Abstract

One of the plantation land conflicts that remains problematic and has yet to reach a consensus on the criminalization of agrarian conflicts is the Rotorejo Kruwuk Plantation in Gadungan Village, Gandusari District, Blitar Regency, and the Kelud Makmur Farmers Association. This study uses empirical legal research methods. The aim of the study is to identify facts related to the author's problem. The results indicate that legal resolution efforts in this agrarian conflict include mediation. Meetings held by several agencies such as the Village Head, Blitar Regency National Land Agency (BPN), the Company, the Regional Office Head, the Sub-district Head, the KPA Chair, the GTRA Team, the Gadungan Village Head, the Ministry of ATR/BPN, the Blitar City Police and the Blitar City Government in 2022 and 2023 resulted in ease in obtaining redistribution because the land status was designated as a Priority Location for Agrarian Reform. Despite the land redistribution, farmers still face obstacles in doing so, including: (1) the lack of clarity from the authorized agency regarding the legality deed; (2) the location of the proposed control does not match the PPKM's wishes; (3) the existence of land leases to other parties; (4) the existence of clashes in information and communication regarding extension of HGU; and (5) the boundary between residents' land and HGU land is not yet clear .

Abstract

Perjanjian kredit yang menggunakan jaminan berupa hak tanggungan memiliki hak eksekutorial yang kuat, sehingga butuh putusan pengadilan untuk membatalkannya. Penelitian ini berusaha mengkaji perkara gugatan penundaan eksekusi lelang hak tanggungan pada Putusan Pengadilan Negeri Surabaya Nomor 36/Pdt.G/2023/PN Sby. Pada penelitian ini bertujuan menganalisis dasar pertimbangan hakim dalam memutus perkara Nomor 36/Pdt.G/2023/PN Sby dan menganalisis bagaimana akibat hukum bagi para pihak dari putusan Nomor 36/Pdt.G/2023/PN Sby. Penelitian ini merupakan penelitian yang bersifat yuridis normatif dengan pendekatan kasus, pendekatan perundang-undangan, dan pendekatan konsep. Hasil dari penelitian ini memperoleh kesimpulan bahwa majelis hakim dalam memutus perkara Nomor 36/Pdt.G/2023/PN Sby mempertimbangkan tiga hal yaitu pertimbangan mengenai wanprestasi, pertimbangan keterlambatan karena Pandemi Covid-19 yang dianggap sebagai force majeur, dan pertimbangan adanya kebijakan yang mendukung stimulus pertumbuhan ekonomi yang ada dalam Peraturan Otoritas Jasa Keuangan Republik Indonesia Nomor 11/PJOK.03/2020. akibat hukum bagi para pihak yakni lelang ditunda dan diperintahkan untuk renegosiasi Kata Kunci: Perjanjian Kredit, Penundaan Lelang, Force Majeur

Abstract

Penelitian ini bertujuan untuk menganalisis apa dasar pertimbangan hakim dalam menyelesaikan perselisihan hak meskipun terdapat dissenting opinion berdasarkan Putusan Nomor 801K/Pdt.Sus-PHI/2020 dengan adanya keberlakuan surat edaran menakertrans dan untuk menganalisis apa akibat hukum dari perselisihan hak antara pekerja dan pengusaha berdasarkan Putusan Nomor 801K/Pdt.Sus-PHI/2020. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan statute approach dan conseptual approach. Penelitian ini mengangkat permasalahan mengenai pemenuhan uang penggantian hak bagi pekerja yang mengundurkan diri. Berawal dari putusan Nomor 29/Pdt.Sus-PHI/2019/PN.Smg dan berlanjut pada tingkat MA dengan nomor putusan 801k/Pdt.sus-PHI/2020 yang merupakan salah satu permasalahan hubungan industrial terkait perselisihan hak. Para pihak yang berselisih ialah PT Multi Mayaka (Penggugat) dengan Gregorius Puji Satriyo Nugroho (Tergugat) selaku pekerja dari PT. Multi Mayaka. Penggugat tidak memberikan uang atau menahan gaji bulan Februari 2019, uang pisah serta uang penggantian hak sebesar 15% (lima belas persen) Tergugat sesuai dengan ketentuan yang sudah diatur dalam peraturan perusahaan berupa Keputusan Direksi Ref.No.003/DIR/I/2019 tentang peraturan untuk bagian penjualan. PT Multi Mayaka menyampaikan bahwa Tergugat masih mempunyai kewajiban untuk diselesaikan yaitu menagih piutang dealer yang masih belum tertagih sejumlah Rp. 7.410.000,- (tujuh juta empat ratus sepuluh ribu rupiah). Abstract

