Abstract

The Inter-traditional marriages have long been occurring in Minangkabau, such as in Pariaman and Luhak 50 Kota. In Pariaman it is known as the bajampuik system, that is the prospective husband asks for a certain amount of money from the prospective wife who comes from another tradition. Meanwhile in Luhak 50 Koto it is known as the maisi sasuduik system or the prospective wife's party asks the prospective husband's party to provide all the contents of the bridal chamber. This system certainly needs to be reviewed for its suitability with Islamic Law because it sometimes escapes the attention of researchers. Through qualitative research with data sources of observation, interviews and documentation, it is known that the Inter-customary marriage as mentioned is following Indonesian law. In addition, inter-customary marriage in Pariaman and Luhak does not violate Islamic law or 'Urf as agreed by experts. However, the decision to carry out or not the marriage is in the hands of each customary ruler

Abstract

This study examines the certification of Pusako Tinggi land within the Minangkabau community from the perspective of Maqashid Syari'ah. Pusako Tinggi land, which is inherited through a matrilineal lineage, holds significant economic and social value and is governed by Minangkabau customary law. However, there has been a growing need for land certification to provide legal certainty in a modern context. This certification process raises various questions, particularly concerning its alignment with the principles of Maqashid Syari'ah, which emphasize the protection of religion, life, intellect, lineage, and property. This research aims to analyze the extent to which the certification process of Pusako Tinggi land aligns with the principles of Maqashid Syari'ah and its impact on the sustainability of customary values and the welfare of the community. The study employs a qualitative approach using library research methods. The analysis shows that land certification can provide legal certainty and protection of property (hifz al-mal), but it must be carried out with caution to avoid undermining communal and customary rights. The protection of lineage (hifz an-nasl) and religious principles (hifz ad-din) must also be considered to ensure that the certification process does not erode customary rights and remains consistent with Islamic law. In conclusion, the certification of Pusako Tinggi land should be conducted with caution, taking into account the alignment between state law and customary law, and prioritizing the welfare of the community in accordance with the objectives of Maqashid Syari'ah.

Abstract

The e-commerce transaction payment system is not only limited to credit cards, debit cards, electronic wallets, or paylaters, but also via the COD (Cash On Delivery) method, where payment is made in cash when the goods arrive at their destination, which is handed over by the courier. Basically, in mu'amalah jurisprudence there have been studies relating to transaction rules, but in the case of e-commerce with a COD system, this has not been found in classical jurisprudence studies. Therefore, the author is interested in conducting further research on this topic, especially regarding e-commerce transaction mechanisms using the COD method and aspects of contracts from the perspective of mu'amalah jurisprudence. This research will be carried out through literature analysis with a qualitative approach. Data will be processed and analyzed using qualitative techniques, including inductive, deductive and comparative approaches. The results of this research show that the e-commerce transaction mechanism using the COD system is by opening the application, selecting goods, checking out, and inspecting the goods before making payment for the order in cash when it arrives at its destination via a courier intermediary. The position of the contract in e-commerce transactions using the COD system, from the perspective of mu'amalah jurisprudence, is that it is permissible as long as the harmony and appropriate terms and rules are met. Abstract

Handling of children as perpetrators of criminal acts cannot be equated with adults. This study aims to examine the application of restorative justice in handling children as perpetrators of criminal acts and the perspective of national criminal law and Islamic criminal law. The type of research conducted is library research with data sourced from primary, secondary and tertiary data sources. The collected data is then analyzed using qualitative data analysis methods. This study concludes that the application of restorative justice in resolving criminal acts whose perpetrators are in the criminal law system in Indonesia is relatively new since the birth of the Child SPPA Law which regulates the diversion mechanism in it. According to this regulation, children who commit crimes with a threat of less than 7 (seven) years must be resolved using a diversion mechanism. The restorative justice approach is indeed not known in Islamic criminal law, but its principles are identical to the practice of diyat and peace (ishlah) in Islamic criminal law.

Abstract

This study aims to determine the status of land ownership that is prevented by the mamak when it is about to be transferred, To find out the reason the  mamak does not allow the mortgage. And to find out the review of Muamalah Fiqh on the reasons for not allowing the mortgage: The research method used is qualitative with data sources originating from KAN, Niniak Mamak, Cadiak Pandai, Bundo Kanduang, Nephews who own land, Mamak Penghulu from those who own land, one of the communities there. For data collection techniques, the researcher used the interview method. The results of the study explain that the land is a high pusako land which is classified as joint property/syirkah property; and the approval of the mother is a form of agreement from all members, and the mother's disagreement is understood as they do not agree to transfer property by one of the clan members, and if one member releases his rights without the approval of other clan members, it is a reprehensible act because it can encroach on the rights of others. This study provides implications that joint rights must be considered if one member wants to release his rights.

