Abstract

Penelitian ini bertujuan untuk menganalisis Prosedur Pengangkatan Anak Menurut Kitab Undang-Undang Hukum Perdata (KUHPerdata) Di Indonesia serta mengetahui Kedudukan Anak Angkat Dalam Memperoleh Hak Waris Di Indonesia. Secara umum, KUHPerdata mengatur bahwa hak waris hanya diberikan kepada ahli waris yang memiliki hubungan darah dengan pewaris, sehingga anak angkat tidak secara otomatis berhak atas warisan dari orang tua angkatnya. Namun, orang tua angkat dapat memberikan hak waris melalui wasiat atau hibah yang sah secara hukum. Penelitian ini menggunakan pendekatan normatif dengan mengkaji berbagai ketentuan hukum yang mengatur pengangkatan anak, hak waris, dan perbedaan antara hukum perdata, hukum Islam, dan hukum adat terkait hak waris anak angkat. Hasil penelitian menunjukkan bahwa meskipun anak angkat tidak memiliki hak waris otomatis, mereka masih bisa memperoleh hak waris melalui mekanisme wasiat, hibah, atau perjanjian hukum lainnya. Oleh karena itu, disarankan agar masyarakat lebih memahami pentingnya pembuatan wasiat atau hibah untuk memberikan perlindungan hukum bagi anak angkat, serta perlunya reformasi regulasi yang lebih jelas mengenai hak waris anak angkat dalam sistem hukum Indonesia.

Abstract

Penelitian ini bertujuan untuk mendeskripsikan implementasi model pembelajaran Discovery Learning terhadap kemampuan berpikir kritis peserta didik pada mata pelajaran Pendidikan Pancasila di SMK YPPP Wonomulyo. Discovery Learning merupakan model pembelajaran yang menekankan pada proses pencarian dan penemuan pengetahuan secara mandiri oleh peserta didik. Melalui pendekatan ini, peserta didik didorong untuk aktif dalam mengamati, mengolah informasi, dan menyimpulkan konsep, sehingga kemampuan berpikir kritis mereka dapat berkembang secara optimal. Penelitian ini menggunakan metode deskriptif kualitatif dengan jenis data primer dan sekunder. Data primer diperoleh melalui observasi kegiatan pembelajaran, wawancara dengan guru dan peserta didik, serta dokumentasi proses belajar.Sementara itu, data sekunder diperoleh dari dokumen penunjang seperti Modul Ajar, dan hasil evaluasi belajar siswa. Analisis data dilakukan melalui reduksi data, penyajian data, dan penarikan kesimpulan. Hasil penelitian menunjukkan bahwa implementasi model Discovery Learning dalam mata pelajaran Pendidikan Pancasila mampu meningkatkan kemampuan berpikir kritis peserta didik, khususnya dalam hal mengidentifikasi isu-isu kebangsaan, menganalisis nilai-nilai Pancasila, serta merumuskan solusi atas permasalahan sosial. Peserta didik menjadi lebih aktif, reflektif, dan memiliki keberanian untuk mengemukakan pendapat. Namun, pelaksanaan model ini juga menghadapi kendala, seperti keterbatasan waktu pembelajaran dan perbedaan tingkat kesiapan belajar antar peserta didik. Meskipun demikian, model Discovery Learning terbukti memberikan kontribusi positif terhadap peningkatan kualitas proses dan hasil belajar Pendidikan Pancasila di SMK YPPP Wonomulyo.

Abstract

Tujuan penelitian ini adalah untuk menentukan penyelesaian sengketa kewenangan antara lembaga negara di Indonesia. Lembaga negara memiliki kewenangan masing-masing, dan kewenangan tersebut dapat menimbulkan sengketa antara lembaga negara. Namun, dalam konteks administrasi negara, sengketa kewenangan antara lembaga negara dapat terjadi akibat munculnya prinsip checks and balances, yang mengakibatkan saling mengontrol antara satu cabang kekuasaan dengan cabang kekuasaan lainnya, serta interpretasi kewenangan lembaga negara dan sebagainya. Institusi negara yang memiliki kedudukan hukum dalam sengketa kewenangan antara institusi negara adalah institusi negara yang kewenangannya dapat berupa kewenangan atau hak dan kewajiban yang diberikan oleh Undang-Undang Dasar 1945. Proses penyelesaian sengketa kewenangan institusi negara tidak memiliki batasan yang pasti mengenai ruang lingkup dan definisi “institusi negara” serta frasa “kewenangan yang diberikan oleh Undang-Undang Dasar” dalam Undang-Undang Dasar 1945. Hal ini menimbulkan berbagai interpretasi mengenai lembaga negara mana yang dapat menjadi pihak dalam sengketa kewenangan lembaga negara. Dalam setiap kasus, Mahkamah Konstitusi memberikan interpretasi mengenai lembaga negara yang dapat menjadi pihak, baik sebagai subjectum litis maupun objectum litis.

