Res Publica: Jurnal Hukum Kebijakan Publik is a peer-reviewed journal published by Constitutional Law Department, Faculty of Law, Universitas Sebelas Maret three times a year in April, August, and December. This Journal aims primarily to facilitate scholarly and professional discussions over current developments on legal issues in Indonesia as well as to publish innovative legal researches concerning constitutional law and democracy. It provides immediate open access to its content on the principle that making research freely available to public support a greater global exchange of knowledge. Published exclusively in English and / or Bahasa Indonesia (will be considered), the Review seeks to expand the boundaries of Indonesian legal discourses to access English-speaking contributors and readers all over the world. The scope of the articles published in this journal deal with a broad range of topics in the fields of constitutional law and democracy. Abstract

This study aims to determine the implementation of internet’s cafe licensing based on Surakarta City Regional Regulation Number 4 of 2016 concerning the operation of internet cafes related to control pornography. The research method used is a type of empirical legal research with the nature of descriptive research. The research approach used is a qualitative approach with research locations in the Surakarta City Government. The type and source of research data is divided into primary data and secondary data with data collection techniques consisting of interview techniques and literature study. Data analysis techniques used are qualitative analysis techniques. Based on the results of the research that the author did, it was known that the implementation of internet cafe business licensing related to pornography control was classified into 2 main aspects namely procedural aspects related to the implementation of licensing carried out by the Investment and Integrated Licensing Agency of Surakarta City Government (BPMPT) with various terms and conditions and Substantive aspects relating to the supervision of internet cafe businesses related to pornography control with technical requirements carried out by the Department of Transportation, Communication and Information of Surakarta City (Dishubkominfo).

Abstract

Penelitian ini merupakan upaya mendeskripsikan dan mengkaji permasalahan, pertama implementasi Peraturan Daerah Kabupaten Sijunjung Nomor 2 Tahun 2013 tentang Perlindungan Anak. Kedua faktor pendukung  dan  faktor  penghambat  Pemerintah  Kabupaten  Sijunjung dalam mengimplementasikan Peraturan Daerah Kabupaten Sijunjung Nomor 2 Tahun 2013 tentang Perlindungan Anak dalam rangka penerapan  kabupaten/kota  layak  anak  di  Kabupaten  Sijunjung.  Metode  penelitian  yang  digunakan adalah metode penelitian non-doktrinal atau penelitian empiris dengan menggunakan sifat penelitian deskriptif. Adapun pendekatan yang digunakan adalah pendekatan kualitatif. Dalam teknik ini peneliti cenderung  untuk memilih informan yang dianggap  mengetahui  informasi  dan  masalahnya  secara mendalam dan dapat dipercaya untuk menjadi sumber data yang akurat. Hasil penelitian menunjukkan bahwa   terdapat  beberapa   permasalahan  yang  belum   dipenuhi   oleh  Kabupaten   Sijunjung  dalam mengimplementasikan   Peraturan   daerah   Kabupaten   Sijunjung   Nomor   2   Tahun   2013   tentang Perlindungan  Anak  seperti  pelanggaran  terhadap  hak-hak  anak  dan  pemenuhan  hak  anak  belum terlaksana sebagaimana seharusnya dengan berbagai macam kendala seperti belum ada regulasi khusus terkait  pengembangan kebijakan kabupaten layak  anak,  kendala  kesadaran  masyarakat,  dan  kendala fasilitas serta instrumen dari pemerintahan. Oleh karena itu, perlu adanya keseriusan dan fokus yang diberikan   Pemerintah    Kabupaten    Sijunjung    dengan    segera    mengeluarkan   Peraturan    Daerah, menjalankan Rencana Aksi Daerah (RAD)  Kabupaten/Kota  Layak  Anak  dan  monitoring terkait  Gugus tugas Kabupaten/Kota Layak Anak Kabupaten Sijunjung dalam melaksanakan tugas pokoknya.

Abstract

ABSTRACTThis study aims to determine how the requirements for nominating a member of the Regional Representative Council and the consideration of judges in passing Decision Number 30 / PUU-XVI / 2018. The results of the research show that the requirements for nominating members of the Regional Representative Council are as stipulated in Article 182 of Law Number 7 of 2017 concerning General Elections and the consideration of Judges in the Decision of the Constitutional Court Number 30 / PUU-XVI / 2018, violating 2 (two) principles attached to the Constitutional Court’s post, namely the erga omnes principle and the legislative negative principle.Keywords: constitutional court; regional representative council.

