Abstract

Somali pirates activities in the Gulf of Aden have become an international security threat. Moreover, every countries which involved in international sea trade are also affected with the disadvantage impacts in economic sector. Recognizing the existence of these international security threats and losses, The United Nations is released a mandate for every member countries to contributing on handling the Somali pirates issue in the Gulf of Aden. With this mandate, the European Union is showing its active role to handling the Somali pirates issue. The European Union’s role have been realized through the assignment of EU NAVFOR Patrols since 2008. This research used qualitative methods alongside with international issue and European norms as a conceptual base, to explain the European Union’s role in the Gulf of Aden especially from the assignment of EU NAVFOR Patrols. The result of this research indicated that the European Union’s role with the assignment of EU NAVFOR patrols has an impact on reducing the number of Somali pirates activity and ship attacked by the Somali pirates.

Abstract

Indonesia has become the second largest country in Asia after Thailand in child sextourism. The situation will increase every year because the tourists migrated from Thailandto Indonesia, since Thailand implement the Child Protection Act’s amendment in theircountry. These conditions make this research made for knowing obstacle from IndonesianGovernment and ECPAT’s efford in resolve child sex tourism crimes through RAN TPPOand ESKA 2009-2014. After research conducted using collective action teory,implementation of policy teory, and an explanatory method, researcher found there areobstacle in the implementation of the RAN TPPO and ESKA 2009-2014. These obstaclescome from groups of people who abuses the system, where the group of people helptourists to get child, or they sell the women and children by reason of giving them job. Theobstacle also come from the implementation of the policy, where there is no clearregulatory standards, target in the policy not comprehensive, and bad conditions in theeconomic and social sectors of society.

Abstract

This thesis aims to analyze the role of the Indonesian government in protecting the rightsof migrant workers in Hongkong from underpayment practice in 2011 to 2017 by firstdescribing the description of underpayment practices in Hongkong, system andemployment policy of Hongkong, and the relationship between Indonesia and Hongkongin migrant workers. This thesis uses qualitative research methods with descriptive researchtypes and analyzed by collecting data collected from interviews, books, reports of NGOsand mass media. The range of research in this thesis is 2011 to 2017. To explain the role ofGovernment of Indonesia uses concept of public public, role theory and the concept ofhuman rights. The result of the research is the conclusion that Government of Indonesiaseeks to protect the right of Indonesia migrant workers in Hongkong from underpaymentpractice in form of policies, (i) enacted UU No. 39 tahun 2004, Keputusan Menakertrans98 tahun 2012, ratificate The International Convention on The Protection of The Rights ofAll Migrant Workers and Members of Their Families into UU No. 6 Tahun 2012,(ii) KJRIHongkong provides training to Indonesia migrant workers, blacklist employers andplacement agencies that are proven to be cheating, doing coordination with Ministry ofForeign Affairs and BNP2TKI, (iii) launched kredit usaha rakyat, (iv) doing MoU of laborprotection with Hongkong, and (v) coorporate with alliances of Indonesia migrant workersin Hongkong to monitor problems of Indonesia migrant workers.

Abstract

As a part of counterterrorism tool, the CIA’s armed drone was firstseen attack Al Qaeda in Pakistan on 2004. Some of criticism fromhumanitarian organization claimed that the attacks are inhumane,violate the international law and constitute a war crime. However, theUS government denied and contending that the drone attackscomplied with all applicable law, including the laws of war and thatthe method of attack is effective. This research attempts to explicatehow the US drone attacks in Pakistan and It also analyzes the factorsthat encourage the US to keep using drones as a weapon in counterterrorismin Pakistan despite the fact that the drone attacks havecaused the deaths of civilians in Pakistan.

Abstract

This research was motivated by the increasing incidence of terrorism that threatensglobal security. A terrorism attack can occur because of funding factors where funding forterrorism also categorized into criminal acts which are usually called criminal acts ofterrorism funding. In seeking to eradicate the crime of terrorism funding the Indonesiangovernment cooperated with neighboring countries, in this case the Indonesian governmentthrough the Pusat Pelaporan dan Analisis Transaksi Keuangan (PPATK) collaborated withthe Australian Transaction and Analysis Center (AUSTRAC). Both of these institutions areFinancial Intelligence Units (FIUs) that have a vision to combat the crime of money launderingand terrorism funding. This research aims to explain the effectiveness of the cooperationbetween PPATK and AUSTRAC in combating terrorism funding crimes in Indonesia in 2014 -2017. By using the number of Analysis Results (HA) with the alleged crime of financingterrorism issued by PPATK and the number of terrorist acts that occurred in Indonesia as anindicator of the assessment of the effectiveness of the two FIU cooperation, the authorsproduced research findings , that cooperation established by PPATK and AUSTRAC can besaid to be effective in combating terrorism funding crimes in Indonesia in 2014-2017.

