Abstract

Termination of employment (PHK) must be carried out according to legal procedures, beginning with an official termination letter. However, issues may arise when such termination contradicts labor regulations. This research discusses the case of Bunari, a worker who received a termination letter during the trial process, which is suspected to conflict with Article 155 paragraph (2) of the Manpower Law. The main legal issue examined is the ambiguity of norms regarding the validity of termination during ongoing industrial relations disputes. The objective of this study is to analyze the legal validity of the termination letter issued to Bunari during the trial process, as reflected in Decision Number 1237 K/Pdt.Sus-PHI/2017, and to examine the rules surrounding process wages for workers under trial. This study applies a normative juridical method, analyzing legal events using statutory and regulatory frameworks. The findings reveal that the termination of Bunari is not legally valid due to the ongoing industrial dispute process at the time of termination, rendering the letter formally and legally flawed. Furthermore, Bunari is entitled to process wages as he fulfills the required legal elements. Based on Supreme Court Circular Letter (SEMA) No. 3 of 2015, the payment period for process wages is limited to six months. The study recommends reinforcing clarity in regulations regarding termination procedures during legal proceedings and urges employers to strictly adhere to legal mechanisms to prevent arbitrary dismissals and ensure workers' rights are protected.

Abstract

Kokos Jiang, dkk telah menyepakati Investment Agreement, Sale and Purchase Agreement, Royalty Agreement, dan Agreement for Advances dengan Reliance Group. Seiring dengan berlangsungnya perjanjian Kokos Jiang, dkk menyadari bahwa perjanjian yang telah disepakati merupakan perjanjian proforma yang oleh Reliance Group sebagai penguasaan perusahaan-perusahaan pertambangan batu bara yang dimilikinya. Selain itu, perjanjian yang disepakati hanya menggunakan Bahasa Inggris, hal tersebut melanggar ketentuan Pasal 31 ayat (1) UU No. 24/2009. Kemudian, Kokos Jiang, dkk mengajukan gugatan di Pengadilan Negeri Jakarta Pusat dengan gugatan perbuatan melawan hukum. Pengadilan Negeri Jakarta Pusat mengabulkan gugatan, Reliance Group, dkk mengajukan banding, dan Pengadilan Tinggi DKI Jakarta memutus menguatkan Putusan Pengadilan Negeri Jakarta Pusat. Selanjutnya, Reliance Coal, dkk mengajukan kasasi, Mahkamah Agung memenangkan kasasi Reliance Group. Penelitian bertujuan menganalisa dan mengetahui dasar pertimbangan hakim dalam Putusan Nomor 3415 K/Pdt/2021, serta menganalisa dan mengetahui akibat hukum dari putusan tersebut. Penelitian menggunakan metode penelitian normatif, dengan teknik analisis preskriptif. Penelitian menganalisis dasar pertimbangan yang digunakan oleh Mahkamah Agung bahwa perjanjian arbtrase memberikan kewenangan absolut badan arbitrase dalam menyelesaikan sengketa dan bahasa (Pasal 31 UU No. 24/2009) bukan merupakan faktor utama yang dapat membatalkan perjanjian. Putusan Mahkamah Agung Nomor 3415 K/Pdt/2021 mengakibatkan berubah keadaan hukum kembali pada saat perjanjian-perjanjian yang telah disepakati dan melaksanakan putusan arbitrase SIAC. Abstract

Dalam menguasai dan menggunakan tanah yang menjadi hak atas tanahnya, baik seorang individu maupun sebuah badan hukum tunduk terhadap segala aturan yang telah ditetapkan oleh negara. Adapun jenis-jenis hak atas tanah diatur dalam Pasal 16 UUPA, dan Hak Milik menjadi salah satu jenisnya. Mengklaim dan menguasai tanah tanpa adanya alas hak yang sah merupakan suatu perbuatan melawan hukum. Bagi seseorang yang merasa dirugikan atas perbuatan melawan hukum berupa penguasaan tanah tanpa alas hak dapat mengajukan gugatan. Penelitian ini akan menganalisis bagaimana pertimbangan hakim dan akibat hukum dari Putusan Mahkamah Agung Nomor 4221K/PDT/2022 terkait perbuatan melawan hukum penguasaan tanah tanpa alas hak yang sah. Pada perkara tersebut bermula ketika Daniel Lumele mengklaim dan menguasai tanah milik John Putra. Majelis hakim kurang menjelaskan terkait hak yang dimiliki John Putra dalam mengajukan gugatan sengketa kepemilikan. Selain itu, majelis hakim tidak mempertimbangkan unsur-unsur perbuatan melawan hukum menurut Pasal 1365 KUHPerdata yang telah dilakukan Daniel Lumele. Penelitian ini bertujuan untuk mengetahui bagaimana pertimbangan hakim dan akibat hukum dari Putusan Mahkamah Agung Nomor 4221K/PDT/2022. Penelitian ini menggunakan metode penelitian normatif dengan teknik analisis bahan hukum menggunakan preskriptif. Hasil penelitian dan pembahasan menjelaskan bahwa majelis hakim kurang menjelaskan terkait hak yang dimiliki John Putra dalam mengajukan gugatan sengketa kepemilikan dan juga tidak dipertimbangkannya unsur-unsur perbuatan melawan hukum menurut Pasal 1365 KUHPerdata yang telah dipenuhi oleh Daniel Lumele. Kata Kunci: Perbuatan Melawan Hukum, Penguasaan Tanah, Sengketa Kepemilikan.

