Abstract

This study examines the legal construction, application, and limitations of the First to File principle within Indonesia’s trademark registration system. The research employs a non empirical normative legal method grounded in doctrinal legal inquiry. Legal materials consist of Law Number 20 of 2016 concerning Trademarks and Geographical Indications, Government Regulation Number 22 of 2018 concerning International Trademark Registration under the Madrid Protocol, relevant ministerial regulations, international legal instruments, and scholarly literature on intellectual property law. The analysis applies statutory, conceptual, and doctrinal approaches supported by grammatical, systematic, and teleological interpretation. The findings indicate that the First to File principle functions as the central mechanism for allocating trademark rights and promoting legal certainty through a constitutive registration framework. The study also demonstrates that the principle is not absolute because its operation is constrained by doctrines concerning good faith, protection of well known marks, prior reputation, and judicial intervention in cases involving substantive injustice. The research further identifies the need for stronger substantive examination, improved institutional safeguards, enhanced protection for small business actors, and broader dispute resolution mechanisms. A balanced framework integrating legal certainty and substantive justice is essential for the future development of trademark protection in Indonesia.

Abstract

This study examines siri polygamy in Indonesia through the analytical lens of sociology and legal pluralism by exploring the interaction between Islamic law and state law in the construction of marital legitimacy and dispute resolution. The research employs a non empirical legal method based on normative legal analysis and a socio legal approach. Data were derived from constitutional provisions, marriage legislation, the Compilation of Islamic Law, judicial decisions, and relevant academic literature. The findings indicate that siri polygamy operates within a field of competing normative authorities where religious validity may coexist with limited state recognition. This condition generates legal uncertainty concerning marital status, child protection, inheritance rights, and access to justice. Judicial practice demonstrates a tendency to accommodate social realities through legalization mechanisms rather than relying exclusively on criminal sanctions. The study further reveals that women and children remain the most vulnerable parties within unregistered polygamous relationships. From a criminal law policy perspective, effective regulation requires a balanced approach that integrates legal certainty, substantive justice, and social legitimacy. The research argues that harmonization between Islamic family law and national law is essential for strengthening rights protection and improving the coherence of Indonesia’s plural legal system.

Abstract

This study examines the role of the General Principles of Good Governance (AUPB) in the resolution of administrative court disputes in Indonesia through a normative legal research approach based on statutory, conceptual, and case analyses. The research analyzes administrative court decisions issued between 2020 and 2023 together with relevant legislation governing administrative justice and government administration. The findings indicate that AUPB has evolved from a complementary interpretative standard into a substantive judicial benchmark for assessing the legality and legitimacy of administrative actions. Judicial application demonstrates that governance principles are utilized across diverse categories of disputes, including licensing, land administration, environmental governance, public information, taxation, procurement, and civil service matters, with varying review orientations reflecting the characteristics of each dispute. The study also reveals regional variations in judicial interpretation and application, producing differences in decision consistency, legal certainty, executorial effectiveness, and public trust. Despite these variations, explicit reliance on AUPB strengthens judicial reasoning, enhances administrative accountability, and promotes more responsive administrative justice. The research concludes that AUPB functions as a central normative instrument for improving adjudicative quality and reinforcing good governance within Indonesia’s administrative law system.

Abstract

The development of digital technology has transformed communication patterns, social interaction, and information dissemination in contemporary society. Although it provides significant benefits, digital transformation also generates ethical challenges such as misinformation, hate speech, cyberbullying, privacy violations, and declining communication ethics, which collectively contribute to the erosion of human values in cyberspace. These conditions indicate an imbalance between technological advancement and the strengthening of digital ethics and moral awareness among users. This study aims to analyze the forms of human value degradation in cyberspace and examine the roles of government, society, and educational institutions in restoring digital ethics through a multilateral approach. The study employs a qualitative literature review method based on academic journals, books, policy documents, and institutional reports. Data were analyzed using content analysis to identify and interpret key themes related to digital ethics restoration. The findings show that restoring digital ethics requires coordinated efforts among government regulation, societal participation, and educational reinforcement of digital literacy and character building to create a more responsible and human-centered digital ecosystem.

Abstract

This study examines the legal position, judicial application, and future development of the General Principles of Good Governance (AUPB) as a basis for judicial decision making in the resolution of administrative law disputes in Indonesia. Employing a non empirical normative juridical method, the research analyzes constitutional provisions, statutory regulations, administrative law doctrines, and administrative court decisions to evaluate the interaction between legal norms and judicial interpretation. The findings indicate that AUPB has evolved into a significant normative standard within Indonesian administrative law, functioning not only as a complementary legal principle but also as an independent benchmark for reviewing administrative actions and decisions. Judicial practice demonstrates that AUPB serves as an instrument for assessing legality, controlling abuse of authority, guiding the exercise of discretion, and balancing legal certainty with substantive justice. The study also identifies challenges arising from interpretive variation, regulatory fragmentation, and differing judicial approaches to principle based adjudication. Strengthening doctrinal coherence, judicial capacity, and regulatory harmonization is essential for enhancing consistency in administrative adjudication. The research concludes that AUPB plays a central role in reinforcing administrative justice, governmental accountability, and the realization of good governance within the contemporary legal system.

