Abstract

This study examines the effectiveness of communal intellectual property protection in safeguarding regional specialty products and promoting local economic growth in Indonesia through a normative legal research approach. The analysis is based on statutory and conceptual approaches using primary legal sources, including Law Number 20 of 2016, Law Number 28 of 2014, Government Regulation Number 56 of 2022, and Ministerial Regulation Number 13 of 2017, complemented by scholarly literature on intellectual property governance and regional development. The findings indicate that Indonesia has established a relatively comprehensive legal framework for protecting geographical indications, traditional knowledge, and traditional cultural expressions. Despite this regulatory foundation, implementation remains constrained by documentation deficiencies, fragmented institutional authority, limited community participation, and uneven regional administrative capacity. The study further demonstrates that effective communal intellectual property protection contributes to product differentiation, market reputation, community empowerment, regional competitiveness, and sustainable economic development. Legal protection functions not only as a mechanism for cultural preservation but also as a strategic development instrument. Strengthening institutional coordination, improving registration systems, and expanding community based governance are essential to optimize the developmental benefits of communal intellectual property protection within Indonesia's regional economic landscape.

Abstract

This study examines the legal protection available to football broadcasting license holders against illegal streaming practices in Indonesia through a normative juridical approach. The research relies on primary legal materials consisting of Law Number 28 of 2014 on Copyright, Law Number 32 of 2002 on Broadcasting, Government Regulation Number 36 of 2018 concerning the Registration of Intellectual Property Licensing Agreements, and other relevant regulations, complemented by scholarly literature and doctrinal studies. The analysis demonstrates that football broadcasting licenses possess a legally protected position within the framework of copyright and related rights, granting license holders authority to commercially exploit broadcasting content and to seek legal remedies against unauthorized retransmission. Illegal streaming constitutes an infringement of economic rights and neighbouring rights while simultaneously violating broadcasting regulations governing the dissemination of audiovisual content. Existing protection mechanisms include preventive measures through license registration, regulatory supervision, and public legal awareness, as well as repressive measures through civil litigation, criminal prosecution, and alternative dispute resolution. The findings indicate that Indonesian law provides a relatively comprehensive normative framework, although challenges associated with digital technology, platform accountability, and enforcement effectiveness continue to affect the practical realization of legal protection. Strengthening institutional coordination and adaptive digital governance remains essential for improving future protection.

Abstract

This study examines the effectiveness of law enforcement against trademark infringement in online commerce in Indonesia through a normative juridical research approach. The analysis is based on statutory regulations, international intellectual property instruments, policy documents, and scholarly literature concerning trademark protection, electronic commerce, and digital governance. The findings indicate that Indonesia possesses a relatively comprehensive legal framework for trademark protection, supported by national legislation and international intellectual property standards. Nevertheless, the practical effectiveness of enforcement remains limited due to institutional coordination problems, difficulties in identifying online offenders, challenges associated with digital evidence, marketplace supervision limitations, and procedural barriers affecting criminal and civil remedies. The study identifies a persistent gap between normative legal objectives and enforcement realities within digital commercial environments. To address these challenges, the research proposes an integrated reform model emphasizing regulatory innovation, marketplace accountability, artificial intelligence based monitoring systems, alternative dispute resolution mechanisms, preventive legal protection, and enhanced stakeholder cooperation. The study argues that effective trademark protection in digital commerce requires the convergence of legal certainty, technological capability, and adaptive governance structures capable of responding to evolving patterns of online infringement.

