Abstract

This study aims to analyze the implementation of increased sentencing for recidivists in child sexual abuse crimes in Indonesia and examine the construction of judges' considerations in court decisions. The problem arises because, although laws and regulations regulate increased sentencing for recidivists, inconsistencies in sentencing practice persist. This study uses a normative juridical method with a statutory and conceptual approach. The primary legal materials consist of laws and court decisions, while secondary legal materials are obtained from legal literature and journals. The results indicate that while the regulation of increased sentencing for recidivists is normatively regulated in the Criminal Code and the Child Protection Law, its implementation is not entirely consistent. Judges' considerations are often influenced by subjective factors such as the perpetrator's remorse and social background, resulting in disparities in sentencing. Therefore, stricter sentencing guidelines are needed to ensure legal certainty, justice, and maximum protection for child victims.

Abstract

This research examines the regulation of restorative justice under National Police Regulation (Perpol) No. 8 of 2021 on Handling Criminal Acts Based on Restorative Justice, and its implementation in a sexual violence case in Karawang. This research is motivated by the disharmony between Perpol No. 8 of 2021, Law No. 12 of 2022 on Sexual Violence Crime, and Law No. 20 of 2025 on the New Code of Criminal Procedure, which creates a legal loophole allowing sexual violence cases to be resolved through a deviant application of restorative justice. This research employs a normative-empirical legal method with a descriptive character using case, statutory, and sociological approaches. Primary legal materials were obtained through interviews with the victim's legal counsel, while secondary legal materials were gathered through literature study. The analysis was conducted using Aristotle's theory of justice and Lawrence M. Friedman's theory of legal certainty. The findings show that Perpol No. 8 of 2021 does not include sexual violence among criminal offenses excluded from restorative justice, contradicting Article 23 of the Sexual Violence Crime Law and Article 82 point (d) of the new Criminal Procedure Code. The application in Karawang was carried out through forced unregistered marriage without investigation, official case registration, or special case review, violating Perpol, the Sexual Violence Crime Law, and the new Criminal Procedure Code simultaneously. From Aristotle's theory of justice, this failed to achieve distributive or corrective justice. From Friedman's theory of legal certainty, uncertainty stems from weaknesses in legal substance, legal structure, and legal culture.

Abstract

The rapid expansion of fintech lending services in Indonesia carries significant legal consequences, particularly concerning the bargaining imbalance between platform operators and consumers. Agreements unilaterally standardized by business actors frequently place consumers in a disadvantageous position with no room for negotiation. This study examines whether the standard clauses contained in Kredivo's agreement reflect the principle of balance as stipulated in Article 2 letter c of Law Number 8 of 1999 on Consumer Protection. A normative approach is employed, utilizing comparative analysis against the provisions of the Consumer Protection Act, OJK Regulation Number 10/POJK.05/2022, and the consumer protection theory of Prof. Moch. Isnaeni. The findings reveal that Kredivo's agreement still contains at least three clauses potentially null and void by law: the liability transfer clause for merchant goods and services, the unilateral amendment clause for terms and fees, and the indemnification clause exempting Kredivo from third-party claims related to emergency contact collection. All three clauses directly contravene the prohibitions in Article 18 paragraph (1) of the Consumer Protection Act and do not yet reflect the balance principle required by regulation. Recommendations are directed to OJK to strengthen oversight of standard agreement content, to Kredivo to revise the problematic clauses, and to consumers to enhance their legal awareness.

Abstract

Child custody (hadhanah) in civil cases, particularly after divorce, is not merely viewed as a right of the parents, but rather as a right of the child that must be legally protected. This protection is essential as it concerns the continuity of a child’s physical and psychological development amid changes in family structure. This study aims to analyze the position of hadhanah as an object of proof in civil law and to examine the legal implications from the perspective of the best interest of the child. The method used is normative legal research with a statutory approach. The findings show that hadhanah is a crucial object of proof in judicial decisions, where evidence such as witness testimonies, documents, and court facts form the basis for assessing the suitability of custody. This protection is important as it relates to the sustainability of a child’s growth and development, both physically and psychologically, in the midst of changing family structures. Its legal consequences do not only affect the determination of custody rights, but also the legal responsibilities of parents, including obligations for care, education, and child protection. Therefore, the application of the principle of the best interest of the child must be a primary consideration in every court decision.

Abstract

This research aims to conduct a legal analysis of the effectiveness of implementing the principle of prudence in the credit disbursement cycle, as well as to examine procedural abuses that frequently occur and serve as loopholes for both internal and external parties.This study is a normative legal study employing a statutory approach, a case-based approach, and a conceptual approach. The legal materials used include primary and secondary sources. The technique employed for collecting legal materials is literature review. This study utilizes a deductive analytical method, which involves drawing conclusions from general principles to specific cases. This study analyzes the implementation of the Prudence Principle as a mandatory legal norm in maintaining banking stability and public confidence. Through the cases of Bank Mandiri Bukittinggi, BPD NTT, and Bank Muamalat Harkat, a significant disconnect was found between regulations (the Banking Law and the Sharia Banking Law) and operational practices. Violations include failures in Know Your Customer protocols, manipulation of financial data due to internal collusion, and defects in the authenticity of collateral documents. The study concludes that disregard for these principles degrades bank functions and threatens systemic stability. Regulatory effectiveness requires not only compliance with formalities but also depends on managerial integrity, strict internal oversight, and the ability to detect procedural deviations early on.

