Abstract

This study examines the adequacy of intellectual property protection for Traditional Cultural Expressions within Indonesia through a non empirical normative legal research design. It analyzes statutory provisions, doctrinal scholarship, and international frameworks to evaluate whether existing mechanisms sufficiently safeguard communal cultural rights. The findings indicate persistent structural misalignment between communal ownership systems and conventional copyright principles, particularly regarding authorship and originality requirements. The study further identifies weaknesses in benefit sharing arrangements, fragmented cultural documentation, and limited enforcement capacity in cross border contexts. Additionally, the emergence of artificial intelligence and generative digital technologies introduces new legal uncertainties concerning reproduction and cultural appropriation. The analysis highlights that current regulatory instruments do not adequately address these multidimensional challenges. It argues for a more integrated legal approach that combines statutory reform with conceptual reorientation toward community based governance. The study concludes that a sui generis framework is essential to ensure equitable protection, cultural sustainability, and legal certainty for Traditional Cultural Expressions in the evolving digital era.

Abstract

The rapid expansion of digital technology has transformed social interaction, education, communication, and economic activities across Indonesia while simultaneously generating complex ethical and social challenges. This study examines the integration of digital literacy and human values as a strategic response to the demands of contemporary digital society. Employing a qualitative library research design, the study analyzes scholarly literature, policy documents, government regulations, and theoretical works related to digital literacy, information ethics, social development, and human centered technological transformation. The findings indicate that digital literacy extends beyond technical competence and encompasses critical evaluation, responsible information use, ethical awareness, and social accountability. The analysis further reveals that digital transformation contributes to challenges such as disinformation, declining empathy, online hostility, privacy concerns, and value disorientation, which may weaken social trust and civic responsibility. Human values grounded in ethical principles, character formation, Pancasila, and religious traditions function as essential safeguards against these risks. The study concludes that effective integration requires collaborative engagement among educational institutions, families, communities, religious organizations, and government agencies. Such an integrative framework strengthens digital competence, ethical resilience, and social trust, thereby supporting inclusive, sustainable, and human centered digital development in Indonesia.

Abstract

Children's attachment is a fundamental emotional bond that plays a crucial role in shaping socio-emotional development and children's relationships with their social environment. However, difficulties in social interaction, emotional regulation, empathy, and adaptation remain common among young children and are often associated with the quality of attachment they experience. This study aims to comprehensively examine the relationship between children's attachment and their interactions within family, school, and broader social environments. A Systematic Literature Review (SLR) was conducted following the PRISMA framework by synthesizing peer-reviewed journal articles published between 2022 and 2025. The findings indicate that secure attachment positively influences children's emotional regulation, empathy, self-confidence, communication skills, cooperation, and social adaptation. In contrast, insecure attachment is associated with emotional insecurity, social withdrawal, low self-esteem, and difficulties in establishing healthy interpersonal relationships. The review further highlights that attachment extends beyond parent–child relationships to include teachers and other significant adults who contribute to children's social development. Overall, secure attachment serves as a fundamental foundation for fostering healthy social relationships, emphasizing the importance of collaborative support among families, schools, and communities to promote children's holistic development.

Abstract

The Merah Putih Cooperative Program was introduced to strengthen local economic development through community-based cooperative institutions. This study examines the effectiveness of community participation in the development planning of the Merah Putih Cooperative in Sukalaksana Neighborhood, Curug District, Serang City. An empirical qualitative approach with a single instrumental case study design was employed. Data were collected through semi-structured interviews, non-participant observations, document analysis, and literature review, and analyzed using Bintoro Tjokroamidjojo's development planning framework covering plan formulation, program formulation, implementation, supervision, and evaluation. The findings indicate that the planning process incorporated local economic potential, development objectives, and collaborative business strategies, although community participation remained limited during the initial planning stage due to the top-down nature of the program. Program implementation was constrained by limited capital, inadequate cooperative literacy, incomplete operational facilities, and uneven institutional support. Supervision was conducted through internal and external mechanisms, while the evaluation highlighted organizational readiness and community engagement as the primary determinants of future effectiveness. The study concludes that strengthening participatory governance, institutional capacity, and public involvement is essential for improving the long-term sustainability of the Merah Putih Cooperative.

Abstract

The rapid development of information technology has fundamentally transformed the music industry by enabling instantaneous and borderless access to musical works. However, this transformation is accompanied by increasing cases of illegal exploitation that violate intellectual property rights. This study aims to analyze the anatomy of music infringement and piracy, identify its underlying causal factors, and examine its impacts on copyright protection within the dynamics of digitalization in Indonesia. Using a normative juridical approach, the study examines Law Number 28 of 2014 on Copyright (Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta) and relevant scholarly literature. The findings reveal that digital music piracy manifests in various forms, including illegal downloading, unauthorized streaming, unlawful redistribution, and moral rights violations through unlicensed remixing and adaptation. These practices are driven by multidimensional factors such as low purchasing power, weak legal awareness, technological advancement outpacing regulation, and limited enforcement effectiveness. The implications extend beyond economic losses for rights holders, also weakening creative incentives and disrupting the sustainability of the national creative industry. The study concludes that although the legal framework is normatively adequate, its implementation in the digital ecosystem remains problematic and requires stronger institutional coordination, improved collective management systems, and enhanced public legal literacy.

