Abstract

The rise of national agraria conflicts that occurred seem to have been in the point is quite worrisome. Because he has a slice of various forms of human rights dimensionless violations. Various discourses in the effort to resolve the conflict continue. The discourse on the creation of a special court of land seems to have begun to gain a lot of attention. The reason, he is present in the situation of national agraria conflict that never ends, besides the passage of this discourse is full of momentum, which coincides with the draft Land Law Bill which is now entered the political space of legislation in parliament. A special court of land will certainly be a topic of discussion is quite fierce considering the issue will reach the settlement areas of national agraria cases that include land tenure by the plantation company (onderneming), PT. Perkebunan Nasional (PTPN), to the control of land by the military. This paper would like to discuss that the establishment of a special land court in the draft national land law is a necessity in solving a just national agrarian conflict. Abstract

Indonesia in the aftermath of Reformation, the relationship between powers of central and local governments has shifted the paradigm in which the power of central government has been transferred from centralized-authoritarian to decentralized-autonomy. One of decentralized powers of local government is by providing the power to self-regulate without certain interventions from central government, including the initiative to establish bylaws (Peraturan Daerah) as the results of local autonomy. In further development of autonomy, however, the wider decentralization and autonomy attached to local governments has been responded differently. One of such responses is the establishment of sharia bylaws in which they result in problems in the Indonesian constitutional law system. From constitutional views, bylaws in local governments other than Aceh province violate citizen’s constitutional rights by which those are not accomodated in the hierarcy of national regulations. On the other hand, however, the establishment of sharia bylaw is important as an attempt to nurture social morality. Accordingly, there should not be abandonment regarding the establishment of sharia bylaws in several local governments other than Aceh province. But, the reaffirmation is needed relating to the position of sharia bylaws in the constitutional perspective which is not only seen formally, but also materially. Abstract

Kebebasan beragama di Indonesia dapat dilihat di Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 (UUD 1945) amandemen kedua pada Pasal 28E ayat (1) dan (2). Akan tetapi terdapat pula pembatasan dalam konstitusi tersebut. Warga negara yang tidak mentaati pembatasan tersebut, maka akan dikenakan sanksi sesuai dengan aturan dalam Kitab Undang-undang Hukum Pidana (KUHP). Setelah diundangkannya Undang-Undang Nomor 1/PNPS/1965 tentang Pencegahan Penyalahgunaan dan atau Penodaan Agama, maka dalam KUHP ditambahkan Pasal 156a untuk menjerat tindak pidana penodaan agama. Dalam kasus yang Penulis analisis seharusnya Jaksa Penuntut Umum menggunakan dakwaan kumulatif dengan tetap memilih Pasal 156a huruf a KUHP dan Pasal 335 ayat (1) ke-1 KUHP, hal tersebut karena kedua pasal tersebut bukan merupakan tindak pidana yang sejenis.Hakim menjatuhkan pidana penjara 2 (dua) tahun. Pasal 156a KUHP memberi ancaman pidana 5 (lima) tahun penjara. Ancaman tersebut memang tergolong sangat tinggi dan berat, karena pembuat undang-undang menganggap akibat yang ditimbulkan oleh tindak pidana penodaan agama sangat serius bagi negara dan masyarakat. Hakim Pengadilan Negeri Sampang seharusnya memvonis Terdakwa dengan menjatuhkan pidana penjara 4 (empat) tahun sesuai dengan tuntutan Jaksa Penuntut Umum, sehingga Hakim dalam menjatuhkan pidana terhadap terdakwa sesuai dengan tujuan pemidanaan dalam teori gabungan. Kata Kunci: Tindak Pidana Penodaan Agama, Bentuk Surat Dakwaan, Tujuan Pemidanaan.

Abstract

This article discusses the conceptual idea in addressing the situation of workers in Indonesia who are perceived not to have the right to prosper in the work already owned. In economics, labours play an important role because they are the wheels in driving the production of goods and services. The unfilled labour rights to live prosperous is caused by the absence of their authority to contribute in determining a policy within a company. To overcome the imbalance of bargaining position between workers and employers, a regulation or policy is required to materialise access to share ownership within the company. By owning shares, workers have the right to convey ideas in determining company policy. In addition, labours will also easily access all company information including company report approval. It concludes that the ownership of shares by labours in the company is a necessity and an effort to realise Pancasila Economic System in order to fulfil the more substantive labour rights. Abstract

On each social life will find a difference between behaviour with the law of norms. The discrepancy could cause dispute or tensions between each other that possibly also can happen in the family. The problems often arising during family Is the transition towards treasure in the form of grants from parents to their children. The settlement if there is a standoff over an object of the grant is forced to settle in a court. The Giving in a form of grant was conducted using an authentic deed as has been arranged in article 1682 Indonesian Civil Code. Public officials who given by statute an authority to make the deed of grants is land deed official. Related which for making such deed to as a basis for registration change as a result of a legal action the land. Related to the emergence of signs of a dispute over ownership under the grants, so In this case, every judge as milestone law enforcement have an interpretation of the difference against the rule of law in dispute resolution on the judicial process. In short, there is contradiction a norm between what has been decided by judges with the provision of article 1686 Indonesian Civil Code which the results of the uncertainty laws implementation of the article. Abstract

