Abstract

This research raises the problem of Household Dispute Resolution Perspective Tafsir Buya Hamka  Against Surat An Nisa Verse 34 - 35. The purpose of this study to describe the Settlement of Household Dispute Perspective Tafsir Buya Hamka  Against Surat An Nisa Verse 34 - 35. The method used  in research Library research. The results  of this study that by overcoming the  wickedness of the  wife by giving advice  and  guidance, separating the  bed  or silent  in bed,  and  a resuscitate punch. In the case  of husband nusyuz, Islam offers peace, could  with the initiative of the wife of both parties introspection each  other. In order to maintain a home network, being mutually legowo  to give the best for the couple is a recommendation. If indeed both parties  are no longer able to be reconciled, you should  take a way by using a good 3rd party is willing to solve the problem.

Abstract

Abstract : This research was conducted to describe the basis for consideration by the Religious Court Judge in granting the judge's guardian's request in the marriage contract because the guardian's lineage is adhal. The type of research used in this research is normative legal research using qualitative analysis. Based on the results of the research which became the basis for the judge's consideration in granting the request of the guardian judge in the marriage contract because the guardian of the nasab was adhal, namely firstly the fulfillment of all the requirements and terms of marriage by the prospective bride and groom based on the provisions of the applicable laws and regulations, the second reason the guardian of the nasab refused to become the guardian of the nasab marriage in the marriage contract was not in accordance with the applicable legal regulations and the third was for the benefit of the two prospective bride and groom, that with the marriage (with the guardian of the judge) there would arise or be expected to come. benefit or goodness for the parties involved in the marriage.Keywords: Marriage Contract, Guardian Nasab Adhal, Guardian Judge. Abstrak : Penelitian ini dilakukan untuk mendeskripsikan dasar pertimbangan Hakim Pengadilan Agama mengabulkan permohonan wali hakim dalam akad nikah dikarenakan wali nasab adhal. Jenis penelitian yang digunakan dalam penelitian ini adalah jenis penelitian hukum normatif menggunakan analisis kualitatif. Berdasarkan hasil penelitian yang menjadi dasar pertimbangan hakim mengabulkan permohonan wali hakim dalam akad nikah dikarenakan wali nasab adhal yaitu pertama terpenuhinya semua syarat dan rukun nikah oleh kedua calon mempelai berdasarkan ketentuan Peraturan Perundang-Undangan yang berlaku, yang kedua alasan wali nasab menolak untuk menjadi wali nikah nasab dalam akad nikah tidak sesuai dengan aturan hukum yang berlaku dan yang ketiga untuk kemaslahatan kedua calon mempelai, bahwa dengan dilangsungkannya pernikahan (dengan wali hakim tersebut) akan timbul atau diharapkan datangnya suatu kemaslahatan atau kebaikan bagi para pihak yang terlibat dalam pernikahan tersebut.Kata Kunci : Akad Nikah, Wali Nasab Adhal, Wali Hakim.

Abstract

Abstract: The main problem of this research is that marriages with the status of guardian judge can be held in unregistered marriages. It can be seen how a marriage is carried out with the status of guardian judge in unregistered marriages from the perspective of both laws, namely positive and Islamic law. This research uses a type of field research, namely direct research in the field, where the researcher visits the research object. This research data was collected using a qualitative approach. Researchers chose Kepahiang Regency as the research object. This research found two things, namely as follows: there are marriages with the status of guardian judge in unregistered marriages which can be carried out because the headman carries out his duties based on the provisions in the Marriage Law or KHI as well as other provisions which are still related to headship and not all problems it can be resolved with existing provisions, in such circumstances the headman exercises legal discretion that is not in accordance with existing provisions. Then, the view of Islamic law regarding the transfer of guardianship rights in the marriage bond of the guardian of the family to the guardian of the judge is an emergency legal provision. This transfer of guardianship is seen as emergency law. According to KHI, this trust is considered legally valid by fulfilling the terms and conditions contained in KHI and munakahat fiqh as the basis of Islamic law.Keywords: Guardian Judge Status, Unregistered Marriage, Positive Law and Islamic Law. Abstrak: Permasalahan utama penelitian ini terdapat pada pelaksanaan nikah berstatus wali hakim dapat dilangsungkan pada pernikahan tidak tercatat. Dilihat bagaimana pelaksanaan nikah dengan status wali hakim pada pernikahan tidak tercatat dari pandangan kedua hukum yaitu positif dan hukum Islam. Penelitian ini menggunakan jenis penelitian field research yaitu penelitian langsung ke lapangan, dimana peneliti mengunjungi objek penelitian. Data penelitian ini dihimpun dengan menggunakan pendekatan kualitatif. Peneliti memilih di Kabupaten Kepahiang sebagai objek penelitian. Penelitian ini menemukan dua hal yaitu sebagai berikut: terdapat pelaksanaan nikah dengan berstatus wali hakim pada pernikahan tidak tercatat dapat dilangsungkan karena penghulu menjalankan tugasnya berlandaskan pada ketentuan yang ada pada Undang-Undang Perkawinan atau KHI serta ketentuan lain yang masih berhubungan dengan kepenghuluan dan tidak semua permasalahan itu dapat diselesaikan dengan ketentuan yang ada, pada keadaan demikian penghulu melakukan diskresi hukum yang tidak sesuai dengan ketentuan yang ada. Kemudian, pandangan hukum Islam dari beralihnya hak perwalian dalam ikatan pernikahan wali nasab kepada wali hakim adalah ketentuan hukum yang darurat beralihnya perwalian ini dipandang sebagai hukum darurat. Menurut KHI perwalian ini dipandang sah hukumnya dengan memenuhi syarat dan ketentuan yang ada dalam KHI dan fiqih munakahat sebagai dasar hukum Islam.Kata kunci: Status Wali Hakim, Pernikahan Tidak Tercatat, Hukum Positif dan Hukum Islam.

