Res Publica: Jurnal Hukum Kebijakan Publik is a peer-reviewed journal published by Constitutional Law Department, Faculty of Law, Universitas Sebelas Maret three times a year in April, August, and December. This Journal aims primarily to facilitate scholarly and professional discussions over current developments on legal issues in Indonesia as well as to publish innovative legal researches concerning constitutional law and democracy. It provides immediate open access to its content on the principle that making research freely available to public support a greater global exchange of knowledge. Published exclusively in English and / or Bahasa Indonesia (will be considered), the Review seeks to expand the boundaries of Indonesian legal discourses to access English-speaking contributors and readers all over the world. Novelty and recency of issues, however, is a priority in publishing. The scope of the articles published in this journal deal with a broad range of topics in the fields of constitutional law and democracy. Res Publica is an open access journal which means that all content is freely available without charge to the user or his/her institution (for libraries or individual). Abstract

This article examines the constitutional regulation of the right to food in Indonesia and Brazil by situating food as an economic, social, and cultural right inseparable from human dignity, survival, and welfare. Central issue is the contrast between Indonesia’s implicit constitutional model, in which the right to food is derived from the rights to life, decent livelihood, and physical and spiritual welfare under the 1945 Constitution, and Brazil’s explicit model, which incorporates food as a social right under Article 6 of the 1988 Federal Constitution after Constitutional Amendment No. 64 of 2010. This study employs normative legal research through statutory, case, comparative, and conceptual approaches. The analysis shows that both states embrace a welfare-state orientation and recognize the protection, promotion, and fulfilment of human rights as a constitutional responsibility of the state. However, Brazil’s explicit formulation provides a stronger basis for justiciability and direct constitutional enforcement, as illustrated by ADPF 709 concerning the Yanomami Indigenous community. By contrast, Indonesia’s implicit formulation allows broader constitutional interpretation and policy flexibility, yet weakens the enforceability of the right to food because the issue is often treated as administrative policy rather than a directly claimable constitutional right. The article argues that Indonesia needs a clearer constitutional or judicial construction of the right to food, supported by minimum standards, complaint mechanisms, and institutional accountability. Such reform is necessary to ensure that access to adequate, safe, and nutritious food is protected not merely as a policy objective, but as an enforceable constitutional entitlement for vulnerable groups.

Abstract

The amendments to the 1945 Constitution of the Republic of Indonesia not only restructured the distribution of state power but also reconstructed the national representation system into a pseudo-bicameral model. This model convenes the House of Representatives (DPR) and the Regional Representative Council (DPD) within a single forum, namely the People's Consultative Assembly (MPR), characterized by an asymmetrical distribution of authority. Theoretically, this institutional design presents significant challenges within the framework of representative constitutionalism and deliberative democracy, particularly concerning the quality of territorial representation and the scope of constitutional deliberation. This study aims to analyze the construction of the DPR-DPD relationship within the pseudo-bicameral system and its implications for the deliberative function, the appointment to constitutional offices, and constitutional amendments. Employing a normative legal research methodology, this study utilizes statute, conceptual, and historical approaches. The findings reveal that the dominance of the DPR and the constrained authority of the DPD have resulted in the reduction of the MPR's deliberative function and the erosion of the equilibrium among representative elements. This asymmetric structure generates a tension between the principle of constitutional supremacy and the imperative for inclusive democratic legitimacy. Consequently, strengthening the role of the DPD through a limited constitutional amendment or the reconstruction of the MPR's internal mechanisms constitutes a normative prerequisite for establishing a more deliberative and constitutionally robust representation system.

Abstract

The open proportional representation system currently used in elections for members of the People’s Representative Council in Indonesia is considered not yet fully capable of strengthening the representative relationship and public accountability between the people and their representatives. This situation has spurred a discourse on electoral reform, one aspect of which involves the implementation of a district-based electoral system. This study aims to analyze the compatibility of the district-based electoral system with the principle of popular sovereignty, as well as the possibility of changing the electoral system in accordance with the 1945 Constitution of the Republic of Indonesia, while also examining the relevance of the district-based electoral system as an alternative for electoral reform in Indonesia. This study is a normative legal study employing both a statutory and a conceptual approach. The legal materials used consist of primary and secondary legal sources, which were analyzed qualitatively. The results of the study indicate that the district electoral system does not conflict with the principle of popular sovereignty because popular sovereignty is, in essence, realized through a representative system that guarantees political representation and accountability. Furthermore, the 1945 Constitution of the Republic of Indonesia does not prescribe a specific electoral system model; therefore, changes to the electoral system fall under the legislature’s open legal policy. This study also found that the district electoral system has the potential to strengthen representation and public accountability compared to the open proportional system. Although each variant has its own advantages and disadvantages, the Two-Round System is a viable alternative worth considering in the context of Indonesia’s pluralistic society.

