Abstract

This study examines the tradition of wearing Mispa among the Bugis community in Bulu-Bulu Village, Tonra District, following the performance of the Hajj, from the perspectives of Islamic law and the sociology of religious law. The study aims to explore the social, cultural, and religious foundations underlying the persistence of the Mispa tradition among female pilgrims, as well as to analyze the normative tension between customary practices and Islamic legal prescriptions regarding aurat (modesty requirements). This research employs a qualitative field research method using normative-juridical and empirical approaches, with data collected through observation, in-depth interviews, and documentation. The findings reveal that the tradition of wearing Mispa functions not merely as an item of clothing but as a symbol of honor (siri’), spiritual commitment, and a marker of social identity within Bugis society. The tradition also encompasses socio-economic and cultural dimensions through the involvement of local artisans and constitutes an integral part of post-Hajj cultural expression. However, from the perspective of Islamic law, the practice of wearing Mispa, particularly the use of transparent fabric, raises normative concerns, as it potentially contradicts Islamic prescriptions regarding the covering of aurat. These findings highlight the existence of a dynamic negotiation between customary law and Islamic law, underscoring the importance of cultural and contextual approaches in responding to local religious practices within the demands of Islamic normative frameworks.

Abstract

This article examines a dialogical epistemological engagement between Jacques Derrida’s deconstruction and Hans-Georg Gadamer’s philosophical hermeneutics as a theoretical approach to interpreting contemporary digital texts. The digital era is characterized by fluid, multimodal, fragmented, and algorithmically mediated texts, which challenge classical assumptions about meaning, language, and interpretation. Derrida’s deconstruction emphasizes the instability of meaning through the concept of différance, highlighting the continual deferral and relational movement of meaning within networks of signs. In contrast, Gadamer’s hermeneutics underscores the role of productive prejudice, wirkungsgeschichte (history of effects), and the fusion of horizons in the process of understanding. Through philosophical and library-based research, this study demonstrates that despite their apparent differences, Derrida and Gadamer share important epistemological assumptions, including the non-finality of meaning, the centrality of language, the active role of the interpreter, and the relational positioning of texts. This dialogical engagement is proposed as an interpretive framework referred to as “Digital Deconstructive Hermeneutics,” which is relevant for interpreting digital texts shaped by rapid change, intertextuality, and algorithmic mediation. The findings contribute to contemporary debates on interpretive epistemology in the digital age and offer insights for digital literacy and cultural studies.

Abstract

The ecological crisis and increasing social vulnerability caused by climate-related disasters indicate that environmental stewardship cannot be approached solely as a technical agenda, but must also be grounded in value-based and practice-oriented education. This article examines Pesantren Ekologi Ath-Thaariq in West Java as a case of an Indonesian eco-pesantren where ecological praxis serves as a formative medium for religious moderation. Employing a qualitative case-study design, the study draws on field observations, in-depth interviews with eight informants (caretakers, teachers, students, and non-Muslim visitors), and document analysis of the pesantren’s curriculum and interfaith ecological programs. Data were analyzed using reflexive thematic analysis. The findings show that religious moderation at Ath-Thaariq is not primarily transmitted through doctrinal instruction, but emerges as a habitus shaped through ecological labor, everyday ethics of sharing, and action-based interfaith engagement. Programs that frame nature as a shared home “one roof, one air, one earth”, enable participants from different religious backgrounds to collaborate as co-stewards of the environment. This study contributes to discussions on religious moderation by demonstrating how ecological praxis functions as a lived ethical framework that fosters interfaith solidarity and collective responsibility in responding to ecological challenges.

Abstract

This article explores how hadith-based halal norms are transformed into legal-operational standards within Indonesia’s Halal Product Assurance system. Existing scholarship on halal certification has largely focused on legal, economic, industrial, and technical dimensions, while relatively little attention has been devoted to the process through which hadith functions as a source of normative authority that is subsequently institutionalized within the regulatory framework of a modern nation-state. Drawing on a library-based approach, this article analyzes hadiths concerning halal, haram, doubtful matters (Shubhāt), and slaughtering practices, and traces their transformation into Law No. 33 of 2014 on Halal Product Assurance as well as its implementing regulations issued by the Halal Product Assurance Agency (Badan Penyelenggara Jaminan Produk Halal—BPJPH). The analysis demonstrates that hadith serves not merely as a source of religious and ethical guidance but also as the normative foundation for determining halal criteria, prohibiting specific substances, regulating slaughtering procedures, and governing halal products. Through the mechanisms of bayān, takhṣīṣ, and taqyīd, prophetic norms are transformed from religious authority into positive legal standards implemented through certification systems, material supervision, and halal regulatory governance. This article argues that Indonesia’s Halal Product Assurance system represents a process of the positivization of Islamic law and the institutionalization of prophetic normative authority within the framework of the modern state. By highlighting this transformation, the article contributes to contemporary hadith scholarship and the study of Islamic legal governance by demonstrating how prophetic normative teachings are translated into legal instruments and operational regulatory mechanisms in modern Muslim society.
