Abstract

Disparity in Indonesia has a meaning of distinction, in the Science of law disparity is the difference of ruling that is dropped by judges in the same criminal act, judges in dropping the ruling often occur disparity A verdict in the same case. One of them in the case of narcotics criminal act where there are perpetrators who are in prison and there are perpetrators who are in a rehabilitation ruling in this case a judge must have an understanding and view that a narcotics abuse is a victim that must be healed of a dependency disease. In the proceedings, the judges have the authority to examine and disconnect the judges in the case of a consideration which can be incriminating or alleviating the suspect in order to create justice. The purpose of this research is to know how the authority of a judge in the break of criminal acts and basic consideration of judges so that there is a disparity of verdict in narcotics criminal act. The method used is the type of normative research by conducting a statutory approach, conceptual approach and a case approach analyzed using a systematic technique with a descriptive analytical presented Assisted by the source of the collected legal materials and interpreted. Judge in a narcotics criminal offence authorized to examine the evidence tool, witness information, information defendants, and information experts and in the criminal offence break the judges are authorized to determine the defendant in the rehabilitation or sentenced to prison Proceed to basic consideration of judges in disconnecting disparity against narcotic criminal acts due to different deeds committed by the defendant where if the defendant is only a user then the decision received will be lighter and if The defendant as a distributor will give punishment

Abstract

Corruption is a particular type of crime that is serious because corruption can cause economic losses to a country that threatens the continuity of development in all aspects of a country, so that an extraordinary handling is needed. The involvement of a witness as well as a perpetrator is a breakthrough that can help law enforcement officials in uncovering the complexity of criminal acts of corruption. The choice to act as a witness as well as a perpetrator who assists or cooperates with law enforcement officials is a full risk choice for that it is realized the need for a concept of protection for a witness as well as a collaborating actor so that those who are called witnesses as well as these actors can provide information needed freely without fear of threats or intimidation by parties who are directly harmed by the testimony given. Based on the description above, the issues raised will be the subject of further discussion which are deemed necessary for a learning space around the perpetrators acting as witnesses. As for those problems, namely: how is the legal arrangement for a witness who is also an actor who helps law enforcement officials in uncovering a corruption case and how the government guarantees to provide protection for witnesses and also as perpetrators in corruption cases. To answer this problem, normative research methods are used, namely by implementing a legislative approach that examines the applicable laws and regulations and adopting a conceptual approach, namely reviewing library materials in the form of theories and opinions of legal experts. Legal arrangements for a witness as well as perpetrators are regulated in a number of laws and regulations that provide the basis of guidelines for witnesses and also those who work together in disclosing corruption cases, while we can find these regulations in witness and victim protection laws. Where it provides a guarantee of legal certainty which is characteristic of the law itself because without legal certainty it is impossible to achieve legal ideals, namely the existence of justice.

Abstract

The Civil Service Police Unit is a regional apparatus organization in enforcing the Regional Regulation and holding public order as stipulated in the Republic of Indonesia Government Regulation Number 6 of 2010 concerning the Civil Service Police Unit having the authority to act in carrying out a non-judicial order for the community or a legal entity's violation of Regional Regulations and Regional Head Regulations. The formulation of the problems that can be used for this research are: (1) What is the duty and authority of the Civil Service Police Unit in the enforcement of Regional Regulations with the enactment of Government Regulation Number 6 of 2010 in Badung Regency; (2) Any possible factors that make obstacles in the Enforcement of Regional Regulations in Badung Regency carried out by the Civil Service Police Unit. This research was conducted using normative legal research. The source and type of material of this study are primary, namely looking at legislation and secondary materia,l written by experts and the results of the scientists are then processed and analyzed descriptively to obtain a conclusion. Based on the results of the study, it can be concluded that the Satpol PP officers are part of the Regional Apparatus who carry out their duties and authorities in accordance with statutory provisions, namely in Article 148 of Law Number 23 Year 2014, that the obstacles faced by Satopl PP in Badung Regency are many shops modern people who have not fulfilled the licensing requirements in full as the provisions set by Badung Regency, so that in carrying out their duties the Satpol PP often experiences clashes with relevant agencies and the community. Suggestions given by the authors are expected to have a synergy between the Satpol PP and the relevant agencies so that in terms of enforcing regulations and order will go well so that the impression of arrogance from Satpol PP officers in carrying out their duties does not develop in the community.

