Abstract

The development of artificial intelligence technology, particularly deepfake, has created new challenges in the protection of digital visual works as safeguarded under Law Number 28 of 2014 concerning Copyright. The misuse of deepfake technology that modifies or imitates digital visual works without the creator’s authorization has the potential to infringe upon the creator’s moral rights and economic rights, while specific regulations governing deepfake have not yet been explicitly regulated in Indonesian positive law. This research aims to analyze the form of civil liability for the misuse of deepfake technology against digital visual works based on the concept of unlawful acts. The research method employed is normative legal research using a conceptual approach. The results of the study indicate that the misuse of deepfake against digital visual works fulfills the elements of an unlawful act as stipulated in Article 1365 of the Indonesian Civil Code, namely the existence of an unlawful act, fault, damage, and a causal relationship. Although deepfake is a product of artificial intelligence technology, legal liability remains attached to humans as users and controllers of the technology. Therefore, the appropriate form of civil liability is individual liability based on the element of fault in the form of intent.

Abstract

The regulation of cannabis in Indonesian positive law continues to classify *Cannabis sativa* as a Schedule I narcotic, prohibiting its use for medical purposes and creating legal issues when cannabis is used to address specific health needs. This study analyzes cannabis regulation in Indonesia and several other countries and examines the possibility of legalizing medical cannabis from the perspectives of criminal law and the right to health. Using normative legal research with statutory and comparative approaches, the study relies on literature review of legislation, court decisions, and relevant legal scholarship, analyzed systematically and prescriptively. The findings show that Indonesia maintains a repressive and prohibitionist approach under Law Number 35 of 2009 on Narcotics, which provides no legal basis for medical cannabis use. In contrast, countries such as Thailand, the Netherlands, and Turkey permit limited medical cannabis under strict state supervision. Constitutional Court Decision Number 106/PUU-XVIII/2020 affirms that legalization constitutes an open legal policy subject to legislative discretion based on scientific evidence. The study recommends revising Law Number 35 of 2009 to allow limited and controlled medical cannabis use, enhancing protection of the right to health and reducing criminalization. Its originality lies in integrating criminal law, human rights, and comparative law perspectives to support narcotics policy reform.

Abstract

This study examines the determinants of Green Purchase Intention toward electric motorcycles in Jakarta by extending the Theory of Planned Behavior through the inclusion of Green Image as a mediating construct. A quantitative approach was employed using survey data collected from 150 prospective buyers who intend to purchase a motorcycle. Structural Equation Modeling with PLS was applied to assess the measurement and structural models. The results indicate that Green Attitude, Green Subjective Norm, and Green Perceived Behavioral Control significantly influence Green Image, which in turn exerts a substantial effect on Green Purchase Intention. Normative influence emerges as the most dominant predictor in shaping green image perceptions, highlighting the role of social evaluation in sustainable mobility decisions within an urban context. The model demonstrates moderate-to-strong explanatory power, confirming that image-based cognition strengthens the translation of psychological determinants into behavioral intention. These findings contribute to the theoretical refinement of TPB in green transportation research and provide practical implications for policymakers and industry actors seeking to accelerate electric motorcycle adoption in Jakarta.

Abstract

This study analyzes the regulation of company organs’ responsibilities, particularly commissioners, under Law Number 40 of 2007 concerning Limited Liability Companies and its relevance to the doctrine of piercing the corporate veil. The case of PT WSM Ventures Indonesia is examined to assess the limits of commissioners’ authority, the nature of the unlawful acts committed, and the legal basis for imposing personal liability for corporate losses. This research is a normative juridical study employing statutory and case approaches. It relies on primary and secondary legal materials obtained through literature review and applies a prescriptive analytical method. The findings show that the Company Law grants commissioners limited liability protection insofar as they perform their supervisory and advisory functions in good faith and within the scope of their authority. However, when a commissioner exceeds such authority (ultra vires) and interferes in the company’s management, causing losses, the doctrine of piercing the corporate veil becomes applicable to impose personal liability. In Decision Number 477/Pdt.G/2018/PN.Jkt.Sel, the commissioner was found to have committed an unlawful act under Article 1365 of the Civil Code and held personally liable pursuant to Article 114 paragraph (3) of the Company Law.

