Abstract

This study aims to find out how the implementation of population administrationservices for making birth certificates at the Department of Population and CivilRegistration of Banyumas Regency and to find out how the obstacles or obstaclesfaced and the efforts made by the Office of Population and Civil Registration ofBanyumas Regency, it can be concluded that the implementation of servicespopulation administration making birth certificates at the Department ofPopulation and Civil Registration of Banyumas Regency in accordance withRegional Regulation Number 18 of 2015 concerning Population Administrationin Banyumas Regency where the service has fulfilled the quality of service well allaspects in the service are based on applicable regulations and have standardprocedures in carrying out properly according to applicable regulations.However, the implementation of the service has not been optimal, there are stillobstacles in its implementation, there are several obstacles and problems thatmust be improved, such as the ability of employees to update the system andHuman Resources for the Department of Population and Civil Registration ofBanyumas Regency.

Abstract

This research aims to determine the visiting hours service for inmates atthe Class IIB Nusakambangan Open Penitentiary and to find out theobstacles faced in the visiting hours service for Inmates at the Class IIBNusakambangan Open Penitentiary. The approach method used in thisresearch is a normative juridical research method and the analysis in thisresearch uses a qualitative analysis method. The results of the research atthe Class IIB Nusakambangan Open Penitentiary, namely that visitinghours services for inmates at the Class IIB Nusakambangan OpenPenitentiary were carried out in accordance with the rules stipulated inthe Operational Standards, Service Standards and GovernmentRegulation No. 99 of 2012 concerning Requirements and Procedures forthe Implementation of the Rights of Inmates in Prisons with theimplementation of visiting schedules, guarantees provided and servicesfrom other visiting hours and obstacles faced in serving visiting hours forinmates at the Class IIB Nusakambangan Open Penitentiary, namelylimited crossings for to the Nusakambangan Open Prison location in thespecial Nusakambangan Island Correctional Area and strict procedures,namely administration regarding the Village Head's certificate. However,despite the obstacles, the Class IIB Nusakambangan Open Penitentiary isworking as a solution, namely providing relief for the Village Head'scertificate to be followed up on the next visit provided that the visitor stillhas one Family Card and continues to provide the best service byproviding video call services so that the WBP can still communicate withtheir families.

Abstract

The rental agreement for the boarding house is a specialist in the rentalagreement, which is regulated in Article 1548 of the Civil Code. Theemergence of a boarding house rental agreement is based on the principleof freedom of contract which is regulated in Article 1338 paragraph 1 ofthe Civil Code. The rental agreement for renting a boarding house madeorally is indeed considered legally valid, because the Civil Code does notexplicitly specify the form of the rental agreement made by the parties. Thething that needs to be understood from an oral agreement is that it usuallyhas risks in the future. Even though the owner of the boarding house andthe prospective tenant have agreed not to return the rental of theboarding house to a third party, in reality there is still a transfer to a thirdparty. The purpose of this research is to find out the legal protection forthe owner of the boarding house due to the tenant repeating the rental ofthe boarding house to a third party. To achieve this goal, the writer uses asociological juridical approach; The research specification is descriptive.The data used in this study include primary data and secondary data.Primary data were obtained by free, guided interviews with owners andtenants. Secondary data in the form of the Civil Code; books by experts,research papers, scientific journals, internet, legal dictionaries. Thepresentation of data in the form of descriptions is arranged systematically.The data were analyzed qualitatively. Conclusion: Legal protection forboarding house owners due to tenants repeating boarding houses to thirdparties without asking permission and knowledge of the boarding houseowners, is to be able to cancel the rental agreement and claimcompensation based on Article 1559 of the Civil Code

Abstract

This writing aims to determine the application of Tri Hata Karanacustomary regulations as the basis for implementing Environmental Lawin Penglipuran Village, Bangli Regency, Bali Province. The researchmethod used is Juridical Empirical. The approach method used is theobservation of existing customary regulations combined with statutoryregulations. Tri Hita Karana is a reflection or reflection of the values ofPancasila in a culture or teachings in Indonesian society which includeatashyangan (harmonious relations that take place between humans andGod), pawongan (harmonious relations between humans and fellowhuman beings), and paleahan (harmonious relations between humans andGod). between humans and nature). The awig-awig are written andunwritten rules made by villagers (krama desa) with the aim of regulatingthe order of their daily life. It is local wisdom which is a strong foundationin good management of natural resources and the environment. Awigawig of Penglipuran village regulates things like house layout, felling oftrees as a form of environmental preservation, waste management, andother programs. These regulations are adhered to in order to preserve theancestral heritage as well as contain magical values which are stillbelieved by the villagers.

