Jadwal penerbitan setahun 4 (empat) kali pada bulan Maret, Juni, September dan Desember. Abstract

Threatening crimes are very easy to commit, moreover with modern means accessible, very common for someone to threaten someone by pressure, these threats can lead to death. Criminal sanctions against perpetrators of electronic media intimidation are based on Act No. 19 of 2016 on electronic information and transactions and criteria that determine the presence of threats through electronic media. This research uses normative jurisprudential methods, methods that point research to library data, or secondary data through legal foundations and legal comparisons. As regards the form of criminal sanctions for perpetrators of intimidation contained in Article 27 of the Act No. 19 of 2016 on Amendment of the Law No. 11 of 2008 on Electronic Information and Transactions, it is regulated in Article 29 jo. Article 45B of the law No. 11, 2008 on electronic information and transactions as amended by the Act no. 19 from 2016 on amendment to the Act of 11 of 2008.

Abstract

Islamic law does not recognize special marriage registration. In Islamic law, marriage registration is not referred to as one of the elements or conditions of marriage. In the days of the Prophet Muhammad SAW, there were no terms for recording marriages. An eligible marriage and a marriage ceremony are considered legitimate. This research uses a library method, which means that this research looks at the theories, concepts, and provisions of Islamic sharia'at related to the problem being studied. The istinbath qiyas method associates marriage recording with verse 282 of Surah al-Baqarah, which states that when a person makes a transaction, they must write it down. It's because with this record, people can avoid problems that may occur in the future if a denial occurs.

Abstract

Sexual violence is a pressing legal issue because it concerns the human rights of victims and causes serious physical and psychological damage. In Indonesia, cases of sexual violence against children continue to rise, yet many victims still choose to remain silent and do not report the incidents to law enforcement authorities or child protection agencies. This reality has prompted research to examine the extent of the implementation and effectiveness of legal protection for child victims of sexual violence in Palembang City based on Law No. 35 of 2014 on Child Protection. The research was conducted using a qualitative method through a legal-empirical approach, combining literature review and direct interviews with relevant parties. The research findings are expected to provide an overview of legal protection practices while identifying the factors that contribute to the occurrence of sexual violence against children.

Abstract

Investigators exercise discretion to help resolve a traffic violation case where the suspect did so because of negligence that caused injury to others. Weird problems arise as a result of this discretionary act. On the one hand, this discretionary act involves the application of criminal law carried out in accordance with its own policies to make rigid laws effective. All parties have an opportunity to know their position as a legal consequence of the choice of investigators in a traffic crime case. The party committing the violation will compensate the victim for material damage and medical costs. The increased knowledge of discretion by an investigator that is not based on the rule of law means that it is against the law.

Abstract

People's contribution tax to the state treasury is based on the law without receiving any direct merit (contra-performance) which can be directly demonstrated and which is used to pay for public expenses. Tax crime by adding fictitious costs. Making a management contract with a group company abroad incurs management fees/technical fees/consultant costs. But actually, no service is performed. Then, to pay off the management fee/technical fee/consultant fee, funds will be transferred from the company account to the group company account abroad. The company will make costs or receipts where no costs are actually incurred, then the fictitious financing money will be transferred from the company to a temporary escrow account which will then be distributed to shareholders. By making a hedging or wash-out contract with a backdated date, the Taxpayer (WP) will always suffer a loss in the hedging or wash-out. Repayment of hedging/wash out losses will be transferred from the company account to the group company account abroad.

Abstract

Islamic inheritance is the law that regulates the transfer of inheritance rights (tirkah) of heirs, determining who has the right to become heirs and how much each person will share. Polygamy is defined as a marriage in which a man has more than one wife. What is problematic in polygamous marriages is the distribution of inheritance. Where when the husband dies and leaves property, the wife's rights also include the wife's rights which must be distributed fairly. Islamic inheritance law basically does not recognize or recognize the concept of joint property itself, this is because there are no provisions in either the Qur'an or hadith. Meanwhile, positive law has not implemented the provisions contained in Islamic law itself.

Abstract

As a result of the fact that Indonesian people generally own private vehicles, many vehicle dealers, both cars and motorcycles, offer low selling prices to the public, which indirectly causes the public's desire to own vehicles. By buying this car, you can meet all your needs for fast, easy, and personally accessible transportation. Normative law research used. Governments and police should regularly socialize traffic laws and traffic regulations in places like schools and in media such as newspapers, television, and radio. In order to ensure that the handling of traffic violations is smooth and running as expected, the Traffic Police is expected to improve its performance and pay more attention to the quality and quantity of staff.

Abstract

Advances in science and technology have made it easier to establish relationships between individuals, nations, and even countries. These interactions often lead to mixed marriages, both between couples of different nationalities and between workers from different countries. However, mixed marriages often present challenges, especially when it comes to registering the marriage, which can be confusing: should it be done in the husband's or wife's country of origin? Additionally, differences in nationality and cultural backgrounds frequently lead to conflicts within the household, which in some cases result in divorce. This situation directly impacts the children of mixed marriages, particularly regarding their nationality status and legal protection of their rights.

Settlement of consumer disputes in the General Courts is by filing lawsuits and examining evidence in court while settlement of consumer disputes outside the Court is by settlement of immediate (direct) compensation by peaceful means and claims for compensation through the Consumer Dispute Settlement Agency (BPSK).
