Abstract

Law enforcement requires every member of society to comply with applicable norms and regulations as guidelines for conduct. In Indonesia, the high rate of traffic violations and accidents is influenced by low public awareness of the law. Drivers who flee when they are about to be ticketed are generally driven by fear or because they do not meet administrative and technical vehicle requirements, such as not having complete documents, not wearing a standard helmet, having a vehicle that is not roadworthy, or being involved in other criminal acts. Such actions are punishable under Article 216 of the Criminal Code. Therefore, the police need to increase public awareness about driving safety and compliance by involving various elements of society, as well as enforcing the law firmly, consistently, and without discrimination in order to achieve traffic order and safety.

Abstract

Intellectual property rights now function not only to protect individual rights but also to regulate knowledge, culture, innovation, and benefit-sharing in the creative and digital economy era. In Indonesia, the protection of traditional knowledge and traditional cultural expressions has become increasingly important due to the high risk of misappropriation, unauthorized reproduction, and unfair commercialization. This article analyzes the legal protection issues concerning the intellectual property of indigenous and traditional communities and evaluates the adequacy of the existing national legal framework. The study shows that the current regulations remain fragmented across various legal instruments and have not yet formed a comprehensive protection system. Conventional IPR regimes are also not fully capable of accommodating the communal, intergenerational, spiritual, and social characteristics inherent in traditional cultural objects. Therefore, legal reform is needed toward a more substantive, participatory, and culturally just approach.

Abstract

Witness testimony is a crucial element in uncovering material truth in criminal proceedings. However, the practice of providing false testimony under oath remains a serious challenge that undermines the integrity of the justice system and obstructs the achievement of justice. This study analyzes the legal position of witnesses and compares sanctions for false testimony from the perspectives of Indonesian Positive Law and Islamic Criminal Law. The research employs a qualitative method with normative-juridical and comparative approaches through literature review. The findings indicate that under Indonesian Positive Law, witnesses are recognized as primary procedural evidence regulated by the Criminal Procedure Code (KUHAP), and providing false testimony is punishable by seven to nine years of imprisonment (Article 242 of the Criminal Code) as a form of obstruction of justice. In Islamic Criminal Law, testimony emphasizes the moral integrity (‘adalah) and piety of the witness; false testimony is classified as a major sin (kabirah) and jarimah ta’zir, with sanctions applied flexibly at the discretion of the judge or ruler to restore victims’ rights and social order. Both systems agree that false testimony harms public justice, yet Positive Law emphasizes formal-repressive aspects and secular legal certainty, whereas Islamic law integrates moral, religious-ethical dimensions and spiritual accountability before God. In conclusion, strengthening law enforcement mechanisms and raising witnesses’ legal awareness are essential to ensure a dignified and transparent justice system.

Abstract

This study examines the synchronization of Indonesia’s Archipelagic Sea Lanes policy with international shipping safety standards. ALKI serves as a strategic route for foreign vessels and aircraft exercising the right of archipelagic sea lanes passage under UNCLOS 1982. However, national regulations still place greater emphasis on passage rights, foreign vessel obligations, and the protection of state sovereignty, while shipping safety aspects have not been regulated in an integrated manner. This study uses a normative legal method with statutory and conceptual approaches. The legal materials analyzed include UNCLOS 1982, SOLAS 1974, COLREG 1972, the SAR Convention 1979, IMO standards, and relevant national regulations on ALKI. The findings show that ALKI policy needs to be strengthened through the synchronization of norms on navigational safety, collision prevention, ship reporting systems, vessel traffic services, search and rescue, and inter-agency coordination. This synchronization is essential so that ALKI does not merely function as an international passage route, but also as a legal instrument to ensure shipping safety, protect sovereignty, and preserve Indonesia’s marine environment.