Untuk       mengetahui penafsiran     hakim     Pengadilan      Agama Purbalingga   terhadap  ketentuan   berbakti  lahir dan batin  kepada  suami  di dalam  batas-batas yang  dibenarkan   oleh  Hukum  Islam  .Metode pendekatan    yang   digunakan   adalah   yuridis normatif..  Data yang diperoleh  akan dianalisis secara  normatif  kualitatif   Kesimpulan:    basil penelitian      ini   menunjukan     bahwa    dalam praktek  penyelesaian   perkara  perkawinan   di Pengadilan    Agama   tidak   selalu   sikap   dan tindakan    seorang      isteri         yang     tidak melaksanakan   kewajibannya   berupa  berbakti lahir dan bathin kepada suaminya dalam batas- batas   yang   dibenarkan    agama   dinyatakan sebagai   nusyuz.   Dalam  menginterpretasikan ketentuan    KHI   tentang   berbakti   lahir   dan bathin   dalam   batas-batas    yang   dibenarkan agama  dari  seorang  isteri   kepada  suaminya, ternyata    para    hakim    Pengadilan     Agama banyak    berbeda    pandangan.        Adanya perbedaan   interpretasi   tersebut,   mengakibat- kan   adanya   perbedaaan   dalam   menentukan

Berdasarkan    pendekatan    hierarkis,    niscaya undang-undang  diderivasi  dari Tap MPR yang secara   substansial   sebagai   "tafsir"   terhadap Konstitusi.

Abstract

Pembaharuan   hukum   pidana      (Penal Reform) terus  diupayakan  oleh   pemerintah untuk    mewujudkan   bangunan   negara Indonesia    sebagai   negara   hukum   yang berdasarkan    Pancasila   dan   UUD   1945. Berbagai upaya telah dilakukan baik dengan pembentukan undang-undang hukum pidana yang  sesuai  dengan  kebutuhan  waktu  dan jaman     hingga   sekedar     meng-insert (menyisipkan)  pasal  tertentu  dalam produk perundangan yang sudah ada.  Namun semua usaha tersebut belum menjadi sebuah kerjua besar   bagi  kegiatan  pembaharuan  hukum pidana di Indonesia. Sebuah kerja besar yang banyak dinanti adalah terwujudnya kodifikasi hukum pidana Indonesia yang baru yaitu Kitab Undang-undang   Hukum   Pidana   (KUHP) sebagai  ganti  atas   Kitab   Undang-undang Hukum    Pidana    (KUHP)    positif    yang merupakan  terjemahan  dari   Wetboek  van Strafrechtvoor Netherlands Indie (WVSNI).Kodifikasi dan unifikasi  hukum merupakan kebutuhan  dalam upaya membangun sistem  hukum nasional.  KUHP adalah produk perundangan yang diharapkan dapat meujudkan cita-cita suatu kodifikasi dan unifikasi    hukum   pidana    di   Indonesia Rancangan  Kitab  Undang-Undang  Hukum Pidana (RKUHP) memiliki karakteristik yang unik karena merupakan basil dari rekodifikasibukum   pidana     nasional      Indonesia. Karakteristik ini berbeda dengan Rancangan Undang-Undang   (RUU)   lainnya.    Dengan adanya rekodifikasi hukum pidana nasional ke dalam  RKUHP  ini,    maka  segala  macarn ketentuan    perundang-undangan   pidana menjadi     tersatukan    (terunifikasikan) (Moeljatno,2008: 18)  secara sistematis dalam satu buku khusus.

Abstract

Pelaksanaan   dekonsentrasi    di   tengah otonomi luas yang merupakan aktualisasi dari Sentralisasi, clipandang oleh beberapa akandulkan  otonomi.      Daerab  terkesan aJefgi  terhadap  pelaksanaan   dekonsentrasi ag secara normatif sab karena diatur dalamperaturan    perundang-undangan      tentang pemerintahan daerah.   Dekonsentrasi sebagai alat   pusat  dan desentralisasi   sebagai  alat daerah,   meskipun  berada  pada  lingkungan egara Kesatuan,  dalam praktek selalu  tarik menarik hubungan antara keduanya. Tujuan   penelitian    ini    dalam   rangka mengharmonisasikan  hubungan  Pusat  dan daerah  (dekonsentrasi    dan   desentralisasi) dalam kerangka Negara Kesatuan Republik lndonesia.   Melalui pendekatan teori bentuk aegara, desentralisasi,  dan dekonsentrasi diolah  secara yuridis  kwalitatif ,  diharapkan dapat mengkonstruksi upaya harmonisasi pelaksanaan dekonsentrasi di tengah otonomi .uas (desentralisasi).Hasil penelitian menunjukkan babwa suatu negara  yang  menganut  asas  desentralisasi tidak berarti negara tersebut tidak menganut asas   sentralisasi   dan   atau   dekonsentrasi, karena sesungguhnya daerah yang diberi desentralisasi adalah tetap merupakan bagian dari negara pemberi desentralisasi  tersebut, yang diberikan  hanya sebagian kewenangan pemerintaban dan bukan kedaulatan negara .

Abstract

The choice of oil pollution dispute resolution by Tanker Ship in national marine law system is highly important to be analyzed in-depth concerning the choice of oil pollution dispute resolution by Tanker Ship in Indonesia is resolved in peaceful manner based on the principle of polluter pays principle. The dispute resolution choice in peace is amended by the internationalinstrument ofUNCLOS in article 279 which is, in Indonesianpositive law system, generated through several national legal  instruments. Furthermore, the  dispute resolution choice is such an important thing considering   the purposes of marine environment protection by the coastal states through the law enforcement of sovereign coastal  states.  The  consequence of  dispute resolutionchoice with the concept of ecocracy and sustainable environmental development, in  line with  the  reconstructive  purpose  of philosophical approach of environmental problem  settlement  through the concept  of ecocracy and the paradigm of deep ecology and green constitution, itis expected to be able to be included in national legal system withe law  enforcers  who  understand  ecoliteracy