Abstract

Motor Vehicle Tax is one of the sources of local revenue that every motor vehicle owner is required to pay, as stipulated in Banten Province Regional Regulation No. 1 of 2024 concerning Local Taxes and Local Levies. The compliance rate of motor vehicle taxpayers at the Serang Regency Samsat Technical Implementation Unit (UPTD) remains relatively low at approximately 58 percent of all registered vehicles and is accompanied by high levels of tax arrears. Consequently, the local government has implemented a policy to waive Motor Vehicle Tax penalties as an effort to increase tax payments and local revenue. This study analyzes the effectiveness of the policy to waive motor vehicle tax penalties on the compliance rate of motor vehicle taxpayers at the UPTD Samsat in Serang Regency, as well as the obstacles in its implementation. The analysis employs the theory of legal effectiveness and the theory of government action. The research method used is an empirical-juridical approach with a descriptive-analytical framework, utilizing primary data collected through interviews and secondary data sourced from legislation and legal literature. The research results indicate that local government actions including the elimination of administrative sanctions in the form of fines, the simplification of service procedures, and the optimization of tax payment services have proven effective in increasing Motor Vehicle Tax payments and local revenue realization in the short term, as reflected in revenue achievements for the 2020-2024 period, which largely exceeded targets. The decline in revenue realization in 2025 indicates that the effectiveness of these policies has not yet been fully accompanied by the establishment of sustainable taxpayer compliance and remains influenced by policy incentives. Policy implementation still faces obstacles in the form of limited service capacity, technical disruptions to facilities and infrastructure, low public awareness influenced by a legal culture of delaying tax obligations, and perceptions of unfairness among taxpayers who have historically been compliant. This study recommends strengthening policies to encourage sustainable taxpayer compliance and improving the quality of tax service delivery.

Abstract

Currently, the distribution of illegal cigarettes in Indonesia has evolved into a complex legal issue involving the intersection between excise tax violations and trademark infringement. This study aims to analyze the standard of “substantial similarity” in illegal cigarette branding practices, examine the forms of legal accountability imposed on perpetrators, and identify key obstacles in law enforcement. The phenomenon is driven largely by economic disparities, particularly the increase in Tobacco Product Excise (CHT), which incentivizes the emergence of organized illicit distribution networks that exploit well-known cigarette brands to mislead consumers. This research employs a normative juridical method using statutory and case approaches, focusing on legal documents and judicial precedents. The findings reveal three dominant forms of trademark infringement in illegal cigarettes, namely identical imitation, brand name modification, and packaging design replication that creates consumer confusion. Perpetrators may be held accountable through criminal sanctions under excise and trademark laws as well as civil liability based on unlawful acts under Article 1365 of the Civil Code. Although enforcement efforts such as Operation Octopus have been implemented, structural, technological, and societal constraints continue to hinder effectiveness.

Abstract

This study aims to analyze the effectiveness of the Siapang Pintu Gerbang Cooperative in improving the economy of the Lubuk Terap Village community in Bandar Petalangan Subdistrict, Pelalawan Regency. The study employed an empirical qualitative approach with a descriptive research design. Data were collected through observations, semi-structured interviews, and documentation involving the cooperative chairperson, board members, cooperative members, village officials, and community members. The data were analyzed using an interactive model consisting of data reduction, data display, and conclusion drawing and verification. The findings indicate that the cooperative has generally operated effectively by improving members' access to productive capital, supporting the development of microenterprises, strengthening member participation in organizational activities, and gradually enhancing household welfare. The cooperative has also demonstrated organizational adaptability through service improvements and flexible financing policies that respond to members' socioeconomic conditions. However, several challenges remain, including uneven member participation, limited managerial capacity, restricted financial resources, and insufficient business innovation. Strengthening organizational governance, expanding productive programs, improving managerial competencies, and encouraging broader member participation are essential to enhance the cooperative's long-term contribution to sustainable rural economic development and community welfare.