Abstract

Lembaga Pemasyarakatan merupakan salah satu lembaga yang menegakkan hukum dalam hal pembinaan yang dilakukan terhadap para narapidana dimana segala jenis aturan yang dilakukan di dalam Lembaga Pemasyarakatan diatur dalam Undang-Undang Nomor 12 Tahun 1995 tentang pemasyarakatan. Adapun rumusan masalah yang penulis kemukakan yaitu, (1) Bagaimana proses pembinaan narapidana lanjut usia di Lapas Kelas IIA Denpasar menurut UU No.12 Tahun 1995 Tentang Pemasyarakatan. (2) Apakah upaya penyelesaian terhadap kendala yang dihadapi dalam melakukan pembinaan pada narapidana lanjut usia di Lapas Kelas IIA Denpasar. Penelitian ini menggunakan metode empiris dengan mengumpulkan data melalui wawancara di lapangan. Penelitian ini dilakukan di Lembaga Pemasyarakatan Kelas II A Denpasar yang terletak di daerah Kerobokan Kabupaten Badung. Hasil penelitian di lapangan didapat bahwa di Lembaga Pemasyarakatan yang menampung 1684 narapidana dengan klasifikasi 7 orang narapidana anak, 1663 orang narapidana dewasa serta 14 orang narapidana lansia ini telah memberikan perlakuan khusus kepada narapidana yang sudah lanjut usia karena para narapidana yang sudah lanjut usia tidak memiliki kemampuan yang cukup untuk melakukan segala kegiatan pembinaan yang seharusnya dilakukan, namun tidak ada peraturan khusus yang mengatur secara detail terkait hal tersebut. Memberikan perlakuan khusus dan membentuk aturan mengenai tata cara pembinaan terhadap narapidana yang sudah lanjut usia merupakan langkah yang wajib dilakukan agar terciptanya proses pembinaan terhadap para narapidana lanjut usia yang sesuai dengan kondisi narapidana lanjut usia itu sendiri.

Abstract

As part of criminal acts, it is a matter of abortion, namely: mainly among women who experience unwanted pregnancies choose the path for abortion with various risks, namely in the form of death or legal violation of the provisions in the Criminal Code. For example, it often happens that a woman intentionally causes death or death of her womb, or tells another person to cause it, she is sentenced to imprisonment for a maximum of four years, which is regulated in the Criminal Code (KUHP). Abortion is a prohibited act, so it is said to be a criminal act, because the threat of partial criminal law is regulated in the Criminal Code. The formulation of the problem in this study is: what is the background of the perpetrator committing an abortion crime and how is the criminal sanction imposed by the judge on the perpetrator of the crime of abortion. The type of research used in this study is normative legal research. The results of the discussion in this study are: The background of the perpetrators committing abortion crimes, namely from unmarried women (too young, girlfriends refusing to be responsible, not planning to marry a boyfriend, fear of parents, maintaining a good family name and tradition) and those who have gotten married (contraceptive failure, is in the process of divorce, and the husband is not responsible). Criminal sanctions imposed by judges on perpetrators of abortion crimes, namely in the Criminal Code, the perpetrators and those who assist in the occurrence of abortion are charged with Article 346 to Article 349.

Abstract

The Bank temporarily gives or disburses credit to usually preceded by an agreement that is usually called a draft loan agreement. In the loan agreement, there is a statement, as collateral when paying the credit, the agreement of the debtor is in default. In the banking practice specifically credit problems are known to have various institutions. While seen from the object there is a collateral institution of the owner of movable and inanimate objects. The formulation of the problem in this paper is 1) What are the conditions that must be met by the imposition of a mortgage on a ship in a bank credit agreement? and 2) What is the procedure for loading a mortgage on a ship in a bank credit agreement? This type of research used in this research is Empirical Legal Research that is taking facts that occur in the field, obtained through explanations from informants and can be understood by understanding the real law or in accordance with community life in society. The results of this study are, 1) Requirements that must be approved for the imposition of mortgages on marine vessels in a bank credit agreement, namely ships that have entered and are listed in the Indonesian ship list, the owner of the ship that receives a mortgage and who wants to accept individuals for ship assistance (made in in the presence of a Notary) 2) procedures for loading a mortgage on a ship in an approved bank credit agreement and the counter registrants of the ship list are approved for completeness of administration in less than 5 (five) days agreed upon when the documents are received as summarized. Ships that have entered the shipping list and other vessels in the process and parts of the ship that can be given mortgage rights. Like a ship that is burdened with a mortgage, the mortgage recipient is given a ship mortgage deed that has the same executorial power as the result of a trial that has permanent and easy legal power. Sanctions due to mortgage regulations for marine vessels are emphasized in order to prevent arbitrariness from the Office of the Harvesting Office and Port Authority in managing mortgage loading for ships.