Abstract

This study examines the excusing reasons for individuals who perform abortions as regulated by Law No. 36 of 2009 on Health, from the perspective of Islamic law. The background of the problem stems from differing interpretations of abortion’s legality between Indonesian positive law and Islamic legal principles, particularly regarding exceptions for medical emergencies and rape. The novelty of this research lies in its comparative approach, which analyzes the similarities and differences between the abortion provisions in the Health Law and the views of Islamic law, as well as the relationship between national policy and religious fatwās. The research methodology is normative juridical, employing library research with primary data drawn from legislation (the Criminal Code; Law No. 36/2009) and Islamic sources (the Qur’ān, Hadith, fatwās), and secondary data comprising academic literature and prior studies. The main findings indicate that both legal systems permit abortion under emergency conditions (to save the life of the mother or fetus), but differ in gestational age limits; technical regulations and the legal status of abortions resulting from rape also diverge, with scholars holding varying opinions.

Abstract

This study aims to analyze Islamic law and national law in Indonesia regarding the imposition of divorce through social media. The focus of the study is directed at how Islamic law justifies divorce through social media as a valid written form of divorce, and how national law regulates formal divorce through the mechanism of the judicial institution. This study uses a qualitative method with a normative legal approach, namely examining the sources of classical and modern Islamic law, as well as the provisions of regulations in force in Indonesia, such as the Marriage Law, Compilation of Islamic Law, and other laws related to the law of divorce through social media. The results of this study indicate that Islamic law, divorce through social media is considered valid if it meets the requirements such as the existence of a clear or implied talaq statement accompanied by an intention, even though it is not said directly. On the other hand, in the Indonesian national legal system, divorce is only valid if it is decided by the Religious Court through a conference process. Thus, there is a difference in orientation between the two, namely Islamic law which emphasizes substantial and spiritual aspects, while national law emphasizes formality and procedure. Therefore, harmonization is needed between these two approaches so that the resolution of divorce cases can reflect the values of justice, welfare, and legal certainty in family and community life.

Abstract

This study aims to analyze the legality of YouTuber income from an Islamic economic perspective, especially in relation to the content produced and advertisements displayed through the Google AdSense program. The main focus of this study is to review the halal or haram status of YouTuber income based on sharia principles, as well as to understand the form of contract that underlies the cooperation between YouTubers and advertising providers. This study uses a library research method by reviewing Islamic literature, fatwas of the Indonesian Ulema Council, books, scientific journals, and other relevant documents related to muamalah law and digital media. The results of the study show that the profession of YouTuber is permissible in Islam as long as the uploaded content does not violate sharia. The permissibility of income from AdSense depends heavily on two things: content and type of advertisement. If both are in accordance with Islamic values, then the income is halal and even obligatory to be zakat if it meets the nisab and haul. From the perspective of the contract, the collaboration between YouTubers and Google AdSense can be categorized as syirkah abdan and ju'alah, which is valid as long as it meets the requirements such as clarity of the agreement, the consent of both parties, and is free from elements of usury, gharar, and maysir. The MUI fatwa emphasizes that transactions through social media must reflect faith, piety, and noble morals, and avoid all forms of content or activities that damage sharia values. Therefore, Muslim YouTubers have a sharia responsibility to maintain the integrity of content and digital ethics in all their activities. Keywords: Legality, YouTuber Income, Islamic Law

