bahwasanya  Kebijakan Kabupaten Wonogiri diatur melalui Keputusan Bupati Wonogiri  Nomor 176  Tahun  2019 tentang Penetapan Zonasi Penerimaan Peserta Didik Baru pada Taman  Kanak-Kanak, Sekolah DasarNegeri dan Sekolah Menengah Pertama Negeri Tahun  Pelajaran 2019/2020 yang didalamnya mengatur tentang pelaksanaan  sistem zonasi berdasarkan  zona Rukun Tetangga. Keputusan tersebut pada dasarnya telah mewujudkan sekolah yang tanpa  diskriminasi dan berkeadilan,  namun dalam implementasinya   belum   sempurna. Persoalan tersebut muncul karena Adanya wilayah administrasi Kabupaten Wonogiri Yang belum masuk kedalam penetapan zona sehingga menimbulkan beberapa aspek  yang  sedikit bertentangan dengan prinsip tanpa diskriminasi dan berkeadilan. Kata Kunci: Sistem Zonasi, Kabupaten Wonogiri, Diskriminasi, Berkeadilan AbstrActThe purpose of this study was to determine the policies established by the Wonogiri Regency Government in order to implement a zoning system aimed at forming schools that are without discrimination and fair. The results of the study showed that the Wonogiri Regency Policy was regulated through the Decree of the Wonogiri  Regent No.  176 of 2019 concerning  the Determination of the Zonation of New Student Admissions in Kindergartens, Public Primary Schools and Public Middle Schools in the  2019/2020 Academic  Year in which  regulating  the implementation of the zoning system  based on the Neighborhood Association zone. The decision basically has created a school without discrimination and justice, but in its implementation it has not been perfect.  This problem arises  because  the  administrative  area of Wonogiri  Regency has not been included in the zoning, which causes several aspects that are slightly contrary to the principle of non-discrimination and justice. Keywords: Zoning System, Wonogiri Regency, Discrimination, Justice

Abstract

This study examines and discusses the application of Regulation of the Minister of Justice and Human Rights Number 34 of 2016 on City Policy or District Concern for Human Rights. This research is a descriptive legal research that means or raises No. Regulation of the Minister of Justice and Human Rights Number 34 of 2016 on City Policy or District Concerned Human Rights with a qualitative approach. Types of data containing basic materials and secondary legal materials. Techniques used in document studies or interviews, interviews, and interviews. Data analysis techniques data reduction, data presentation, conclusions and verification. The results of this study are in the implementation of Surakarta City Cares for Human Rights for the right to health, the right to education, the rights to women and children, the right to population, the right to housing, and the right to a sustainable environment. The fulfillment of Surakarta City Concerning Human Rights is based on 1) appropriate indicators, structures and processes by filling in the data for documents required for the head of office that must endorse from the Head of the Regional or City Work Unit, the District Secretary or City, the Provincial Secretary discusses and 2) inspections that include arithmetic, validity checks of data identified by marks of approval by the head of the Regional Administrative Work Unit and relevant agencies, the validity of data and supporting documents indicated by the signature of the Regional Secretariat of the Regency or City.

Abstract

Pengembalian kewenangan memutus perselisihan hasil pemilihan kepala daerah kepada Mahkamah Konstitusi berdasarkan Putusan Mahkamah Konstitusi Nomor 85/PUU-XX/2022 bukanlah pilihan yang tepat. Hal ini dikarenakan dalam praktik penyelesaian perselisihan hasil pemilihan di Indonesia selama ini sering kali tidak dapat memenuhi rasa keadilan masyarakat. Penelitian ini merupakan upaya untuk mengetahui keberadaan Badan Peradilan Khusus dalam memutus perselisihan hasil pemilihan kepala daerah berdasarkan Putusan Mahkamah Konstitusi Nomor 85/PUU-XX/2022 dan untuk mengetahui model ideal lembaga penyelesaian perselisihan hasil pemilihan kepala daerah dalam perspektif kelembagaan negara di Indonesia. Penelitian ini merupakan penelitian hukum normatif yang bersifat deskriptif-analitis. Penelitian ini dilakukan dengan menggunakan pendekatan undang-undang, pendekatan kasus, pendekatan komparatif, dan pendekatakan konseptual. Bahan hukum yang digunakan adalah bahan hukum primer dan bahan hukum sekunder dengan teknik pengumpulan bahan hukum menggunakan studi kepustakaan. Bahan hukum yang telah diperoleh selanjutnya dianalisa menggunakan teknik silogisme-deduktif. Berdasarkan penelitian ini, diperoleh hasil bahwa keberadaan Badan Peradilan Khusus dalam memutus perselisihan hasil pemilihan kepala daerah berdasarkan Putusan Mahkamah Konstitusi Nomor 85/PUU-XX/2022 untuk saat ini tidak akan ada karena kewenangan tersebut telah dikembalikan kepada Mahkamah Konstitusi. Akan tetapi, penulis memperoleh pemahaman bahwa Badan Peradilan Khusus merupakan model lembaga penyelesaian perselisihan hasil pemilihan kepala daerah yang ideal dalam perspektif kelembagaan negara di Indonesia. Adapun dalam mekanisme pembentukannya, mentransformasikan Bawaslu menjadi Badan Peradilan Khusus otonom merupakan pilihan yang paling realistis dan konstitusional.

Abstract

This study reviews how the Tunjungmuli Village government regulates and manages village funds obtained from the Central Government. In addition, this study identifies the level of effectiveness of Tunjungmuli Village Fund Management. This research is an empirical research. Has a descriptive analytical research nature with the aim of providing a detailed description or detail supported by a sociological juridical approach. Types and sources of research data used include primary and secondary. Data collection was done by interview and document study. The use of qualitative data analysis techniques produces data in descriptive form. The implementation of the management of Tunjungmuli Village village funds whose use priority is mandated in the Regulation of the Minister of Villages for Development of Disadvantaged Regions and Transmigration Number 13 of 2020 concerning Priority for the Use of Village Funds in 2021, unfortunately, not all indicators can be met by the Tunjungmuli Village Government. But in essence, most of the predetermined indicator points have been well fulfilled by the Tunjungmuli Village Government. In managing its village funds, the Tunjungmuli Village Government has been able to effectively realize the village funds that have been obtained. The realization of village funds in Tunjungmuli Village is divided into four (4) areas of implementation, namely the field of village administration, the field of implementation of village development, the field of community empowerment, and the field of disaster, emergency and urgent management.