Abstract

Consideration Of The Judge On Isbat Nikah In Religious Court Of Curup Viewed From The Effort Of Establishing Harmonious Family. Marriage is one of the instinctive needs of man. To ensure the sanctity and holiness of marriage is maintained, then the state is in this case the government took over to set it up in order to achieve the purpose of marriage is essential to the necessity of recording the wedding on the authorities. But the fact in the community turned out there were people who did not record the wedding and marriage to the authorities. To resolve these problems, the state set by specifying the possibility of isbat nikah application efforts through the Religious Courts. This research is a field research in the form of case studies, using qualitative method, through a normative juridical approach. The results showed that in the case isbat nikah, a lot of consideration of the judge who did not institute the legal basis regulating this matter which is a compilation of Islamic law article 7, so a lot of determination or decision in isbat wedlock is not appropriate because it does not contain elements of fairness / philosophical certainty legal / normative or juridical and benefits / sociological. Consequently, there is underestimation on the institution of marriage by not registering the marriage, lax morality of premarital promiscuity, and leads to the difficulties materialize harmonious family.

Abstract

Abstract : This research has several problems, first, how to implement the cepalo tigo customary sanctions against adulterers in Rawa Indah Village, Ilir Talo District, Seluma Regency. Second, what is the view of Islamic law regarding customary sanctions against perpetrators of adultery from the perspective of al-mashlahah murlah in Rawa Indah Village, Ilir Talo District, Seluma Regency. The method used in this research is field research, where data has been collected through interviews, observation and documentation. The results of this research show that the customary sanctions made by the leaders of the Rawa Indah village in Seluma Regency are as follows: First, the perpetrator of adultery is given a fine. Second, the fine is used to buy goats and for village social causes. Third, the goat is slaughtered and then its blood is sprinkled in the four corners of the village. In the customary sanctions against perpetrators of adultery there is still an element of shirk because there is blood being sprinkled in the four corners of the village to fence off the village to avoid this disgraceful act. The three sanctions that still contain shirk should be abolished, the fourth is that the benefits and benefits of implementing them are effective, because since the implementation of these sanctions, the number of adulterers has been reduced. Abstrak :Pada penelitian ini mempunyai beberapa masalah pertama, Bagaimana pelaksanaan sanksi Adat Istiadat cepalo tigo terhadap pelaku zina di Desa Rawa Indah Kecamatan Ilir Talo Kabupaten Seluma. Kedua Bagaimana Pandangan hukum islam terhadap sanksin adat istiadat terhadap pelaku zina perspektif al-mashlahah mursalah di Desa Rawa Indah Kecamatan Ilir Talo Kabupaten Seluma. Metode yang digunakan dalam penelitian ini adalah penelitian lapangan, dimana data-data telah dikumpulkan melalui wawancara, observasi, dan dokumentasi. Hasil penelitian ini menunjukkan bahwa sanksi adat istiadat yang dibuat oleh tokoh-tokoh desa rawa indah di Kabupaten Seluma sebagai berikut: Pertama, pelaku zina ditetapkan denda. Kedua, denda tersebut digunakan untuk membeli kambing dan untuk sosial desa. Ketiga, kambing tersebut disembelih kemudian darahnya dipercikkan ke empat penjuru desa. Dalam sanksi adat istiadat terhadap pelaku zina masih ada unsur kesyirikan karna adanya memerckkan darah ke empat penjuru desa untuk memagari desa agar terhindar dari perbuatan tercela tersebut. Ketiga sanksi yang masih mengandung kesyirikan mestinya harus ditiadakan, keempat kemaslahatan dan kemanfaatannya diberlakukan sanksinya termasuk efektif karna semenjak dilaksanakannya sanksi tersebut telah mengurangi angka pelaku zina. Abstract

