Abstract

Tanah merupakan hal sangat vital terutama bagi masyarakat Indonesia, karena merupakan induk dari segala pokok kebutuhan yang didapatkan dengan proses penguasaan. Penguasaan kepemilikan tanah dapat diperoleh dengan berbagai macam cara, salah satunya yaitu dengan jual beli yang berdasar pada perjanjian jual beli tanah. Pelaksanaan hak dan kewajiban yang kurang tepat dalam perjanjian jual beli tanah dapat menimbulkan sengketa. Banyak sekali kasus pelanggaran terhadap perjanjian pengikatan jual beli hak atas tanah yang tidak sesuai dengan peraturan perundang-undangan yang berlaku. Kasus tersebut terdapat dalam Putusan Mahkamah Agung Nomor 2108 K/Pdt/2022. Tujuan penelitian ini untuk mengetahui apa dasar pertimbangan hakim pada Putusan Mahkamah Agung Nomor 2108K/Pdt/2022 dan menganalisis akibat hukum dari putusan tersebut. Penelitian ini merupakan penelitian hukum normatif, dengan menggunakan pendekatan perundang-undangan, pendekatan kasus, dan pendekatan konseptual. Sumber bahan hukum yang digunakan berupa bahan hukum primer, sekunder, dan tersier. Hasil dari penelitian ini adalah Perjanjian Pengikatan Jual Beli Nomor 150/D/XI/2005 sudah sah menurut Pasal 1320 KUHPerdata karena memenuhi syarat. Hakim memutuskan gugatan sebagai Perbuatan Melawan Hukum akibat pemutusan sepihak tanpa kesepakatan. Tergugat IV dianggap pembeli beritikad tidak baik karena membeli tanah dalam PPJB pihak lain dan melibatkan Camat sebagai PPAT. Kasasi Tergugat IV ditolak dan dihukum membayar biaya perkara Rp500.000, serta harus merelakan tanah dalam Sertifikat Nomor 655. H. Nazaruddin memenangkan kontra memori kasasi dan dapat melanjutkan PPJB.

Abstract

Kekerasan seksual merupakan tindak pidana yang menjadi permasalahan di seluruh dunia khususnya di Indonesia karena beberapa faktor seperti politik, kemiskinan, budaya patriarki dan sulitnya penanganan kasus kekerasan seksual yang bersifat sensitif bagi sang korban . Hal ini juga dialami oleh Malaysia yang merupakan negara tetangga Indonesia dan memiliki kondisi yang cukup mirip dengan Indonesia. Untuk mengatasi hal tersebut maka dibentuk sebuah penelitian yang akan membandingkan aturan mengenai sistem peradilan pidana dan perlindungan terhadap korban terkait tindak pidana kekerasan seksual antara Indonesia dan Malaysia, dengan menggunakan pendekatan perundang-undangan dan perbandingan. Penelitian ini akan melihat Perbandingan kedua negara ini menunjukkan adanya perbedaan dari kedua negara ini dalam menyikapi kasus kekerasan seksual dengan peraturan yang telah dibuat dan dilaksanakan dan Upaya masing-masing negara untuk meningkatkan perlindungan korban kekerasan seksual dari peraturan-peraturan yang ada di negara masing-masing dikategorikan dengan indikator Declaration of Basic Principles of Justice for Victims of Crime and Abuse of Power. Abstract

Anak-anak yang bekerja di industri hiburan berpotensi besar mengalami eksploitasi ekonomi oleh orang tua maupun pemberi kerja. Para orang tua dan pemberi kerja sering tidak menyadari telah melakukan eksploitasi kepada anak, karena mereka menganggap pekerjaan tersebut untuk mengembangkan bakat dan minat. Rumusan masalah dalam penelitian ini adalah: (1) Bagaimana perbandingan hukum ketenagakerjaan di Indonesia dan Amerika Serikat terkait eksploitasi ekonomi pekerja anak di industri hiburan?, (2) Bagaimana perbandingan formulasi terkait eksploitasi ekonomi pekerja anak di dunia hiburan antara hukum ketenagakerjaan Indonesia dan Amerika Serikat?. Tujuan penelitian ini adalah untuk menganalisis perbandingan hukum ketenagakerjaan di Indonesia dan Amerika Serikat terkait eksploitasi ekonomi pekerja anak di industri hiburan. Metode penelitian yang digunakan adalah penelitian hukum (legal research) dengan menggunakan pendekatan perundang-undangan dan pendekatan perbandingan. Hasil penelitian dapat disimpulkan bahwa di indonesia sendiri peraturan terkait eksploitasi ekonomi terhadap pekerja anak masih kabur, tidak ada batasan konkrit terkait eksploitasi ekonomi, sedangkan salah satu negara bagian California memiliki Coogan Law yang melindungi para artis cilik dari eksploitasi ekonomi. Perubahan peraturan perundang-undangan di Indonesia dilakukan dengan cara menyisipkan atau menambah materi kedalam peraturan perundang-undangan dan menghapus atau mengganti sebagian materi peraturan perundang-undangan, sedangkan di Amerika Serikat dilakukan dengan cara anggota House of Representative ataupun Senate menyebarkan RUU atau meminta kepada anggota lain melalui Dear Colleague Letters untuk menandatangani rancangan tersebut. Abstract

