Abstract

Insurance began to interest the public as a wqy to transfer risk. The important thing is that people should be able to choose health insurance companies (solvent), a reasonable premium rate, a good investment performance (Liquid, safe, and productive), to pay claims on time, do not make poliry holders, to report correctfy and on time, and did not violate an existing report. In practice, disputes often arise between the insurer and the insured Disputes can be resolved through Indonesian Insurance Mediation Board (BMAI). BMAI dispute settlement through the mediation process begins with. if the mediation process fails, will proceed to the level of aqjudication. In addition, if the insured can not accept the decision at the aqjudication level, so that he can bring the dispute to arbitration or court. But besides these advantages, BMAI also not free from some weaknesses. However, their presence is still needed to be one of the alternative dispute resolution insurance agencies in Indonesia.

Abstract

This article was aimed at (1) discovering and constructing the political dynamics in formulating the Law of the Court of Human Rights; (2) analyzing its implication on the future of politic of Human Rights in Indonesia. This essay was a result of content analysis research with qualitative-comparative approach. The finding showed that (1) substantively, the formulation of Law No. 26 Year 2000 on Human Rights Court has fundamental weaknesses such as a partial adaptation of The Roma Statute, the course of human rights court was constructed weak by stating its authority only on investigation, whereas attorney General's Office authority on investigation lacks of detail prescription, deleting the responsibility of command such as those on the Rome Statute, etc. A lot of lacks indicate that the law was only an instrument of transitional authority. The "˜toothless' law indicates the victory of the old regime in political battlement and tension with the new regime in reformation era. The politicization of handling of human rights violation before the release of the law of Court on which the Representative People Council has authority to propose but the decision maker is the President by Presidential Decree. 2) the political dynamic has an implication on two long term situations, hoarding impunity and the crises of human rights values.

Abstract

This article is based on research intended at describing the execution of verdict of private case in court of Sleman Regency and its obstacles. It was a descriptive qualitative research. It was found that the excecution of verdict of private case in court of Sleman Regency begins by accustion or submission of execution by appelant and ends  execution by confiscation. Its obstacle were: (1) its high cost as burdance of appelant; (2) the lack of qualified personels; and (3) the rivalry or rejection of accusted. The efforts to overcome these obstacles were: (1) the chief of regency court encourages both sides to compromise between initiator of accustion and his/her rival (accusted) peacefully; (2) send a  personel substitude of seizure in calling conflicting side and proposing aditional personels but not yet succesful; and (3) the persoel of seizure inform or sends the unsolved problem through electrinic devices to Sleman Regency in order to suspend its execution.

Abstract

Tujuan artikel ini adalah untuk mengidentifikasi dan mengintegrasikan nilai-nilai kearifan lokal masyarakat dalam memperkuat integrasi nasional melalui pendidikan multikultural. Penelitian ini dilakukan dengan menggunakan pendekatan kualitatif dengan metode studi kasus. Nilai-nilai kearifan lokal masyarakat dalam adat pernikahan kelima suku tersebut secara umum terdiri dari nilai ketuhanan, persatuan, dan kerakyatan yang tercermin dalam prosesi sebelum pernikahan, saat pernikahan, dan setelah pernikahan. Dengan demikian, nilai-nilai kearifan lokal masyarakat tersebut pada dasarnya merupakan nilai-nilai yang secara umum terdapat di setiap daerah yang dapat memperkuat integrasi nasional.-------------------------------------------------------------------------------------------------------------------------------------This article was aimed at identifying and integrating local wisdom values fostering national integration through multicultural education. It was a qualitative research with case study as its method. Local wisdom values embedded in the all of five tribes' marriage are the believe in God, Humanity, unity, and democracy. In other words, these local wisdom are in common among society members and can enhance national integration.

Abstract

Tingkat kepatuhan pajak di negara kita tampaknya belum dapat dibanggakan. Kesadaran untuk melakukan serangkaian proses pembayaran pajak belum sepenuhnya melekat pada diri wajib pajak. Rendahnya kesadaran pajak tersebut pada akhirnya berimbas pada rendahnya tingkat kepatuhan pajak wajib pajak. Salah satu pemicu yang menjadikan ketidaksadaran untuk berpajak tersebut “membudaya” justru disebabkan oleh adanya sikap sebagian aparat pajak di lapangan yang menyalahgunakan kewenangan mereka. Hal itulah yang memperburuk citra aparat pajak dan membuat wajib pajak tidak merasa bangga berstatus sebagai wajib pajak. Di sisi lain, penegakan hukum terhadap aparat-aparat tersebut masih sangat lemah, sehingga kepercayaan wajib pajak pun sulit dibangun. Lingkaran yang tercipta antara ketidakpatuhan pajak wajib pajak dengan sikap aparat pajak yang tidak sesuai aturan main harus segera diputus. Salah satu kuncinya adalah dengan menyelenggarakan penegakan hukum terhadap aparat pajak secara konsisten.