Abstract

The monetary crisis that hit Indonesia in 1997 caused by various factors, one of the mainfactor was the practice of concentration of economic power that tend to for a monopolisticmarket. Thus, impacting the fragility of its economic resilience. In order to accelerate theeconomic growth after the monetary crisis, Indonesia had received financial assistancefrom the IMF, with the requirement that Indonesia had to restructure its economic systemas they agreed in the letter of intent. The letter of intent contains a point that Indonesiashall implement the competition law and policy to prevent the concentration of economicpower activities in Indonesia such as monopoly, cartel and bid rigging. In the process of itsimplementation, Indonesia had received assistance by UNCTAD to operate capacitybuilding for stakeholders. This research uses a perspective by neoliberal institutionalist toanalyze capacity building cooperation that conducted by Indonesia and UNCTAD. Thisresearch is descriptive analytic and also used qualitative as its research method. Theconclusion showed that cooperation by Indonesia and UNCTAD are based on rationality,which both sides took the benefit as they desired.

Abstract

Indonesia is an easy target for IUU actors (Illegal, Unreported, Unregulated) fishing due to abundant marine resources. IUU fishing is a problem that can not be underestimate because inflict many disadvantages for Indonesia. In handling IUU fishing, Indonesia requires cooperation with other countries, especially with neighbour countries to solve the problem. This research is aimed to studying the cooperation between Indonesia and Thailand in handling IUU fishing. For analyzing the cooperation, this research use liberalism theory with qualitative method, and explanatory-based research by doing some literature studies. In this research we can see that cooperation between Indonesia and Thailand produces Memorandum of Understanding (MOU) which are expected to help handling IUU fishing. With this cooperation, all the factors of IUU fishing shall be solved.

Abstract

Indonesia is a big a country that being targeted by international narcotics trafficker which is Transnational Organized Crime. One of the example is the Brazilian who tried to smuggle narcotics to Indonesia. This research is using two cases of studies, i.e. Rodrigo Gularte that has been apprehended in 2003 and Reginaldo Bom Fim is in 2012 by Indonesian National Police for smuggling Brazilian narcotics to Indonesia. In this regard, Indonesia – Brazil cooperation on combating narcotics becomes an interesting point to be studied. The research questions of this study is “How is Indonesia – Brazil cooperation on combating narcotics originated from Brazil? ; and Is there any factors that might supports or detains the cooperation?” The point of this research is to explain the procedure of cooperation between Indonesia – Brazil on combating drugs and explaining the factors that tied this cooperation. This research is using Liberalism theory and Implementation Policy theory. The Liberalism is being used to explain the procedure of cooperation between two countries effectively and then being ratified to be implemented. Also Implementation Policy theory is used for explaining the procedure of implementation on combating the drugs. Descriptive methods are being used in this research to explain the cooperation and the implementation of combating drugs policy. As the result, this study found that Indonesian – Brazil cooperation formally established after legal basis has been ratified, and then implemented by two ways of cooperation, which are cooperation between the Government (G to G) and cooperation between national police department (P to P). As for the process of cooperation, has its own tidal wave caused by inhibitor and stimulant factors by the two cases that’ve been the fundamental to this research. The stimulant factors that being referred is the two cases indicate that both of the party needs to cooperate to combat against TOC; both party shared common aspiration and commitment on combating against TOC. The inhibitor factors that being referred is about death penalty still being used towards narcotics convict and difficulties to gather inteligence source for combating narcotics trafficking.

Abstract

The emergence of public distrust of the oil and gas giant ExxonMobil Indnesian was proven by various accusations that were filed for environmental pollution by ExxonMobil. The accusation was filed because there were several cases which resulted in an increase of temperature, gas leakage, and other charge that threatened human security. The thought framework used in this study uses the theory of good governance, human security, and also the preacautionarry principle. This type of research is descriptive-explanatory with qualitative data analysis techniques through data collection of library techniques. This study provides results that ExxonMobil isn’t the cause of environmental damage carried out in the Cepu Block exploration area. Through the results of the PROPER obedience (Corporate Performance Rating Assessment Program) applied by the Government, CSR (Corporate Social Responsibility),  the implementation of the Operations Integrity Management System (OIMS) as a guide in doing business, and enviromental care efforts carried out by the company  was enough to dismiss these environmental pollution allegations.

Abstract

This research’s goal is to understand how TRAFFIC’s role as an NGO in the fight againtrhino horns smuggling from South Africa in Vietnam. TRAFFIC was present in Vietnamto assist the Vietnam Government in overcoming the rhino horns smuggling, whichVietnam become the highest contributor to the end of the journey of rhino horn smugglingfrom South Africa. As an NGO, what TRAFFIC do is to advise the government and makean approach to the community itself that in the end the expected output is the people andthe Vietnam Government able to solve the problem. In analyzing the role of TRAFFIC, theresearch use the concept of the role of NGO. The result of this study explains TRAFFIC’srole in Vietnam based on definition of role of an NGO by David Lewis.