Abstract

This study examines the dynamics of local government in sustainable natural resource management amid the expansion of marine sand mining activities on Tunda Island, Serang Regency, Indonesia. Using an empirical qualitative approach with a case study design, the research investigates how power relations, institutional arrangements, and resource access shape environmental governance outcomes within a coastal socioecological setting. Data were collected through in depth interviews, field observations, and document analysis involving fishers, village officials, community leaders, and policy observers. The findings reveal that local government actors functioned as strategic intermediaries that facilitated access to mining related benefits while simultaneously reproducing unequal patterns of resource control. The study also identifies significant governance gaps resulting from fragmented institutional authority, regulatory ambiguity, limited local oversight, and weak accountability mechanisms following shifts in governmental authority. These conditions contributed to ineffective environmental monitoring and constrained community participation in decision making processes. Ecological degradation, declining fish catches, social fragmentation, and increasing dependence on compensation emerged as major consequences of extractive governance. Community responses included resistance, adaptive livelihood strategies, and demands for environmental justice. The study argues that sustainable coastal governance requires stronger institutional coordination, participatory accountability mechanisms, and greater recognition of local ecological knowledge within resource management frameworks.

Abstract

This study examines the role of Interpol in combating transnational cybercrime in Southeast Asia through Operations HAECHI I to VI. Employing a qualitative non empirical research design and an explanatory case study approach, the research analyzes how Interpol facilitates international cooperation against cyber enabled financial crime across multiple jurisdictions. Data were derived from official Interpol operational reports, annual publications of the Interpol Financial Crime and Anti Corruption Centre, documents issued by the ASEAN Secretariat, reports from international organizations, and relevant scholarly literature. Qualitative content analysis and process tracing were used to identify institutional mechanisms and assess operational outcomes. The findings indicate that cyber enabled financial crime has evolved into a multidimensional threat affecting economic stability, governance capacity, and individual security throughout the region. Interpol has strengthened regional responses by institutionalizing intelligence exchange, coordinating cross border investigations, and supporting asset recovery through mechanisms such as the Interpol Financial Crime and Anti Corruption Centre and the Anti Money Laundering Rapid Response Protocol. Although HAECHI operations have generated substantial enforcement outcomes, persistent challenges remain in legal harmonization, regulatory capacity, and cryptocurrency related investigations. The study concludes that Interpol functions as a critical governance actor whose effectiveness depends on sustained institutional adaptation and deeper regional cooperation.

Abstract

This study examines the electronic readiness of users of the Development Evaluation and Control System Application known as ASEUPAN in Pandeglang Regency. The research employed a quantitative empirical approach using the STOPE plus Budget framework to evaluate readiness across the dimensions of Strategy, Technology, Organization, People, Environment, and Budget. Data were collected through a census survey involving fifty civil servants, administrators, and system operators who actively utilized ASEUPAN. The instrument consisted of twenty five measurement items assessed using a four point Likert scale and analyzed through descriptive statistics using IBM SPSS Statistics 26. The findings indicate that users exhibit a favorable level of readiness across all assessed dimensions. Strategic alignment and technological capability support the operational utilization of the application, while organizational commitment and human resource competence strengthen implementation effectiveness. Regulatory support, interagency collaboration, and sustainable financial resources contribute to the continuity of digital governance initiatives. The study highlights that successful digital government implementation depends on the integration of technological, organizational, human, environmental, and financial factors. These findings provide practical insights for strengthening digital governance capacity and supporting sustainable public sector transformation in local government institutions.

Abstract

This study examines the legal protection of Micro Small and Medium Enterprises trademarks within the Indonesian trademark regime from a trade law perspective by focusing on the application of the first to file principle. The research employs a normative juridical method supported by a descriptive analytical approach and relies exclusively on secondary legal materials, including legislation, judicial decisions, scholarly literature, and relevant legal doctrines. The analysis reveals that the first to file principle provides a structured mechanism for determining trademark ownership and contributes to commercial certainty in trade relations. The study also identifies persistent structural challenges affecting MSMEs, including limited legal awareness, registration barriers, unequal access to legal protection, trademark appropriation practices, and normative gaps concerning prior users. These conditions create tensions between formal legal recognition and substantive economic justice. Through doctrinal and conceptual analysis, the study proposes a reconstructed protection framework that integrates good faith considerations, recognition of prior use, alternative dispute resolution mechanisms, collective trademark models, digital registration reforms, and targeted incentive policies. The findings indicate that a balanced approach between legal certainty and equitable protection is necessary to strengthen MSME competitiveness and support sustainable trade development in Indonesia.

Abstract

This study examines the legal regulation of Merchant Discount Rate within the Quick Response Code Indonesian Standard payment system and analyzes the implications of passing MDR costs on to consumers for Micro, Small, and Medium Enterprise operators in Indonesia. Employing a non empirical normative legal research design, the study relies exclusively on statutory materials, regulatory documents, scholarly literature, and official publications. The analysis combines statutory and conceptual approaches to evaluate the consistency between legal norms governing MDR allocation and practices reported in the literature. The findings indicate that the regulatory framework clearly positions MDR as a merchant obligation and prohibits the transfer of such costs to consumers. Despite this normative clarity, MDR pass through practices continue to occur due to regulatory literacy gaps, economic pressures faced by MSMEs, digital adoption challenges, and limitations in monitoring and enforcement mechanisms. The study further demonstrates that cost transfer practices generate multidimensional consequences, including reduced consumer trust, weakened price transparency, lower digital payment acceptance, and risks to long term MSME competitiveness. The findings support the need for adaptive regulatory strategies, differentiated MDR policies, and strengthened stakeholder coordination to promote sustainable digital payment governance, consumer protection, and inclusive economic development.