Abstract

This study aims to describe the lingual units used in the utilization activities of Mbah Tonjong River by the people of Kedung Glatik Hamlet, as well as to examine the relationship between language and local culture reflected in the use of these lingual units. The approach used is qualitative with the method of language ethnography, where data is collected through participatory observation, in-depth interviews, and documentation. The analysis was conducted using the Sapir-Whorf ethnolinguistic theory which emphasizes that language shapes people's perspective and socio-cultural reality. The results show that lingual units in activity expressions such as adus kali, jeguran, kungkum, as well as ritual terms such as nazar and munjung not only function as naming activities, but also reflect cultural values, belief systems, and meaning constructions that live in the community. Thus, language in this context becomes an important medium in maintaining cultural identity while representing the community's relationship with their natural and spiritual environment. This research contributes to the development of ethnolinguistic studies and the preservation of local languages and cultures.

Abstract

This study aims to examine the legal protection provided by international humanitarian law to combatants who become prisoners of war during armed conflict, as well as to identify the legal mechanisms applied to address violations of this protection. The methods used in this study include a legal approach, case analysis, and conceptual review. The findings of this study reveal that international humanitarian law, particularly the 1949 Geneva Conventions, provides comprehensive protection for prisoners of war, including basic rights such as humane treatment, health, and welfare, as well as preventing torture or cruel treatment. The Conventions ensure that the rights of combatants are respected without discrimination, even when they are under enemy control. Enforcement mechanisms involve the obligation of states to adopt national laws in accordance with the Convention and to prosecute serious violations through national courts, with the support of international mechanisms such as ad hoc tribunals and the International Criminal Court (ICC) if necessary.

Abstract

This study aims to (i) analyze the process of fire performance in Gattareng Village, Pujananting District, Barru Regency. (ii) analyze the dialectic of Bugis and Islamic culture in the Sere api performance in Gattareng Village, Pujananting District, Barru Regency. (iii) analyze the cultural changes contained in the fire sere performance in Gattareng Village, Pujananting District, Barru Regency. This type of research is a qualitative research by presenting data in the form of narrative-descriptive, which aims to provide an in-depth understanding related to the Sere api Performance in Gattareng Village, Pujananting District, Barru Regency by interviewing 7 informants. The data collection techniques in this study are observation, interviews and documentation. As well as using the source triangulation data validity technique. The results of the study show that (i) the performance process which is divided into three main stages of preparation, implementation, and closing shows the depth of cultural meaning and spirituality of the community. The preparatory stage reflects gratitude and well-being through young rice harvests and purification rituals. The performance of the performance, which is characterized by the sound of mortars and a procession of fireworks, depicts the courage and inner strength of the participants, as well as the spiritual transformation that occurs during the ritual. The end of the performance, which is marked by the extinguishing of the fire and the harmony of movement, signifies the completion of the ritual in a sacred way. (ii) This tradition is not just a physical performance, but a ritual that combines traditional values (pangngadereng) with Islamic teachings in a complementary way. No conflict was found between the two; On the contrary, Islamic values provide a spiritual and moral framework for the implementation of rituals, while Bugis culture provides the structure and form of expression of the rite. (iii) The Sere api performance has not undergone significant changes from year to year. The procession is still carried out according to the traditional pattern as a form of respect for the ancestors and a symbol of the community's cultural identity. However, there is flexibility in terms of the time and location of the performance.