Abstract

Abstrak Penelitian ini bertujuan untuk menganalisis kekuatan hukum serta keterbatasan sistem Content ID dalam perspektif Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta. Perkembangan teknologi digital telah mengubah pola distribusi dan pemanfaatan karya lagu secara signifikan, khususnya melalui platform berbagi video seperti YouTube. Di satu sisi, kemudahan distribusi membuka peluang ekonomi yang luas bagi pencipta; di sisi lain, kondisi tersebut meningkatkan potensi pelanggaran hak cipta secara masif dan lintas batas. Penelitian menggunakan metode hukum normatif dengan pendekatan peraturan perundang-undangan dan konseptual, melalui penelaahan bahan hukum primer dan sekunder. Hasil kajian menunjukkan bahwa Content ID berfungsi sebagai mekanisme preventif berbasis teknologi yang memperkuat perlindungan hak ekonomi pencipta melalui deteksi otomatis, opsi pemblokiran, dan monetisasi. Namun demikian, sistem ini memiliki keterbatasan, antara lain akses yang tidak merata, potensi klaim keliru, serta kedudukannya yang bersifat kebijakan internal platform dan bukan instrumen penegakan hukum formal. Oleh karena itu, diperlukan penguatan regulasi dan harmonisasi kebijakan guna menjamin kepastian serta keadilan hukum dalam perlindungan hak cipta lagu di era digital. Abstract This study aims to analyze the legal force and limitations of the Content ID system from the perspective of Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta. The development of digital technology has significantly transformed the distribution and utilization patterns of musical works, particularly through video-sharing platforms such as YouTube. On the one hand, the ease of distribution creates broad economic opportunities for creators; on the other hand, it increases the risk of massive and cross-border copyright infringements. This research employs a normative legal method with statutory and conceptual approaches, based on the examination of primary and secondary legal materials. The findings indicate that Content ID functions as a technology-based preventive mechanism that strengthens the protection of creators’ economic rights through automated detection, blocking options, and monetization features. However, the system also has limitations, including unequal access, the potential for erroneous claims, and its status as an internal platform policy rather than a formal law enforcement instrument. Therefore, regulatory strengthening and policy harmonization are necessary to ensure legal certainty and justice in the protection of song copyrights in the digital era. Abstract

Transformasi sistem pembayaran digital mendorong bank sentral mengembangkan Central Bank Digital Currency (CBDC) sebagai representasi digital mata uang negara yang tetap berada dalam kendali otoritas moneter. India dan Indonesia termasuk negara yang menginisiasi CBDC dengan pendekatan kelembagaan dan desain yang berbeda. Artikel ini bertujuan menganalisis secara komparatif pemanfaatan CBDC dalam transformasi sistem pembayaran di India dan Indonesia dari perspektif yuridis, skema distribusi, dan desain arsitektur. Penelitian menggunakan metode yuridis komparatif dengan pendekatan peraturan perundang-undangan dan kebijakan bank sentral, serta analisis konseptual terhadap model distribusi dan struktur sistem CBDC di kedua negara. Hasil penelitian menunjukkan bahwa India memanfaatkan e-Rupee secara integratif dengan infrastruktur pembayaran nasional yang telah mapan sehingga berfungsi sebagai ekstensi digital ekosistem pembayaran ritel, sedangkan Indonesia mengembangkan Rupiah Digital melalui arsitektur ritel yang lebih terstruktur dan terkendali dengan peran bank sentral yang dominan dalam penerbitan dan pengawasan. Perbedaan tersebut menegaskan bahwa pemanfaatan CBDC merefleksikan pilihan kebijakan hukum dan kelembagaan masing-masing negara. Dengan demikian, keberhasilan transformasi sistem pembayaran melalui CBDC ditentukan oleh kesesuaian desain arsitektur, skema distribusi, dan kerangka hukum dengan tujuan stabilitas moneter dan sistem pembayaran nasional.