Abstract

This study describes and examines the problems of: firstly how the implementation of usage management priority of the village funds, especially in Laban Village the Sub-district of Mojolaban of Sukoharjo Regency in 2017, secondly what are the obstacles that occur in the process of implementing the use of Village. This study is the type of empirical legal research. Sources of data in this study using primary data sources, and secondary data sources. The techniques of data collections are from interview and observation techniques, from data that has been collected, then will be analyzed.The results of this research indicate that implementation of usage management priority of the village fund in 2017 is focused on the development of basic infrastructure, such as road construction, culverts, ducts, and dams. The budget of the Village Fund in 2017 had not been used for community empowerment. Obstacles that occur in the usage of Village Funds such as: the level of community participation in the planning stage is less than maximum, the liquefaction stage is delayed because arrangment of the APBDes is too long, the implementation stage is not accordance with the Village Ministerial Regulation Number 22 Year 2016 about implementation of usage management priority of the village fund in 2017, lack of community to oversee the usage of the Village Fund, and inadequate human resources in making accountability reports.

Abstract

Gagasan-gagasan untuk menunda Pemilu Serentak 2024 yang disuarakan oleh beberapa pejabat publik dan petinggi Partai Politik perlu dikaji konstitusionalitasnya. Alasan yang mereka ajukan untuk menunda Pemilu adalah bahwa saat ini kondisi perekonomian negara masih pada masa-masa pemulihan pasca dihantam pandemi Covid-19 sejak awal tahun 2020 lalu. Mereka beranggapan bahwa penyelenggaraan Pemilu Serentak 2024 akan mengganggu momentum pemulihan perekonomian dan mengganggu agenda pembangunan seperti IKN. Penelitian ini dilakukan untuk mengkaji mengenai, pertama, bagaimanakah praktik penundaan Pemilihan Umum dari perspektif konstitusionalisme. Kedua, Apakah kondisi instabilitas perekonomian negara pasca Covid-19 termasuk kategori “gangguan lainnya” pada Pasal 431 juncto pasal 432 Undang-Undang Nomor 7 Tahun 2017 tentang Pemilihan Umum. Ketiga, Apa saja dampak yang mungkin terjadi apabila dilakukan penundaan Pemilu serentak. Penelitian ini merupakan penelitian deskriptif normatif yang bersifat analitis. Dari hasil penelitian ini, ditemukan bahwa konstitusionalitas penundaan Pemilu pada dasarnya terletak pada terpenuhinya syarat-syarat menunda pemilu yang diatur oleh hukum. Kemudian, alasan instabilitas perekonomian negara pasca covid-19 tidak dapat menjadi alasan untuk menunda Pemilu Serentak 2024 akan tetapi instabilitas perekonomian negara sendiri dapat secara logis menjadi alasan untuk menunda Pemilu. Dampak dari Penundaan Pemilu diantaranya; terganggunya regenerasi kepemimpinan politik, terganggunya penyelenggaraan pemerintahan, dan potensi kemunculan pemerintah otoriter.

Abstract

ABSTRACTThis research aims to find out how was the management of Village Fund at Toriyo village in Bendosari sub-district of Sukoharjo District in supervision of the Village Fund Allocation in accordance with Law Number 6 of 2014 concerning Villages. Based on Government Regulation No 60 of 2014 juncto Government Regulation No. 8 of 2016 about Village Fund sourced from State Budget and Expenditure as well as analyze the obstacles that arise in the management of the Fund. The author of this research choose the empirical legal research with descriptive character using qualitative approach, research method that generates descriptive analytical data that is stated by the respondents according to their writing or orally also real behavior, that is researched and studied as a whole. This research uses the secondary and primary sources. While the sources collection technique carried out trough  interview and observation. Considering the result of research and discussion, it could be stated that the management of Village Fund at Toriyo village in Bendosari sub-district of Sukoharjo District were appropriate with the applicable law, but it still have obstacles that occurred because of the late report from the country side which got the stimulants fund of Village Fund at Toriyo village. The late report occurred because of the country side people still unfamiliar with the existence of Village Fund. So that, a socialization concerning on technical management of the Village Fund is needed. This socialization purpose is to adjust the implementation of the applicable Law concerning on Village Fund Management.Keywords : management; village fund; development.