Abstract

The development of Islamic economics demands adaptive legal regulations to address new issues not explicitly addressed in the Qur'an and Hadith. Islamic jurisprudence (qawa'id fiqhiyyah) serves as a crucial legal basis for establishing and interpreting Islamic economic law to ensure its adherence to Islamic principles. This is crucial for strengthening justice, transparency, and sustainability in Islamic economics. This study aims to examine the role of Islamic jurisprudence (qawa'id fiqhiyyah) as a conceptual pillar in the development of Islamic economics, focusing on how Islamic legal principles within these principles serve as a normative basis for formulating economic policies and practices that align with Islamic values. The method used is a qualitative jurisprudential-normative approach through a literature review of classical and contemporary literature. The results of this study indicate that Islamic jurisprudence facilitates the interpretation and enforcement of laws for modern economic transactions, guarantees the validity of contracts, protects ownership rights, and promotes justice, accountability, and transparency in Islamic economics. The implication of this research is that the application of Islamic jurisprudence as a normative framework can strengthen the governance of Islamic financial institutions, assist in the formulation of equitable economic policies, and encourage innovation in financial products in accordance with Islamic principles that are adaptive to the dynamics of the times. Thus, Islamic jurisprudence is a vital instrument in maintaining the integrity and sustainability of the Islamic economy while simultaneously increasing public trust and sustainable Islamic financial inclusion.   Perkembangan ekonomi syariah menuntut aturan hukum yang adaptif untuk mengatasi persoalan baru yang belum diatur secara eksplisit dalam Al-Qur’an dan Hadits. Qawa’id fiqhiyyah menjadi landasan hukum penting untuk menetapkan dan menafsirkan hukum ekonomi syariah agar tetap sesuai prinsip syariah. Hal ini krusial untuk memperkuat keadilan, transparansi, dan keberlanjutan dalam ekonomi syariah. Penelitian ini bertujuan untuk mengkaji peran qawa’id fiqhiyyah sebagai pilar konseptual dalam pengembangan ekonomi syariah, sekaligus menawarkan suatu kerangka konseptual berupa sintesis kaidah-kaidah fiqhiyyah yang relevan bagi ekonomi syariah kontemporer. Kebaruan penelitian ini terletak pada sintesis qawa’id fiqhiyyah muamalah sebagai kerangka normatif sistematis bagi pengembangan ekonomi syariah kontemporer.  Metode yang digunakan adalah kualitatif dengan pendekatan yuridis-normatif melalui studi pustaka dari literatur klasik dan kontemporer. Hasil penelitian ini menunjukkan bahwa qawa’id fiqhiyyah memberikan kemudahan dalam menafsirkan dan menetapkan hukum terhadap transaksi ekonomi modern, menjamin keabsahan akad, melindungi hak kepemilikan, dan mendorong keadilan, tanggung jawab, serta transparansi dalam ekonomi Islam. Implikasi dari penelitian ini adalah penerapan kaidah fiqh sebagai kerangka berpikir normatif dapat memperkuat tata kelola lembaga keuangan syariah, membantuk perumusan kebijakan ekonomi berkeadilan, serta mendorong inovasi produk keuangan sesuai prinsip syariah yang adaptif terhadap dinamika zaman. Dengan demikian, qawa’id fiqhiyyah  menjadi instrumen vital dalam menjaga integritas dan keberlanjutan ekonomi syariah sekaligus meningkatkan kepercayaan publik dan inklusi keuangan syariah secara berkelanjutan.

Abstract

This study aims to analyze the tradition of prohibiting marriage during the month of Muharram, which is still believed by the people of Pasaman Regency, West Sumatra, and to examine this practice from the perspective of Islamic law (fiqh al-munakahat). This tradition is rooted in the belief that marriage during Muharram may bring misfortunes such as conflict, divorce, or even death; therefore, the community tends to avoid holding weddings in that month. This research employs a qualitative method with a field research approach through observation and interviews with residents of Jorong Air Abu, Bonjol District; Jorong Sundata, Lubuk Sikaping District; and Jorong Sungai Ranyah Mudik, Rao Utara District, as key informants. The findings indicate that most of the community still upholds this tradition and relies on customary calculations in determining the timing of marriage as a form of respect for ancestral heritage. However, from the perspective of Islamic law, there is no textual evidence in the Qur’an or Hadith that prohibits marriage in any specific month, including Muharram. Therefore, this marriage prohibition is not based on shar‘i law but rather represents a local cultural belief reflecting the community’s perception of auspicious and inauspicious times in marital life. Penelitian ini bertujuan untuk menganalisis tradisi larangan menikah pada bulan Muharram yang masih diyakini oleh masyarakat Kabupaten Pasaman, Sumatera Barat, serta meninjau praktik tersebut dalam perspektif hukum Islam (fiqh al-munakahat). Tradisi ini berakar dari keyakinan bahwa menikah pada bulan Muharram dapat mendatangkan kemudaratan seperti pertengkaran, perceraian, bahkan kematian, sehingga masyarakat cenderung menghindari pelaksanaan pernikahan pada bulan tersebut. Penelitian ini menggunakan metode kualitatif dengan pendekatan lapangan melalui observasi dan wawancara terhadap masyarakat di Jorong Air Abu Kecamatan Bonjol, Jorong Sundata Kecamatan Lubuk Sikaping, dan Jorong Sungai Ranyah Mudik Kecamatan Rao Utara sebagai informan kunci. Hasil penelitian menunjukkan bahwa sebagian besar masyarakat masih mempertahankan tradisi ini dan melakukan perhitungan adat dalam menentukan waktu pernikahan sebagai bentuk penghormatan terhadap warisan leluhur. Namun, dalam perspektif hukum Islam, tidak ditemukan dalil yang melarang pernikahan pada bulan tertentu, termasuk bulan Muharram. Dengan demikian, tradisi larangan menikah ini tidak memiliki dasar hukum syar‘i dan lebih bersifat budaya lokal yang mencerminkan sistem kepercayaan masyarakat terhadap waktu yang dianggap membawa keberuntungan atau kesialan dalam kehidupan rumah tangga.