Abstract

In Indonesia, copyright protection is governed by Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta. This law serves as the legal foundation for the regulation, protection, and enforcement of the rights of creators. Copyright protection cannot be separated from the continuous evolution of technology, as digital transformation has given rise to Artificial Intelligence (AI). AI is capable of creating a work of art merely by receiving an instruction and compiling data, thereby enabling it to imitate original works that have previously been protected by copyright. This raises questions regarding the ownership status of works generated by AI. This research aims to analyze and determine the ownership of a painting created by AI. The type of research employed is normative juridical with a prescriptive nature, utilizing statutory and conceptual approaches. The results of the study indicate that the ownership status of AI-based works is determined by the level of creativity of the prompt creator as well as the outcome of the Substantial Similarity Test to assess whether there is any infringement upon works that have been protected. This research underscores the necessity for more adaptive regulations in order to provide legal certainty in response to the development of AI technology.

Abstract

The Board of Directors, as an organ of the company, has the authority and responsibility to manage the company in accordance with the principles of good faith and prudence as stipulated in the Limited Liability Company Law. In practice, directors may act beyond their authority or engage in negligent or intentional conduct that causes losses to the company or third parties. This study aims to analyze the forms of directors’ liability for unlawful acts based on Article 1365 of the Civil Code and the Limited Liability Company Law. The research employs a normative legal method using statutory and conceptual approaches. The results indicate that directors may be held personally liable if they are proven to have committed fault or negligence in performing their duties resulting in losses, and if they fail to comply with the principles of fiduciary duty and duty of care. Therefore, personal liability of directors serves as an important legal instrument in promoting good corporate governance and providing legal protection for the company and third parties.

Abstract

The development of the television broadcasting industry in Indonesia has demonstrated an increasing trend of consolidation through acquisitions, potentially resulting in vertical integration between content producers and broadcasting channel operators. This article aims to analyze acquisitions as a form of vertical integration in the television broadcasting industry and their implications for business competition under Law Number 5 of 1999 concerning the Prohibition of Monopolistic Practices and Unfair Business Competition. This research employs a normative legal method using statutory and conceptual approaches, supported by an analysis of the structural characteristics of the broadcasting industry. The findings indicate that although Article 14 of Law No. 5 of 1999 textually regulates vertical agreements, acquisitions that create control across different market levels may be qualified as vertical integration under a systematic and effects-based interpretation. Vertical integration through acquisition is not strictly prohibited but is assessed using a rule of reason approach by balancing efficiency gains against the risk of vertical foreclosure, particularly in industries characterized by limited distribution channels and high entry barriers. Therefore, the legality of such acquisitions depends on whether they restrict market access and distort competitive market structures.

Abstract

This study aims, first, to analyze the harmonization of regulatory frameworks between the OECD standard setting concerning algorithmic collusion and the provisions of Law Number 5 of 1999 concerning the Prohibition of Monopolistic Practices and Unfair Business Competition. Second, this study seeks to formulate legal harmonization measures that can be undertaken to address collusive practices arising from the use of artificial intelligence–based pricing algorithms. This research constitutes normative legal research employing a conceptual approach. The findings indicate that there remains a regulatory disharmony between Law Number 5 of 1999 concerning the Prohibition of Monopolistic Practices and Unfair Business Competition and the OECD standard setting related to algorithmic collusion. Legal harmonization measures may be carried out through the reform of legal instruments as well as the strengthening of the institutional role of the Business Competition Supervisory Commission (Komisi Pengawas Persaingan Usaha).