Abstract

In the past times, the moral issue is a core and main face of education. The talks about education, educators, or well-educated people refer ni"'ainfy to illustration of aspect of their morality and personality. Although the paradigm of education as a inheritance of values, especialfy moral values, are considered as an old-fashioned or conseruatiie, but , such education is very relevant for the solution to improve the morality of the nation.  Subjects of Civic Education have distinctive vission, namely the formation of good citizens.  Definition of ''good citizens" shows that the moral content is essential. However it is often based on interpretation of the ruler. As a consequence, these subfects are regarded as more political  than academic and suf?jects with a weak saentificfoundation.  As a part of formal curriatium, the moral dimension in Civic Education should be abso­ lutefy developed from the content or material standards. Beside, teachers with the aTttonomy thry had could inculcate moral values, whether unitersal or contextual or cultural or local. Thus, it is possible for teachers to develop iiformal curriculum or hidden curriculum, beside the formal curriculum

Abstract

 This paper described the role of New Order Regime in Indonesia to build the citizen characters through the educational system. The regime effort to inculcate its interpretation on Pancasila (Five Principles) such as "Pedoman Penghayatan dan Pengamalan Pancasila" (P4). Citizens have been forced to receive and agree what regime intentions on Pancasila. They should be loyal to what regime interests on Pancasila. In the schooling, the New Order Regime has established P4 as core contents of civic virtues to build "good citizen" characters. Some policies in the educational (schooling) system released namely "Pendidikan Moral Pancasila" (Education of Moral Pancasila, PMP) and "Pendidikan Pancasila dan Kewarganegaraan" (Pancasila dan Civic Education, PPKn). This paper seemed the political decision making on how civic virtues have been implemented in the textbooks and two curriculum periods (1984 and 1994). The last, this paper examined the opportunity and prospect the new paradigm of civic education post-1998, i.e. the transitional democracy period after the fall of Suharto as leader profile of the New Order Regime.

Abstract

Political education, therefore, as such, has not had a central part in curiculum, although what is often referred to as the hidden curriculum could be argued to have contributed to a political education of sorts, shaping the attitudes of students towards authoriry and implicitlY forming the values of the students in such politicallY important matters as socialjustice, racial and gender equaliry, or nationallqyaliry. But such political formation would be implicit, and indeed the protesters in the 1970s against the exploration in clasrooms of the rights and wrongs of nuclear warfare did not see that their own action enforced a particular political position as the legitimate one to be subscribed to ry teachers. Education and politics are inextricablY linked. Politics is inseparable from education, unless the country plans to generate illiterate politicians' who could not be expected to lead the republi~ out of the current crises. You cannot escape politics or separate it from education. Politics is the way to manage the broad environment, and not merelY a struggle for power. Therefore it is the dury of schools to help students dijJerentiate between good politics and bad politics.

Abstract

Classroom Action Research was conducted in class VIII C SMP Negeri 3 Berbah Academic Year 2013/2014 by using Jigsaw cooperative learning approach. This study aims to implement cooperative learning Jigsaw to improve the activity and learning outcomes of students in the subject of Citizenship Education. The method used in this study is a qualitative descriptive analysis. The results of this study indicate that prior to the implementation of the action no activity learners are categorized very active, the active category 5 (22.73%), fairly active 6 (27.27%) and less active 11 (50.00%). After the first cycle are very active category 5 (27.27%), the active category 11 (50.00%), quite active 4 (18.18%) and less active 1 (4.55). And after the second cycle which is very active category 7 (31.82%), the active category 9 (40.91%), quite active 5 (22.73%) and less active 2 (09,09%)). When viewed in the development of mastery learning it before action 9 learners otherwise completed (40.91%), following which the first cycle were 17 (77.27%) students who otherwise completed and after the second cycle students who achieve mastery learning 19 learners (86.36%). During the implementation of the action has been an increase in both, the level of activity and learning outcomes of students. Student activity levels increased along with the lessons learned in the initial group of experts and grouped. With increasing activity of the learner cognitive structure and his memory be better study results also increased