Abstract

The revision of Indonesian criminal law from the WvS to the National Criminal Code (KUHP) certainly has several implications for the Indonesian legal world, one of which is the transition process from the old rules to the new rules. This uses a principle that already exists in both the WvS and the National Criminal Code, known as lex favor reo, which states that if there is a change in the rules, the one that benefits the defendant is the one that is applied. This principle is transitional in nature, serving as a bridge between the effectiveness of one criminal law and the newly enacted criminal regulations. This was directly considered by the judge in the Nadiem corruption case involving the procurement of Chromebook Chrome Device Management laptops, which caused the state to suffer financial losses of Rp2.18 trillion. The state losses were detailed as consisting of Rp1.56 trillion for the education digitization program and US$44.05 million, or Rp621. 39 billion, so it is necessary to look at how the principle of lex favor reo is applied in Indonesian criminal law. This study uses normative juridical research by tracing primary and secondary legal materials, which are analyzed descriptively. The results of the study show that the principle of lex favor reo in the WvS and the new Criminal Code has been regulated and has a clear position, and in the Nadim corruption case, the panel of judges will consider the application of this principle, bearing in mind that its application must be relevant to the facts presented in court.

Abstract

Nowadays, dental technicians also perform procedures outside their scope of practice, such as installing braces, teeth whitening, and dental veneers; this often leads to undesirable consequences such as prolonged pain, infection, cancer, and death. This study aims to examine the legal perspective on dentists’ actions beyond their scope of practice, along with their criminal liability under Law No. 1 of 2023 on the Criminal Code. Using a normative legal research method, the results indicate that the legal perspective on dentists’ actions beyond their scope of practice—such as IBG, IBG, and EPBG are unlawful and constitute a violation of the law; and that dental technicians who act negligently may be charged under Articles 474 and 475 of the National Criminal Code.

Abstract

The development of the juvenile criminal justice system in Indonesia has shifted from a retributive to a restorative approach through the implementation of diversion as regulated under Law Number 11 of 2012 concerning the Juvenile Criminal Justice System. In practice, however, diversion decisions are not always accepted by the parties involved, giving rise to the need for a legal mechanism known as verzet, which remains unclear in positive law. This study aims to analyze the legal status of verzet against diversion decisions, its procedural mechanism, and the juridical and practical obstacles encountered in its application. The research employs a normative legal method with statutory and conceptual approaches, using qualitative analysis of primary, secondary, and tertiary legal materials. The findings indicate that the legal status of verzet is still ambiguous due to the absence of explicit legal basis, while its procedural mechanism lacks standardized guidelines and is applied interpretatively in practice. Additionally, obstacles include normative gaps and conceptual conflicts juridically, as well as limited understanding among law enforcement officers and societal legal culture practically. Therefore, comprehensive regulation on verzet is necessary to ensure legal certainty while upholding the principles of child protection within the juvenile criminal justice system in Indonesia.

Abstract

One of the institutions that has an important role in handling cases of violence against women and children, including rape cases, is the Women and Children's Service Unit which is under the auspices of the Republic of Indonesia National Police. How is the Role of the Women and Children's Service Unit in Handling Rape Cases Involving Children in Accordance with Law Number 35 of 2014 concerning Child Protection? The research method used is the type of research and normative legal approach. The role of the Women and Children's Service Unit in providing legal protection to rape victims in accordance with Law Number 35 of 2014 concerning Child Protection is to encourage victims to participate in the investigation and prosecution process through regulations / procedures that create a sense of physical and psychological security, reduce trauma experienced by victims, protect victims from violence and retaliatory attacks from the perpetrator or the perpetrator's family, resulting in punishment for those guilty of committing crimes. Recommendations, the Women and Children's Service Unit needs to build a stronger network of cooperation with related agencies, such as the Integrated Service Center for the Empowerment of Women and Children (P2TP2A), social services, and hospitals.

Abstract

Public demand for security and protection continues to increase along with growing social, economic, health, and occupational risks. Insurance serves as an important instrument for transferring risk to another party through a protection mechanism, including conventional insurance, sharia insurance, and life insurance. In the employment context, social protection plays a crucial role in maintaining workers’ welfare, improving work motivation, and supporting national productivity. The enactment of Law Number 24 of 2011 concerning the Social Security Administering Body marked an institutional transformation in Indonesia’s social security system, including the conversion of Askes into BPJS Kesehatan and Jamsostek into BPJS Ketenagakerjaan. This protection is particularly important for employees of the Palembang City Fire Department because firefighting work carries high risks to safety, health, and life. However, the implementation of social security programs may also create disputes among participants, employers, BPJS, and the government. Therefore, a clear legal mechanism is needed to prevent and resolve disputes effectively, either through litigation or non-litigation procedures. This study emphasizes that social security does not merely function as administrative protection, but also as a legal instrument to guarantee workers’ rights, improve welfare, and provide legal certainty for workers in high-risk occupations.