Abstract

In the context of secondary education, the Strategic Plan (Renstra) is an essential instrument in directing the implementation of school performance in a structured and long-term orientation. This study aims to evaluate the implementation of the Strategic Plan-based school performance implementation system in Minahasa Regency, by highlighting the integration of strategies into managerial practices, leadership effectiveness, and stakeholder participation. Using a qualitative approach of case studies, data was collected through in-depth interviews, participatory observations, document analysis, and questionnaires that were distributed to school principals, teachers, education staff, and school committees. The study results show that although most schools have prepared the Strategic Plan document according to the provisions, its implementation has not been thoroughly internalized in daily operational management. Many schools still position the Strategic Plan as an administrative document without integrating it into the evaluation and strategic decision-making process. The role of the principal as a strategic leader greatly determines the success of the implementation, but the uneven leadership capacity is a significant challenge. Stakeholdeconsider the Strategic Planr participation, especially teachers and the community, is also still minimal, while the evaluation system does not use comprehensively structured performance indicators. These findings underscore the importance of strengthening collaborative organizational culture, strategic leadership training, and the development of data-driven performance measurement systems. This research contributes to the literature on strategic education management. It opens opportunities for further exploration related to the digitalization of the Strategic Plan and the integration of strategy-based school performance evaluation.

Abstract

Digital transformation in the health sector requires an innovative and adaptive information management system, one of which is through the implementation of Electronic Medical Record (EMR). This study aims to evaluate the role of creativity and innovation management in improving the performance of EMR use at Hermina Manado Hospital. The research approach used was descriptive quantitative, with data collection techniques through online questionnaires to 24 medical personnel as respondents. The research instrument was tested for validity and reliability, resulting in a Cronbach's Alpha value of 0.891. Data were analyzed using a single-sample t-test and one-way ANOVA. The results showed that all dimenimplementingsions of EMR use—including efficiency and productivity, quality of service, comfort and ease of use, organizational satisfaction, and support for creativity and innovation—obtained a satisfaction score above 88%, with the comfort category reaching the highest score. All categories showed significant differences from the theoretical mid-scale (p < 0.05), and there was a significant difference between categories (p = 0.0351). These findings confirm that the success of EMR implementation is heavily influenced by managerial strategies that encourage innovation and creativity, not just by technological factors. This research makes an empirical contribution to the study of health information systems and underlines the importance of integrating innovative cultures in hospital digitalization policies. The practical implications of this study lead to the importance of ongoing training, user-friendly system design, and participatory-based performance evaluation.

Abstract

Trade secrets are a form of intellectual property that have economic value and are confidential in nature. Legal protection for trade secrets is essential to provide legal certainty for their holders and to promote a healthy business competition environment. This article discusses the legal protection provided to trade secret holders in Indonesia under Law No. 30 of 2000 on Trade Secrets, and analyzes the effectiveness of such protection in ensuring legal certainty. Using a normative legal approach, this paper demonstrates that while legal frameworks exist, there remain various challenges in their implementation, particularly regarding proof and enforcement. Therefore, it is necessary to strengthen protection mechanisms and increase business actors' awareness of the importance of maintaining trade secrets.

Abstract

Penelitian ini bertujuan untuk menganalisis pertanggungjawaban pidana anak sebagai pelaku tindak pidana pembunuhan dalam perspektif hukum pidana Indonesia, dengan berlandaskan pada Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak (SPPA). Penelitian ini menggunakan metode penelitian normatif, dengan pendekatan perundang-undangan, kasus, dan konseptual. Hasil penelitian menunjukkan bahwa sistem peradilan pidana anak di Indonesia telah memberikan ruang bagi pendekatan yang berorientasi pada pembinaan dan rehabilitasi anak pelaku tindak pidana, termasuk dalam kasus pembunuhan. Namun, pelaksanaan prinsip keadilan restoratif dan mekanisme diversi pada kasus berat seperti pembunuhan masih menghadapi sejumlah tantangan, termasuk resistensi dari pihak korban dan keluarga korban. Selain itu, ditemukan bahwa peran Lembaga Pembinaan Khusus Anak (LPKA) dan pengawasan terhadap implementasi kebijakan SPPA perlu diperkuat untuk memastikan keberhasilan reintegrasi sosial anak pelaku. Penelitian ini merekomendasikan peningkatan kompetensi aparat penegak hukum dalam menangani kasus anak dan revisi kebijakan SPPA agar lebih adaptif terhadap kasus berat seperti pembunuhan