Abstract

This study aims to analyze the legal basis for granting child custody to the father and the application of the principle of the best interests of the child by the judge in Decision No. 982/Pdt.G/2024/PN.Mdn. The study employs a normative legal method using a statutory approach and a case-based approach, supported by primary and secondary data analyzed through legal syllogisms using deductive reasoning. The study findings indicate that the granting of custody to the father is based on the revocation of the mother’s custody rights due to proven neglect, which has a negative impact on the child’s health and development. The principle of the best interests of the child is applied through a comprehensive assessment of both parents’ parenting capacity and maturity, which concluded that the father is better able to ensure the child’s best interests, while visitation rights are still granted to the mother to maintain the child’s psychological well-being. This ruling also reflects the fact that child protection in the legal sphere requires an integrated approach that simultaneously combines legal norms, trial evidence, and an understanding of the child’s psychological needs.

Abstract

Indonesia's retributive sentencing system, dominated by imprisonment, has caused serious problems including prison overcrowding. The Indonesian National Penal Code addresses this by incorporating community service as a principal punishment, marking a paradigm shift toward a rehabilitative approach. This study aims to compare the regulation of community service punishment in Indonesia's National Penal Code with the Dutch Wetboek van Strafrecht (WvSr) using normative legal research methods with statutory, conceptual, and comparative approaches. The findings reveal similarities in both systems regarding the classification of community service as one of primary sanction with its unpaid nature and the 240-hour maximum. However, significant differences exist when both penal code were being compared. The Indonesian National Penal Code restricts its application through sentencing thresholds and cumulative subjective criteria, whereas the WvSr offers a more flexible framework through categorical prohibitions for serious offenses, pre-adjudication mechanisms, sentence combinations, recidivism regulations, and a comprehensive juvenile justice sub-system.

Abstract

This article aims to analyze the regulation of copyright protection for movie creators through Digital Rights Management (DRM) technology implemented in Over The Top (OTT) services. This study employs a normative legal method with a prescriptive nature and a statutory approach. The article examines the provisions of Law Number 28 of 2014 concerning Copyright through Philipus M. Hadjon’s theory of legal protection. The findings indicate that the Copyright Law has not comprehensively regulated DRM technology within OTT services, particularly due to the absence of provisions regarding the prohibition of DRM circumvention tools (anti-circumvention), as well as the lack of clear regulations concerning technical standards and supervisory procedures for DRM technology. The author concludes that reforms regarding digital copyright protection, particularly DRM regulation within the Copyright Law, are necessary to ensure legal protection for movie creators as legal subjects and for movies distributed through OTT services.

Abstract

Persekongkolan tender merupakan salah satu bentuk pelanggaran persaingan usaha yang berpotensi merusak mekanisme pasar yang sehat dan kompetitif. Penegakan hukum terhadap praktik tersebut dilakukan oleh Komisi Pengawas Persaingan Usaha (KPPU) melalui pendekatan per se illegal dan rule of reason. Namun, pasca pencabutan Peraturan KPPU Nomor 2 Tahun 2010, belum terdapat pedoman yang secara eksplisit mengatur kriteria penggunaan kedua pendekatan tersebut dalam perkara persekongkolan tender. Penelitian ini bertujuan untuk menganalisis dasar pertimbangan KPPU dalam menentukan penggunaan pendekatan per se illegal atau rule of reason serta mengkaji penerapannya dalam Putusan KPPU Nomor 15/KPPU-L/2023 mengenai tender pekerjaan konstruksi di Kabupaten Bogor. Penelitian ini merupakan penelitian hukum normatif dengan pendekatan perundang-undangan dan konseptual. Bahan hukum primer, sekunder, dan tersier dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa penentuan penggunaan pendekatan per se illegal atau rule of reason dipengaruhi oleh sifat perbuatan, tingkat dan kekuatan pembuktian, jenis dan tingkat pelanggaran, serta dampak perbuatan terhadap pasar. Dalam putusan tersebut, KPPU cenderung menggunakan pendekatan per se illegal dengan menitikberatkan pada pembuktian adanya kesepakatan dan koordinasi antar pelaku usaha melalui bukti tidak langsung. Penelitian ini menyimpulkan bahwa belum adanya pedoman yang jelas mengenai parameter penggunaan pendekatan per se illegal dan rule of reason berpotensi menimbulkan ketidakpastian hukum dalam penegakan hukum persaingan usaha.

Abstract

This study examines the juridical qualification of breach of contract involving quantity discrepancies in online sales transactions and the effectiveness of consumer legal protection mechanisms, with a case study on Decision No. 629/Pdt.G/2020/PN JKT.SEL (Namastudio Case). A normative prescriptive legal method is applied using the statute and case approaches. The findings indicate that quantity discrepancies constitute imperfect performance under Article 1243 of the Civil Code, obliging the seller to provide compensation. Consumer protection may be pursued preventively through government supervision and repressively through the BPSK or general courts. Although the legal framework is adequate, its effectiveness remains hindered by low public legal awareness and weak oversight of digital businesses.