Tanah merupakan hal sangat vital terutama bagi masyarakat Indonesia, karena merupakan induk dari segala pokok kebutuhan yang didapatkan dengan proses penguasaan. Penguasaan kepemilikan tanah dapat diperoleh dengan berbagai macam cara, salah satunya yaitu dengan jual beli yang berdasar pada perjanjian jual beli tanah. Pelaksanaan hak dan kewajiban yang kurang tepat dalam perjanjian jual beli tanah dapat menimbulkan sengketa. Banyak sekali kasus pelanggaran terhadap perjanjian pengikatan jual beli hak atas tanah yang tidak sesuai dengan peraturan perundang-undangan yang berlaku. Kasus tersebut terdapat dalam Putusan Mahkamah Agung Nomor 2108 K/Pdt/2022. Tujuan penelitian ini untuk mengetahui apa dasar pertimbangan hakim pada Putusan Mahkamah Agung Nomor 2108K/Pdt/2022 dan menganalisis akibat hukum dari putusan tersebut. Penelitian ini merupakan penelitian hukum normatif, dengan menggunakan pendekatan perundang-undangan, pendekatan kasus, dan pendekatan konseptual. Sumber bahan hukum yang digunakan berupa bahan hukum primer, sekunder, dan tersier. Hasil dari penelitian ini adalah Perjanjian Pengikatan Jual Beli Nomor 150/D/XI/2005 sudah sah menurut Pasal 1320 KUHPerdata karena memenuhi syarat. Hakim memutuskan gugatan sebagai Perbuatan Melawan Hukum akibat pemutusan sepihak tanpa kesepakatan. Tergugat IV dianggap pembeli beritikad tidak baik karena membeli tanah dalam PPJB pihak lain dan melibatkan Camat sebagai PPAT. Kasasi Tergugat IV ditolak dan dihukum membayar biaya perkara Rp500.000, serta harus merelakan tanah dalam Sertifikat Nomor 655. H. Nazaruddin memenangkan kontra memori kasasi dan dapat melanjutkan PPJB.

Abstract

The difference between election (Pemilu) and regional head election (Pilkada) systems stems from Constitutional Court decision No. 97/PUU-XI/2013. This decision states that the Constitutional Court does not have the authority to handle disputes over election results, unless a Specialized Judicial Body has not been established. However, the question is whether the Constitutional Court is still authorized to handle disputes over election results after Constitutional Court Decision Number 85/PUU-XX/2022, and whether there needs to be an adjustment regarding this authority in the 1945 Constitution. In this context, the understanding of the meaning of elections also needs to be studied after Constitutional Court Decision No. 85/PUU-XX/2022. Through a normative approach and by using primary and secondary legal sources, this study concludes that after Constitutional Court Decision No. 85/PUU-XX/2022, the distinction between the two regimes has disappeared, so that the Constitutional Court has the authority to permanently handle disputes over election results.

Abstract

Sexual violence is a crime that is a problem throughout the world, especially in Indonesia due to several factors such as politics, poverty, patriarchal culture and the difficulty of handling cases of sexual violence that are sensitive for the victim. This is also experienced by Malaysia, which is a neighboring country of Indonesia and has similar conditions to Indonesia. Malaysia in addressing sexual violence in its country built the Anti-Sexual Harassment Tribunal which is quite unique and different from other countries from Indonesia, then a study was formed that will compare the rules regarding the criminal justice system and protection of victims in it related to the crime of sexual violence between Indonesia and Malaysia, using a legislative and comparative approach. This study will look at the comparison of these two countries in responding to cases of sexual violence with the regulations that have been made and implemented, as well as looking at the efforts of each country to improve the protection of victims of sexual violence from the regulations in their respective countries categorized by the Declaration of Basic Principles of Justice for Victims of Crime and Abuse of Power indicators.