One of the Indonesian government's programs to fulfill the housing needs of Low-Income Communities (MBR) is through the Home Ownership Credit (KPR) program, implemented via a credit agreement between PT Bank Tabungan Negara (Persero) Tbk. and the customer. A legal issue arises when the debtor transfers the KPR house to a third party without the written consent of the creditor while the mortgage is still under installment. This study aims to analyze whether such a transfer of ownership rights is legally permissible and to examine the legal consequences of this action. The research employs normative legal methods with statutory, conceptual, and case approaches, using a prescriptive analysis technique. The findings show that the transfer of ownership rights to KPR houses during the installment period without creditor approval violates the provisions of the credit agreement and the Mortgage Law. This action also contravenes the fiduciary principle embedded in the credit system, where the creditor retains legal control over the asset until the debt is fully repaid. The legal consequence is the absence of legal certainty for the third-party buyer, as the transfer cannot be registered at the Land Office, thus rendering the transaction invalid in the eyes of the law. The study recommends increasing public awareness of credit agreement obligations and stricter enforcement from financial institutions to prevent unauthorized transfers and protect all parties involved.

Abstract

Pre-prosecution procedures are often repeated, resulting in inefficiencies due to the continuous exchange of case files between investigators and public prosecutors. This situation stems from the normative vagueness in Article 109 paragraph (1) of Law Number 8 of 1981 concerning the Criminal Procedure Code, particularly regarding the principle of coordination between investigators and prosecutors. Such procedural delays threaten legal certainty and violate suspects' human rights, particularly the right to freedom. This study aims to analyze the validity and binding force of the Circular Letter of the Deputy Attorney General for General Crimes Number SE-3/E/EJP/11/2020, which limits the issuance of P-19 instructions to only once during the pre-prosecution stage in general criminal cases. It also aims to assess the legal protection available to suspects when case files are returned multiple times. This research employs normative juridical methods using statutory and conceptual approaches. The findings show that while the Circular Letter provides guidance, it is not legally binding and thus easily deviated from in practice. The absence of strict limitations on the number of times a case file can be returned results in legal uncertainty and potential human rights violations. As a form of legal protection, investigators may issue an Order to Terminate Investigation (SP3), provide rehabilitation to the suspect, and improve coordination with prosecutors as mandated by Article 109. The study recommends codifying clear limits on pre-prosecution procedures to ensure efficiency and protect suspects’ rights.

Abstract

In an employment relationship, discrepancies between employees and employers can lead to employees voluntarily resigning. This can result in industrial relations disputes if there are rights that the employer has not fulfilled for the employee, as seen in the case of the Supreme Court Decision number 318 K/Pdt.Sus- PHI/2023. This research aims to analyze the rights of employees who voluntarily resign and whose wages have not been paid, through a case study of the Supreme Court decision number 318 K/Pdt.Sus-PHI/2023. This type of research is normative with a legislative, case, and conceptual approach. The technique for collecting legal materials is done through literature study and analyzed using a prescriptive technique. The research findings indicate that the judge's consideration of applying Article 50 of Government Regulation 35/2021, supported by the available evidence, states that employees who voluntarily resign are still entitled to unpaid wages and holiday allowances (THR), as well as severance pay. The research also concludes that employees who voluntarily resign should also be entitled to compensation for rights. The legal consequence of this decision is the annulment of the previous ruling, which rejected the lawsuit in its entirety. Consequently, the Defendant is obligated to pay the unpaid wages and THR, as well as the severance pay, to the Plaintiffs.

Abstract

The Ministry of Health through Regulation Number 62 of 2017 has mandated that baby diaper products, as part of Household Health Supplies (PKRT), must include proper markings and product information before distribution. This regulation ensures consumer safety and compliance with health standards. This study aims to analyze the level of legal awareness among mothers regarding PKRT markings and information on baby diaper products, and identify the factors influencing that awareness. Conducted in Pasongsongan Sub-district, Sumenep Regency, East Java, the study applies an empirical juridical research method using interviews, observation, and documentation as data collection techniques. The findings reveal that mothers’ legal awareness is generally low, as assessed through four key indicators: legal knowledge, legal understanding, legal attitudes, and legal behavior. Most mothers lack awareness of the obligation for producers to include PKRT markings, and this is reflected in their indifferent behavior when selecting baby diapers. Contributing factors to this low awareness include limited reading interest, low levels of education, and age-related constraints. The study concludes that the legal awareness of mothers as consumers remains insufficient and recommends that relevant authorities, including health offices and consumer protection agencies, intensify socialization and education regarding the importance of PKRT markings and information. Increasing public literacy and access to clear, comprehensible labeling on household health products is essential to enhance consumer protection and public health standards.

