Abstract

Abstract

Background: Wanprestasi (breach of contract) as a cause of land transaction disputes is a persistent and recurring problem in the governance of the agrarian legal system in Indonesia. The use of irrevocable powers of attorney to facilitate one-sided title transfers is a common manifestation of this issue. Objective: The purpose of this paper is to analyze the mechanism of legal protection for the seller in the land transaction dispute involving fundamental wanprestasi and bad faith, with a case study of Supreme Court Decision No. 2134 K/Pdt/2024. Methods: This article uses a normative juridical approach with a case study, focusing on Supreme Court Decision No. 2134 K/Pdt/2024 as the primary legal material, in addition to KUHPerdata Articles 1243–1248 (on compensation), 1320 (on the requirements for the validity of a contract), 1338 (on the general principles of good faith), and 1464 (on the retention of a down payment). Results: The AJB (sale and purchase deed) and PPJB (binding sale and purchase agreement) should have been nullified (ex tunc/retroactive) since the buyer failed to pay the remaining balance of Rp2 billion—having only tendered Rp10.00 (ten rupiah)—and submitted falsified blank account documents. The court confirmed that the retention of the Rp2.32 billion seller's deposit was an essential protection measure to compensate for moral and material damages, as stipulated in Article 1464 of the Civil Code. Conclusion: This jurisprudence enhances seller protection against predatory property development practices but highlights a significant gap in consumer protection within the existing land registration system. This study recommends legislative harmonization between the restitution provisions of the Civil Code and the Consumer Protection Law (UUPK).

Abstract

Background: Hepatocellular carcinoma (HCC) contributes significantly to cancer-related mortality worldwide, particularly in hepatitis B–endemic regions such as Indonesia. The need for reliable preoperative biomarkers remains a major gap, especially to predict microvascular invasion (MVI) and tumor proliferation. PIVKA-II was specifically selected over AFP because of its superior ability to reflect tumor-invasive biology through MET and JAK/STAT pathway activation. Objective: This study aimed to assess whether serum PIVKA-II levels can predict MVI and Ki-67 proliferation index. Methods: A retrospective study was conducted on 20 patients with HBV-related HCC who underwent liver resection at Cipto Mangunkusumo Hospital (2017–2025). Serum PIVKA-II was categorized as high (>40 mAU/mL) or low (≤40 mAU/mL). MVI was identified histologically; Ki-67 expression was categorized as high (>20%) or low (≤20%) using immunohistochemistry. Results: PIVKA-II levels showed a significant relationship with AFP (p = 0.033) and BCLC stage (p = 0.038). ROC analysis showed that PIVKA-II had fair discriminative ability (AUC = 0.703) in predicting vascular invasion, with a sensitivity of 87.5% and specificity of 75%. There was a significant relationship between high PIVKA-II levels and the occurrence of vascular invasion (p = 0.032; RR = 2.33). However, PIVKA-II did not show good predictive ability for tumor cell proliferation (Ki-67) (AUC = 0.484), and no significant relationship was found between them (p = 0.530). Conclusion: PIVKA-II is a useful preoperative biomarker for predicting microvascular invasion in HBV-related HCC. Its lack of association with Ki-67 indicates that additional markers are needed to assess tumor proliferative behavior. These findings support the integration of PIVKA-II into preoperative risk assessment.

Abstract

Background: Customer service employees operate in emotionally demanding environments characterized by high job demands, performance monitoring, and continuous interpersonal interaction. Such conditions potentially increase job stress and threaten psychological well-being. Objective: This study examines whether emotion regulation mediates the relationship between job stress and psychological well-being among customer service employees in Indonesia. Methods: A quantitative approach with a mediational correlational design was employed involving 258 customer service employees in Indonesia selected through purposive sampling. The research instruments included a job stress scale, the Emotion Regulation Questionnaire (ERQ), and the Psychological Well-Being (PWB) scale. Data analysis was conducted using path analysis via Hayes' PROCESS Macro Model 4. Results: Job stress was not significantly associated with psychological well-being (β = 0.0415, p > .05). Emotion regulation did not significantly predict psychological well-being and did not mediate the relationship between job stress and psychological well-being (95% CI [-0.0113, 0.0101]). Conclusion: The findings suggest that psychological well-being in this sector may be maintained by broader organizational and social resources rather than individual emotion regulation strategies alone.