Abstract: Data collection techniques using the Document Method (Documentation). The conclusion results state that, 1) As for the juridical review of Issuance of family cards for unregistered married couples, this is the right policy. However, the issuance of a family card for unregistered married couples does not constitute state legitimacy in legalizing unregistered marriages, but only as an affirmative policy for the time being until marriage registration or marriage registration/certification of marriages is carried out. Family cards for unregistered spouses are a solution to population administration problems. However, the Family Card does not legalize the occurrence of a marriage, but only accelerates the population administration data collection process at the Population and Civil Registry Service. 2) Issuance of family cards for married couples who are not registered according to the perspective of maslahah mursalah is included in Al-Maslahah al-Tahsiniyah, is a maslahah whose human life needs do not reach the dharuri level, nor do they reach the hajji level, but these needs need to be met in order provide perfection and beauty to human life. Maslahah in the form of tahsini is also related to the five basic human needs. Benefit in this case is guaranteeing population administration rights for unregistered married couples, realizing the wishes of unregistered married couples in obtaining population rights, realizing orderly national population administration, collecting data on unregistered marriages to be encouraged to perform marriage certificates, and realizing population administration which is not discriminatory.Keywords: Family Card, Unrecorded Marriage, Maslahah Mursalah Perspective Abstract: Teknik pengumpulan data menggunakan Metode Dokumen (Documentation). Hasil kesimpulan menyatakan bahwa, 1) Adapun tinjaun yuridis terhadap Penerbitan kartu keluarga bagi pasangan perkawinan tidak tercatat adalah kebijakan yang sudah tepat. Akan tetapi, penerbitan kartu keluarga bagi pasangan nikah tidak tercatat bukan merupakan legitimasi negara dalam melegalkan perkawinan tidak tercatat, namun hanya sebagai kebijakan afirmatif untuk sementara waktu sampai dilaksanakan pencatatan perkawinan atau isbat nikah/pengesahan perkawinan. Kartu Keluarga bagi pasangan tidak tercatat merupakan solusi terhadap masalah administrasi kependudukan. Akan tetapi, Kartu Keluarga tersebut tidak mengesahkan terjadinya suatu perkawinan, melainkan hanya mempercepat proses pendataan administrasi kependudukan pada Dinas Kependudukan dan Catatan Sipil. 2) Penerbitan kartu keluarga bagi   pasangan perkawinan tidak tercatat menurut persepktif maslahah mursalah masuk ke dalam Al-Maslahah al-Tahsiniyah, adalah maslahah yang kebutuhan hidup manusia kepadanya tidak sampai pada tingkat dharuri, juga tidak sampai tingkat hajji, namun kebutuhan tersebut perlu dipenuhi dalam rangka memberi kesempurnaan dan keindahan bagi hidup manusia. Maslahah dalam bentuk tahsini tersebut juga berkaitan dengan lima kebutuhan pokok manusia. Kemaslahatan dalam hal ini yakni menjamin hak administrasi kependudukan bagi pasangan perkawinan tidak tercatat, mewujudkan keinginan pasangan perkawinan tidak tercatat dalam mendapatkan hak-hak kependudukan, mewujudkan tertib administrasi kependudukan secara nasional, terkumpulnya data perkawinan tidak tercatat untuk didorong melakukan isbat nikah, serta terwujudnya administrasi kependudukan yang tidak diskriminatif.Kata kunci : Kartu Keluarga, Perkawinan Tidak Tercatat, Perspektif Maslahah Mursalah

