Abstract

This study describes the pardon granted by the Government of Indonesia to Corby underthe Government of Susilo Bambang Yudhoyono in the case of drug crimes committed bySchapelle Leigh Corby, and explains the reasons of Indonesia under the administration ofPresident Susilo Bambang Yudhoyono in granting clemency to Corby. The method used inprocessing the data is by qualitative method, by analyzing the data of the identifiedmaterial sources, such as interviews, international agreements, and other sources such asscholarly documents, articles, journals, or scientific writing on similar themes with thisresearch. The concept in this study explains that bilateral cooperation in achieving thenational interest of each country is very influential on foreign policy applied by state actors.It also affects Indonesia and Australia in cooperating. International cooperation is a toolfor international relations actors whose function is to facilitate and serve a variety ofunlimited activities. Foreign Policy has a national importance for a country and is anobjective of the national Government at the international level. Governments within acountry, of course, have a goal to promote and prosper the country by making policies andconnecting with other countries. The Indonesian government grants clemency toAustralian citizen inmates involved in narcotics case Schapelle Leigh Corby on an interestbasis. Corby was found guilty of having found 4.2 kilograms of brutto or 4.1 kilograms netin his surfboard satchel at Ngurah Rai airport, Bali on October 8, 2004. Corby's grant wasmade on the basis of the Government of Indonesia's wishes and interests to Australia.

Abstract

Since 1962, the government of Myanmar had been controlled by themilitary power. This matter caused Myanmar people losing theirrights in social, political, and economic sectors. The losing of thoserights then became the factor of Myanmar people to do illegalmigration. However, the illegal migration that was done byMyanmar people make them became the victim of human trafficking.Myanmar even become the country with the highest number ofhuman trafficking victims in Mekong River region. In 2010,Myanmar did the election as a sign of the occurrence of politicaltransition there and became the end of the military power thatcontrolled the government for over 48 years. The purpose of theresearch is to know the effect of political transition in Myanmar onhandling human trafficking. This research is mainly based onGuillermo O’Donnell’s and Philippe C. Schmitter PoliticalTransition theory, stating that in times of political transition the shiftin human rights promotion occurs. Therefore, an idea arise in timesof Myanmar’s political transition, the number of human traffickingdeclines. Descriptive type is use on this research to explain thehuman trafficking phenomenon that happen when political transitionin Myanmar was on going. The result of this research shows thatpolitical transition in Myanmar take effect on the reduction of humantrafficking victim in Myanmar.

Abstract

Rohingya is a minority ethnic in Myanmar that has been discriminated since the reign of the military junta (tatmadaw). In the era of Aung San Suu Kyi which the Rohingya crisis has not handled well, places Myanmar in a difficult position internationally. In the domestic sphere, conflict between the civilian government and tatmadaw related to Rohingya handling policies occured because the position of tatmadaw in politics remains strong, as stipulated in the 2008 Myanmar Constitution. This study discusses how the conflict influences Myanmar policies towards the handling of Rohingya crisis. The civilian government formed an Advisory Commission on Rakhine State to handle the case, while the tatmadaw carried out a clearance operation in handling it which caused instability in Myanmar. This study will use a decision-making model on bureaucratic politics by Graham T. Allison to analyze how the conflict within Myanmar government influences Rohingya policies by looking at two contested actors, tatmadaw and civilian government. This research uses qualitative and descriptive methods by using literature study in data collection. The result of this study shows the fact that the conflict between the civilian government and tatmadaw of Myanmar has been detaining the process of handling Rohingya case.

Abstract

Deradicalization program emerged from Indonesian government anxiety towards a high rateof radicalism and terrorism among civil society. Soft approach that became the cornerstone ofderadicalization program will be able to rehabilitate terrorist, its group, and family fromradical mindset effectively. They’re expected not to repeat the previous acts of terror, notback to being an agent of radicalism, and able to live in peace among others. Problems thenarise when the deradicalization program drawn criticism from several activists and religiouspractitioners group of civil society and rejection from the convict that said the program wasmade to discredit Islamic values. The purpose of this study is to describe and explaining theformulation of Indonesian deradicalization program in detail. This study uses a constructivistperspective and disengagement theory in explaining the formulation and implementation ofBNPT de-radicalization program. In this study, the author used qualitative methods withexplanatory research type, followed by collecting data through literature and interviewtechniques. Based on existing findings, the deradicalization program, which rooted inconstructivist basic assumptions and disengagement theory, is comprehensively establishedwithout discrediting certain religious values. And because terrorism in Indonesia is dominatedby radical Islamic thoughts, the implementation and approach of the deradicalization programare tailored to go harmoniously, to ensure the effectiveness of the rehabilitation program.