Abstract

The inclusion of a coverage termination clause in insurance policies is mandated under Article 11 letter k of OJK Regulation Number 23/POJK.05/2015 concerning Insurance Products and Marketing. However, the same clause is restricted under Article 30 paragraphs (4) and (5) of OJK Regulation Number 6/POJK.07/2022, which prohibits exculpatory clauses that limit insurers' responsibilities. This study aims to analyze the validity of the coverage termination clause in Article 7 of PT Asuransi Artarindo’s Insurance Policy in relation to the prohibition of exculpatory clauses and to examine its legal consequences. This research is normative legal research, utilizing a statutory and conceptual approach. Data is collected through literature study and analyzed prescriptively. The findings indicate that the termination clause in PT Asuransi Artarindo’s policy aligns with Article 11 letter k of OJK Regulation 23/POJK.05/2015 and with Articles 249, 276, and 293 of the Indonesian Commercial Code. The clause does not meet the criteria of an exculpatory clause as defined in Article 30 of OJK Regulation 6/POJK.07/2022. Consequently, the legal impact of its inclusion is minimal, as the agreement fulfills both subjective requirements (mutual consent and legal capacity) and objective requirements (legal cause and lawful object). Therefore, the policy remains valid and enforceable. This study recommends clearer regulatory harmonization between OJK regulations to avoid legal ambiguity for insurers and consumers in the future.

Abstract

This research explores the regulatory framework of BPJS Employment tariffs, focusing on workers whose wages fall below the Regency/City Minimum Wage (UMK). The study aims to examine how BPJS Employment regulates contribution payments between employers and workers earning below the UMK, as well as to analyze the legal implications arising from discrepancies in reported wages during BPJS registration. The research adopts a normative juridical method, grounded in the logic of legal science from a normative perspective. It views the law as a structured system of norms, principles, and statutory rules used to resolve legal issues. The study identifies a normative void in existing regulations, stemming from the unclear articulation of the wage components subject to BPJS contributions. To address this, the research applies legal reasoning by analogy. It concludes that in the absence of an official wage suspension, employers must comply with Article 32 paragraph (2) of Presidential Regulation Number 64 of 2020, which mandates adherence to the prevailing minimum wage standard. Moreover, companies that fail to register their employees with BPJS Employment are subject to administrative sanctions, including formal warnings, cessation of business operations, or revocation of business licenses. The study recommends regulatory clarification on wage components used in calculating contributions and stricter enforcement mechanisms to ensure compliance, particularly for vulnerable low-wage workers.

Abstract

Abstrak Perkawinan di Indonesia merupakan perkara yang diatur dalam Peraturan Perundang-undangan, sehingga untuk melaksanakan perkawinan harus memperhatikan syarat-syarat yang telah diatur. Perkawinan yang telah dilaksanakan, apabila dikemudian hari diketahui tidak sesuai syarat yang telah diatur, maka perkawinan tersebut dapat dibatalkan. Seperti halnya pada salah satu perkara dalam Putusan Pengadilan Agama Parepare Nomor 372/Pdt.G/2019/PA.Pare, dalam putusan tersebut terjadi suatu perkara pembatalan perkawinan akibat adanya paksaan yang mendasari perkawinan tersebut, dimana hal ini bertentangan dengan Pasal 6 Ayat (1) UU Perkawinan. Majelis Hakim dalam memutuskan untuk membatalkan perkawinan tersebut tidak memberikan pertimbangan yang jelas dan rinci mengenai bagaimana bentuk paksaan yang terjadi. Hal ini mengakibatkan adanya kekaburan makna paksaan dalam Pasal 6 Ayat (1) UU Perkawinan, dan menyebabkan perbedaan interpretasi mengenai bagaimana sebenarnya bentuk paksaan yang dapat membatalkan perkawinan. Sehingga dalam penelitian ini, yang akan dibahas adalah: Apa dasar pertimbangan hakim dalam mengabulkan permohonan pembatalan perkawinan perkara Putusan Nomor 372/Pdt.G/2019/PA.Pare, serta apa akibat hukum yang timbul dari Putusan Nomor 372/Pdt.G/2019/PA.Pare terhadap perkawinan yang dibatalkan. Metode penelitian yang digunakan adalah penelitian hukum normative, dengan menggunakan pendekatan perundang-undangan, konsep, dan kasus, serta menggunakan teknik preskriptif dalam analisisnya. Berdasarkan hasil analisis, Majelis Hakim mengabulkan gugatan tersebut berdasar pada pengakuan Tergugat II, serta bentuk paksaan yang dapat membatalkan perkawinan tidak hanya paksaan yang mengandung unsur kekerasan saja, melainkan termasuk perbuatan yang menekan seseorang untuk melakukan sesuatu yang tidak dikehendaki. Selanjutnya, akibat hukum yang timbul yaitu dibatalkannya perkawinan dalam perkara tersebut, sehingga kembali status keduanya sebagaimana sebelum perkawinan dilaksanakan.