Abstract

Abstract: There is a phenomenon on the internet called doxing or the act of publishing private information about someone on the internet, typically with malicious intent. Doxing act violates people rights of their privacy of personal data. Not only with malicious intent, doxing act often carried out by victims of crime to seek justice. This study aims to determine the application of the protection of personal data principals from doxing act in ITE Law and to identify the legal liability of doxing actions on social media that is carried out by victims of crime in related to the concept of privacy protection.This research was conducted using normative juridical approach and descriptive analytical research specifications, namely by describing the issue with the phenomenon being studied as the research object, in this case doxing act, and then reviewed with secondary data. The data analysis was carried out using a qualitative juridical method.The results of the study show that in the ITE Law, the protection of personal data from doxing act can be found in Article 26 (1) regarding the consent to disclose personal data, Article 27 (1), (3), and (4) regarding to the content of personal data that is disclosed, and Article 30 (2) regarding to the method in obtaining the content or personal data that is disclosed. Doxing actions on social media carried out by victims of crime to seek justice in the concept of privacy protection can be held legally responsible under the ITE Law Article 26 by filing a lawsuit, criminal sanctions and fines based on Article 45 (1), (3), and (4) and Article 46 (2), or administrative sanctions based on the Ministry of Communication and Informatics Regulation No. 20 of 2016 Article 36 such as verbal and written warnings, temporary suspension of activities and/or announcements on online websites. Keywords: Privacy and Personal Data Protection, Doxing, Legal Liability Abstrak: Terdapat fenomena di internet yaitu tindakan doxing atau tindakan mempublikasikan data pribadi seseorang tanpa izin di internet dengan maksud atau niat jahat. Tindakan doxing melanggar privasi seseorang atas data pribadinya. Tidak hanya dengan maksud atau niat jahat, tindakan doxing sering dilakukan korban kejahatan untuk mencari keadilan. Penelitian ini bertujuan untuk mengetahui penerapan prinsip-prinsip perlindungan data pribadi dari tindakan doxing dalam UU ITE serta untuk mengidentifikasi pertanggungjawaban hukum atas tindakan doxing di media sosial yang dilakukan oleh korban kejahatan dikaitkan dengan konsep perlindungan privasi.Penelitian ini dilakukan menggunakan metode pendekatan yuridis normative dengan spesifikasi penilitian deskriptif analitis yaitu dengan menggambarkan permasalahan terkait peristiwa yang menjadi objek penelitian, dalam hal ini tindakan doxing, kemudian ditinjau dengan data sekunder. Kemudian dilakukan analisis data dengan metode yuridis kualitatif.Hasil penelitian menunjukkan bahwa dalam UU ITE perlindungan data pribadi dari tindakan doxing dapat ditemukan pada Pasal 26 ayat 1 berkaitan ada atau tidaknya persetujuan (consent) diungkapkan suatu data pribadi, Pasal 27 ayat 1, 3 dan 4 berkaitan dengan muatan atau bentuk data pribadi yang diungkapkan, serta Pasal 30 ayat 2 berkaitan cara perolehan muatan atau data pribadi yang diungkapkan. Tindakan doxing di media sosial yang dilakukan oleh korban kejahatan untuk mencari keadilan secara konsep perlindungan privasi dapat diminta pertanggungjawaban hukum berdasarkan UU ITE Pasal 26 dengan mengajukan gugatan perbuatan melawan hukum, penjatuhan sanksi pidana dan denda sesuai Pasal 45 ayat 1, 3 dan 4 dan Pasal 46 ayat 2 atau dengan sanksi administratif sesuai Permen Kominfo 20/2016 Pasal 36 berupa peringatan lisan, tertulis, penghentian sementara kegiatan dan/atau pengumuman di situs dalam jaringan (website online). Abstract

Abstracts: The countries of Egypt and Sudan share a close historical and legal relationship. Egypt has undertaken the codification of family law since the 18th century, while Sudan has not done yet so. However, both nations continue to pursue reforms in family law, specifically drawing from the Hanafi school of thought. The focus of this paper begins with the question of how Islamic family law reforms have manifested in Egypt and Sudan, particularly within the realm of family law. The approach taken adopts a descriptive method with a historical-legal perspective, encompassing the first, the general historical development of family law in both countries, and the second, the application of family law in Egypt and Sudan. This research reveals that both Egypt and Sudan have undergone transformations in family law, considering societal, cultural, and temporal developments, while still upholding and adhering to the principles of Sharia law.Keywords: Law, Family, Egypt, Sudan Abstrak: Negara Mesir dan negara Sudan memiliki hubungan sejarah dan hukum yang erat antara satu sama lain. Mesir telah melakukan kodifikasi hukum keluarga sejak abad ke-18, sementara Sudan sebelumnya tidak pernah melakukannya. Namun, kedua negara ini terus melakukan reformasi hukum keluarga, dengan mengacu khusus pada madzhab Hanafi. Fokus tulisan ini berawal dari pertanyaan bagaimana bentuk reformasi hukum keluarga Islam di Mesir dan Sudan, terutama dalam konteks hukum keluarga. Pendekatan yang diambil adalah pendekatan deskriptif dilakukan dengan mengadopsi perspektif historis-yuridis, yang mencakup pertama sejarah perkembangan hukum keluarga secara umum di kedua negara, dan kedua penerapan hukum keluarga di Mesir dan Sudan. Penelitian ini menunjukkan bahwa negara Mesir dan negara Sudan telah mengalami perubahan (transformasi) dalam hukum keluarga yang memperhatikan perkembangan social, budaya masyarakat serta perkembangan zaman (modernisasi), dengan tetap mempertahankan dan berpegang teguh pada prinsip-prinsip syariah.Kata kunci: hukum, keluarga, Mesir Sudan.