Abstract

Diplomatic protection by the Indonesian government is crucial in safeguarding Indonesian citizens facing legal problems under foreign jurisdictions. The cases of Siti Zainab and Tuti Tursilawati highlight the challenges faced by Indonesia in providing effective diplomatic assistance, where both citizens were sentenced to death with permanent legal force abroad. This research aims to analyze the resolution of criminal cases involving Indonesian citizens who have received final and binding criminal sentences abroad from the perspective of international law and international relations. The study employs a normative juridical method with a prescriptive approach, focusing on the analysis of legal norms to offer constructive solutions. The findings show that Indonesia’s diplomatic efforts in such cases are often hindered by limited access to legal processes in the host country and the principle of state sovereignty. Nonetheless, the Indonesian government undertakes several strategies to provide protection: (1) legal protection through consular assistance, (2) forming bilateral agreements on placement and protection of migrant workers, and (3) implementing a Single Channel Placement System (SPSK) through digital diplomacy. The study recommends strengthening diplomatic relations and proactive legal frameworks to enhance the state's ability to intervene effectively. By fostering mutual agreements and international cooperation, future cases similar to those of Tuti Tursilawati and Siti Zainab can be better addressed, ensuring the rights and safety of Indonesian citizens abroad are more effectively protected.

Abstract

Marital Rape is a form of sexual violence against a wife or husband that occurs in a marital relationship. In general, sexual violence has been regulated in the construction of Indonesian criminal law, specifically (lex specialist) as outlined in Law Number 8 of 2004 concerning the Elimination of Domestic Violence (UU-PKDRT). However, it is necessary to develop subject qualifications in these regulations to emphasize the elements of marital rape so that the evidence obtained is more objective. This research aims to analyze the validity and proof of marital rape as a criminal offense of domestic violence. As normative research, this research uses a legal approach (statute approach) and a conceptual approach (on conceptual approach), using primary and secondary types of legal materials, and techniques for collecting legal materials using literature study using qualtatꬵ with analysis descriptive, based on the method A conclusion was found that, marital rape (rape within marriage) can be used as a type of criminal act of domestic violence if the evidence presented has been acknowledged, but the lack of evidence makes the proof process less objective.

Abstract

This research analyzes Supreme Court Decision No. 316 K/TUN/2021, where the judges only considered the aspects of authority and land registration procedures up to the issuance of property rights certificates. The focus of this study is the ambiguity in the judges' considerations, as seen in Article 10, which is the basis for the plaintiff's lawsuit regarding the carelessness of the Land Office in issuing property rights certificates, thus causing legal uncertainty. This research uses a normative legal approach with methods including legal, conceptual, and case studies. The analysis results show a violation of the General Principles of Good Governance (AUPB), particularly the principles of legal certainty and accuracy. The violation of legal certainty is related to the uncertainty of property rights over state land based on Article 55 (1) of Law No. 30 of 2014 on Public Administration. Meanwhile, the violation of accuracy occurs because the Lombok Barat Regency Land Office did not conduct document verification meticulously according to Articles 50 (1) and (2) of the same law. This research emphasizes the importance of the government ensuring that every stage of land registration is conducted accurately, especially in collecting physical data, legal data, and researching land ownership history according to applicable regulations. Abstract

