Abstract

Marital Rape is a form of sexual violence against a wife or husband that occurs in a marital relationship. In general, sexual violence has been regulated in the construction of Indonesian criminal law, specifically (lex specialist) as outlined in Law Number 8 of 2004 concerning the Elimination of Domestic Violence (UU-PKDRT). However, it is necessary to develop subject qualifications in these regulations to emphasize the elements of marital rape so that the evidence obtained is more objective. This research aims to analyze the validity and proof of marital rape as a criminal offense of domestic violence. As normative research, this research uses a legal approach (statute approach) and a conceptual approach (on conceptual approach), using primary and secondary types of legal materials, and techniques for collecting legal materials using literature study using qualtatꬵ with analysis descriptive, based on the method A conclusion was found that, marital rape (rape within marriage) can be used as a type of criminal act of domestic violence if the evidence presented has been acknowledged, but the lack of evidence makes the proof process less objective.

Abstract

This research analyzes Supreme Court Decision No. 316 K/TUN/2021, where the judges only considered the aspects of authority and land registration procedures up to the issuance of property rights certificates. The focus of this study is the ambiguity in the judges' considerations, as seen in Article 10, which is the basis for the plaintiff's lawsuit regarding the carelessness of the Land Office in issuing property rights certificates, thus causing legal uncertainty. This research uses a normative legal approach with methods including legal, conceptual, and case studies. The analysis results show a violation of the General Principles of Good Governance (AUPB), particularly the principles of legal certainty and accuracy. The violation of legal certainty is related to the uncertainty of property rights over state land based on Article 55 (1) of Law No. 30 of 2014 on Public Administration. Meanwhile, the violation of accuracy occurs because the Lombok Barat Regency Land Office did not conduct document verification meticulously according to Articles 50 (1) and (2) of the same law. This research emphasizes the importance of the government ensuring that every stage of land registration is conducted accurately, especially in collecting physical data, legal data, and researching land ownership history according to applicable regulations. Abstract

The provision of restitution for victims of human trafficking crimes in Indonesia remains ineffective due to the absence of specific regulations regarding the confiscation of perpetrators’ assets to fulfill restitution obligations. Restitution, as a form of compensation, aims to restore the rights and dignity of victims. Although regulated under Law No. 31 of 2014 and Supreme Court Regulation (PerMa) No. 1 of 2022, its implementation in practice falls short. Victims often do not receive full restitution, and in some cases, no compensation is awarded at all. This issue is evident in three court decisions analyzed in this study: Decision No. 592/Pid.Sus/2021/PN Ckr, No. 168/Pid.Sus/2020/PN.Pml, and No. 48/Pid.Sus/2021/PN.Cbn, where restitution was either unpaid or avoided by perpetrators claiming inability to pay, resulting in subsidiary imprisonment of up to one year. The research uses normative legal methods to highlight a legal vacuum regarding asset seizure for restitution purposes. The findings indicate that the current legal framework lacks enforceable mechanisms to guarantee victims’ rights to restitution. Therefore, this study recommends revising existing laws to include provisions on mandatory asset confiscation from trafficking perpetrators. Additionally, stronger judicial interpretation under Article 1 paragraph (1) of Law No. 48 of 2009 concerning Judicial Power can support the realization of victims’ restitution rights. Strengthening these aspects is crucial to ensuring justice and adequate compensation for victims of human trafficking.

Abstract

Law Number 17 of 2016 concerning Child Protection introduces chemical castration as an additional punishment for perpetrators of child sexual violence, regulated under Article 81 paragraph (7). The implementation of this punishment is mandated to doctors under Article 9 letter b of Government Regulation Number 70 of 2020, based on orders from prosecutors. However, this obligation conflicts with the medical ethical code and the doctor's oath, prompting the Indonesian Medical Ethics Honorary Council (MKEK PB IDI) to issue Fatwa No. 1 of 2016, expressing professional opposition to doctors performing chemical castration. Despite this, doctors—especially those with civil servant status—are legally required to obey state orders, with refusal risking sanctions as outlined in Article 216 paragraph (1) of the Criminal Code. This research aims to examine the legal position of doctors in carrying out chemical castration and possible legal avenues to resist this duty. Using a normative legal research method with statutory and conceptual approaches, and literature-based data collection, the study concludes that doctors are legally bound to implement chemical castration if mandated by law, particularly as civil servants subject to disciplinary rules. However, doctors who object may pursue a judicial review to the Supreme Court, arguing that the duty infringes upon their professional ethics and mental integrity. Such legal recourse seeks to balance state obligations with individual professional conscience.

