Abstract

In the implementation of the Online Loan application service, it continues to receive many complaints from Pinjol customers about the problem of personal data shared by individual online loan providers. This is directly proportional to the number of pinjol consumer complaints to the Financial Services Authority, most of which contain the dissemination of personal data accompanied by threats. Therefore, it is very important for consumers to understand this regulation governing how personal data is protected when performing Online Loan services. The regulations that protect personal data in Online Loans will be discussed in this research. Applying normative legal methods, such as the implementation of laws and regulations relating to the legal protection of the parties through observation of the identification of personal data cases of online loan consumers. In its development, many online loan consumers are in arrears / have not paid off their receivables with online loans. So that opportunities arise for leaking personal data accompanied by threats in collection. Actually, this is not justified because it contradicts the regulations for organizing online loans stipulated in the Financial Services Authority Regulation Number 10/POJK.05/2022 Article 47 which states that to collect and use personal data, the organizer must obtain the consent of the data owner. So as to further strengthen the legal power for online loan consumers in protecting their personal data, there is a Republican Law Number 27 of 2022 concerning Personal Data Protection consisting of 78 articles spread over 18 chapters that regulate the transfer of personal data. These documents address a variety of issues, such as institutions, international collaboration, community involvement, administrative sanctions, dispute resolution, and civil legal proceedings. It also includes provisions regarding uses of personal data prohibited by law, penal provisions, transitional measures, and concluding clauses.

Abstract

This article was written to determine the implementation of welfare guarantees at Intellectual Disability Social Service Institution of "Raharjo" Sragen. This research was written using the juridical-empirical method with an observation, interview and document research approach as a means of supporting the data that has been collected. The research results show that the Intellectual Disability Social Service Institution of "Raharjo" Sragen has implemented welfare guarantees for people with disabilities in accordance with applicable laws and regulations. Not only that, the Intellectual Disability Social Service Institution of "Raharjo" Sragen plays an important role in creating independent, skilled and integrated people with disabilities in society. Welfare guarantees for people with disabilities are very important to ensure their rights are fulfilled and they get a decent life. However, in implementing the welfare guarantee policy, there are still obstacles faced, namely social stigmatization, limited facilities, and a lack of human resources, especially social workers.

Abstract

Intellectual Property Rights (IPR) are exclusive rights granted to individuals or groups for their creative works that benefit society. They protect interests, financial rights, and prevent infringement. This research aims to find out how the regulations in Indonesia and its benefits in the registration of Intellectual Property Rights, especially Patent Rights. This research uses normative juridical research to analyze legal issues using various legal materials. It focuses on positivistic views, principles, doctrine, discovery, systematics, harmonization, comparative studies, and history. The approach includes statutory and conceptual analysis, grammatical and systematic interpretation. Copyright protection in science, art and literature often coincides with creation, where the creator does not register the work. Indonesian copyright law uses principles such as lex posterior derogat legi priori. Islamic jurisprudence emphasizes intellectual property rights and the prohibition of unlawful consumption, the researcher draws from a concept namely Maqashid As-Sharia. The Maqashid as-Sharia approach, which focuses on the benefit of protecting the mind and property, can be used to study intellectual property rights in Islamic law. In this case, it is expected that the creators can register their creations for the sake of the formation of benefits.

Abstract

In accordance with Law No. 35 Article 76 I of 2014 on child protection, this study investigates the impact of child exploitation on the mental and emotional health of children in Surakarta. This study shows that child exploitation adversely affects children's mental and emotional health. That many of them experience anxiety, depression, sleep disorders, and also experience high psychological burden, which causes emotional disorders such as anger, frustration, and deep sadness. In addition, this study found that Law No. 35 Article 76 I of 2014 provides significant protection for child victims of exploitation in Surakarta. The law also regulates the sanctions given to the perpetrators of child exploitation. This study aims to review and analyze how much child exploitation in Surakarta and what are the factors that cause child exploitation that affect the mental and emotional health of children. Data analysis is conducted using empirical methods to explore cases of experience and concrete facts by means of observation and interviews. The results of this study suggest that communities and government agencies should be more aware of combating child exploitation. To prevent children from exploitation that harms their mental and emotional health, strict education and socialization should be conducted.

Abstract

The primary objective of this study is to scrutinize and evaluate the process of transferring ownership rights to land lacking certification and its associated legal implications, while also assessing the proactive measures taken by National Land Agency Grobogan Regency in addressing instances of uncertified land transactions. Employing an empirical juridical research approach, which entails analyzing real world social issues to acquire pertinent knowledge for resolution, this study seeks to gain insights into the subject matter. Findings from the research indicate that the transfer of ownership rights to uncertified land in Grobogan Regency can occur through both formal and informal channels. These factors are influenced, among other things, by incomplete land documentation, the high cost of sale and purchase deeds, the still strong legal culture of local communities, and the low level of legal knowledge of local communities to carry out effective sales and purchases in accordance with government regulations. The legal consequence of owning uncertified land in the Globogan Regency area is that it is detrimental to the party holding the rights to the land because there is no guarantee of legal certainty. National Land Agency Grobogan Regency's approach to addressing instances of land transactions lacking certificates involves implementing a free land registration program, also known as Complete Systematic Land Registration (PTSL) by the National Land Agency. This initiative aims to streamline the registration process, particularly for rural communities, thereby ensuring legal certainty and protecting community land rights. Embracing principles such as simplicity, affordability, efficiency, safety, fairness, equity, transparency, and accountability, the program aims to facilitate accessible and fair land registration procedures.

