Abstract

Pemutusan Hubungan Kerja (PHK) memiliki beberapa jenis salah satunya PHK oleh perusahaan, dalam praktiknya terdapat pekerja yang melakukan pelanggaran terhadap peraturan perusahaan. Salah satu pelanggaran peraturan perusahaan yang terjadi ialah tidak memenuhi target kerja yang ditetapkan perusahaan dan berujung pada PHK dengan menyatakan bahwa pekerja melakukan tindakan indisipliner. Perusahaan dapat melakukan PHK akibat pekerja melakukan pelanggaran peraturan perusahaan termuat dalam Pasal 154A ayat (1) huruf k UU No. 6 Tahun 2023. Dalam hal PHK akibat pelanggaran peraturan perusahaan, pekerja mendapat hak sebagaimana Pasal 52 ayat (1) PP No. 35 Tahun 2021. Terdapat kasus pekerja yang di putus hubungan kerjanya akibat pelanggaran peraturan perusahaan namun tidak mendapatkan uang penggantian hak. Tujuan dari penelitian ini untuk mengetahui apakah pekerja yang tidak memenuhi target kerja dapat diputus hubungan kerjanya serta untuk memahami akibat hukum yang ditimbulkan akibat pemutusan hubungan kerja karena pelanggaran peraturan perusahaan. Penelitian ini menggunakan jenis penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Teknik pengumpulan bahan hukum dilakukan dengan studi kepustakaan. Metode analisis bahan hukum yang digunakan bersifat deskriptif dan perspektif. Adapun hasil penelitian menunjukkan bahwa pekerja A yang tidak memenuhi target kerja dapat dikatakan telah melalukan pelanggaran terhadap Peraturan Perusahaan PT. X Tahun 2021-2023. Berdasarkan perjanjian bersama antara pekerja dengan perusahaan hak yang didapatkan oleh pekerja yang melanggar peraturan perusahaan hanya mendapatkan uang pesangon dan uang penghargaan masa kerja tanpa uang penggantian hak tidak sesuai sebagaimana Pasal 52 ayat (1) PP No. 35 Tahun 2021.

Abstract

The crime of corruption is an extraordinary crime, which should be able to deter the perpetrators from committing the crime again. However, the new rules made in Law No.1 of 2023 concerning the Criminal Code have lightened the prison sanctions and fines for perpetrators of corruption when compared to Law No.31 of 1999 concerning corruption. The purpose of this research is to find out what is the basis for the rules of corruption offenses to be included in the National Criminal Code and to find out the basis for reducing the sentences for corruption offenses in the National Criminal Code. So that problems related to the reduction of criminal sanctions for corruption motivate the author to conduct research using normative legal research methods with a statutory approach, conceptual approach, and historical approach. The data collected is then analyzed prescriptively. The result of the research is that corruption can be included in the National Criminal Code through the principle of codification and it can be seen that the reduction of punishment for corruption offenders is based on the politics of criminal law, individualization of punishment, and punishment. However, this is not in accordance with the existing facts considering that this corruption case is detrimental not only to the state but also to society.

Abstract

The mechanism of enforced disappearance is regulated in Law No. 39 Year 1999 on Human Rights and Law No. 26 Year 2000 on Human Rights Court, but in the law the definition of enforced disappearance is still unclear, there is no active subject and there is no element of degrading human dignity in crimes against humanity. This study was conducted to analyze the urgency of ratification of the International Convention For The Protection Of All Persons From Enforced Disappearance (ICPPED) in upholding human rights in Indonesia and to examine the legal protection of victims and families of victims of enforced disappearance. This research uses normative juridical research method by using laws and regulations and legal science concepts as the basis of analysis. As for the research results obtained, ratifying the International Convention For The Protection Of All Persons From Enforced Disappearance (ICPPED) was carried out as an effort to break the chain of enforced disappearance practices, anti-impunity, and as an effort to provide guarantees of recovery for victims of enforced disappearance. Legal protection is provided as a form of strengthening regulations and as an effort to favor victims in the form of restoring the rights of victims of deprived rights protection including restitution, compensation, and rehabilitation.