Abstract

The involvement of the child in narcotic crime that becomes a narcotic courier is a series of malicious agreement in conducting illegal narcotics circulation, but in the capacity category of children who become courier, this is one thing That is so concerned that the child has been faced with the law and is classified as a narcotic crime. Based on the explanation above, the problems that will be considered in this study are as follows: 1. how is the legal arrangement for a child to be a courier in a narcotic crime? 2. How is criminal liability for children as a courier in narcotic crime? The type of research used in this study is a type of normative legal research. The analysis technique is that after the collected legal materials are then analyzed using the technique of description, after all required legal materials are fulfilled, analyzed in a qualitative descriptive. Please note that the determination of the child's age in relation to the criminal liability that can be submitted before the proceeding is 12 (twelve) years up to 18 (eighteen) years in accordance with the verdict of the Constitutional Court No. 1/PUUVIII/ 201/021. In the context of child accountability as a drug courier one of them is that narcotics LAW does not restrict the age in the judiciary, both adults and minors, so that children as narcotics courier can still be punished when Children's capabilities that are still limited and are not as perfect as adults.

Abstract

Buying and selling land is one of the legal acts that can cause the transfer of land rights from the hand of the seller to the buyer. The transition of land rights must be registered based on the evidence of the relevant deed. If traced from the beginning, there is a real buying and selling land arising based on an agreement or approval that is set in the form of a covenant between the seller and the buyer. Based on the background of this research problem is: how the existence of land-Buy sales certificate handled by PPAT certificate was cancelled and how the legal sanctions on Dibatalkannya legal status of PPAT deed in the purchase and Sale of land. The type of research used is empirical legal research. The results of the discussion in this study are: the existence of land purchase certificate that issued PPAT certificate was cancelled because PPAT is State Administration officer, in the event of a dispute, BPN is responsible for the certificate that has been Issued. PPAT has never come into contact with the TUN judiciary relating to the treaty Deed of ownership of the land. Guidelines for creating a certificate of land ownership in BPN. If the certificate is cancelled, the party that is won shall apply for the cancellation of the certificate to BPN, and juridically the PPAT deed that has been registered to the land Office is automatically null and void. Legal sanctions against the legal status of PPAT certificates and the sale of land, which have the same consequences as the unlawful act is only a violation of the law can be resolved through a public court, not Can be resolved through the State Administrative Court.

Abstract

The state of law requires that the law always be enforced, respected and obeyed by anyone without any reason for exclusion. Addressing this, positive law in Indonesia is required to respond to the crime phenomena committed by utilizing the technology. The problem of this study is 1) how is the arrangement of criminal Sanctions on the criminal act of account breach through the Mandiri Teller machine (ATM)? 2) What is the judge's consideration in discontinuing the account breach through the Mandiri Teller machine (ATM)? The research method used is a normative legal research method, with the literature study of primary and secondary legal materials. Abstract

To improve the welfare of the community, one of the non-banking institutions is the cooperative providing credit loan facilities for the needs of the community. The aim is as a means of channeling loans or credit for priority communities and people in general. But in reality, the easier the provision of credit services to the public, tends to be a serious problem in the payment of credit. For example, defaults carried out by the community by not implementing the agreed agreement. Therefore the authors are interested in conducting research with the formulation of the problem 1) What are the causes of default by the debtor in the implementation of the loan agreement at Dana Rahayu Cooperative? 2) How do you settle defaults by debtors at the Dana Rahayu Cooperative? The research method used is a empiris research method. The debtor can be said to default if the debtor does not do what he is willing to do, does what he promised is not as promised, does what he promised but is too late, does something that according to the agreement he cannot do. The cause of the default at the Dana Rahayu Cooperative was because the debtor did not pay the arrears for one year and nine months as agreed in the credit agreement. In the Dana Rahayu Cooperative Management Decision, the default made by the debtor on the credit agreement is resolved as far as possible using a family approach to the borrowing member. and it is impossible to do a settlement, the last resort is to carry out the seizure of collateral.
