Peer Review Process Setiap artikel yang masuk akan melalui proses peninjauan oleh tim reviewer IJSSH yang memiliki keahlian sesuai dengan bidang naskah tersebut. Penulis diwajibkan untuk melakukan registrasi dan mengirimkan artikel secara mandiri melalui sistem Open Journal Systems (OJS) untuk memastikan transparansi dan akuntabilitas proses publikasi. Open Access Policy IJSSH mendukung akses terbuka terhadap ilmu pengetahuan. Seluruh artikel yang diterima akan dipublikasikan secara Open Access dan tersedia secara bebas untuk dibaca serta diunduh oleh publik. Seluruh naskah yang diterbitkan berada di bawah lisensi: Creative Commons Attribution-ShareAlike 4.0 International License (CC BY-SA 4.0). Publication Frequency IJSSH telah aktif terbit sejak tahun 2020. Abstract

This study examines dispute resolution mechanisms available to lenders against operators of Information Technology-Based Joint Funding Services (LPBBTI) that fail to disclose required funding information, as well as the role of the Financial Services Authority (OJK) in resolving such disputes. The research employs a normative legal method using statute, case, and comparative approaches. Findings reveal that OJK Regulation No. 40 of 2024 does not comprehensively regulate dispute resolution mechanisms for compensating formal and/or material losses suffered by lenders due to operators' failure to fulfill disclosure obligations. OJK's authority is limited to imposing administrative sanctions without any mechanism for restoring lenders' rights. These findings are analyzed through preventive and repressive legal protection theory and compared with U.S. peer-to-peer lending regulation under the Securities Act of 1933 and the Private Securities Litigation Reform Act of 1995. Supreme Court Decision No. 1206 K/Pdt/2024, ordering OJK to develop comprehensive consumer protection regulations, further underscores the urgency of reform. This study recommends revising POJK No. 40 of 2024 to integrate compensation mechanisms, alternative dispute resolution, and mandatory guarantee funds for LPBBTI operators. Abstract

Abstract The Single Economic Entity (SEE) doctrine is a concept in competition law that regards parent companies and subsidiaries within a corporate group as a single economic unit. This study aims to analyze the regulation of the Single Economic Entity doctrine in the perspective of Indonesian competition law. This research employs normative legal research using statutory, case, and conceptual approaches. Legal materials were collected through library research and analyzed deductively. The results show that the Single Economic Entity (SEE) doctrine has not been explicitly regulated under Law Number 5 of 1999, but it has been applied by the Business Competition Supervisory Commission (KPPU) in several competition law cases, such as the Temasek case, the Barclays Premier League broadcasting rights case, and the Amlodipine pharmaceutical industry case. The Single Economic Entity (SEE) doctrine is used to assess control relationships and economic unity among companies within the same corporate group. However, the absence of clear parameters regarding its implementation has created legal uncertainty in the enforcement of competition law in Indonesia. Keywords: Single Economic Entity , Competition Law, Business Actor Liability Abstrak Doktrin Single Economic Entity (SEE) merupakan konsep dalam hukum persaingan usaha yang memandang Perusahaan induk dan anak Perusahaan dalam satu grup usaha sebagai satu kesatuan ekonomi. Penelitian ini bertujuan untuk menganalisis pengaturan doktrin Single Economic Entity dalam perspektif hukum persaingan usaha di Indonesia. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan, pendekatan kasuss, dan pendekatan konseptual. Bahan hukum diperoleh melalui studi kepustakaan dan dianalisis secara deduktif. Hasil penelitian menunjukkan bahwa doktrin Single Economic Entity (SEE) belum diatur secara eksplisit dalam Undang-Undang Nomor 5 Tahun 1999, namun pernah diterapkan oleh Komisi Pengawas Persaingan Usaha (KPPU) dalam beberapa perkara persaingan usaha seperti Temasek, hak siar Barclays Premier League, dan industri farmasi Amlodipine. Penerapan doktrin Single Economic Entity (SEE) digunakan untuk menilai hubungan pengendalian dan kesatuan ekonomi antar perusahaan dalam satu grup usaha. Namun, belum adanya pengaturan yang jelas mengenai parameter penerapannya menimbulkan persoalan kepastian hukum dalam praktik penegakan hukum persaingan usaha di Indonesia. Abstract

The migration of Indonesian citizens to South Korea shows a trend that is increasing every year. Behind this migration, the Indonesian Muslim diaspora still faces discrimination based on minority identity, impacting on the safe space of the diaspora. This study aims to analyze the limitations of state actors in fulfilling human security, especially community security, for the Muslim diaspora, and analyze the role of the Indonesian Muslim Community (KMI) that is present in the midst of the limitations left by the state. This study uses a qualitative approach by collecting data through literature studies. The concept of human security from UNDP and multi-level governance by Hooghe and Marks is used to examine the dynamics of human rights protection reviewed at each level. The results of the study show that Indonesia as a sending country is still based on formal procedures so that the protection of human rights is reactive, then from the side of South Korea as the receiving country is in a condition of uncertainty of the anti-discrimination legal order and social conditions that have not fully accepted minority identities. This study found that each level in the multi-level governance configuration experienced coordination problems so that KMI was present through a community-based solutions approach by carrying out the function of substitution, practical and emotional assistance. Thus, the fulfillment of the human security of the Indonesian Muslim diaspora is more based on the sense of togetherness that grows organically from the community rather than from the state's structural guarantees