Abstract

The rapid advancement of technology and communication has driven many companies in Indonesia to adopt remote working systems. However, the existing labor regulations, particularly Law Number 13 of 2003 concerning Manpower and Law Number 11 of 2020 concerning Job Creation, do not explicitly regulate remote working arrangements. This study aims to examine the regulatory framework and legal protection for remote workers in Indonesia, especially in relation to working hours and access to welfare facilities. The research adopts a normative legal method supported by statute and conceptual approaches. The findings reveal that although Government Regulation No. 35 of 2021 and Government Regulation No. 36 of 2021 provide general provisions on employment relations and wages, they fall short of comprehensively addressing the specific needs of remote workers. As a result, the legal status, rights, and obligations of remote workers remain ambiguous, particularly in the aspects of working time flexibility, occupational health and safety, and entitlement to welfare benefits. The absence of detailed regulation risks legal uncertainty for both employers and employees engaged in remote work. This study recommends the formulation of specific and adaptive legal norms that respond to the dynamic nature of remote working, including clear definitions, work-hour arrangements, and protections for workers' well-being. Strengthening the legal framework is essential to ensure fair and sustainable labor practices in the digital work environment.

Abstract

The judge's decision is the final decision taken by the judge in the trial to determine whether the defendant will be sentenced or not. This decision is an official statement from the judge in resolving a case in court and has permanent legal force. This decision serves as a legal basis that determines the rights, obligations, or sanctions that must be carried out by the parties involved in the case. Independent judicial power is used to uphold law and justice. In Decision Number 26/Pid.Sus.Anak/2021/PNSak, the child was ordered by his biological brother to store methamphetamine. This research is conducted to examine and analyze whether the judge has considered the sociological factors of the defendant and analyze how the influence of the judge's consideration of the defendant's sociological factors on the imposition of punishment in Decision Number 26/Pid.Sus.Anak/2021/PNSak. This research is useful for reviewing and analyzing legal norms, as well as the judge's decision using normative legal research. The approaches used include statute approach, case approach and concept approach. This analysis also uses prescriptive. The results of this study are the Decision of the Judge of the Siak Indrapura District Court in case Number 26/Pid.Sus.Anak/2021/PNSak, which has fulfilled the juridical elements but the judge did not pay enough attention to the sociological aspects of the defendant because it did not cover the defendant's condition at that time. The child followed his brother's orders to store methamphetamine due to threats from him.

Abstract

This study aims to examine the legal awareness of traditional medicine micro-business sellers in Bojonegoro Regency regarding halal certification and to identify the factors influencing this awareness. The research was motivated by the fact that many traditional medicine micro-business actors in the region have not registered their products with the Halal Product Assurance Agency (BPJPH), despite the growing importance of halal certification in consumer protection and market access. The research adopts an empirical legal method with two central problems: (1) the level of legal awareness among traditional herbal medicine sellers concerning halal certificates, and (2) the internal and external factors influencing this awareness. The study reveals that legal awareness in this sector remains relatively low, as reflected in four key indicators: legal knowledge, legal understanding, legal attitudes, and patterns of legal behavior. Contributing factors include internal aspects such as limited educational background and lack of access to legal information, as well as external influences such as weak regulatory enforcement and insufficient socialization by relevant authorities. Based on these findings, the study recommends intensified outreach and education programs targeting traditional medicine sellers, as well as policy interventions to simplify the halal certification process for micro businesses. Strengthening collaboration between BPJPH, local government, and community leaders is also essential to enhance legal compliance and promote the legitimacy and competitiveness of traditional medicine in the halal market.

