Abstract

This paper attempts to, firstly, examine in some depth various writers' investigations into Islam, women and human rights. Secondly, and more importantly, it attemps provide a clear conceptual framework within which to articulate a foundation for the subject in the future. Such a re-conceptualisation is necessary to anchor future attempts at law reform within an Islamic jurisprudential heritage. By re-locating the debate within the Islamic heritage, any articulation of human rights and Muslim women will have the authority of a fiqh-inspired methodology. For muslim women engaged in the struggle for human rights, such a strategy will be more successful than either employing secular "Western" feminist discourse or by claiming the right to interpret the original Islamic sources whilst ignoring fiqh history, methodology and terminology.DOI: 10.15408/sdi.v10i1.640

Abstract

Following the demise of the New order Regime in 1998, a period to become known as reformasi (reformation), the demand for the implementation of Islamic shari'ah became louder. Helped by the Regional Autonomy Laws of 1999, a number of regions in Indonesia demanded Islamic law to be implemented. Aceh was most adamant in its demand. At present, the implementation of Islamic shari'ah in Aceh has been provided with a legal basis by Law No. 44, 1999 and Law 18, 2001 on special Autonomy and the implementation of lslamic shari'ah in Aceh. The Regional Government of Nangroe Aceh Darussalam (NAD) has also issued a number of practical Regional Bylaras (Qanun) including the prohibition on drinking alcoholic beverages (khamar), regulated in Qanun No. 12/2003, the prohibition on gambling (maisir) in Qanun No. 13/2003, and the disallowance of illicit sex (khalwat) in Qanun No. 14/2003.DOI: 10.15408/sdi.v14i3.548

Abstract

This theme is discerningly discussed by George C. Decasa, in this book derived from his doctoral dissertation, which he currently completed from the Gregorran UIniversity, Rome, Italy. Decasa begins his work with an over flowing elaboration of the word umma. He follows Fazlur Rabman's recommendation to study the meanings of umma in various Qur'anic verses in the order of their revelation to get a full understanding of the term. Decasa impressively uses a phenomenological approach in understanding the interpretation of Qur'anic exegesis of the word umma. Employing a contextual historical reading enables him to figure out the reflections of umma in some different particular historical contexts. In the context of the Qur'an, as shown in its varied commentaries, umma as a religious community, is likely open to various interpretations. In general, however, the term umma in the Qur'an reflects a reference to humankind as one community. The mainstream of belief in Islamic tradition is that God sent prophets to different peoples at different times, where they preached one religion and one religious community. In particular, the term umma may also suggest People of the Book (Ahl al-Kitab), Abraham and certainly Muslim community.DOI: 10.15408/sdi.v6i3.727

Abstract

In the early years of the twentieth century, the Hadrami community showed interest in the place from where their ancestors came to Indonesia. This research aims to analyze these historical events and provide logical interpretations of them. It relies on historical and contemporary documents, especially newspapers issued by the Hadrami community in Indonesia. It also identifies factors, causes and consequences of these events through many tracks. First, it extrapolates  the development of the community from the beginning of the twentieth century, when Hadrami nationalist ideas and feelings of belonging to the Hadrami homeland appeared. Secondly, it identifies the reasons behind that, the factors that helped its spread and the problems that resulted from these events. Thirdly, the research explores the status of the community after the outbreak of this problem and the nature of the relationship between the two groups during the subsequent years until the Japanese occupation of Indonesia in 1942. Finally, it studies the impact on the future of the Hadrami community in Indonesia.DOI: 10.15408/sdi.v22i3.2355

Abstract

Religion is among the most overlooked factors in the development of nation-states in Southeast Asia. Some reasons for this include a bias emphasizing religious ideology in the study of anti-colonial organizations that dates to the origins of the politics of state formation; the influence of many ideas on the patterns of modern elite formations that stress the need for religion to shape national constitutions, and the fact that religion is difficult to neglect in shaping the behavior of masses in the region. Nevertheless, an early observation to the behavior of nations in Southeast Asia holds that religion influences the politics in public space varies from one country to another.DOI: 10.15408/sdi.v19i2.367

Abstract

This paper tries to present an early discussion on tradition and intellectual movement of Kyai Ihsan Jampes, which has not been intellectually discussed. From various legitimate sources, there are 12 religious work written by Kyai Ihsan Jampes, both in printed forms and manuscript. It worth noted, different from general works of ulama in the Malay-Indonesia world, Kyai Ihsan Jampes had never learned Islam from Middle East ulama. He had only visited Mecca and Medina, which are the center of Islamic knowledge, once. And it was purely for pilgrimage purposes. However, this did not prevent him to be a productive writer.DOI: 10.15408/sdi.v11i3.598

Abstract

This article examines the failure of Islamism to make a greater political impact in Indonesia through these years. That failure would have decisive ramifications for the future shape of the Indonesian state, in that it left Islamism politically and intellectually impoverished and politically marginalized in the face of the dominant claims of pseudo-secular nationalists. In part, its failure flowed from organizational and administrative weakness, but it was centrally rooted in the strategic, political and intellectual shortcomings of Islamist politicians'. That opportunity was never taken up effectively. For the most part, the list decade or so of the colonial period witnessed Islamism's intellectually unsophisticated, internally divided and counter-productive efforts to progress its agendaDOI: 10.15408/sdi.v16i1.488

Abstract

This article will examine early life and career of Ahmad Muhammad al-Surkitti in the Sudan and Saudi Arabia, and critically assess his contribution to the Islah and Tajdid movements in Southeast Asia. Special attention will be as well paid to his intellectual and religious encounter with the 'Alawi Sayyids, who branded him as a "Wahhabi" and sometimes as a "preacher of the Sudanese Mahdi's teachings" in the Netherlands East Indies.DOI: 10.15408/sdi.v8i1.695