Abstract

The implementation of business licensing has been regulated in government regulation Number 5 of 2021 concerning the Implementation of Risk-Based Business Licensing, however the use of the online single submission risk-based approach system in reality causes many problems including collusion and abuse of the authority of the verifier team's access rights which will cause investment realization becomes undirected and there are elements of criminal acts. This matter uses the Empirical Juridical method. In implementing the online business licensing system, the single submission risk-based approach is contrary to Law No. 28 of 1999 concerning State Administration that is Clean and Free from Corruption, Collusion and Nepotism. In conclusion, regarding Artificial Intelligence in public services, it should prioritize good governance that is accountable, not merely in the capacity to take advantage or enter into malicious conspiracy or collusion with those who have the authority to access rights.

Abstract

This research aims to describe the various forms of promotions conducted by businesses and the legal protection available for e-commerce consumers. Promostion is a method employed by companies or businesses to provide direct or e-commerce-based product information to consumers with the aim of making consumers interested the products. E-commerce involves the buying, selling dan marketing of goods or services through electronic media. Based on the discussions conducted, it’s known that forms of promotion include advertisting, personal selling, publicity, public relations and sales promotion. It’s also known that there are still some promotions that don’t have legal protection due to the lack of Indonesian language labelling, provision of false information, pricing discrepancies and fraudulenr elements.

Abstract

This research aims to examine the concept of expanding job opportunities in Sukoharjo Regent Regulation No. 6 of 2017 and the effectiveness of the Sukoharjo Regency Industry and Manpower Service in implementing job expansion. It is hoped that this will be useful in providing insight and knowledge regarding the problem of workforce expansion that is occurring in Sukoharjo Regency and how the efforts of the Sukoharjo Regency Industry and Manpower Service to overcome the problem of workforce expansion. Research Results: The Concept of Expanding Job Opportunities in Sukoharjo Regent Regulation No. 67 of 2017 is an effort by the Regional Government and Community Institutions to create new jobs and develop available jobs. The aim is to create and develop productive and sustainable work opportunities by utilizing the potential of natural resources, human resources, community institutions, as well as appropriate technology. The effectiveness of the Sukoharjo Regency Industry and Manpower Service regarding Job Expansion has carried out its obligations well and effectively by making various regulations and policies. which is proven to have a positive impact on people who need work by opening opportunities for job expansion because regardless of special criteria, anyone can and deserves to get a job according to their wishes and all people have the right to live by doing their own work.

Abstract

Most people in Indonesia pay relatively high nominal prices for well-known brands. Situations like this provide an opportunity for unscrupulous businesses to approve the use of a recognizable brand. It is very detrimental for the original owners of well-known foreign brands to infringe their IPRs and thereby reduce their income from the sale of goods or services. Owners must register their trademarks to protect them legally. The problems in this research will be discussed using doctrinal method analysis. The purpose of this research is to determine the position of the owner of the Hugo Boss and Hugo trademarks in terms of Indonesian law and to determine the legal consequences following the Commercial Court decision no. 92 K/PDT.SUS-HKI/2017. Hugo's position is in accordance with Article 21 Paragraphs 1, 2 and 3 of Law Number 20 of 2016 concerning Marks and Geographical Indications. The legal consequences include granting the cassation petition submitted by the cassation plaintiff, HUGO BOSS TRADE MARK MANAGEMENT GMBH & CO. the KGs, and cancel the decision of the Commercial Court at the Central Jakarta District Court Number 30/Pdt.Sus.Merek/2016/PN Niaga on October 3 2016, in Jakarta PST.

Abstract

The purpose of this writing is to find out how to assist and what obstacles there are when assisting victims of online sexual violence at SPEK HAM Solo.It is hoped that this research can increase awareness of victims of violence to report perpetrators to the authorities and provide a deterrent effect for perpetrators so that they do not misuse the internet as a medium for sexual violence against women.Violence against women is a very serious and concerning problem in society. Violence can be physical, sexual, emotional, economic, and so on.This research uses empirical legal research methods or field research to collect empirical data directly from the field. This research is juridical-empirical and field type, where the author conducts research directly at the location to collect data. This research is a type of empirical research because it describes in detail and in depth a situation or phenomenon of the research object by developing concepts and collecting existing data. Data analysis in this research uses qualitative methods by collecting, grouping and selecting data from field studies and literature studies. Data is processed and compiled to draw conclusions in accordance with regulations, theories, principles and legal rules.Online sexual violence experienced by women in the city of Solo is a complex problem.