Abstract

China has been trying to enhance their industry production in pursuit ofeconomic growth to overcome poverty in the region.In other hand, theindustrial growth have a negative impact on the environment, causing severeair pollution. Air pollution did not only hurt China but spread to SouthKorea’s region, which is causing problem to South Korea. This study aims tofind why South Korea did not protest related to China’s Transboundary AirPollution. The study uses qualitative research method with analythicdescriptive research type. Abstract

The Night Wolves Motorcycle Club, Russia’s first and largest Motorcycle Club, became one of the Non-state Actors who played a role in the Russia – Ukraine conflict in 2014. They succeeded in defending Crimean Peninsula from Ukraine Army and Ukraine Radical Nationalist who were willing to harm and kill any Crimean who support Russia. This becomes interesting to see how a Motorcycle Club could influence a whole city to join them in their social movement. This research aimed to explore the evolution of the Night Wolves Motorcycle Club from the protester of the government to a patriotic organization who support the government, describe the ideology of the Night Wolves motorcycle club, analyses the role of the Night Wolves motorcycle club in Ukraine, and explain the political process of Night Wolves as a non state actor. This research uses Descriptive Exploratory as the research method and uses theories of Social Movement and Political process. The result of this study indicate that Night Wolves’s parade over a few years back with Putin and several political figure has made their reputation as a patriotic organization and announced their ideology. By doing so, people of Crimea who had the same perspective were willing to join them. Night Wolves’s success in defending Crimea made their reputation in International World as a non-state actor who could intervene with international conflict. This shows the importance of Non-state actor in International Relations Study and the new type of non-state actor besides Non Governmental Organization and International Organization

Abstract

Slow loris or Nycticebus sp is one of endemic primate animals in Indonesia. Since 2007, slow loris has been categorized into Appendix I CITES (Convention on International Trade in Endangered Species of Wild Fauna and Flora). It means that slow loris is threatened to extinction, so this species cannot be used as a commodity on commercial trade. In fact, the number of slow loris in Indonesia, specifically on Sumatra island still continue decreased from 2007-2014. Even though, Indonesia has ratified CITES which is explained on UU No. 5 Tahun 1990 relates to Conservation of Natural Resources and Ecosystems. Through this regulation, Indonesia spreads and delegates an authority to implement CITES on Ministry of Environment and Forestry as management authority and Research Center for Biology-LIPI as scientific authority. This paper aims to analyze to what extent the compliance of Indonesia on CITES regime and determine main factors that cause trade of slow loris in Indonesia. To achieve these objectives, it is used a qualitative method through literature reviews and policy documents, then, it compared with compliance theory and public policy implementation. The findings of this paper shows that Indonesia has respect and compliant to CITES. Indonesia compliant CITES to achieve the national interest, especially in the protection of slow loris. However, slow loris trading still occurs due to several factors, such as lack of bureaucratic structure, lack of communication, less of resources quality and quantity, and disposition. In addition, a partnership and bilateral agreement among Indonesia and other country to minimize slow loris trading is still unsuccessful.

Abstract

The Pirate Bay is one of the gigantic peer-to-peer (P2P) sites with the origin server was Sweden which until now has become a portal for illegal downloading activities in the digital world. Praised and favored combined with defense mechanisms makes the site that released in 2003 is still working. Even though it highly criticized by various backgrounds such as the state, industry, even the international organizations the site remains exist as a liability threat as infringement of right-holders in the digital world. Categorized as cybercrime, the European Union has intention to overcome intellectual property rights violations that are actualized through the Pirate Bay’s P2P platform. Regarding to the case study, through the Supranationalism principle and the concept of Republicanism of Liberalism, the European Union plays a role in accordance with the authority, as initiator of legal products which has mutual agreements among its members, including legal consequences relating to the issue of indirect violations of intellectual property rights. In addition, the role of the European Union is also based on the Spillover effect scheme, in which the European Union's efforts are to address intellectual property violations, moreover the other cybercrime issues. Start by overcoming The Pirate Bay as analogical step by sweep-out digital-age of piracy as a symbol of an Eropean Union resistance and supremacy against the giant pirates of the digital ocean.

Abstract

Shipping has been the most reliable system and important in the interstate commerce forits ease and efficiency. But it will not come without any risk, numerous maritime crimethat threaten the vessels and ports such as petty theft and armed robbery against shipsmade the international community agreed to implement the International Ship and PortFacility Security ( ISPS ) Code for the urge of security of shipping activity in their ownterritory. Indonesia as one of the country that implementing the ISPS Code have failed tolower the crime rate in its area from 2009 to 2013. As for the failure was caused by the lessmaximum coverage of the ISPS Code as an international rules and human resources factorbeside the insufficient facilities in the ports of Indonesia, all of which were analyzed usingthe concept of Order of Hedley Bull.

Abstract

Food crime in the form of food product fraud especially in fraudulent olive oil commodities frequently occurred in the period 2014 to 2017 in Italy. The estimated profit gained by organized crime groups reaches millions of euros. Italian agriculture has finally become the focus of  mafia's Ndrangheta involvement in the food chain. This research is aimed to find out why the Ndrangheta group committed food crime in Italy and to analyzed the Ndrangheta group as transnational organized crime group. The Ndrangheta group in the Italian food crime scheme is puzzling as to why human-food relations bring up the Ndrangheta group to commit food crimes in Italy. In response to this phenomenon, this thesis used the concept of transnational organized crime groups and non-traditional security concepts, with qualitative methods. The results showing that the presence and characteristics of the Ndrangheta group, the socio-economic conditions of the Calabria region and the facilitative system encouraged food crime take place in Italy. Also extreme power of Ndrangheta made them worse to be controlled. Therefore multilateral cooperation is needed in the form of institutions or regimes that can press for the urgency of food crime, pursue strategies in deterring and detecting the existence of organized crime groups.