Abstract

Changes in Land and Building Tax (PBB) objects are mandatory to be reported via a Tax Object Notification Letter (SPOP) according to Mojokerto Regent Regulation Number 71 of 2020 concerning Procedures for Collecting Regional Taxes. This research aims to analyze the legal awareness of taxpayers regarding reporting changes to Land and Building Tax objects through Tax Object Notification Letters as well as analyzing the obstacles faced by taxpayers in Harmoni Residence Housing, Mojokerto Regency regarding reporting changes to Land and Building Tax objects. This writing is included in empirical legal writing using data collection techniques through interviews and observation. The data analysis technique used in this research is descriptive analytical. The research location is at Harmoni Residence Housing, Mojokerto Regency and the Regional Revenue Agency of Mojokerto Regency. The results of research on taxpayers' legal awareness regarding reporting changes to Land and Building Tax objects through the Tax Object Notification Letter show a low value. Efforts to increase taxpayers' legal awareness in this research are by conducting legal counseling and routine passive and active supervision from the Mojokerto Regency Regional Revenue Agency.

Abstract

Case of looting of goods in the trading ship Fort Royal 1 in the Mediterranean Sea located on the continental shelf is a violation of international legal protection of Underwater Cultural Heritage. The looting violates provisions of the 2001 UNESCO Convention. Looting can result in the loss of human cultural heritage in the past. The purpose of this study is to identify the protection of underwater cultural heritage according to international law as well as the responsibility of the state due to the looting of Underwater Cultural Heritage. The research method used is normative legal research using legislation approach, case approach, and conceptual approach. The existence of cases of looting of goods in the trading ship Fort Royal 1 in the Mediterranean Sea proves that the lack of strict safeguards and strict rules regarding the protection of Underwater Cultural Heritage. France as a state party is still in the process of investigating the search for looters and looted goods. France as a state party must certainly take responsibility for the looting that occurred, namely by way of restitution and satisfaction.

Abstract

Abstrak Pertimbangan hakim merupakan penentu dari nilai nilai yang terdapat pada suatu putusan hakim dengan menilai baik atau buruknya, tepat atau tidak tepat dan benar atau salahnya suatu peristiwa dengan melihat rasa keadilan dan juga kepastian hukum. Lalu, bagaimana bila terdapat pertimbangan hakim yang kurang memberikan kepastian hukum dan argument argument yang sesuai hukum seperti pada putusan Nomor 469/Pid.Sus/2020/PT.Pbr. Pada pertimbangan putusan tersebut yang menjadi pokok permasalahan yang akan di analisis oleh penulis adalah perdamaian dimuka persidangan dan surat permohonan sebanyak 129 orang desa setumuk yang menjadi keringanan pidana. Akan hal tersebut putusan 469/Pid.Sus/2020/PT.Pbr menimbulkan ketidakpastian hukum dan ketidakadilan. Tujuan dari penelitian ini adalah untuk mengetahui terkait dengan apakah pertimbangan yang dibuat oleh hakim sudah sesuai dengan hukum atau belum. Pada penelitian ini menggunakan metode yuridis normatife dengan pendekatan perundang undangan dan juga kasus. Hasil dari penelitian ini adalah adanya perdamaian di muka persidangan dan surat permohonan tidak memenuhi ancaman hukumannya, seharusnya ancaman hukumannya seimbang dengan pidana yang telah diperbuat agar dapat memberikan efek jera terhadap pelaku pencabulan. Kata Kunci: Pencabulan, Perdamaian, Surat Permohonan.