Abstract

This study examines the legality of Bandung Administrative Court Decision Number 180/G/2024/PTUN.BDG concerning a dispute over the transfer of a civil servant position through the perspective of the General Principles of Good Governance. The research employed a non empirical normative juridical approach based on statutory analysis, case analysis, and conceptual analysis. Primary sources consisted of the court decision and relevant Indonesian administrative law regulations governing state administrative justice, government administration, and the state civil apparatus. The findings indicate that the disputed transfer decision was issued by a competent authority but contained significant procedural and substantive defects. The court identified the use of an expired technical recommendation, administrative error, insufficient objective justification, and non compliance with merit based personnel management standards. These deficiencies resulted in violations of legal certainty and due care principles that form essential components of good governance. The analysis further demonstrates that the General Principles of Good Governance function as substantive standards for reviewing administrative discretion beyond formal legality. The decision strengthens judicial oversight, promotes bureaucratic accountability, reinforces merit system implementation, and contributes to the development of governance oriented administrative law in Indonesia.

Abstract

Political money remains one of the most persistent challenges confronting democratic development in Indonesia. This study examines the anatomy of political money, its consequences for electoral integrity and democratic governance, and potential strategies for restoring substantive democracy. The research employs a non empirical qualitative design using a descriptive and analytical literature approach based exclusively on secondary sources, including academic publications, legal documents, election monitoring reports, and institutional records. Data were analyzed through thematic categorization, comparative interpretation, and critical synthesis supported by source triangulation. The findings indicate that political money is sustained by structural weaknesses in political institutions, deficiencies in campaign finance governance, and limited accountability mechanisms. Its consequences include distorted electoral competition, declining political neutrality, weakened democratic accountability, increased corruption incentives, and the erosion of public trust in democratic institutions. The study further finds that the persistence of transactional politics contributes to democratic regression and compromises the realization of substantive democracy. Institutional reforms emphasizing campaign finance transparency, electoral justice, constitutional safeguards, and democratic accountability are essential for strengthening electoral integrity and promoting sustainable democratic governance in Indonesia.

Abstract

Digital technological advancement has fundamentally transformed various dimensions of human life, including education, social interaction, economic activities, and information security. This study aims to examine the positive and negative impacts of digital technology through a descriptive-analytical literature review approach. Data were collected from academic journals, books, institutional reports, and other relevant scholarly publications. The findings indicate that digital technology contributes to broader access to information, supports flexible online learning, enhances communication efficiency, promotes the growth of e-commerce, facilitates the digitalization of micro, small, and medium-sized enterprises, and creates new employment opportunities. At the same time, digital transformation generates several challenges, including gadget dependency, cyberbullying, reduced face-to-face interaction, misinformation, cybercrime, and risks related to personal data misuse. The review highlights that the effects of digital technology are multidimensional and depend on how technology is utilized, regulated, and integrated into society. Strengthening digital literacy, cybersecurity measures, and collaborative governance is essential to maximize the benefits of digital transformation while mitigating its associated risks.

Abstract

This study examines the effectiveness of administrative remedies as a mandatory prerequisite for filing lawsuits before the Administrative Court within the Indonesian administrative law system. The research employs a non empirical normative juridical approach based on doctrinal legal analysis and extensive library research. Primary legal materials consist of Law Number 5 of 1986 concerning the State Administrative Court, Law Number 30 of 2014 concerning Government Administration, and Supreme Court Regulation Number 6 of 2018. Secondary materials include scholarly literature on administrative justice, governance, accountability, procedural fairness, and the rule of law. The findings indicate that administrative remedies serve an important function in promoting administrative justice by providing opportunities for internal correction, strengthening accountability, and supporting good governance principles. The mechanism also contributes to procedural efficiency by filtering disputes before judicial review. Despite these advantages, its practical effectiveness remains influenced by administrative burdens, regulatory inconsistencies, institutional bias, transparency deficits, and the growing complexity of technology based administrative decision making. The study concludes that administrative remedies possess a strong normative foundation, yet their effectiveness depends substantially on regulatory coherence, institutional capacity, procedural transparency, and adaptive governance capable of responding to contemporary administrative challenges.

Abstract

This study examines the legal implications of the use of the “Gudang Baru” trademark as an alleged trademark infringement and form of unfair competition against the well established “Gudang Garam” trademark within the Indonesian legal system. The research adopts a non empirical normative juridical approach based on statutory analysis, case analysis, and conceptual legal reasoning. Primary legal materials consist of international intellectual property instruments, national trademark legislation, competition law regulations, trademark registration rules, and judicial decisions relevant to the dispute. The findings indicate that the legal assessment extends beyond visual similarity and requires consideration of consumer confusion, the protection of well known trademarks, good faith registration requirements, and broader principles of market fairness. The study further demonstrates that the status of Gudang Garam as a well known trademark strengthens its entitlement to enhanced legal protection under domestic and international legal frameworks. The analysis also reveals that the use of the Gudang Baru trademark raises concerns regarding passing off, free riding, and bad faith registration that may distort fair competition. Stronger integration between trademark law and competition law is necessary to preserve legal certainty, protect commercial goodwill, and promote equitable market competition.