The provision of restitution for victims of human trafficking crimes in Indonesia remains ineffective due to the absence of specific regulations regarding the confiscation of perpetrators’ assets to fulfill restitution obligations. Restitution, as a form of compensation, aims to restore the rights and dignity of victims. Although regulated under Law No. 31 of 2014 and Supreme Court Regulation (PerMa) No. 1 of 2022, its implementation in practice falls short. Victims often do not receive full restitution, and in some cases, no compensation is awarded at all. This issue is evident in three court decisions analyzed in this study: Decision No. 592/Pid.Sus/2021/PN Ckr, No. 168/Pid.Sus/2020/PN.Pml, and No. 48/Pid.Sus/2021/PN.Cbn, where restitution was either unpaid or avoided by perpetrators claiming inability to pay, resulting in subsidiary imprisonment of up to one year. The research uses normative legal methods to highlight a legal vacuum regarding asset seizure for restitution purposes. The findings indicate that the current legal framework lacks enforceable mechanisms to guarantee victims’ rights to restitution. Therefore, this study recommends revising existing laws to include provisions on mandatory asset confiscation from trafficking perpetrators. Additionally, stronger judicial interpretation under Article 1 paragraph (1) of Law No. 48 of 2009 concerning Judicial Power can support the realization of victims’ restitution rights. Strengthening these aspects is crucial to ensuring justice and adequate compensation for victims of human trafficking.

Abstract

Law No. 17 of 2016 concerning Child Protection contains chemical castration for perpetrators of child sexual violence in Article 81 paragraph (7) of the Law. The implementation of chemical castration on the orders of the prosecutor is carried out by a doctor in accordance with Article 9 letter b of Government Regulation No. 70 of 2020. This task is contrary to the doctor’s oath, the issuance of the MKEK PB IDI fatwa in 2016 contains the position of the medical profession agreeing or disagreeing in responding to chemical castration, while the task of castration has become a doctor's obligation as a State duty on the orders of the law with the legal umbrella of Article 50 of the Criminal Code and has the risk of sanctions if they refuse in accordance with Article 216 paragraph (1) of the Criminal Code. Thus, further discussion is needed regarding the obligations of doctors as implementers of chemical castration and legal efforts by doctors to avoid their duties as implementers of chemical castration. The research method is normative by taking a legislative and conceptual approach. The collection technique used is a literature study with a prescriptive analysis technique. The results and discussion show that doctors are obliged to carry out the order of the law regarding chemical castration, especially if they have the status of a civil servant who is bound by the Civil Servant Discipline to carry out state duties. If there are doctors who refuse by referring to the MKEK PB IDI fatwa No. 1 of 2016, they can file a judicial review to the Supreme Court regarding the task given causing a heavy mental burden in the form of violating the doctor's oath with the chemical castration action in Article 9 letter b of Government Regulation No. 70 of 2020.

Abstract

The development of technology and communication, more and more companies in Indonesia are starting to adopt remote working. There is no clear regulation of remote working in the Manpower Law Number 13 of 2003 or the Job Creation Law Number 11 of 2020. This research will discuss the regulation and legal protection for remote workers or remote working related to working hours, as well as welfare facilities based on labor law in Indonesia. Researchers use normative legal research as well as a statue approach and conceptual approach. The application of remote working systems can currently be based on the rules of labor law in Indonesia regarding working time, which has been determined in Government Regulation No. 35 of 2021 and Government Regulation No. 36 of 2021. However, The Employment Law has yet to further regulate the implementation and existence of remote working, which has not been fully defined under Indonesian Employment Law.

Abstract

The judge's decision is the final decision taken by the judge in the trial to determine whether the defendant will be sentenced or not. This decision is an official statement from the judge in resolving a case in court and has permanent legal force. This decision serves as a legal basis that determines the rights, obligations, or sanctions that must be carried out by the parties involved in the case. Independent judicial power is used to uphold law and justice. In Decision Number 26/Pid.Sus.Anak/2021/PNSak, the child was ordered by his biological brother to store methamphetamine. This research is conducted to examine and analyze whether the judge has considered the sociological factors of the defendant and analyze how the influence of the judge's consideration of the defendant's sociological factors on the imposition of punishment in Decision Number 26/Pid.Sus.Anak/2021/PNSak. This research is useful for reviewing and analyzing legal norms, as well as the judge's decision using normative legal research. The approaches used include statute approach, case approach and concept approach. This analysis also uses prescriptive. The results of this study are the Decision of the Judge of the Siak Indrapura District Court in case Number 26/Pid.Sus.Anak/2021/PNSak, which has fulfilled the juridical elements but the judge did not pay enough attention to the sociological aspects of the defendant because it did not cover the defendant's condition at that time. The child followed his brother's orders to store methamphetamine due to threats from him.