Abstract

Background: Digital violence, including cyberbullying, hate speech, doxing, and online gender-based violence, has surged in Indonesian schools, with over 445,000 cases reported in 2024. Despite its growing prevalence, limited systematic analysis has been conducted to identify which curricular components of peace education can effectively address digital violence in Indonesia’s multicultural school contexts. Objective: This study aims to identify and synthesise key curricular components of peace education to prevent digital violence in Indonesian multicultural schools, integrating Tyler’s four-stage curriculum rationale, UN human dignity principles, Indonesian local cultural values (gotong royong, musyawarah), and digital ethics into the proposed PEACE-D Framework. Method: A Systematic Qualitative Review (SQR) was conducted, synthesising 45 peer-reviewed articles (2017–2026) retrieved from Scopus, Google Scholar, and Garuda Portal. The data was analysed using Braun & Clarke’s six-phase thematic analysis, validated by investigator triangulation, achieving 87% intercoder agreement. Result: Thematic synthesis identified four core curricular domains forming the PEACE-D Framework: (1) cross-national peace competencies (knowledge, attitudes, and skills for conflict transformation); (2) human personal dignity (UN-grounded digital privacy and non-degradation norms); (3) contextual cultural values (gotong royong, musyawarah, Sufistic empathy as cyber-ethical foundations); and (4) digital ethics and online responsibility (netiquette, cyberbullying prevention, bystander intervention). Conclusion: The PEACE-D Framework advances curriculum theory by integrating Tyler’s rationale with cultural and ethical dimensions specific to Indonesia’s digital educational context. Practical implications include adaptive module development within Kurikulum Merdeka and policy integration at the national level. Future quasi-experimental research in multicultural schools is recommended to empirically validate framework effectiveness.

Abstract

Background: Despite extensive international research on court interpreting, little empirical evidence exists regarding its practical implementation and user-centered evaluation in Indonesian courts, particularly in cases involving foreign defendants. Objective: This study evaluates the performance and challenges of court interpreters in supporting foreign defendants' access to justice in Bali. Methods: This research employs a descriptive quantitative design with complementary qualitative interpretation of findings. Data were collected through structured interviews and Likert-scale evaluations involving 16 participants (four defendants, four prosecutors, four lawyers, and four interpreters). Results: The findings show notable disparities in interpreter evaluations across stakeholder groups: defendants rated interpreter performance moderately (3.375/5), while prosecutors provided a significantly higher assessment (4.557/5). Defendants reported limited interpreter availability during early police examinations and concerns regarding neutrality, whereas interpreters identified legal terminology and rapid information processing as key challenges. Conclusion: This study contributes empirically to access-to-justice scholarship by demonstrating how stakeholder perceptions reveal structural inconsistencies in interpreter provision within Indonesian courts. Strengthening standardized certification, specialized legal training, and early-stage interpreter deployment is essential to enhance procedural fairness for foreign defendants.

Abstract

Background: Medical professionalism is grounded in ethical and humanitarian commitments; however, persistent ethical violations and malpractice cases indicate potential deficiencies in non-cognitive competencies. Despite growing scholarly attention, existing evidence remains fragmented and lacks comprehensive synthesis. Objective: This research systematically synthesizes empirical evidence (2020–2024) to identify appropriate and inappropriate non-cognitive profiles in medical professionals and to examine their implications for professionalism, clinical performance, and ethical conduct. Methods: This systematic review synthesizes empirical evidence identifying non-cognitive profiles supporting exemplary medical practice while distinguishing appropriate from inappropriate characteristics associated with ethical conduct and malpractice risk. Employing systematic methodology based on empirical literature (2020–2024), PRISMA 2020 guidelines ensured transparent evidence mapping, quality assessment, and synthesis across major databases (Scopus, Web of Science, PubMed) following standardized identification, screening, eligibility, and inclusion protocols. Results: Most included studies were observational and predominantly cross-sectional, with moderate methodological heterogeneity. Positive non-cognitive competencies—particularly empathy, resilience, emotional intelligence, professionalism, and compassion—demonstrate consistent associations with improved professional conduct, reduced burnout, and enhanced patient-related outcomes. In contrast, maladaptive traits, including Dark Triad characteristics, maladaptive perfectionism, and neuroticism, are associated with unethical behavior, interpersonal conflict, and diminished professional performance. Conclusion: Non-cognitive profiles constitute essential determinants of medical professionalism alongside cognitive competence. Although the evidence is largely observational, findings support the structured integration of non-cognitive assessment and development into medical education, professional selection, and continuing training frameworks to strengthen ethical standards and reduce professional misconduct.

Abstract

Background: Employer non-compliance in BPJS Employment contribution payments poses a systemic risk to Indonesia's employment social security system, as persistent arrears threaten financial sustainability. The Sulawesi–Maluku Regional Office consistently ranks among the highest contributors to national receivables, recording IDR 158.84 billion in 2023 and IDR 157.27 billion in 2024 despite a declining number of delinquent entities. This divergence, particularly at the Makassar Branch Office, indicates a structural arrears problem that uniform compliance approaches have failed to address. Objective: This study aims to analyze the compliance conditions of Business Entities with contribution arrears at the Makassar Branch Office, identify key determinants of non-compliance, and formulate adaptive risk-based strategies to improve employer compliance in the Sulawesi–Maluku region. Methods: This study applies a quantitative approach using descriptive analysis of receivable trends (2022–2024) and binary logistic regression based on survey data from employers with outstanding contributions. Strategic priorities were formulated using SWOT analysis and the Analytic Hierarchy Process (AHP), supported by Focus Group Discussions (FGD). Results: Non-compliance was found to be structural and sectoral rather than random. Logistic regression analysis (n = 120) indicates that financial capacity is the only statistically significant determinant of non-compliance (OR = 3.47; p = 0.003), while perceptual and administrative factors show no significant effects. Conclusion: Non-compliance is primarily driven by financial constraints, highlighting the need for integrated, risk-based compliance strategies emphasizing governance strengthening and segmented billing to improve contribution recovery.