Abstract

Tourism village empowerment has become a strategic regional policy for increasing Local Own-Source Revenue (LOR) through the utilization of local cultural assets. Bakaran Wetan Tourism Village in Pati Regency is developed under Pati Regent Regulation Number 28 of 2022, yet its implementation remains constrained by limited funding, weak institutional coordination, declining tourist interest, and the tourism sector's modest contribution to regional revenue. This study analyzes the implementation, constraints, and optimization strategies of the Pati Regency Youth, Sports, and Tourism Office (DINPORAPAR) in empowering Bakaran Wetan Tourism Village. An empirical juridical approach with qualitative methods was employed using semi-structured interviews with government officials, Batik Bakaran artisans, local residents, and tourists, supported by legal and documentary analysis. The findings show that DINPORAPAR has implemented tourism village assessment, institutional guidance, tourism promotion, batik training, and community-based cultural development as unilateral governmental legal actions. Policy implementation remains constrained by weak inter-agency coordination and limited tourism funding. Batik training and digital marketing effectively strengthen community capacity while preserving cultural authenticity, whereas batik printing assistance is less effective because it overlooks the traditional identity of hand-drawn Batik Bakaran.

Abstract

The rapid growth of social media, particularly the X (Twitter) platform, has expanded opportunities for public interaction and freedom of expression while increasing the prevalence of online gender-based violence (OGBV). This study examines users' perceptions of gender-based violence on X, identifies the factors contributing to its occurrence, and analyzes its impacts from a digital criminological perspective. Using an empirical qualitative descriptive approach, data were collected through an online questionnaire administered to 50 active X users. The findings reveal that user anonymity is the primary factor facilitating gender-based violence, accompanied by weak content moderation, limited digital literacy, poor online communication ethics, and the rapid dissemination of harmful content. Respondents frequently encountered verbal harassment, sexist and misogynistic comments, cyberbullying, doxxing, body shaming, victim blaming, and threats of sexual violence. These findings support the Online Disinhibition Effect, which explains how anonymity encourages aggressive online behavior, and Routine Activity Theory, which emphasizes the interaction between motivated offenders, suitable targets, and inadequate guardianship in facilitating cyber-enabled victimization. The study recommends strengthening content moderation, improving reporting mechanisms, enhancing digital literacy, enforcing legal protections, and promoting gender equality campaigns to create safer and more inclusive digital environments.

Abstract

This study examines the strategic utilization of social media platforms in constructing the political image of Budi Rustandi and Nur Agis Aulia during the 2024 Serang City Election. Employing an empirical qualitative approach with an instrumental case study design, this inquiry analyzes how digital campaign operations cultivate political branding and manage candidate impressions among young voters. Primary data were gathered through semi-structured interviews with key campaign actors and targeted youth demographics, supplemented by non-participant observation of official social media repositories. The findings reveal that Instagram and TikTok were deployed in a highly differentiated manner to maximize algorithmic reach and validate candidate credibility. By projecting a carefully curated balance between legislative competence and grassroots populist values, the campaign generated significant cognitive alignment within the youth electorate. Crucially, the final results demonstrate that while digital communication offers immense cost efficiency in building widespread political visibility, actual electoral conversion relies on the strategic integration of virtual image formation and physical network mobilization.

Abstract

This article examines the casework approach in handling children experiencing psychosocial trauma. The topic is significant because psychosocial trauma affects not only children's psychological well-being but also their behavior, social relationships, educational participation, sense of security, and overall social functioning. Children exposed to physical, emotional, or sexual abuse, neglect, bullying, family conflict, or the loss of caregivers require comprehensive and child-centered interventions. This study aims to explain the characteristics of psychosocial trauma in children, analyze the stages of the casework approach, and describe the roles of social workers in facilitating children's recovery. A qualitative descriptive design employing a literature review was adopted. Data were obtained from scholarly books, peer-reviewed journal articles, official reports, and policy documents related to social work, child protection, psychosocial trauma, and clinical social work interventions. The findings indicate that the casework approach provides a systematic framework encompassing engagement, assessment, intervention planning, implementation, evaluation, termination, and follow-up. Social workers perform multiple professional roles, including assessor, counselor, advocate, broker, mediator, case manager, and service coordinator. Effective implementation of casework requires trauma-informed, ethical, child-friendly, and multidisciplinary practices to promote sustainable psychosocial recovery and strengthen children's resilience.