Abstract

Children working in the entertainment industry have a high potential for economic exploitation by parents and employers. The problem formulations in this research are: (1) How is the comparison of labor law in Indonesia and the United States related to the economic exploitation of child labor in the entertainment industry, (2) How is the comparison of formulations related to the economic exploitation of child labor in entertainment between Indonesian and United States labor law? The purpose of this study is to analyze the comparison of labor law in Indonesia and the United States related to the economic exploitation of child labor in the entertainment industry. The research method used is legal research using a statutory approach and a comparative approach. The results of the study can be concluded that in Indonesia itself the regulations related to economic exploitation of child labor are still vague, there are no concrete limits related to economic exploitation, while one of the states of California has the Coogan Law which protects child artists from economic exploitation. Changes to laws and regulations in Indonesia are carried out by inserting or adding material to laws and regulations and deleting or replacing some of the material of laws and regulations, while in the United States it is done by members of the House of Representatives or Senate distributing the Draft Law or asking other members through Dear Colleague Letters to sign the draft.

Abstract

One of the Indonesian government's programs to fulfill the housing needs of Low-Income Communities (MBR) is through the Home Ownership Credit (KPR) program, implemented via a credit agreement between PT Bank Tabungan Negara (Persero) Tbk. and the customer. A legal issue arises when the debtor transfers the KPR house to a third party without the written consent of the creditor while the mortgage is still under installment. This study aims to analyze whether such a transfer of ownership rights is legally permissible and to examine the legal consequences of this action. The research employs normative legal methods with statutory, conceptual, and case approaches, using a prescriptive analysis technique. The findings show that the transfer of ownership rights to KPR houses during the installment period without creditor approval violates the provisions of the credit agreement and the Mortgage Law. This action also contravenes the fiduciary principle embedded in the credit system, where the creditor retains legal control over the asset until the debt is fully repaid. The legal consequence is the absence of legal certainty for the third-party buyer, as the transfer cannot be registered at the Land Office, thus rendering the transaction invalid in the eyes of the law. The study recommends increasing public awareness of credit agreement obligations and stricter enforcement from financial institutions to prevent unauthorized transfers and protect all parties involved.

Abstract

The purpose of this study is to analyze whether or not the Circular Letter of the Deputy Attorney General for General Crimes Number SE-3/E/EJP/11/2020 of 2020 concerning prosecutor's instructions (P-19) at the pre-prosecution stage is carried out once in handling general criminal cases and legal protection for suspects for the return of case files from the public prosecutor to the investigator more than once. This research method is normative juridical. The results and discussion show that pre-prosecution restrictions through Circular Letter of the Deputy Attorney General for General Crimes Number SE-3/E/EJP/11/2020 of 2020 concerning prosecutor instructions (P-19) at the pre-prosecution stage are carried out once in handling general criminal cases are non-binding so that they can be easily deviated from and the form of legal protection for suspects whose rights are violated by the return of alternating case files is that the investigator issues an Order to Terminate Investigation (SP3), provide rehabilitation and coordinate well with the public prosecutor as stated in Article 109 paragraph (1) of Law Number 8 of 1981 concerning the Criminal Procedure Code.

Abstract

This research aims to analyze the rights of employees who voluntarily resign and whose wages have not been paid, through a case study of the Supreme Court decision number 318 K/Pdt.Sus-PHI/2023. This type of research is normative with a legislative, case, and conceptual approach. The technique for collecting legal materials is done through literature study and analyzed using a prescriptive technique. The research findings indicate that the judge's consideration of applying Article 50 of Government Regulation 35/2021, supported by the available evidence, states that employees who voluntarily resign are still entitled to unpaid wages and holiday allowances (THR), as well as severance pay. The research also concludes that employees who voluntarily resign should also be entitled to compensation for rights. The legal consequence of this decision is the annulment of the previous ruling, which rejected the lawsuit in its entirety. Consequently, the Defendant is obligated to pay the unpaid wages and THR, as well as the severance pay, to the Plaintiffs.