Abstract

The relocation of the capital from Jakarta to the Nusantara is a strategic policy with fundamental implications for Indonesia's constitutional architecture. Law No. 3 of 2022, as amended by Law No. 21 of 2023, established the IKN Authority, a sui generis ministerial-level institution granted special regional government authority and placed directly under the President. This hybrid position combines the functions of the central and regional governments, creating conceptual and practical challenges related to the distribution of authority, public accountability, and checks and balances. This study aims to analyze the existing mechanisms of relations between state institutions and the IKN Authority and formulate an ideal concept for realizing constitutional governance. Using normative legal research methods with legislative, conceptual, and comparative approaches, the study examines patterns of institutional relations within the framework of the theory of separation of powers and institutional relations. The results of this study indicate that the current legal design and practice of institutional relations tend to emphasize strategic centralization, which has the potential to create ambiguity of authority and deficits in legislative oversight mechanisms and fiscal accountability. Therefore, it is recommended to strengthen checks and balances through clarification of authority boundaries, increased fiscal and administrative accountability, and harmonization of inter-institutional norms to ensure the implementation of the IKN is accountable, transparent, and in accordance with the principles of the rule of law.

Abstract

The non-procedural dismissal of Constitutional Court Justice (CCJ) Aswanto by the House of Representatives demonstrates a serious threat to judicial independence and reveals fundamental problems in the system of judicial recruitment. This study employs normative legal research. The issues examined concern how a CCJ can be dismissed non-procedurally during an active term and replaced through an equally flawed mechanism, as well as how weaknesses in the recruitment system and ethical oversight contribute to such practices. This research applies a normative, case-based, and conseptual approach. The Constitutional Court Law, and the cases surrounding the dismissal of Aswanto and the appointment of Guntur Hamzah, including the decision of the Honorary Council of the Constitutional Court (MKMK) which confirmed a violation of integrity values. The findings indicate that Aswanto dismissal lacked a solid legal basis, weakened judicial independence, and potentially violated the principle of legal certainty. The appointment of the replacement justice was also procedurally defective and adversely affected the legitimacy and independence of the Constitutional Court (MK). Accordingly, the root problem lies in the misinterpretation of the Constitutional Court Law, necessitating a reconstruction of the judicial selection mechanism and the strengthening of ethical oversight of CCJ.

Abstract

This study analyzes the settlement of serious human rights violations by Komnas HAM in terms of its authority to the East Timor case studies. This study is a prescriptive normative law that aims to analyze the effectiveness of the authority of Komnas HAM in the resolution of serious human rights violations and provide solutions for problems that were examined by the author. This study uses primary data in the form of an investigation report of the East Timor Human Rights Violation Investigation Commission and secondary data in the form of primary legal materials and secondary law. Data collected through library research to find secondary data using primary legal materials, secondary, and tertiary. In writing this law, the writer uses the statutory approach, the concept approach, the case approach, and the historical approach. The results of this study show that the authority of Komnas HAM to be ineffective causing delays resolution of cases of serious human rights violations in Indonesia, which according to the author due to the weak legitimacy of institutions, lack of subpoena authority of Komnas HAM and disharmony with the Attorney General.

Abstract

Gross human rights violations in Indonesia have persistently faced structural obstacles, particularly due to the limited authority of the National Commission on Human Rights (Komnas HAM) and the dominant role of the Attorney General’s Office (Jaksa Agung). Although Komnas HAM is constitutionally mandated to conduct inquiries into gross human rights violations, its findings often fail to translate into effective prosecution, as evidenced by the practice of indicting only individual perpetrators while neglecting structural or command responsibility. This condition not only weakens inter-institutional coordination but also undermines accountability for gross human rights violations. This paper aims to analyze the institutional design governing Komnas HAM’s authority in handling gross human rights violations and to examine how the imbalance of power between Komnas HAM and the Attorney General’s Office (Jaksa Agung) affects the effectiveness of the human rights justice process. The study further seeks to formulate a model for strengthening Komnas HAM’s independence to ensure meaningful accountability. This research employs a normative juridical method with a statutory, conceptual, and case-based approach, focusing on Law No. 39 of 1999 on Human Rights and Law No. 26 of 2000 on Human Rights Courts, as well as selected gross human rights cases adjudicated in Indonesia. The findings indicate that Komnas HAM’s subordinate position in the criminal justice process contributes to fragmented prosecutions and the non-fulfillment of victims rights. Accordingly, this paper argues for institutional reform through the enhancement of Komnas HAM’s authority and procedural standing to strengthen accountability mechanisms for gross human rights violations in Indonesia.