There are two legal issues proposed in this study, inter alia, the nature of the right to public information and state's responsibility for the fulfillment of the right to public information. This study uses legal research with statute and conceptual approaches. The results of this study shows that the right to public information becomes part of the human rights as guaranteed by the 1945 Constitution. Public information has become a logical consequence of the obligation of the state to account for the implementation of its government to the citizens as its main purpose is to ensure the accountability and credibility of public institutions through the provision of information and documents at the public request so that the principle of information disclosure is one component in the realization of good governance. As a constitutional right of citizens, it also shows that ‘a contrario’ the fulfillment of public information is the responsibility of the state. According to this view, the fulfillment of the right to public information is not only related to obligations, but the content must be true and provided openly and honestly. Abstract

Pengaturan atas hak asasi manusia telah dijamin dan dilindungi dalam UUD NRI 1945 serta UU HAM itu, maka dari itu seharusnya tidak perlu lagi dibuat pengaturan oleh undang-undang untuk memastikan adanya kemerdekaan atau kebebasan bagi setiap orang itu untuk berorganisasi dalam wilayah negara Republik Indonesia. Hanya saja, bagaimana cara kebebasan itu digunakan, apa saja syarat-syarat dan prosedur pembentukan, pembinaan, penyelenggaraan kegiatan, pengawasan, dan pembubaran organisasi itu tentu masih harus diatur lebih rinci, yaitu dengan undang-undang beserta peraturan pelaksanaannya. Karena alasan itulah, pemerintah memandang perlu untuk menyusun satu undang-undang berdasarkan ketentuan UUD 1945 sebelum reformasi, yaitu UU No. 8 Tahun 1985 tentang Organisasi Kemasyarakatan. Akan tetapi, UU Ormas yang lama tersebut sudah tidak relevan lagi dengan dinamika masyakarat kini yang kemudian mendorong lahirnya UU Nomor 17 Tahun 2013 sebagai UU Ormas yang baru. UU Ormas yang baru diharapkan mampu memberikan kontribusi yang signifikan untuk mengatur ruang lingkup dan definisi ormas secara jelas terkait dengan aspek legal administratif. Walaupun demikian, nyatanya UU Ormas yang baru masih meninggalkan beberapa masalah sehingga perlu ditinjau apakah UU Ormas yang baru tersebut telah sesuai dengan konstitusi serta dapat melindungi hak asasi manusia dari tindakan anarkis melalui sanksi yang tercantum dalam batang tubuh UU tersebut. Abstract

During Reformasi Era, Indonesia has still had serious social issues with reference to social clashes and religious violence. The contestation between majority and minority and the monopoly of interpretation of Pancasila as a state ideology have dominated public sphere which affects on the increase of social clash with various backgrounds. The increase of social clash including religious violence results in the uncertainty whether or not Pancasila as a state ideology is capable of tackling contemporary Indonesian realities. Moreover, Pancasila also needs to tackle religious transnationalism ideology which has spread across the nation and receive positive sympathy from some Indonesians. Based on these realities, this writing aims to examine dimension of divinity and humanism in Pancasila and then propose an ideal concept of the divinity in the framework of Indonesian unity. Abstract

Divorce or dissolution of the marriage means the return of husband and wife into group family own. According to Osing adat law in Aliyan village, Rogojampi, Banyuwangi Regency, the divorce will give the rise to rights and obligations of children and joint property. The community of Osing adat law embraces the system of bilateral kinship which pulls the descendant line of the second parent with regard to the divorce by which children are given the freedom to choose by following the father or the mother. The community of Osing adat law never discriminates on the ground of biological children, legal children, adopted children and stepchildren, and legal position children. In the system of bilateral kinship, with regard to the divorce, the legal position of the property will return to the origin and joint property will be shared equally. Abstract

Banyuwangi is a regency in East Java which focuses to transforming the regency into a tourism city, especially in the coastal tourism. As the development has sustained, it persuades investors to explore coastal tourism as a new business area. Consequently, the development of tourism in Banyuwangi regency generates new tourism places. On the other hand, however, there are further problems in areas of coastal tourism which were previously established. Watu Dodol Beach for instance, the beach has a lot of traditional outlets as business activities as results of coastal tourism with more than 37 years without any administrative documents. This paper is aimed to revisit the response of Government of Banyuwangi toward permanent buildings at beach’s borders according to administrative procedures according to Government Bylaw (Perda) Number 9 Year 2014 on Building. There are some critical notes to outline implications of such bylaw with the following dispute settlement. As mentioned by such bylaw, the absence of administrative documents on the establishment of outlets will impose the Government to issue reminder in writing, restrictions of building, postponement of activities, revocation of building permits (IMB), revocation of feasible function standard (SLF) and dismantling of buildings. As a result, the dispute settlement provided to address such administrative sanction comprises litigation and non-litigation processes. Keywords: Government of Banyuwangi, Building, Coastal Tourism