Abstract

This research  raises the problem  about  the implementation of parent  grants to children between  justice and  equity in urban  village of Bengkulu.  This research  method using qualitative  research  method. The results of this study concluded that the implementation of parental grants to children in the perspective of civil law in the community in Betungan Village Bengkulu City has implemented a grant in accordance with article 1667  contained in the Book of Civil Law, an agreement, with which a grantee  deliver a good Free of charge,  without being able to withdraw it, for the benefit of a person  who received the delivery of the merchandise. The law only recognizes grants among  the living. (KUHPerd 170, 172ff., 179, 913, 1314,  1675,  1683,  1688.). Implementation of parent  grants to children  in the perspective of Islamic law in the community in Betungan Village Bengkulu City, Implementation of grants conducted by the community in Betungan Village has been  implemented well, and  follow the rules in accordance with the provisions.  Being fair and  equating giving to children  is obligatory.  Doing tafdhil (exaggeration) is forbidden, except  when  there  are factors that allow it. It is permissible  to treat others  against  fellow children if there  are any exclusionary  factors justified in the case  of a disability that makes  a person  unable  to work in search  of a livelihood  such as paralysis, blindness,  inability to work, to seek knowledge  and others

Abstract

Abstracts: This study aims to examine the implementation of Law Number 16 of 2019 in Air Dikit District and analyze it from the perspective of Maqasid Sharia. This is a field research using a qualitative descriptive approach. The results indicate that the implementation of Law Number 16 of 2019 concerning Marriage has been fairly well optimized. However, some members of the community are still reluctant to apply for a dispensation when the prospective bride or groom has not reached the minimum legal age, as stipulated in the law. As a result, some marriages are carried out unofficially (sirri). The reluctance is generally due to time constraints and urgent conditions that demand the marriage to be held immediately, whereas the dispensation process is considered time-consuming and procedurally complex. From the perspective of Maqasid Sharia, the provision regarding age maturity in Law Number 16 of 2019 aligns with the five fundamental objectives of Islamic law: hifz al-din (protection of religion), hifz al-‘aql (protection of intellect), hifz al-mal (protection of wealth), hifz al-nasl (protection of lineage), and hifz al-nafs (protection of life). Thus, raising the minimum age of marriage is a step that reflects Islamic values and promotes the well-being of family life.Keywords: Implementation, Law Number 16 of 2019, Maqasid Syariah.Abstrak : Penelitian ini bertujuan untuk mengetahui implementasi Undang-Undang Nomor 16 Tahun 2019 di Kecamatan Air Dikit serta menganalisisnya dalam perspektif Maqasid Syariah. Penelitian ini merupakan penelitian lapangan dengan pendekatan deskriptif kualitatif. Hasil penelitian menunjukkan bahwa implementasi Undang-Undang Nomor 16 Tahun 2019 tentang Perkawinan telah berjalan cukup baik. Namun demikian, masih ditemukan masyarakat yang enggan mengajukan dispensasi bagi calon mempelai yang belum mencapai usia minimal sebagaimana diatur dalam undang-undang, sehingga mereka memilih melangsungkan pernikahan secara sirri. Faktor penyebabnya antara lain karena keterbatasan waktu dan kondisi mendesak yang menuntut pernikahan segera dilaksanakan, sedangkan proses sidang dispensasi dianggap memakan waktu dan prosedurnya cukup panjang. Dalam perspektif Maqasid Syariah, ketentuan mengenai pendewasaan usia dalam Undang-Undang Nomor 16 Tahun 2019 sejalan dengan lima tujuan utama syariat, yaitu hifz al-din (menjaga agama), hifz al-‘aql (menjaga akal), hifz al-mal (menjaga harta), hifz al-nasl (menjaga keturunan), dan hifz al-nafs (menjaga jiwa). Dengan demikian, peningkatan usia minimal perkawinan merupakan langkah yang sesuai dengan nilai-nilai syariat Islam demi tercapainya kemaslahatan dalam kehidupan berkeluarga.Kata kunci : Implementasi, UU Nomor 16 tahun 2019, Maqasid Syariah.