Abstract

An agreement is a legally valid act conducted by two or more parties with the intention of establishing a binding relationship that functions as law. Generally, agreements made legally refer to the provisions and requirements set forth in the Indonesian Civil Code. One of the conditions for a valid binding agreement is that the consent must result from free will and without coercion.The objective of this research is to analyze the basis for the judicial considerations in the Surabaya High Court Decision No. 668/Pdt.G/2018/PT.Sby and the Supreme Court Decision No. 981 K/Pdt/2020 concerning breach of contract (wanprestasi) and its implications for the validity of a land sale and purchase agreement that is in dispute. As normative legal research, this study employs a statute approach and a conceptual approach, utilizing primary and secondary legal materials. The research adopts a library research method and employs a qualitative descriptive analysis technique. Based on these methods, the research concludes that a sale and purchase agreement involving a disputed object violates material requirements because it does not align with the principle of good faith. Abstract

Dasar pertimbangan Majelis Hakim dalam menjatuhkan Putusan Nomor 1117 K/Pdt/2024 memiliki perbedaan dengan pertimbangan Majelis Hakim Judex Facti dalam hal jual beli diantara Pihak yang bersengketa. Selain itu, Majelis Hakim ditingkat kasasi tidak mempertimbangkan ataupun mengulas mengenai perbuatan melawan hukum seperti yang terdapat didalam dalil gugatan Penggugat. Berangkat dari hal tersebut membuat Penulis tertarik untuk melakukan analisis mengenai dasar pertimbangan Hakim serta akibat hukumnya setelah dijatuhkan Putusan Mahkamah Agung Nomor 1117 K/Pdt/2024. jenis penelitian yang dipakai yakni penelitian hukum secara normative dengan menggunakan pendekatan perundang-undangan (statute approach), pendekatan kasus (case approach), dan pendekatan konseptual (conceptual approach). Bahan hukum didalam penelitian menggunakan bahan hukum primer dan sekunder. Adapun Teknik pengumpulan bahan hukum yang dilakukan dalam meneliti yaitu studi kepustakaan serta menggunakan metode Preskriptif sebagai Teknik Analisa bahan hukumnya. Hasil Analisis terhadap Putusan Nomor 1117 K/Pdt/2024 menunjukan bahwa jual beli antara Penggugat dan Tergugat merupakan jual beli yang sah karena telah memenuhi syarat sah perjanjian dan syarat materi (baik yang mengenai Penjual, Pembeli maupun tanahnya). Selanjutnya, tergugat telah melakukan perbuatan melawan hukum karena melakukan sesuatu yang bertentangan dengan kewajiban yang telah diberikan oleh hukum terhadap dirinya. Akibat hukum langsung bagi Para Pihak adalah diterimanya memori kasasi dan ditolaknya kontra memori kasasi, sedangkan akibat hukum tidak langsung bagi Isnayati (Tergugat) adalah dapat sepenuhnya menguasai objek sengketa dan bagi Ilham Arrasyid (Penggugat) tidak dapat menikmati dan mengelola objek jual beli. Kata Kunci : Jual Beli, Perbuatan Melawan Hukum.

Abstract

Penyalahgunaan narkotika bagi diri sendiri terjadi pada anak dalam Putusan Pengadilan Negeri Pariaman dengan Perkara Nomor 13/Pid.Sus.Anak/2021/PN.Pmn. Anak diputus bersalah melanggar Pasal 127 Ayat 1 huruf a UU Narkotika dan Hakim menjatuhkan pidana penjara didalam LPKA selama 6 (enam) bulan. Penelitian ini menggunakan metode penelitian hukum normatif serta pendekatan perundang-undangan (Statute Approach), pendekatan konseptual (Conceptual Approach) dan pendekatan kasus (case approach) untuk mengkaji dan menganalisis apakah pertimbangan hakim dalam Putusan Perkara Nomor 13/Pid.Sus.Anak/2021/PN Pmn mengenai pidana penjara terhadap Anak Penyalah Guna Narkotika sesuai dengan prinsip-prinsip perlindungan anak dan pemulihan ditinjau dari Pasal 67 UU Perlindungan Anak dan pengaturan pembiayaan rehabilitasi Anak Penyalah Guna Narkotika dapat dilakukan secara mandiri tanpa membebani keuangan negara. Hasil penelitian adalah Putusan Hakim Pengadilan Negeri Pariaman dengan Nomor 13/Pid.Sus.Anak/2021/PN Pmn mengenai pidana penjara terhadap Anak sudah tepat karena pidana penjara diberikan untuk memperbaiki perilaku anak. Namun, secara keseluruhan putusan hakim tersebut belum memenuhi prinsip-prinsip perlindungan anak dan pemulihan dalam Pasal 67 UU Perlindungan Anak. Seandainya Anak dalam Putusan Nomor 13/Pid.Sus.Anak/2021/PN Pmn mampu secara ekonomi, maka Hakim seharusnya menawarkan pembiayaan rehabilitasi dengan dana pribadi.