Abstract

The writing of this study aims to analyze the Consumption of Unprotected Wildlife for Indonesian Public Health, this research is a normative legal research, which is carried out by means of a Statutory Approach, a Legislative Approach, and a Conceptual Approach. This approach departs from the views and doctrines that developed in legal science related to Juridical Analysis of the Consumption of Wildlife That Are Not Protected for Indonesian Public Health. There are incomplete norms that make these laws and regulations do not have a strong foundation to solve problems related to the consumption of unprotected wildlife. In the case of zoonotic diseases, there is no specific regulation regarding the consumption of wildlife, there are incomplete norms related to the case where if the consumption of wildlife continues, it is likely that the Indonesian state will experience another outbreak event in the future. In order to create regulations to deal with the spread of the plague through wildlife, it is necessary to have regulations that regulate matters related to food or consumption of wildlife that are susceptible to spreading the virus to humans so that it will become a dangerous outbreak. Abstract

In Article 108 paragraph (1) of Law no. 13 of 2003 concerning Manpower states that entrepreneurs who employ at least 10 (ten) workers/laborers are obliged to make company regulations which come into effect after being ratified by the Minister or appointed official. Referring to this article, business actors in Gresik Regency who have at least 10 (ten) workers/laborers are required to make and record company regulations with the Gresik Regency Manpower Office. In several companies, especially in Gresik Regency, there are still many companies that have not registered or ratified company regulations owned by the Gresik Regency Manpower Office. This is because business actors do not hesitate and comply with the applicable provisions in the Employment Law. This research uses empirical legal research methods with a qualitative approach to obtain primary data obtained and collected directly in the field by direct interviews with informants, namely industrial relations mediators and business actors. The research results show that: First, legal compliance among business actors is still at its lowest point, namely at the level of compliance where someone will comply with a rule because they are afraid of being sanctioned. Second, the efforts made by the Gresik Regency Manpower Office in complying with the law for business actors are preventive, where the Gresik Manpower Service carries out outreach to several companies with direct visits to companies in the Gresik area.

Abstract

This study examines the OSS-RBA licensing process, which adapts the positive fictitious principle from the Government Administration Law (UUAP) for KTUN implementation. PP 5/2021 underlies the OSS system, adopting this principle. The study addresses issues with OSS licensing applications due to inconsistencies with positive fictitious regulations. Using a normative juridical method with statute, historical, case, and conceptual approaches, it relies on legislation and secondary materials such as books and journals. Indonesia's policies now use technology, including OSS-RBA in PP 5/2021, replacing PP 24/2018. Despite the positive fictitious concept in PP 24/2018 and UUAP, PP 5/2021's implementation is inconsistent, causing licensing delays and legal uncertainty, hindering investment. Improving OSS-RBA is crucial to effectively apply the AUPB principle, creating a transparent, efficient bureaucracy and increasing legal certainty for businesses. This supports sustainable economic growth and enhances Indonesia's global competitiveness. Inconsistencies between licensing practices and regulations like PP 5/2021, and the absence of a Presidential Regulation on legally granted KTUN forms, cause legal uncertainty. Legal remedies include legal construction, ombudsman, residual theory, and establishing a special institution for positive fictitious cases.

Abstract

This research aims to investigate the practice regarding the process of application. August 15, 2023, became a historic day for Indonesia with the approval of the Constitutional Court's Decision, allowing campaigning in educational institutions. The proposal to amend Constitutional Court Decision Number 65/PUU-XXI/2023 was first submitted by Ong Yenny and Handrey Mantiri, members of the Jakarta Regional People's Representative Council. This research falls under the category of normative juridical research, also known as conceptual and legal approaches. Normative juridical research is conducted by examining secondary sources such as literature and regulations related to the researched issue. According to the petitioner, the Constitutional Court Decision Number 65/PUU-XXI/2023 contradicts Law Number 7 of 2017, specifically Article 280 paragraph (1) letter h and its explanation. There are two different provisions in the law, which have resulted in legal norms becoming uncertain. The main issue with Article 280 paragraph (1) letter h of Law Number 7 of 2017 is not based on norm conflict, but rather on differences in law enforcement, leading to injustice in the conduct of elections. The primary purpose of elections is to provide an opportunity for Indonesian citizens to express their aspirations and choose their preferred leaders to represent them in government. Elections are a means of upholding popular sovereignty based on democratic values. The Constitutional Court's decision not only limits the role of campuses in educating future generations but also enhances Indonesia's democracy by helping to create voters who make decisions based on logical reasoning and facts.