Abstract

Keniscayaan atas keterbukaan informasi dan akses komunikasi merupakan hak masyarakat yang dilindungi negara dan konstitusi. Kedua hal tersebut juga merupakan implementasi nyata nilai-nilai demokrasi secara langsung yang dapat dirasakan oleh masyarakat selain pemilihan umum yang dilaksanakan tiap periodenya. Undang-Undang Nomor 40 Tahun 1999 tentang Pers tentu hal tersebut bukanlah persoalan yang remeh, karena mengingat pemaknaannya sebagai gambaran “harga diri” pers Indonesia. Selain itu Undang-Undang Nomor. 40 Tahun 1999 tentang Pers juga menjadi dasar pers dan kegiatan jurnalistik di Indonesia. Dengan adanya penelitian ini, penulis berharap permasalahan akan jati diri pers di Indonesia dapat terjawab dengan memahami Kembali harkat martabat pers Indonesia yang terkandung dalam Undang-Undang Nomor 40 Tahun 1999. Adapun metode penelitian yang digunakan adalah penelitian yuridis-empiris dengan pendekatan perundang-undangan dan pendekatan konseptual. Dalam pembahasannya, penulis menemukan bahwa terdapat sejumlah permasalahan dalam yang terjadi dalam kegiatan pers dan jurnalistik di Indonesia. Permasalahan tersebut disebabkan oleh tiga faktor, yakni disrupsi teknologi, konglomerasi media massa dan minimnya kualitas sumber daya manusia wartawan di Indonesia.

Abstract

Penelitian ini merupakan upaya mendeskripsikan dan mengkaji permasalahan, pertama implementasi peraturan daerah kabupaten karanganyar nomor 12 tahun2018 tentang penyandang disabilitas dalam Pemenuhan Hak Aksesibilitas). Kedua Faktor Keberhasilan Serta Hambatan Implementasi Pada Peraturan Daerah Kabupaten Karanganyar Nomor 12 Tahun 2018 tentang Penyandang Disabilitas terkhususnya Pemenuhan Hak Aksesibilitas. Penelitian ini adalah penelitian hukum non-doktrinal atau penelitian socio-legal dengan menggunakan sifat penelitian deskriptif. Jenis data yang digunakan adalah sumber data primer dan sumber data sekunder. Pengumpulan data primer dilakukan dengan teknik wawancara dan observasi. Sumber data sekunder meliputi bahan hukum primer, sekunder, dan tersier. Dalam teknik ini peneliti cenderung untuk memilih informan yang dianggap mengetahui informasi dan masalahnya secara mendalam dan dapat dipercaya untuk menjadi sumber data yang akurat. Hasil penelitian menunjukan bahwa dalam kualitatif kerangka peraturan perundang-undangan dan kelembagaan pemenuhan hak aksesibilitas bagi Penyandang Disabilitas telah dilaksanakan oleh Pemerintah Kabupaten Karanganyar melalui Peraturan Daerah Nomor 12 Tahun 2018 tentang Penyandang Disabilitas meskipun dapat dikatakan belum maksimal dengan kendala-kendala yang ada yang meliputi belum adanya peraturan daerah yang membahas pemenuhan hak Penyandang Disabilitas, kendala kesadaran masyarakat serta pemerintah.

Abstract

Putusan Mahkamah Konstitusi (MK) No. 22/PUU-XV/2017 mengakibatkan terbitnya Undang-Undang Nomor 16 Tahun 2019 tentang perubahan atas UU Nomor 1 Tahun 1974 tentang Perkawinan. Undang-undang ini menetapkan batasan usia minimal untuk kawin adalah 19 tahun baik untuk laki-laki maupun perempuan. Perubahan ini dianggap sebagai langkah maju dari Pemerintah Indonesia dalam menanggulangi praktik perkawinan anak. Namun, hingga saat ini Indonesia masih menghadapi tantangan dalam menurunkan angka perkawinan anak yang tercermin dari peningkatan jumlah dispensasi nikah yang diberikan setelah peningkatan usia batas perkawinan tersebut. Studi ini bertujuan untuk mengkaji implikasi Putusan MK No. 22/PUU-XV/2017 terhadap Hak Asasi Anak terkait pengaturan batas usia kawin. Penelitian ini akan menganalisis apakah peningkatan usia minimal untuk kawin, sebagaimana yang diatur oleh Undang-Undang Nomor 16 Tahun 2019 tentang Perubahan UU Nomor 1 Tahun 1974 tentang Perkawinan, merupakan langkah yang efektif dalam melindungi Hak Asasi Manusia, khususnya Hak Asasi Anak dari praktik perkawinan anak. Metode penelitian hukum ini termasuk ke dalam jenis penelitian hukum normatif yang bersifat deskriptif analitis. Pendekatan yang digunakan penulis adalah pendekatan perundang-undangan, pendekatan kasus dan pendekatan konseptual. Jenis dan sumber bahan hukum yang digunakan dalam penelitian ini meliputi bahan hukum primer dan bahan hukum sekunder. Teknik pengumpulan data dilakukan dengan studi kepustakaan. Teknik analisis bahan hukum menggunakan metode silogisme dengan pola pikir deduktif. Hasil dari penelitian ini adalah Undang-Undang Nomor 16 Tahun 2019 telah menaikkan batasan usia minimal untuk kawin menjadi 19 tahun baik untuk laki-laki maupun perempuan, implementasi undang-undang ini belum sepenuhnya mampu mengubah norma sosial terkait perkawinan dini yang telah tertanam dalam masyarakat.