Abstract

This study analyzes the implementation of Ministerial Regulation of Village, Acceleration Development Backward Regions, and Transmigration Number 19 of 2017 Related The Priorities of the Village Funds Usage in bakipandeyan village, baki District, Sukoharjo Regency in 2018 and obstacles faced by village goverment. This legal research is an empirical and descriptive study with a qualitative approach. Sources of legal material in the form of primary and secondary legal materials. Legal material collection techniques are interviews with data reduction analysis techniques, data presentation and conclusions and verification. The results of the study show that the implementation of priority management of village fund use in Bakipandeyan village has been running well and in accordance with the provisions outlined in 5 stages, namely planning; distribution, realization, supervision and guidance, reporting and accountability of village funds. However, at the planning stage, the determination of the priority use of village funds is not fully appropriate because it only sets one priority, namely in the field of village development. Constraints faced include human resources in the village government apparatus that are less competent, delays in the distribution of village funds, differences in the expensiveness index of construction of districts and villages, the low work ethic of the community; village government agenda’s outside village development, and natural conditions.

Abstract

This study examines how the implementation of command accountability in the military on gross human rights violations. This research is normative legal research is prescriptive. Types of legal materials include primary and secondary legal materials. Primary Legal Material: NRI Constitution 1945, Law No. 39 of 1999 on Human Rights, Law No. 26 of 2000 on Human Rights Courts, Association of Decisions pn, PT, MA in human rights cases. Secondary legal material: Textbooks written by legal experts, legal journals, research in the form of thesis and thesis, and scientific papers. The technique of collecting legal materials is obtained through literature studies through complaint report data, books, journals, and also directly through interviews. The results showed that the application of command responsibility in the military to gross human rights violations in Indonesia applies to crimes of genocide and crimes against humanity. The application of command accountability in the military to gross human rights violations in Indonesia is tried and decided based on the relationship between superiors and subordinates, between the perpetrator and the accused who has fulfilled the elements of involvement, relationship, and knowledge of the commander who has the authority to commit crimes committed by his subordinates. So if these elements are not met then one cannot be criminally prosecuted based on the doctrine of command responsibility.

Abstract

The local elections with a single candidate elections to elect regional heads who followed only one pair of candidates only / single candidate. This study aims to determine how the voting mechanism in the implementation of the local elections with a single candidate against the order of the Constitutional Court Number 100 / PUU-XIII / 2015. In this  study the authors will solve the problem regarding the enactment of a new voting mechanism in the implementation of the local elections with a single candidate. This research is a normative legal or commonly called the doctrinal legal research done by researching library materials or secondary data consists of primary legal materials, secondary law and tertiary legal materials. Primary legal materials consist of legislation, notes the official records, the minutes in the making of legislation and the decision of the judge's decision. As for the secondary law in the form of all the publicity about the law which is not an official documents. The results of research and discussion to explain that after the decision of the Constitutional Court Number 100 / PUU-XIII / 2015 there is a new mechanism of voting in local elections with a single candidate by selecting "agree" or "disagree" on a single candidate head area.

Abstract

Badan Permusyawaratan Desa (BPD = The Villager Consultative Council) is democratic institution in a village. Since the law of Number 6 Of 2014 about village is applied, the position of The Villager Consultative Council has government function. The members of The Villager Consultative Council is representative of peoples of the village based on representation of the region which has been applied by the conference.From the result of the research and the discussion, a conclusion could be drawn that the role of The Villager Consultative Council in supervising government village to achieve good government exist in Pasal 55 and Pasal 73 The Law Number 6 of 2014 about village. That the role of Badan Permusyawaratan Desa is discussing and approving Rancangan Peraturan Desa with the Village Chief, accommodating and distributing peoples’ aspiration, supervising the Village Chief’s performance and forming Rancangan Anggaran Pendapatan dan Belanja Desa with the Village Chief.
