Proses pencalonan kepala desa di daerah Jember telah diatur didalam peraturan daerah Kabupaten Jember pasal 30 nomor 6 tahun 2006 tentang pemerintahan desa. Jika dikaji lagi ayat perayat secara mendalam pada pasal 30 peraturan daerah kabupaten Jemebr nomor 6 tahun 2006 tentang pemerintaha desa mengenai mekanisme pencalonan kepala desa terdapat hal- hal yang tidak sesuai dengan aturan atau undang-undang diatasnya terutama pada hal penyerahan persyaratan menjadi calon kepala desa yang tertera pada pasal 30 ayat (1) peraturan daerah kabupaten Jember nomor 6 tahun 2006 tentang pemerintahan desa, dimana persyaratan untuk menjadi kepala desa di kabupaten jember mengacu pada pasal 26 peraturan daerah kabupaten jember nomor 6 tahun 2006 tentang pemerintahan desa, pada persyaratan inilah terdapat suatu syarat tepatnya pada pasal 26 huruf c peraturan daerah kabupaten jember nomor 6 tahun 2006 tentang pemerintahan desa yang menyatakan bahwa seorang calon kepala desa tidak pernah terlibat langsung atau tidak langsung dalam kegiatan yang mengkhianati Pancasila dan Undang-Undang Dasar 1945, dengan adanya persyaratan seperti ini dalam peraturan daerah kabupaten jember khususnya dalam hal pencalonan kepala desa yang tertera dalam mekanisme pencalonan kepala desa pada pasal 30 peraturan daerah kabupaten jember nomor 6 tahun 2006 tentang pemerintahan desa telah melanggar peraturan diatasnya yaitu peraturan pemerintah nomor 72 tahun 2005 tentang desa, karena pada dasarnya dalam peraturan pemerintah nomor 72 tahun 2005 khususnya dalam hal persyaratan menjadi kepala desa tidak membubuhkan persyaratan tersebut. Dengan menyertakan syarat yang akhirnya akan menjuru pada tindak diskriminatif seperti itu secara langsung pemerintah Kabupaten Jember telah mellanggar konstitusi dan pancasila . Hal seperti ini tentunya akan menimbulkan konflik pada saat pencalonan Kepala desa Kata Kunci: Mekanisme Pencalonan, Kepala Desa, Pemerintah Desa

Law Number 11 / 2008 on Information and Electronic Transaction (UU ITE) is the regulation concerning on criminal law in addition to the Criminal Code (KUHP). UU ITE is commonly regarded additional regulation of the Criminal Code as a special law (lex specialis) in which Penal Code is deemed as lex generalis. It is based on the principle of lex specialis derogate legi generalis. This article uses legal research to review the decision of District Court in Bandung Number 1033/PID.B/2014/PN.BDG where it comprises legislation and cases. It concludes that the judge is not frugal in applying the principle lex specialis derogat legi generalis in the consideration. This is associated with the indictment of public prosecutor which only prejudges with article 303 paragraph (1) to 2. In contrast, the indictment which does not meet the requirement of a careful, clear, and complete description asserts to become void by law. Keywords: Online Gambling, Criminal Principle, Indictment

Civil Society Organization (CSO) is an organization founded and formed by the community voluntarily based on the similarity of aspirations, wills, needs, interests and objectives to participate in development in order to achieve the objectives of the Unitary State of the Republic of Indonesia (NKRI). But many established organizations are not based on the common vision and mission required by the government. The emergence of a number of radical organizations that perform anarchist actions make people feel uneasy about the actions of mass organizations that commit acts of violence by using the pretext of religion as a justification reason. The Government in this case has considerable authority in Law No. 17 of 2013 on Civil Society Organizations where the ultimate estuary is the revocation of registered certificate which affects the dissolution of problematic community organizations. With the authority granted to the government, it is suggested that the government should be able to crack down on mass organizations which generate problematic causes and break public orders. This study discuss legal issues concerning control of reclamation without possessing land rights as the result of the unregistered reclamation by communities in the Village of Tanddan, Sub-district Campling in the Sampang Regency. The aim of this study is to show legal implications and analyze effectivity of law enforcement on the accomplishment land control of reclamation without possession. By using empirical legal research with socio-juridical approach, the result of study shows that legal subject cannot control over and build houses over land of reclamation withou posession of land rights. In other words, houses built over land of reclamation without land rights can be evicted without any compensation. Therefore, such land of reclamation should be registered as the governmental land to the National Agrarian Board or Badan Pertanahan nasional (BPN) in the Sampang regency. It also affirms that there is a problem of effeciency of law enforcement on the accomplishment of land control of reclamation without any repressive and preventive measures. Indonesia adopts democracy based on the rule of law as it is guaranteed in the constitution. But, the practice of violations of Freedom of Religion and Belief (KBB) still frequently occurs in Indonesia, including in the province of East Java. As a result of intolerance under the ground of religion and belief, social conflict is inevitable. There are several alternatives as a means to establish transitional justice in the aftermath of conflict, such as truth finding, independent and impartial tribunal, mainstreaming collective consciousness on the importance of diversity, and utilization of policy to counter social conflict. Nevertheless, another important aspect is the need of communal consolidation in the aftermath of intolerant practice and social conflict. Thus, communal consolidation which involves interested parties should be seen as an instrument of conflict mitigation under the ground of religion in East Java. The dispute settlement between Indonesia and Malaysia in the Malacca Strait started with the unilateral claims of both countries. The prevailing unilateral claims resulted in the area of Exclusive Economic Zone in the Malacca Strait overlap. The United Nations Convention on the Law of the Sea (UNCLOS) 1982 is the existing International Law of the Sea and both countries, Indonesia and Malaysia, ratified to this Convention. The purpose of this article is to find out how to resolve the sea border disputes between Indonesia and Malaysia in the Malacca Strait under the International Law of the Sea. There is a substantial difference between the ordinary crime related to its results and that related to its causes. In order to classified as a crime, the negligence carried out by medical personnel needs to be previously described regarding the fulfillment of the elements of lawlessness. This paper analyzes whether there is medical malpractice and with the following lawlessness in the court decision number 257/Pid.B/2015/PN.Dps. Throughout the analysis, it will provide a comprehension to the qualification of whether malpractice, medical negligence or medical risk. The result of the study finds that such a crime can be qualified to medical malpractice, even though he did not fulfill the nature against formal law but it meets the element of nature against material law. As the nation's future generation, children have the right to a protected environment, as a lack thereof endangers their growth. One form of child protection is specifically regulated in Law Number 35 of 2014 on the Amendment to Law Number 23 of 2002 on Child Protection (Child Protection Act). Decency crimes against children as in case Number 535 / Pid.sus / 2015 / PN.Bls, the judge drops Article 82 Paragraph (1) of the Child Protection Act. This article contains two problems, inter alia, the judge's decision in case Number 535 / Pid.sus / 2015 / PN.Bls whether it is in accordance with Article 82 paragraph (1) or Article 81 Paragraph (2) of the Child Protection Law and whether the witnesses are examined in case Number 535 /Pid.sus/2015/PN.Bls complies with Article 171 of the Criminal Procedure Code (KUHAP). This study uses the method of legal research with conceptual approach. The results and conclusions obtained in the writing of this article states that the judge must be more thorough in proving the elements of the article, and examine the witness more carefully to see the provisions of Article 171 of the Criminal Procedure Code. Nowadays, Indonesia remains challenged to the barrier in means of transportation, especially in small areas in which it makes arduous the Election Organizers Honorary Council (DKPP) to carry out its duties. Based on Article 25 of DKPP Regulation Number 2 of 2012, one of the facilities provided to DKPP is the implementation of a long-distance trial by video conference. There are a number of challenges faced by DKPP, including the relatively new age so that people do not really know this institution. In addition, the DKPP institution is quite limited to being located only in the capital, while the task of the institution encompasses national jurisdiction. The geographical condition of Indonesia is broad and consists of many areas also make the response to ethics code violations less efficient along with issues of compliance with DKPP decisions. Thus, the role of the DKPP is needed in maintaining the independence and integrity of the organizers of the General Elections (Elections) and ways to strengthen the role of the DKPP in maintaining the independence and integrity of election administration in Indonesia. The 1945 Constitution of the Republic of Indonesia states that every citizen has the right to work and a decent life. As a consequence, citizens have the right to receive salary and fair treatment in employment relations. The state has a constitutional responsibility to guarantee the fulfillment of the right to work of migrant and foreign workers in order to provide protection and legal certainty between them. Meanwhile, the national labor law and government regulations on migrant workers only include professional workers. In fact, foreign workers in Indonesia are not only professional workers but also unskilled laborers. Such paradox emerges after the amendment of the regulation of foreign workers which frees and tightens foreign workers in Indonesia. Keywords: Foreign Workers, Right to Work, Legal Certainty
